Utility & Property Info:

Taxes: Town of Williston—$3,291.66 (2015/16 non-homestead rate). Property is NOT enrolled in the state’s tax reductionprogram called Use Value Appraisal, often referred to as Current Use. This program can reduce taxes for the

commitment of non-development and proper timber or agricultural management.

Power: Power poles run along the properties road frontage on Oak Hill Rd. The service provider is Vermont Electric Co-op.

The closet pole to the proposed home site is number # “31B/19C”

Septic: Property has been issued a State wastewater permit and design for a mound septic system servicing a fourbedroom single family residence. Permit number WW-4-4107. The mound location is in the NE corner of the

property and appears to be marked by wooden stakes and orange flagging.

The septic design was completed by Phil Savoy out of Westminster, VT. He has indicated that he felt it would be aninexpensive system to install and estimate it would cost about 18 -20K for an installation. He said it may cost a littlemore in Chittenden County but it is still an inexpensive mound system.

The engineer’s basic description was that it is a concrete 1000 gal tank with a siphon pump. The effluent can go

through inexpensive plastic drain pipe and because of the siphon pump and gravity feed system the pipe does not

need to be buried more than 1’ below ground. The mound is of the inexpensive “Infiltration” type, not the expensive

Water: A drilled well installation is approved within the state approved wastewater permit for this property. Currently,

there is no formal drinking water source.

Zoning: Property is within the Agricultural/Rural Residential District of the Williston Zoning Regulations. Please see

attached for partial zoning information. Please direct any specific zoning inquiries to the Williston Zoning Officials.

Boundaries: The property has some boundary descriptions as part of the wastewater permitting process. The boundaries do not

seem to be well marked, however, they are easily identifiable by road frontage and neighboring pastures.

Services: Fairpoint offers phone, high speed DSL internet, and satellite TV—through their affiliate DirecTV.

Road: Oak Hill Rd in a year-round, town maintained and plowed road.

Address: The properties address has been created for GPS purposes only. A formal 911 address will be issued by the town, ifa residence is built. The Thomas Chittenden Medical Center is approximately across the road from the proposed

home site. The TCMC address is 586 Oak Hill Rd.

Brook: Allen Brook runs the entire length of the property near the eastern border. According the Agency of Natural

Resources mapping system, there is approximately 2,420 feet of frontage.

Town

Parcel: There is a small parcel of land, owned by the town of Williston along the western edge/Oak Hill Rd frontage where a

water utility station is located. The town has indicated that it is utilized by Thomas Chittenden Medical Center.

Additional Zoning & Regulatory Information:

In response to a large number of inquiries from prospective buyers wondering, “What can I doon this property?” we have created this document presenting relevant information and resources.As this is largely a Williston town zoning regulatory question, we have consulted with a zoning officialto gather some broad information. Understand this is general information only and should not berelied upon for any decisions. Formal applications, reviews, and permitting must be acquired by thetown and/or the state regulatory systems dependent on plans and desires.

While the Agricultural/Rural Residential zoning district of Williston, is effectively 2 acreszoning, that does not mean 30+ homes could be developed on the property. Zoning laws indicate thatonly 25% of the property can be developed, however, this portion of land would need to be calculatedafter removing water features, wetlands, and adequate buffer zones. Therefore, 25% of developableland would not be calculated from the full acreage. Based on very general calculations it appearsthat 3 homes could potentially be built on the property. Although there is currently only awastewater permit for one 4-bedroom single family residence, we were informed by the engineerthat he remembers there is likely enough septic capacity for an additional 2 homes, but we currentlydo not have any test data to that effect. Per state regulation, if a current and approved forestry plan or an agricultural operation

approved by the state exists, then local zoning regulations will most likely not apply to the property.

This only excludes the property from the town zoning regulations for the approved forestry or

agricultural plan. One cannot obtain these measures, only to develop as pleased. But if one intends

on farming the property and producing income from the operation it is very likely that with an

approved plan the land can be cleared for the desired agricultural purposes. This is also true if a

purchaser wishes to log the property for income and remove evasive species they will be allowed to

do so with an approved plan. We suggest that buyers speak directly with the county forester for

Williston town zoning allows for a half acre of clearing per housing lot for development. Anymore than this would require town approval through the proper channels. Further clearing forpurposes other than an approved agricultural or timber operation, could pose a tough challengethrough a long process of incremental town approval. The half acre clearing does not typicallyinclude any clearing required for driveway or utility purposes; those are in additional to the half acre.

What needs to be understood is the town has an obligation to uphold a standard of regulationand expectations that are clearly defined in the zoning regulations. Subdivision is a lengthy processand whether it is the goal or another goal suits your desires – a clearly defined plan is the best wayto approach the town officials. They cannot make decisions on undefined plans or desires.
