Regulations regulating the Registration of Social Workers

Definitions

1. In these regulations, unless the context otherwise indicates -

“appeal committee” means an appeal committee appointed under section 40 of the Act;

“college” means any educational institution which provides or has provided post-matriculation courses, instruction or training in social work and which has been approved by the Minister for the purposes of these regulations;

“commission” means the commission to which the Board has, under section 4(4) of the Act, delegated the functions referred to in the said section;

“legal representative” means counsel or an attorney and includes any person appointed in writing by any respondent referred to in regulation 9 to represent him at an enquiry conducted under section 35 of the Act;

“register” means any register referred to in regulation 4(1);

“registered social worker” means any social worker registered under section 33(1) or (2) of the Act or whose name has been restored to the register in terms of regulation 11;

“social welfare officer” means any officer employed in the professional division of the public service and who in the performance of his official duties is mainly engaged in social work;

“the Act” means the National Welfare Act, 1965 (Act 79 of 1965);

Regulations regulating the Registration of Social Workers

“training school” means any educational institution which provides or has provided instruction or training in social and which has been approved by the Minister for the purposes of these regulations;

“university” means any university or university college established by or under any Act of Parliament and any such educational institution outside the Republic, approved by the Minister for the application of these regulations;

and any word to which a meaning has been assigned in the Act shall bear that meaning.

Application for Registration as a Social Worker

2. (1) Any application for registration as a social worker in terms of section 33 of the Act shall be made in the form of Schedule A and shall be submitted to the registrar for consideration by the Board.

(2) Such application shall -

(a) be accompanied by the birth certificate or baptismal certificate of the applicant or, if he is unable to produce his birth certificate or baptismal certificate, by such other documentary evidence of his date of birth or age as the registrar may deem fit;

(b) where possible, be accompanied by a copy of the diploma or certificate setting out the educational qualifications by virtue of which the applicant claims registration as a social worker, duly certified as a true copy of the original of such diploma or certificate by any officer in the service of the Department of Social Welfare and Pensions or the Department of Justice;

(c) if the applicant claims registration as a social worker by virtue of the provisions of regulation 3(1)(h), (i) or (j), be accompanied by documentary evidence in support of his claim;

(d) be accompanied by revenue stamps to the value of R3, affixed to such application.

(3) Every revenue stamp affixed to such application in terms of subregulation (2)(d) shall be cancelled by the registrar by impressing thereon in indelible ink his office and date stamp.

Qualifications

3. (1) No person shall be registered as a social worker unless -

(a) he has satisfied all the requirements for a bachelor’s degree or for a diploma of any university or college in the Republic after pursuing a course of study for such degree or diploma of not less than three years which included not less than three courses in social work and either not less than three courses in sociology and not less than two courses in psychology or not less than three courses in psychology and not less than two courses in sociology; or

(b) he has satisfied all the requirements for a bachelor's or higher degree of a university, other than the degree referred to in paragraph (a), and has passed all the examinations in social work, sociology and psychology conducted by a South. African university which included, either separately or together with the degree already obtained, not less than three courses in social work and either not less than three courses in sociology and not less than two courses in psychology or not less than three courses in psychology and not less than two courses in sociology; or

(c) he has, before the 7th day of August 1970. satisfied all the requirements for a bachelor’s degree or a diploma of any university in the Republic after pursuing a course of study for such degree or diploma of not less than three years which included not less than three courses in social work and either not less than three courses in sociology or not less than three courses in psychology or not less than three courses in criminology and in addition included not less than one course in any of the last-mentioned three subjects not already included in such course, or

was, at such date, registered as a student at any such university for such degree or diploma and has satisfied all the requirements for such degree or diploma after pursuing such course of study; or

(d) he has, before the 7th day of August 1970, satisfied all the requirements for a bachelor’s degree or for a diploma of any university or college in the Republic or was at such date, registered as a student at any such university or college for such degree or diploma and has satisfied all the requirements for such degree or diploma, and a person acting on the authority of the university or college concerned certifies in writing that the holder thereof is qualified as a social worker, or that the course of study pursued by the holder for such degree or diploma was regarded as adequate training for the practice of the social worker’s profession by such university or college, at the time of the commencement of such course of study by the person as stated in such certificate; or

(e) he has, after he has satisfied all the requirements for a bachelor’s degree other than the degree referred to in paragraph (a), (b), (c) or (d) of any university in the Republic or after the has been admitted to the status of such degree by such university, satisfied all the requirements for the honours, master’s or doctor’s degree in social work of any university in the Republic before the 31st day of December 1973, or has been registered by such date as a student for the honours or master’s or doctor’s degree in social work at such university and has satisfied all the requirements for such degree; or

(f) he has satisfied all the requirements for a degree or diploma of any university or educational institution in any country outside the Republic after completing a course of study for such degree or diploma which is the accepted course of study' in social work in the country concerned and which is considered by the Commission to be a course equivalent or superior to the courses referred to in paragraph (a) or (b); or

(g) in the case of a person other than a White person, he has satisfied all the requirements for the diploma in social work of any training school in the Republic; or

(h) he has, before the 7th day of August 1970, performed in the Republic social work, as defined in paragraph (a). (b), (c). (d) or (e) of the definition of “social work” in section 1 of the Act, for a period of not less than 15 years and has passed the matriculation examination conducted and controlled by the joint matriculation board referred to in section 15 of the Universities Act. 1955 (Act 61 of 1955), or an examination certified by the said joint matriculation board to be equivalent or superior thereto; or

(i) he has, before the 7th day of August 1970, lectured on the subject social work at any university, college or training school in the Republic for a period of not less than 15 years; or

(j) he has, before the 7th day of August 1970, performed social work, as defined in paragraph (a), (b), (c), (d) or (e) of the definition of “social work” in section 1 of the Act, in the Republic and lectured on the subject social work at any university, college or training school in the Republic for a period of not less than 15 years in the aggregate.

(2) No person shall be provisionally registered as a social worker unless -

(a) he has satisfied all the requirements for a bachelor’s degree of any university in the Republic and is registered as a student at any university, college or training school in the Republic for any degree or diploma referred to in subregulation (1)(a) or (g) and is engaged in a course of study for such degree or for such diploma, the successful completion of which would in accordance with the rules or regulations of such university, college or training school, then in force, entitle him to the award of such degree or diploma; or

(b) he has performed in the Republic, social work as defined in paragraph (a), (b), (c), (d) or (e) of the definition of “social work” in section 1 of the Act for a period of not less than five years and is registered as a student at any university, college or training school in the Republic for any degree or diploma referred to in subregulation (1)(a) or (g) and is engaged in a course of study for such degree or diploma, the successful completion of which would, in accordance with the rules or regulations of such university, college or training school, then in force, entitle him to the award of such degree or diploma; or

(c) he is registered as a student at any university, college or training school in the Republic for any degree or diploma referred to in subregulation (1)(a) or (g) and is engaged in a course of study for such degree or diploma, the successful completion of which within a period of six months of the date of his application for registration as a social worker would, in accordance with the rules or regulations of such university, college or training school, then in force, entitle him to the award of such degree or diploma.

(3) For the purposes of this regulation “White person” means a person classified as a White person in terms of the Population Registration Act, 1950, and includes any person who would probably be so classified if the provisions of the Population Registration Act are or were applicable to him.

Registration of Social Workers

4. (1) The registrar shall keep separate registers of persons registered in terms of section 33(1) and (2) of the Act in which he shall record or cause to be recorded in respect of every such person -

(a) the reference number assigned by him to such person;

(b) the date of his registration;

(c) his full name, population group and sex;

(d) the identity number assigned to him in terms of section 6 of the Population Registration Act, 1950 (Act 30 of 1950), or section 3(1) of the Identity Documents in South-West Africa Act, 1970 (Act 37 of 1970);

(e) his residential address;

(f) particulars of any warning given to him in terms of section 35(1)(a) of the Act;

(g) particulars of any action taken under section 35 of the Act or under regulation 10 whereby his registration has been suspended or his name has been removed from the register; and

(h) in the case of a person registered under section 33(2) of the Act, also the date of expiration of his registration certificate or the date to which the validity of such registration certificate has been extended, the conditions on which he has been provisionally registered in terms of such section and whether or not he has ultimately been registered in terms of section 33(1) of the Act.

(2) The registrar shall issue to every person -

(a) registered in terms of section 33(1) of the Act, a registration certificate in the form of Schedule B;

(b) registered in terms of section 33(2) of the Act, a registration certificate in the form of Schedule C.

(3) Every registration certificate so issued shall be signed by the chairman of the commission and by the registrar and shall be sealed with the official seal of the Board.

(4) No person who has been provisionally registered as a social worker in terms of section 33(2) of the Act shall be registered under subsection (1) of the section unless he has surrendered to the registrar the registration certificate issued to him in terms of the said section 33(2) or has satisfied the registrar that such registration certificate has been destroyed or is lost and cannot be found.

(5) (a) No person shall be provisionally registered as a social worker under section 33(2) of the Act for a period exceeding four years in the aggregate.

(b) Notwithstanding the provisions of paragraph (a), the validity of a certificate of provisional registration shall not be extended for any period in excess of one year at a time.

(c) A registration certificate issued under section 33(2) of the Act to a person referred to in regulation 3(2)(c) shall expire if such person docs not satisfy all the requirements of the degree or diploma referred to in the said regulation before the end of the year in which such registration certificate has been issued to him.

Certified Copy of Registration Certificate

5. The registrar may on the application of any registered social worker and on payment of a fee of R1 and if he is satisfied that the registration certificate issued to such registered social worker under these regulations has been destroyed or is lost and cannot be found, issue to such registered social worker a copy of the registration certificate so issued and shall certify such copy to be a true copy of such registration certificate.

Improper Conduct

6. Subject to the provisions of section 36 of the Act, a registered social worker shall be guilty of improper conduct if he -

(a) is convicted of any offence by a court of law and is sentenced to imprisonment without the option of a fine or to a fine exceeding R50;

(b) conducts himself in a disgraceful, improper or unbecoming manner;

(c) makes excessive use of intoxicating liquor or any habit-forming drug;

(d) in the execution of his duties as a registered social worker, makes any false statement, knowing it to be false or not knowing or believing it to be true; or

(e) publishes or communicates to any other person other than in the performance of his duties as a social worker, any information or matter coming to his knowledge while performing such duties.

Complaints and Charges of Improper Conduct

7. (1) Any person alleging improper conduct on the part of a registered social worker may lodge with the registrar a complaint in writing against such registered social worker, setting out under oath or affirmation full particulars of the alleged improper conduct.

(2) The registered shall forthwith submit such complaint to the chairman of the commission and a copy thereof to each of the Commission.

8. (1) If the chairman of the commission is, after consultation with the other members of the commission, whether as a result of a complaint lodged under regulation 7(1) or otherwise, of the opinion that there are reasonable grounds for conducting an enquiry under section 35 of the Act against any particular registered social worker, he may cause a notice to be served on such registered social worker calling upon him to show cause at a place and time specified in the notice why he should not be found guilty of improper conduct.

(2) Such notice shall set forth the improper conduct with which the registered social worker concerned is charged together with such particulars thereof as may be reasonably sufficient to inform him of the nature of the charge and shall be signed by the registrar and served on the registered social worker concerned by a social welfare officer by delivering or tendering a copy thereof to such registered social worker not less than four weeks before the day specified in such notice for the holding of the enquiry or, if he cannot be found, by leaving a copy of such notice not less than four weeks before the day so specified, at his residence or place of business or employment with a person apparently not less than 16 years of age and apparently residing or employed there.

(3) The social welfare officer to whom such notice is entrusted for service shall -

(a) immediately after effecting service thereof, notify the registrar in writing that service has been duly effected;

(b) if he is unable to effect service thereof, notify the registrar in writing of his inability to effect service;

(c) return the notice to the registrar together with the notification referred to in paragraph (a) or (b).

Enquiry

9. (1) (a) On the appearance of the registered social worker (hereinafter in this regulation referred to as the respondent) at the enquiry or if the respondent is not present at the enquiry and the commission is satisfied that the notice has been duly served on the respondent, the commission shall conduct an enquiry into the improper conduct referred to in the notice and may call and examine or re-examine any person present at the enquiry and shall hear such evidence as may be adduced by or on behalf of the respondent.

(b) The chairman of the commission may authorise any person to be present at an enquiry and to adduce evidence and arguments supporting the allegations stated in the notice referred to in regulation 8(1) and to cross-examine any person who adduces evidence to refute such allegations.

(2) The respondent shall be entitled to appear at such enquiry and to be represented thereat by his legal representative.

(3) Any respondent or his legal representative may at the enquiry examine any witness called for or on behalf of the respondent and may cross-examine any other witness giving evidence at the enquiry.

(4) (a) The commission may direct any person to give his evidence at the enquiry on oath or affirmation.

(b) The chairman of the commission or the member of the commission, as the case may be, presiding at the enquiry, may administer an oath to, or accept an affirmation from, any person appearing before the commission to give evidence or to produce any book, document or thing.

(5) In connection with the giving of evidence or the production of any book, document or thing at such enquiry, the law relating to privilege as applicable to a witness giving evidence or summoned to produce a book, document or thing in criminal proceedings in a magistrate’s court shall apply.

(6) The commission may in its discretion order that no person whose presence is not necessary shall be present at the enquiry.

(7) The provisions of regulations 8 and 9(2), (3) and (4) of the regulations promulgated under Government Notice R.1413 of 13 August 1971, shall mutatis mutandis apply to any enquiry held by the commission under section 35 of the Act.

(8) (a) The commission may, when holding an enquiry under section 35 of the Act or when making a finding of improper conduct under section 36 of the Act, take into consideration any evidence in any proceedings in a court of law or accept as prima facie proof any finding of fact made in such proceedings or in any previous proceedings under the said section 35 or 36 and not set aside or overruled on appeal.

[The word “of” should follow the word “proof” in the phrase “or accept as primafacie proof any finding of fact” in the Official Gazette, as reproduced above.]

(b) A copy of such proceedings or finding, purporting to have been certified by the registrar of any division of the Supreme Court or by the clerk of the Court or by the registrar appointed under section 6 of the Act or by any other officer in the public service, having the custody of the records relating to such proceedings or finding of fact, shall on its mere production be prima facie evidence of the contents thereof.

(9) The commission may, in its discretion, from time to time postpone or adjourn the enquiry for such periods as it may deem fit.

(10) (a) The chairman or the member of the commission presiding at the enquiry shall cause a record to be kept of the proceedings at the enquiry in such manner as he may determine.

(b) Such record shall be accessible to and copies may be made thereof by any interested person on such conditions as to time, and place as the registrar may determine.

(c) The records of any enquiry held by the commission under section 35 of the Act or of any proceedings under section 36 of the Act shall be preserved by the registrar at such places and for such periods as the Secretary may determine.

(11) The commission may, after having heard all the evidence and arguments adduced at the enquiry, adjourn to consider its verdict in private.

(12) (a) If the respondent or his legal representative is present immediately after the majority of the members of the commission has agreed upon the verdict, the chairman or member of the commission presiding at the enquiry shall in the presence of the respondent or his legal representative announce the finding of the commission and, if the commission has taken any action under section 35(a), (b) or (c) of the Act, of the particulars of such action.

(b) The registrar shall -

(i) except in the case where the provisions of paragraph (a) apply, notify any person found guilty of improper conduct under section 35 or 36 of the Act of such finding and of the particulars of any action taken under section 35(a), (b) or (c) and shall cause such notification to be served on the respondent in the manner provided by regulation 8(2) or, if service thereof cannot in the opinion of the registrar be so effected, such notification shall be served on such respondent by the registrar by placing it in an envelope and addressing and posting it by pre-paid registered letter to the last known address of such respondent; and

(ii) notify in writing any person, department of State or organization by which such person is alleged to be employed of any finding or action so made or taken.

10. The commission may -

(a) on the application of a registered social worker made in the appropriate form and if it is satisfied that no proceedings under section 35 or 36 of the Act are pending or contemplated against such registered social worker, order that his name be removed from the register of social workers;

(b) on being satisfied by documentary evidence or otherwise that a registered social worker has died, order that his name be removed from the register of social workers.

Restoration of Registered Social Workers to Register

11. (1) The commission may on the application of a person whose name has been removed from the register, made in the form of Schedule D, if it is satisfied that it is just that the name of such person be restored to such register, order that his name be so restored;

(3) Such application shall be accompanied by revenue stamps to the value of R1 which shall be defaced in the manner prescribed by regulation 2(3).

(4) The registrar shall restore the name of any person in respect of whom an order has been made under subregulation (1) by recording in respect of him the particulars prescribed by regulation 4(1) in the register from which his name had previously been removed.

(5) Subject to the provisions of regulation 4(3), the registrar shall issue to any person whose name has been so restored a registration certificate in the appropriate form.

Appeal

12. (1) An appeal against a finding made or action taken by the commission under section 35 or 36 of the Act shall be noted by the delivery to the registrar for submission to the Minister of a notice setting out distinctly and succinctly the grounds, whether of fact or law or both fact and law, on which the appeal is based.

(2) The registrar shall submit such notice to the Minister immediately on receipt thereof and shall transmit a copy thereof together with a copy of the record of the proceedings in question, including a transcript thereof if it was taken down in shorthand or recorded by mechanical means, to the chairman or member of the commission who presided at the enquiry or at the meeting of the commission at which the appellant was found guilty of improper conduct and such chairman or member of the commission shall, within 14 days thereof, furnish the register with a statement, in writing setting out -

(a) the facts the commission found to be proved at such enquiry or meeting;

(b) the commission’s reasons for any finding of fact specified in the appellant’s notice of appeal as a finding of fact appealed against;

(c) the commission’s reasons for any ruling on any question of law or as to the admission or rejection of evidence so specified as a ruling appealed against.

(3) Every notice of appeal and statement supplied to the registrar in terms of subregulation (2) shall become part of the record of the proceedings concerned.

(4) The registrar shall immediately upon receipt by him of the statement referred to in subregulation (2) -

(a) transmit to the chairman of the appeal committee the record of the proceedings together with a copy or transcript thereof if it was taken down in shorthand or recorded by mechanical means;

(b) transmit to the other members of the said appeal committee a copy of the record of the proceedings or a transcript thereof if it was taken down in shorthand or recorded by mechanical means;

(c) furnish the appellant with a copy of the statement supplied to the registrar in terms of subregulation (2).

(5) (a) The chairman of the appeal committee shall direct the registrar to notify the appellant in writing of the date and place fixed by the appeal committee for the hearing of the appeal.

(b) Such notification shall be served on the appellant in the manner provided in regulation 9(12)(b).

(6) Subject to the provisions of section 40(5) of the Act, the appeal committee shall decide the appeal on the record of the proceedings concerned.

(7) No person whose presence is not necessary shall, except by leave of the appeal committee, be present at the hearing of any appeal under section 40 of the Act.

(8) The registrar shall by direction of the chairman of the appeal committee notify the appellant in writing of the decision of the appeal committee.

Application of Regulations in the Territory

13. These regulations shall also apply in the territory, including the Eastern Caprivi Zipfel.

N.B. -

(i) (A) certified copy(ies) of the original document(s) of qualification by virtue of which you claim registration, as well as your birth certificate or baptismal certificate, must accompany this form or, if you are unable to produce such certificates, such other documentary evidence of your date of birth or age as the registrar may deem fit.

(ii) Your application for registration must be accompanied by revenue stamps to the value of three rand which must be affixed to the application.

(iii) If you were provisionally registered, it is not necessary to complete an application form again. Your provisional registration certificate must, however, be surrendered to the registrar together with documentary evidence that the registration requirements have been complied with. If such registration certificate has been destroyed or is lost and cannot be found the registrar must be satisfied accordingly.

(iv) If the subjects are not mentioned on your degree or diploma certificate, documentary evidence must be obtained by you from the training institution in which an indication is given of the subjects passed by you on a one, two, three or, where applicable, four year basis or with which you are busy. In the case of an application to be registered provisionally, the relative document issued by tile training institution must indicate that you are a final year student and that the degree/diploma will be conferred upon you if you pass.
