CHINA MSA 1. The MSA are not out to catch faults2. The MSA must comply with the IMO rules on PSC. Detainable items

are detainable items and all deficiencies are to be dealt with. There is no arguing with that and China MSA are almost always factually right: there is a deficiency and it has to be dealt with

3. The MSA give the Master a ‘Ship Initial Inspection Checklist’ when they come on board and the Master can pro-actively inform the boarding inspectors of any known deficiencies on his ship, and what has been done about them (asked and obtained dispensation from Hong Kong Marine Department, informed Seaspan office, repair is arranged and confirmed, class have attended and given dispensation or a statement in writing to give a time window for rectification – in other words there is evidence that action has been taken and the system works)

4. The MSA want to see that the safety management system works, they do not expect that the ship is perfect and they do allow for honest mistakes.

CHINA MSA

1. BUT if deficiencies are not pro-actively reported, and then discovered by the boarding inspectors or prompt action to rectify deficiencies is not taken, then ‘everything changes’ (their words)

2. You never get a second chance to make a good first impression and the inspector’s mind is already 90% made up when he walks to the gangway, climbs on board and has his first encounter with the ship and the crew. If that first impression is not good, then he knows he will find deficiencies. By the time he gets to the ships’ office or Master’s cabin, his mind is 98% made up.

3. Ships’ staff and we shall not hesitate to pro-actively inform MSA/PSC of deficiencies and actions taken, we must get dispensations from MarDep (who have a 24/7 service and Hong Kong MarDep are very good at responding to such requests), get Class involved (it costs an attendance fee, but if Class gives dispensation or extended time to rectify then MSA will not object) when we have deficiencies – above all we have to be pro-active and show that the management system works.

MLC Inspection: The AMSA Inspector went through the documentation initially and then took a round of the Deck, Accommodation as well as the Engine Room. The Inspector checked the following in relation to the MLC- He was shown the Maritime Labour Certificate and the Declaration of Maritime Labour Compliance (DMLC Part I & DMLC Part II).- He asked for the work and rest hours and checked the same with the arrival and departure times for some ports randomly.- He also checked that the total hours worked for ratings matched with the overtime report.- The Employment agreement, Medical certificates as well as the Flag State and National Certificates were checked for all crew.- He asked for the onboard complaint procedure and was told regarding the same. He asked the Bosun as well as the Gangway watchman whether they had any complaints on board. When they replied in negative, they were asked the procedure if any complaints were to arise. They replied that a copy of the on-board complaint handling procedure was given to them and they would follow the same.The Inspector was satisfied with the answers given. The Inspector while taking rounds of the Accommodation checked the galley, pantries, provision stores, reefer chambers, hospital and also checked 2 crew cabins randomly.
