ESTABLISHMENT OF STATUTORY MEASURE AND DETERMINATION OF GUIDELINEPRICES: LEVY ON FRESH CITRUS FRUIT INTENDED FOR EXPORT

I, Tina Joemat-Pettersson, Minister for Agriculture, Forestry and Fisheries, acting under sections13 and 15 of the Marketing of Agricultural Products Act, 1996 (Act No 47 of 1996), herebyestablish the statutory measure set out in the Schedule.

SCHEDULE

Definitions

1. In this Schedule any word or expression to which a meaning has been assigned in theAct shall have that meaning, and unless the context otherwise indicates -

"CGA" means the Citrus Growers Association of Southern Africa, incorporated under section 21of the Companies Act, 1973 (Act No. 61 of 1973) with registration number 2000/010147/08;

"exporter" means an exporter of citrus fruit that exports citrus fruit on behalf of a producer, andincludes a producer that exports on his own behalf or on behalf of other producers;

"export citrus fruit" means fresh citrus fruit intended for export;

"producer" means grower of export citrus fruit; and

"the Act" means the Marketing of Agricultural Products Act, 1996 (Act No. 47 of 1996).

Purpose and aims of statutory measure and the relation thereof to the objectives of theAct

2. The purpose and aim of this statutory measure is to compel the parties to pay a levy tothe CGA. The levy builds on the statutory levy introduced in 2008, and is needed by the CGA forthe funding of production research and development, plant improvement, information andstatistics and market access functions to maintain current and develop new export markets, aswell as the transformation of the citrus sector.

The measure will not be detrimental to the number of employment opportunities or fair labourpractice and will only affect the role players in the citrus industry. On the contrary, the statutorymeasure aims to maintain the position of South Africa as one of the largest producers of freshcitrus in the world.

The measure will be administered by CGA, a company incorporated under section 21 of theCompanies Act, 1973.

Product to which statutory measure applies

3. This statutory measure shall apply to all export citrus fruit.

Area in which statutory measure shall apply

4. This statutory measure shall apply within the geographical area of the Republic of SouthAfrica.

Imposition of levy

5. A levy is hereby imposed on export of fresh citrus fruit.

Amount of levy

6. The amount of the levy shall be:2013: 3.13 cents per kg (47 cents per 15 kg carton),2014: 3.33 cents per kg (50 cents per 15 kg carton)2015 3.53 cents per kg (53 cents per 15 kg carton)2016 3.73 cents per kg (56 cents per 15 kg carton)

Persons by whom and to whom levy is payable

7. The levy imposed in terms of clause 5 shall -

(a) be payable by producers;(b) be payable in the manner set out in clause 8

Payment of levy

8. (1) Payment of the levy must be made on behalf of a producer by the exporter of thecitrus fruit concerned: Provided that -

(a) if the amount of the levy has been paid by the exporter of the citrus fruitconcerned, he or she may deduct the amount thereof from any moniesowed to the producer concerned or collect such amount from theproducer concerned; and

(b) an exporter shall be entitled to retain an administration fee of 1%of the levy thus deducted or collected in terms of subclause (1)(a)for his or her own account.

(2) Payments shall be made no later than thirty days after the citrus fruit had beenapproved for export in terms of the Agricultural Product Standards Act by meansof a cheque or electronic transfer in favour of CGA, and shall -(a) when forwarded by post, be addressed to -

Use of levy

9. The Minister approves that -(a) at least 70% of the levy funds should be used for the core business e.g.

production research and development;(b) not more than 10% for administrative use; and(c) approximately 20% be allocated towards transformation activities.

Commencement and period of validity

10. This statutory measure shall come into operation on the date of publication hereof andshall lapse 31 December 2016.



ESTABLISHMENT OF STATUTORY MEASURE: RECORDS AND RETURNSBY EXPORTERS AND PRODUCERS OF FRESH CITRUS FRUIT

2. The purpose and aims of this statutory measure is to compel the parties set out herein torender records and returns to the CGA. This is necessary to ensure that the amount of leviespaid by producers correlate with the total of fresh citrus fruit exported. By prescribing the



keeping of records with the rendering of returns on an individual basis, this information canbe correlated to ensure that all producers are actually paying what they are supposed to.

The measure will be administered by the CGA, a company incorporated under section 21 ofthe Companies Act, 1973.

Products to which statutory measure applies


Area in which measure shall apply

4. This measure shall apply within the geographical area of the Republic of South Africa.

Records to be kept and returns to be rendered

5. (1) All exporters and all producers shall keep such records and render the returns as may berequired by the CGA relating to export citrus fruit produced, received, sold, exported orotherwise utilized.

(2) The Perishable Product Export Control Board shall render a copy of all export certificatesor the information required by the CGA contained in such certificates within the periodspecified in subclause (4) to the CGA.

(3) The records referred to in subclause (1) shall -a) be recorded on a computer or with ink in a bookb) be kept at the registered premises of the person required to keep it for a

period of at least three years.

(4) The returns referred to in subclause (1) and (2) shall be rendered electronically, or on aform, obtainable free of charge for this purpose from the CGA, within 15 days after theend of each calendar month and shall -

(a) be submitted, when forwarded by post, to -CGAP 0 Box 461HILLCREST3650

By combining compulsory registration with thekeeping of information and the rendering of returns on an individual basis, information for thewhole of the industry can be co-ordinated to ensure the orderly collection of levies.

4. This statutory measure shall apply within the geographical area of the Republic of SouthAfrica.

Registration of parties concerned

5. All exporters and all producers shall register with the CGA.

Application for registration

6. Application for registration shall -

(a) be made within 30 days of the commencement of this statutory measure, and inthe case of a person becoming a party as contemplated in clause 5 after suchdate of commencement , within 30 days of becoming such a party;

(b) be made on the application form obtainable free of charge from CGA.

(c) Be submitted, when forwarded by post, to -CGAP 0 Box 461HILLCREST3650

I, Johannes Theodorus Crouse, Registrar of Labour Relations, hereby,

give notice in terms of section 109 of the Labour Relations Act, 1995, that,

following an application by the above-mentioned Council, its scope has

been varied as contained in the Annexure hereto.

The scope of registration of the above-mentioned council has in terms of

Section 58 of the Labour Relations Act, been varied.

With effect from 2012 -12- 1 3, the council is

registered in respect of -

The Hairdressing, Cosmetology, Beauty and Skincare Trade in the

Magisterial Districts of Pretoria, Wonderboom and Bronkhorstspruit.

For the purpose hereof, Hairdressing, Cosmetology, Beauty and Skincare

Trade is defined as follows:

"Hairdressing Trade' means the trade in which employers and

employees are associated for the purpose of rendering salon services in

any establishment where such services are normally rendered to

members of the public:-

`Salon services' means any one or more of a combination of the

operations generally and usually performed by and known as the

profession of nail technicians, beauty culturist, cosmeticians,

cosmetologists or hairdressers, and includes, but is not limited to the

following operations:

(a) The arranging, dressing, cutting, highlighting, shaving, curling,

cleaning, singeing, shampooing, bleaching, dyeing, colouring,

tinting, straightening, styling, waving (permanent, Marcel or water)

of hair, or any other treatment of the hair of the head or the face;

(b) the performance of any manicure; pedicure , nail technology or the

application of artificial nails or nail extensions, whatever the

substance used is acrylic, fibre glass or gel or any other substance;

(c) the shaping and plucking of eyebrows, including the application of

false or artificial eyebrows and eyelashes;

(d) the performance of any cosmetic and camouflage make-up of the

face and its features, whether by permanent, semi-permanent of

temporary means;

(e) the performance of any facial skin care operations;

(f) the removing of unwanted or superfluous hair from the head and

face by whatever means, including waxing, chemical depilatories,

electrical or mechanical means, but excluding shaving;

(g) the performance of any beauty treatment ;

(h) the performance of any beauty therapy or the massaging or

stimulating treatment or exercising of the face, scalp or neck;

whether or not any apparatus, appliance, preparation or substance

is used in any of these operations;

(i) the performance of any operation referred to in (a) on any wig or

hairpieces to be won by any person, whether or not any apparatus,

appliance, preparation of substance is used in any of these

operations.

"Skincare Trade' means the trade in which employers and employees

are associated for the purpose of rendering "salon services" and including

but not limited to cosmic, camouflage, spa treatment, tattooing and or


painting of the face or full body features, whether by permanent or semi

permanent or temporary means in any establishment where such services

are normally rendered to members of the public.

The organisation has ceased to function as a genuine employers' organisation as envisaged bythe Act.
