26. Earhart Commons (Private Conrnons) Restrictions

A. The Comrpns area is to remain as permanent open spece, preserved andmaintained in its constructed state for the equal and exclusive benefit, useand enjoyment of the property o$Iners of EARHART KN0LLS SUBDMSION. Each ofthe eighty (80) lot owners shall have a one-eightieth (' l l80) or ( 1 114%jundivided interesi in the Cosmons. This interest shall be mandatory for eachoriginal lot owner and tirat interest shall be conveyed to any future lot owner,:in perpetuity and shall run concurrent nith the ournership of the lot. Thisinterest nny not be separated from owrrership of the lot to which it is appiicable,except through new rate reduction by additions of other orvners as beloll described.

B. Add-on provision: Should interest be expressed by the City of Ann Arbor orby adjacent prcperty owners outside EARfIART l(l0LLS SUBDIVISI0I{ to participatein the shared interest and liabil i ty of the Cofflons, such interested parties maybe granted an interest by affirmative vote af 2/? of the current lot ovtners.Any new interest which may be granted wil l be pro-rated on the basis of theabove formula.

C. The existing topography, storrrt retention facil i t ies, vegetation, easententsof record and nature of thc Conrnons area, having been deemed assets t'torthy ofpreservation, shall remain !ntact and undisturbed to the extent possible, exceptor fiorfinl lawn nnintenance.

0. Construction of bui' lding, roads or other such structures on the Commons isprohibited.

E. Regrading of the existing topography is prohib'ited. Cutting or clearingof vegetation, other than grass or dead or diseased trees is proh'ibited.

F. Operation of notorized vehicles on or across the contmons, other thanrnintenance vehicles which nray be used for routine, short terni clean-up operationsincluding necessary nuintenance of the vegetation in the City uti l i ty easementsSlanted to said C'jty' is strictly prohibited.

G. Storage or dunping of any items or nraterials inciuding but not l inrited tovehicles, structures, building naterials, trash or refuse is prohibited ott theCorrnons.

In January of ev,ery year' theArchitectural Control Corfinittee shall prepare an estimate of 'Lhe ccst ofrnaintenaltce for that year and shall mail a copy of the estimate-togetherwittt u b'i l l for 1/80 6f the estimaied cost to each Lot owner. Each Lot olnerJfri i f-piy ttreir rispective l/80 share of the estimated cost te the ArchiteciuralControl Corrnrittee by March lst of every year.

In the event ttre conrnons is not properly r;raintained as set forth above,the City of Ann Arbor nny subsequent to giving 30 days_written notice to theA"ifriteitu"al Control Coirnittee, have the necessary maintenance perforrrred-
