AMENDMENT /APPROVAL OF AGENDA 31 At this juncture, the body unanimously approved to include in the 32 agenda particularly under the business of the day the following matters: 33 a. Communication from Hon. Mayor Florenito T. Gonzaga requesting for 34 an authority to waive the right of confidentiality of financial information 35 of the Local Government Unit of Magpet as one of the requirements in 36 securing Monetary Board Opinion from the Bangko Sentral ng Pilipinas. 37 This was approved to be included in the agenda through the motion 38 of Hon. Councilor Marañon duly seconded by Hon. Councilor Apostol. 39 b. Communication from Hon. Mayor Florenito T. Gonzaga requesting for 40 the passage of a resolution designating Engr. Daniel A. c. Communication from Magpet PNP Personnel requesting that PSI 50 Mamon to be designated as full-fledged Chief of Police of the Magpet 51 PNP Magpet Police station. 52

53 With no other amendment presented, Hon. Councilor Lobaton moved for 54 the adoption of the agenda as amended. Hon. Councilor Apostol 55 seconded the motion. The body unanimously approved the motion. 56 57

4. QUESTION HOUR 58 At this juncture, Hon. Apostol moved to suspend the IRP in order to 59 accommodate the visitors. Hon. Councilor Lobaton seconded the motion. 60 The body unanimously approved the motion. 61 62 The Presiding Officer welcomed Ms. Evelyn Mandolado & Mr. Karl Jone 63 Tanaid ,Magpet Tourism Office Personnel. He informed them of the issue of 64 the slash and burn activities in Kisandal & Bongolanon area particularly 65 along the trail going to Mt. Apo. He too informed them about the issue of 66 the Kidapawan trail which is actually within the Magpet territory. 67 68 Hon. Lobaton was then given the floor to make the opening statement. 69 He stated the reason why the two Tourism Office personnel were invited to 70 attend the session. The first issue is the slash and burn activities which are 71 happening at Bongolanon and Kisandal area particularly along the trail 72 going to Mt. Apo. The second issue is about the Kidapawan Trail which is 73 actually within Magpet Territory. 74 75 Hon. Acupan was also given the floor. He stated that the slash and burn 76 activity is happening in more or less 50 hectares land area. 77 78 Hon. Councilor Apostol rose to ask if the said area is under the Ancestral 79 Domain. 80 81 Hon. Takinan answered that the Kinarum area is under ISF and other areas 82 is still subject for dialog because it has many claimants. 83 84 At this juncture the Presiding Officer declared for a recess. 85 86 87 88 89

On resumption, Hon. Lobaton was given the floor. He proposed that a resolution 94 be passed by the body entitled A RESOLUTION REQUESTING HON. MAYOR 95 FLORENITO T. GONZAGA TO CREATE A TASK FORCE WHICH WILL CONDUCT 96 INVESTIGATION & OCCULAR INSPECTION OF THE REPORTED SLASH AND BURN 97 ACTIVITIES IN BRGY. BONGOLANON, BRGY. KISANDAL & BRGY. KINARUM. He 98 reasoned that this is needed because the body does not have enough 99 information regarding this issue. 100 He then moved that this be included in the business of the day. Hon. Apostol 101 seconded the motion. The body unanimously approved the motion. 102 103 The body then proceeded to discuss the issue about the Kidapawan trail which 104 is actually within the Magpet Territory. 105 106 Ms. Mandolado rose to confirm that indeed majority of the Kidapawan trail 107 actually within Magpet territory. He also told the body that the said trail is badly 108 damaged. She also said that the municipality is not given any share of what the 109 City of Kidapawan is collecting. She suggested that the municipality of Magpet 110 should assert its right on this issue. 111 112 Mr. Tanaid was also given the floor. He presented to the body the map of the 113 Kidapawan Trail. It was presented clearly in the map that majority of the 114 Kidapawan trail is within Magpet territory. 115 116 Hon. Mamon rose to react. She stated that maybe the reason why Kidapawan is 117 collecting the tourist fee is because the entrance of the trail belongs to 118 Kidapawan city. 119 120 The Presiding Officer stated that even the previous tourism officer of Kidapawan 121 City recognized that the majority of the part of the Kidapawan trail is owned by 122 Magpet. 123 124 Hon. Marañon rose to suggest that an ordinance be passed imposing fees on 125 climbers who would use the Kidapawan trail considering that big part of it is 126 owned by Magpet. He suggested that a collector from LGU Magpet would be 127 assigned at trail to collect the fees. 128 129 Hon. Mamon reacted that she thinks the said ordinance will only complicate 130 things because the climbers would pay twice. She added that it might create 131 trouble between the climber and the collector from Magpet. She proposed that 132 a negotiation between Magpet and Kidapawan be done so that this issued 133 could be resolved calmly. 134 135 136

Hon. Aboy rose to agree with the statement of Hon. Mamon that negotiation 141 with Kidapawan city is the best way to address this issue. He reasoned that the 142 suggestion of Hon. Marañon might create trouble as the climbers will surely be 143 irked because they will pay twice. 144 145 Hon. Apostol rose to suggest to Ms. Mandolado to bring the issue during the 146 KMM meeting. 147 148 Hon. Lobaton rose to state that we should negotiate so that we will get a share 149 on what Kidapawan city is collecting from the climbers. 150 151 The Presiding Officer subscribed to the idea of Hon. Apostol that the matter be 152 brought to the KMM meeting. 153 154 Hon. Talotalo rose to agree to the idea of Hon. Mamon. She also suggested that 155 the ordinance imposing fees on climbers be reviewed. 156 157 Hon. Acupan rose to say that he would go for the closure of the trail if ever 158 Kidapawan city will not agree on giving Magpet share on their collection. 159 160 Hon. Marañon asked Ms. Mandolado if she has any idea of road concreting 161 project which is funded by the Department of Tourism. 162 163 Ms. Mandolado answered that what she knows is such will be implemented by 164 DPWH. 165 166 The Presiding Officer stated that to his knowledge, the funding for the said 167 project would be coming from the PDAF of Hon. Congresswoman Catamco. 168 169 Hon. Yunting rose to say that Magpet has a trail in going to Mt. Apo.She asked 170 why the Kidapawan trail is being used. 171 172 The Presiding Officer answered that the Bongolanon trail is still existing and that it 173 is the choice of the climbers which trail they are going to use. 174 175 With no other questions presented, the Presiding Officer thanked the Magpet 176 Tourism Office personnel for coming to the session and for answering the queries 177 of the councilors. 178 179 At this juncture, Hon. Apostol rose to move to restore the IRP of the august body. 180 Hon. Marañon seconded the motion. The body unanimously approved the 181 motion. 182 183
