the Oonsolidated Fund, the Public vVorks Fund, and otherAccounts to the Services of the Year ending the Thirty-firstDay of March, One thousand eight hundred and ninety-eight,and to appropriate the Supplies granted in this Present Session.
[22nd December, 1897.MOST GRAOIOUS SOVEREIGN,-We, Your Majesty's mostdutiful and loyal subjects, the House of Representatives of NewZealand, in Parliament assembled, towards making good the supplywhich we have cheerfully granted to Your Majesty in this session ofParliament, have resolved to grant unto, Your Majesty the sumshereinafter mentioned, and do therefore most humbly beseech YourMajesty that it may be enacted: And be it enacted by the GeneralAssembly of New Zealand in this present Parliament assembled, andby the authority of the same, as follows :-
1. The Short Title of this Act is "The Appropriation Act,1897." ,
2. The Oolonial Treasurer may issue out of the ConsolidatedFund, and apply towards making good the supplies granted to HerMajesty for the servioes of the year endi119 on the thirty-first day

of March, one thousand eight hundred and ninety-eight, the sum of'seven hundred and eighty-two thousand two hundred and ninety-fourpounds, together with the amount of the fees hereinafter mentioned.
3. All sums granted as aforesaid out of the Consolidated Fund Appropriation ofby this Act, together with the sums granted out of that Fund by £2,538,280, and fees,out of Oonsolidatedthe other Acts mentioned in First S,chedule hereto, amounting, in Fund.tEte whole to two million five hundred and thirty-eight thousand twohundred and eighty pounds, as appears by the said Schedule, togetherwith the fees collected by such public officers as are authorised toretain the same in lieu of salary,are hereby appropriated for theseveral services and purposes expressed in the several votes specifiedin the Abstract in the said First Schedule.
4. The Colonial' Treasurer may issue and apply, out of the Grant of £5?3,467Public Works Fund, towards making good ~he supplies granted to ~:tn~f. PublIc WorksHer Majesty for the works and services of the year endingon the thirty-first day of March, one thousand eight hundred andninety-eight, any sum or sums not exceeding in the whole. thesum of five hundred and three thousand four hundred and sixty-seven pounds.
5. All sums granted as aforesaid out of the Public \Vorks Fund Appropriation ofby this Act, together with the sums granted out of that Fund by the ~~t~;~7ir~~:so~und.other Acts mentioned in the Second Schedule hereto, amounting inthe whole to nine hundred and ninety-two thousand seven hundredand seventy-seven pounds, as appears by the said Second Schedule,are hereby aFpropriated for the several works and services expressedin the several votes specified in the Abstract in the said SecondSchedule.
6. Out of the respective Accounts mentioned in the Abstract in Grant of £47,936the Third Schedule hereto the Colonial Treasurer m~y issue and apply out of separate'towards making good the supplies granted to Her Majesty for th~ accounts.services of the year ending on the thirty-first day of March" onethousand eight hundred and ninety-eight, any sums amounting in thewhole to forty-seven thousand nine hundred and thirty-six pounds.
7. All sums granted as aforesaid out of the said. respective Appropriation ofAccounts by this Act, together with the sums granted out of those ;;:~;~~Z ~~~o~fnts.Accounts by the other Acts mentioned in the said Third Schedulehereto, amounting in the whole to one hundred and sixty-seventhousand six hundred and seventy-seven pounds, as appears by thesaid Third Schedule, are hereby appropriated for the respectiveservices and purposes expressed in the several votes specified in theAbstract in the said Third Schedule.
8. The, Colonial Treasurer may issue and payout. of the Con- Authority to paysolidated Fund all moneys lawfully payable to any Natives under :::~e~~~erand by virtue of the agreements validated by " The Auckland Gold- validated by "Thefields Proclamations Validation. Act 1869" or to any, persons law_Auckland ~oldfields, , ProclamatIOnsfully entitled to the lands from which the revenues accrue in virtue Validation Act,of any such agreement. . 1869."
9. (1.) There shall be issued and paid by the Colonial Treasurer Subsidies to be paidout of the Consolidated Fund to the Oouncil or Board of each county, to local bodies.road district, town district, and borough, in respect of the generalrates described in the Schedule to "The Local Bodies' Finance andPowers Act, 1885" (in this section referred to as "the said Act "),

levied for the year ending the thirty-first day of March,one thousandeight hundred and ninety-eight, and actually collected on or beforethe thirtieth day of June ensuing next after the said thirty-first dayof March, one-fourth of the amounts to which they would be entitledunder the plan of distribution described in the Schedule to the said Act:
Provided that upon the application of the local body settingforth the amount of general rates collectable for the year ending thethirty-first day of March, one thousand eight hundred and ninetyeight, and showing separately how much thereof is in respect of Nativelands, seventy-five per centum, and no more, of the amount whichit is estimated by the Commissioner of Taxes may become payableto such local body for rates other than rates on Native lands may beadvanced to such local body within that year:
Provided also that on receipt by the Commissioner of Taxesof returns, duly verified 'by the declaration of the Chairman or Treasurer of a local body, showing the amount of the rates aforesaidactually collected to the thirtieth day of June, one thousand eighthundred and ninety-eight, the amount of subsidy found to be payablein respect of such rates, less the amount (if any) advanced as aforesaid, shall be paid to such local body; and any sum advanced inexcess of the amount so found to be payable shall be repaid by thelocal body to the Public Account or be recovered by the ColonialTreasurer out of any moneys payable to such local body.
(2.) In case any doubt arises as to the several payments to be madeunder this section and the Schedule to the said Act, or as to paymentsto be made in respect of newly-formed districts wherein the Boardhas not had sufficient time to levy and collect rates, the Governor inCouncil may authoritatively decide the amounts of such payments.
10. (1.) The Colonial Treasurer is hereby authorised to issue andpayout of the Consolidated Fund, by way of temporary advance, anysum or sums, not exceeding one thousand pounds in the whole, forthe purpose of defraying any charges or expenses incurred by or onbehalf of any local governing body.
(2.) All such advances shall be repaid to the Consolidated Fundout of the first moneys thereafter accruing to such local governingbody, and may be deducted or recovered by the Colonial Treasureraccordingly.
(3.) For the purposes of this section the expression "localgoverning body" means a County Council, Borough Council, TownBoard, Road Board, River Board, Harbour Board, and an EducationBoard, and includes any other body or persons, however designated,to whom any moneys are paid or payable out of the ConsolidatedFund.
11. It shall be' lawful for the Governor, in the name and onbehalf of Her Majesty the Queen, to enter into any contracts, or toincur any liabilities, for carrying on the works and servicesfor whichmoney is appropriated by this Act: Provided that the amount ofliability thereby incurred in respect of any work or service shall not,together with the sum appropriated therefor, exceed the sum set ;down in the ninth column in the Fourth Schedule opposite to eachrailway or other work or service for which money is appropriated bythis Act.

12. The moneys appropriated by this Act for the construction of Power to pay oyer
Public roads and such other public works as are usually constructed to l?cal govermngbodIes.by or are under the control of local governing bodies may be paidover to such local governing body or bodies as the Minister in chargeof the department in connection with which such roads or works areconstructed determines, upon such terms and conditions as areagreed upon between such Minister and any such local governingbody, to be expended by such body upon any of the works or servicesfor which the same are appropriated by this Act; and the ColonialTreasurer shall make all such payments in accordance with any suchagreement.
, 13. (1.) The moneys appropriated by this Act for the construction Money appropriated

of tools, plant, provisions, clothing, or other requisites necessitated bythe employment of labour, whether the same are to be used for thebenefit of or lent or sold to workmen employed on such works or not,and also the expenses incurred in the payment of fares and freightsby land or sea in respect of the transit of such workmen and theirfamilies and effects to or from such works.
(2.) Except where otherwise specially directed by the Minister incharge of the department in connection with which such expenses areincurred, all such expenses shall be deducted in such manner as thesaid MiniFlter directs from the amounts earned by such workmenfrom time to time, anything in " The Truck Act, 1891," or any otherAct to the contrary notwithstanding. ,
14. Whereas the Colonial Treasurer has, under the authorityof section forty-eight of "The Public Revenues Act, 1891," issued,during the twelve months ended the thirty-first day of March, onethousand eight hundred and ninety-seven, in excess of or without theappropriation of Parliament, the respective sums mentioned in theFifth Schedule hereto out of the Consolidated Fund, the' PublicWorks Fund, and the other Accounts mentioned in the said Schedule,amounting in the whole'to the sum of fifty-nine thousand onehundred and sixty-one pounds four shillings and sixpence, and hasalso discharged from the Public Account the sum of three hundredand eleven pounds eleven shillings and sixpence mentioned in thesaid Schedule as being due to but irrecoverable by the Crown, andhas caused the said sums to be applied to the several purposes andservices mentioned in the said Fifth Schedule: Be it enacted that
.the application and discharge of the said sums are hereby sanctioned.15. (1.) Whenever it becomes necessary that money should be
expended on account of the Government Insurance Department, thePublic Trust Office, or the Government Advances to Settlers Office,in excess of or without the appropriation of Parliament, the Government Insurance Commissioner, the Public Trustee, or the Superin-tendent, as the case maybe, may, with the sanction of the ColonialTreasurer, but not otherwise, pay such money in excess of or withoutthe appropriation of Parliament. -
(2.) All such expenditure shall be charged to the UnauthorisedExpenditure Account.

Schedules.
16. The Colonial Treasurer may transfer any sum or sums notexceeding in the whole three hundred thousand pounds from theOonsolidated Fund to the Public Warks Fund, to b~ issued andapplied to the purposes and services provided far in this Act.
17. (1.) Notwithstanding anything to the contrary contained in" The Lands Improvement and Native Lands Acquisition Act, 1894,"the separate accounts called "The Lands. Improvement Account"and" The Native Lands Purchase Account" are hereby abolished,and the balances standing at credit of those accounts on the thirtyfirst day of March, one thousand eight hundred and ninety-seven,shall be transferred to and form part of the Public Works Fund.
(2.) The receipts into and the payments out of the sai.d separateaccounts as directed by the aforesaid Act are hereby authorised to bemade into and out of the Public Works Fund from and after the saidthirty-first day of March.
18. From and after the passing of this Act the cost of collectionreferred to in, section three of "The Local Bodies' Finance andPowers Act, 1885," shall not be defrayed out of ~he revenues whichby virtue of that section form part of the county fund, and that Actis hereby amended accordi.ngly.
