What’snew inHorizon2020withregardtoIP?

Ø Horizon2020hasestablishedasetofrulesconcerningtheexploitationanddissemination

ofprojectresults,includingtheirprotectionthroughintellectualproperty(IP)

Ø Itestablishescommitmentsfromtheparticipantsintermsofdissemination andexploitation

oftheprojectsresults

Ø “dissemination”= thepublicdisclosureoftheresultsbyanyappropriatemeans(otherthan

resultingfromprotectingorexploitingtheresults),includingbyscientificpublicationsinany

medium

Ø “exploitation”=theuseofresultsinfurtherresearchactivitiesotherthanthosecoveredby

theactionconcerned,orindeveloping,creatingandmarketingaproductorprocess,orin

creatingandprovidingaservice,orinstandardisation activities

Ø “projectresults”=anytangibleorintangibleoutputoftheproject,suchasdata,knowledge

orinformation,thatisgeneratedintheproject,whateveritsformornature,whetherornot

itcanbeprotected,aswellasanyrightsattachedtoit,includingintellectualpropertyrights.

ExploitationofResults

Ø Therefore,effectivelyexploitingresearchresultsdependsonthemanagementofIP,whichshouldbepartoftheoverallmanagementofknowledgeintheproject.

Ø Inotherwords,IntellectualPropertyisthecornerstoneofH2020projects,duetoitscapacitytogiveitsholdersacompetitiveadvantageinthemarket.

ManagementofIP

• Therefore,participantsmusteffectivelymanageintellectualpropertywithintheirproject,especiallyincollaborativeprojects.

• Why?BecauseeventhoughresearchcollaborationleadtolowerR&Dexpensesandrisks,itcanleadtodisagreementsintermsofresultsownership,useandevenmisappropriation,ifnostepsaretakentoprotectIP.

• Inthisrespect,apropermanagementofIPenhancesthechancesofaneffectiveexploitationoftheresearchresults.

• IPhastobeconsideredwhendescribingthemeasuresforexploitingtheresults.

• IPrulesarepartofasinglesetofrulesdetailedintheofficial“RulesofParticipation”.

• Changesandspecificationswithregardtoterminology:“foreground”☞ “results”.

• Why?Tomakesurethatasuitablestrategyandmanagement isimplemented

• Ithasaspecialimportanceattheproposalstage(wewillseeitinthepresentationon“HandlingIPintheproposalstage”)

• Furthermore,ithasanimportancewhendescribingtheconsortiumasawholeandhoweachpartnerwillcomplementeachother

• Thisshouldinclude informationontheskillsofeachpartnertodealwithIP(forexample:byhavingin-housepersonnelwithexperienceinthefieldcouldbeseenpositivelybytheevaluationteam)

Exploitation,dissemination,OpenAccess

• Exploitation,dissemination(openaccess),ownershipandaccessrightsaswellasprotectionandlicensingofIPshouldbeconsidered.

• OpenaccessinH2020canbedefinedasthepracticeofprovidingon-lineaccesstoscientificinformationthatisfreeofchargetotheend-user.

• InthecontextofR&D,'scientificinformation'canrefertopeer-reviewedscientificresearcharticles(publishedinacademicjournals)andalsotoscientificresearchdata(dataunderlyingpublications,curateddataand/orrawdata).

OpenAccess

• Openaccessisnotarequirementtopublish,as

researchersarefreetopublishornot,nordoesit

interferewiththedecisiontoexploitresearch

resultscommerciallye.g.throughpatenting.

• Thedecisiononwhethertopublishopenaccess

documentsmustcomeafterthemoregeneral

decisiononwhethertogoforapublicationdirectly

ortoseekfirstprotectionusingIntellectualProperty
