PROPOSED AMENDMENT TO THE CITY OF GREELEY HOME RULE CHARTER:

Section 17-10 Procedures for Acquisition and Provision of Ground Water and/or Recycled

Wastewater.

a. No ground water and/or recycled wastewater may be purchased/leased, and/or

provided, either directly, through the City's ownership of existing ground water

rights, or indirectly, through ownership of shares in ditch and reservoir companies,

through the City of Greeley's water system, water treatment plants or other water

infrastructure, to the registered electors of Greeley for their drinking water and/or

non-potable use unless and until the question of whether to purchase/lease and/or

provide such ground water or recycled wastewater has first been submitted to and

approved by a majority vote of the registered electors of the City of Greeley.

b. Prior to submitting the qu-stion of the purchase/lease of ground water and/or

recycled wastewater to the voters, the City Council shall cause a comprehensive

and objective independent engineering study to be performed to determine the

long-term effects, benefits, cost, advantages, disadvantages and advisability of

such an action.

c. The engineering report, including all data and calculations, conclusions, and

recommendations, shall be complete and available for inspection by the public,

and copies shall be available to the public at least sixty (60) days prior to the

election. The City Council shall hold at least one public hearing on the question at

least thirty (30) days prior to the election. The engineer who prepared the

independent study shall be present at the public hearing to answer any questions which may be presented at the hearing.

d. The City Council shall cause to be published at least twice, one week apart, public advertisement to give notice that the engineering study is available by download from the City's website and on file and available in the City offices and library, the first such publication to be at least twenty (20) days before any public hearing. Notices of the public hearing shall be published at least twice, one week apart, the first publication to be at least fifteen (15) days before the public hearing.

e. The above prohibitions shall supersede any City of Greeley Charter provision, City Ordinance and any Contract entered into by the City or agent of the City.

Petitioners request that the proposed Charter Amendment be submitted at the next regular election in November 2021.
