STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER

PURSUANTTOREQUIREMENTOFTHEUNIFIEDDEVELOPMENTORDINANCE,THEBOARD OFCOMMISSIONERSFINDSTHATTHEFOLLOWINGSTANDARDSARERELEVANTIN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEAL TH, SAFETY, MORALITY OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

PLEASE RESPOND TO THE FOLLOWING STANDARDS IN THE SPACE PROVIDED OR USE AN ATTACHMENT AS NECESSARY:

(A) WHETHER A PROPOSED SPECIAL USE PERMIT WILL PERMIT A USE THAT IS SUITABLE IN VIEW OF THE USE AND DEVELOPMENT OF ADJACENT AND NEARBY PROPERTY:

Annistown Road Baptist Church is requesting a special use approval in order to operate The Shepherd's Academy, a preschool serving children 6weeks - 12 years of age in Building D which is located at 4554 Annistown Road Snellville. GA 30039. The space would be primarily used as a childcare center which also provides. summer enrichment/camp for K-12 students 7 a.m. - 6 p.m. Monday-Friday. The proposed location was previously utilized as a Mom's morning out daycare service. meaning there would be little alteration required and suitable areas for parking, drop-offs and outdoor recreational space are already available. The lot contains a two-story church that is composed of a sanctuary wing and an education wing. A fenced playground is located behind the education wing and a 350 space parking lot is sited along the northern. eastern and southern parcel boundaries. behind the building. Churches. roadways, Annistown Elementary school, and green space surround the the subject site: the Ashington neighborhood is located to the north; the Anchor and Living Waters Christian Church are sited to the east; greenspace and Annistown Elementary School are located to south. The Ashington neighborhood and residential housing is located ,across Annistown Road. Annistown Church and residential neighborhoods are to the west of the subject site. across Spain Rd.

PROPOSAL The applicant proposes to operate a Christian child care. in a 7,670 square foot space in the Annistown Road Baptist Church. Approximately 100 to 150 students from pre-school age to the sixth grade level would be accommodated in six classrooms. Classrooms for the infants. toddlers. preschoolers. kindergarteners. and school age afterschool and summer camp children would be located on the first floor of the education. The childcare classes meet Monday through Friday 7 a.m. - 6 p.m. The students will use the playground and parking area located behind the education wing Monday through Friday and the church's Sunday school participants would play there during Sunday church services. The applicant has a second playground and garden area to the west of the building. Approximately 12 staff members would work at the proposed educational establishment. In addition to day care and classroom instruction, the applicant would schedule evening meetings with parents. faculty and the board of directors in the youth building, sanctuary, or a classroom on the education wing. An annual Christmas banquet and festival will be scheduled at the site for school families as well as the general public. I ED W 1

Twice a year (special events) Pick-up/Drop-off Hours: 7:00 a.m. - 8:20 a.m. Monday-Friday 12:30 p.m. -1:15 p.m. Monday-Friday 3 p.m. - 3:30 p.m .. Monday-Friday 5 p.m. -6:00 p.m .. Monday-Friday Number of Children: 100 students in day care 50 students in afterschool. summer camp 150 students total children proposed

Child Ages: 6 weeks to 12 years old

Staff: Approximately 12 staff members

Play area: Two play areas currently on-site (behind and to the west of the building).

Noise: Minimal noise expected while children are indoors. The streets. parking lots. and green space tree border would buffer potential noise for adjacent residences during outdoor play times. No new construction is required thus there will not be any construction noise or traffic.

Trash/Litter: Typical trash such as office paper and food wrappers resulting in 1 trash container of refuse a week. Trash will be collected during the church's weekly pick up. Trash and garbage shall be stored inside or in sealed containers that do not allow odors to escape or invasion by animals. No trash or debris shall be allowed to accumulate outside of those containers.

Parking: The Zoning Ordinance (section 240-20) requires that a daycare must provide one off-street parking space per 300-400 sq. ft. The proposal exceeds the zoning requirement for parking spaces by providing one hundred parking spaces exclusively for school use. Additionally. the applicant is permitted to use any available parking. beyond the allotted spaces. in the 350-space church lot during the weekdays.

STUDENT PICK-UP/DROP OFF For morning drop off of children. the applicant proposes that parents enter the church parking lot from Annistown Road at the curb cut marked as an entrance and proceed to park in the lot. Parents would escort children along the sidewalk and walk them into the classroom. After returning to their cars. parents would leave the parking lot at the curb cut designated as an exit and onto Annistown Road. Parents would reverse this process in the afternoon and early evening when picking up their children. Although there is a fire lane outside the entrance the proposed preschool will require parents to escort children into and from the facility rather than provide a carpool line. The applicant shall provide adequate drop off and pick up facilities so as to create minimal impact on pedestrian and vehicular traffic. specifically. drop off and pick up shall occur in the parking lot associated with the facility; drop off and pick up shall not occur on the public rights-of-way. The applicant shall provide information about alternative forms of transportation (school bus. Express bus. etc.) to the day care. including but not limited to print and electronic promotional materials, posting on the day care website. and other similar methods.

ZONING/MASTER PLAN DESIGNATION The property at 4554 Annistown Road is located in 01/0ffice and Industrial zone. Pursuant to Section 210-150. - 0-1 Office-Institutional District of the Zoning Ordinance. daycare are permitted with Special Use Permit approval in the zone The proposed uses are consistent with the Unified Development Ordinance which designates the property for institutional uses.

EXISTING USE OR USABILITY OF ADJACENT OR NEARBY PROPERTY:

The proposed special use permit will not adversely affect the existing use or usability of adjacent or nearby property. Please see attached exhibits (floor and site plan with intent letter). Nearby property consists of similar or more intense school and retail uses, such as Annistown Elementary School. The applicant requests to operate a childcare on a parcel zoned 0-1 (Office-Institutional District). The proposed school is approximately 7,670 s.f., part of a parent parcel containing 7.849-acres. The subject property is located on the southeast corner of the Annistown Road and Spain Road intersection. The proposed daycare would be located near the rear or southeast corner of the property, which is currently developed in the Annistown Road Baptist Church

Neighborhood impacts regarding noise are not anticipated since the parking lot. playground, and extensive landscaped grounds set the church building apart from adjacent residences, churches, and elementary school. Additionally, our staff does not believe that the pick-up and drop off process is likely to result in traffic congestion on neighborhood streets due to the number of available parking spaces in the sizable lot during the weekdays. Off-street parking for day care center staff is sufficient in the church parking lot. Further, standard conditions have been included regarding litter, employee notification of SUP conditions, and the publication of alternative forms of transportation to the site. Students may be dropped off or picked up for before and after care by local elementary school buses. The facility shall obtain all required state, federal. and local licenses and certificates prior to opening its place of business. The applicant shall conduct employee-training sessions on an ongoing basis, including as part of any employee orientation, to discuss all Special Use Permit provisions and requirements

(C) WHETHER THE PROPERTY TO BE AFFECTED BY A PROPOSED SPECIAL USE PERMIT HAS REASONABLE ECONOMIC USE AS CURRENTLY ZONED:

The property to be affected by a special use permit does not have economic use as currently zoned . Due to the property's location and exiting zoning for church and school uses, the subject property does not have reasonable economic use except to provide for the proposed childcare and private use in addition to the exiting church zoning.

(D) WHETHER THE PROPOSED SPECIAL USE PERMIT WILL RESULT IN A USE WHICH WILL OR COULD CAUSE AN EXCESSIVE OR BURDENSOME USE OF EXISTING STREETS, TRANSPORTATION FACILITIES, UTILITIES, OR SCHOOLS:

This property is located in an area with access to public water and sewer, and direct access to two major thoroughfares (Annistown Road and Centerville Hwyt and highways (Hwy 78 and Hwy 124). The development is consistent with the unified plan, which supports similar residential development in this commercial and residential corridor. The proposed use will support and alleviate any impact on, and will not cause excessive use of existing streets, transportation facilities, or utilities.

(E) WHETHER THE PROPOSED SPECIAL USE PERMIT IS IN CONFORMITY WITH THE POLICY AND INTENT OF THE LAND USE PLAN:

The surrounding area is a mix of residential and institutional uses. developed with low-density residential subdivisions. churches. and an elementary school. The subject property is bounded by the Annistown Elementary School to the south. and the Living Water Christian Church to the east. To the north and west of the subject site are additional churches and residential subdivisions. The nearest existing residence is across Annistown Road and approximately 600 feet from the building. The proposed special use permit is in conformity with the 2030 Unified Plan which identifies the subject property and areas as being appropriate for the promotion of reuse of existing developed sites.

RE: Zoning Letter of Intent

Dear Sirs,

The applicant, Annistown Road Baptist Church, submits this Special Use Permit Application for a public childcare for the existing church tenant located at 4554 Annistown Rd Snellville, GA 30039. The subject property covered by this application is currently zoned 0-I and has been used as a church since December 1964. This request is consistent with the existing zoning conditions, 2030 Unified Plan, and Special Use Permits. The church currently has a positive impact on the community and has helped to increase property values in the area.

The applicant intends to lease the existing church building to The Shepherd's Academy which will serve the church and surrounding neighborhoods. The school will provide the following educational services:

•Childcare 6 weeks-12 years 7 a.m. - 6 p.m. Monday-Friday The childcare program will offer before and afterschool and summer camp services. The

childcare program will be licensed by the Georgia Department of Early Care and Education: Bright from the Start. A written letter specifying zoning is required for the licensing application.

The preschool will be a member of the Association of Christian Schools International and offers inclusive services for Georgia Department of Education Title I students with disabilities.

The Shepherd's Academy team of Christian educators design technology-integrated early childhood learning experiences that enable young children to reach their full potential, prepare them for academic success, build a firm biblical foundation, and interest in life-long learning. We use research proven ABeka™ Publishers and Teaching Strategies™ Creative curriculum® curricula. Daily teaching and learning objectives focus on the holistic development of each child spiritually, emotionally, cognitively, and physically. Staff members and volunteers must have a teaching certificate, a satisfactory criminal background check, First Aid/CPR, and other mandated training.

Studies have shown that the quality of a childcare facility's environment directly influences children's cognitive, social, and emotional development. Childcare programs are located in churches throughout Gwinnett county and along signalized intersections on major arterial roads like the subject property which sits on Annistown Road. The request is consistent with prior board of commissioner's precedent in approving childcare uses on similarly situated properties throughout the county. The program will extend the uses of nearby schools to serve children who have siblings in nearby schools with little to no impact upon noise levels, traffic, water, or sewer, and existing uses. The property has sufficient parking, access to public water supply, public sanitary sewer, and convenient access to collector streets, major thoroughfares and interstate highways.
