In the cas:;,s wr.ere promotion to he held either on seniority-cum-fitness or on senio.-ity leaving the unsuitable person, there shall be oo zone of consideration . Only that number of Government servant shall be considered according to seniority, which in each cadre is sufficient to fill the posts available or expected to be vacant due 10 retirement during one year.

In the select list, the names of two public serv;mt o r 25 percentage of the numbe.r of the public servant included in select list whichever in more the name~ o f the required number of the public servant shall be considered for each category to fill up the unforeseen vacancies occurring during the course of the aforesaid period.

(4) Promotion shall be done acconling to Rescrvati~n Roster prescribed for promotion by Governmcnt.

(5) In the matter of promotion, the PTOvisions of Chhattisgarh Public Service (Promotion) Rule, 2003 shall be applicable.

15. Preparation of list of suitable Ca.ndidate :-( I) The committee shall prepare a list of such persons as satisfy the condition prescribed in. rule 14

above and as held by the committee 10 be suitable for promouon to the service. This list shall include as many numbers as arc expected to be vacant due to retirement or promotion within o ne year of the date of preparing the list. Apart from this a list shall also be prepared to fulfill the rost unexpectedly vacant during the period.

(2) The list suitable employee shall be prepared according to the provision of Chhauisgarh Public Service (Promotion), Rule 2003.

(3) The list so prepared shall be reviewed every year.

(4) Lf in the process of selection, review or revision it is proposed to supersede any member of thc Civil Service. the commiuee shall record its reasons for the proposed super session.

16. Consultation with th e commission :- The recommendation of Departmental Promotion Committee prescribed presided over by the Chairman or a member of the com,nission shall be deemed to be compliance of the requirement of the consullation with the commission under sub clause (b) of clause (3) of Article 320 of the Constitution and separate consultation with the commission shall not be necessary.

re.:eived from the Government and unless il considers any change necessary. approve the I isL .

(21 lf lhe Commi»s,on considers it necessary lo make any c hange in the list received from the Govern­ment. the Commi<~ion shall inform the Government fo< the c hanges proposed and. after, taking into account the comments. if any. o f the Government may approve the list finally with such modification. if any. as may in its opinion be justified and proper.

18. Appointment to the Service from the Select List:-( I ) Appointments of the employees in<:luded in lhe Select lis t to posts bome on the cadre of the Service

shall follow 1he order in which the names of such officials appear in Select List.

Provided that. where administrative exigenc ies so required. a perso n whose name is nol included in the Select List or who is nol next in order in lhe Select list. may be appointed 10 1he service if the Government is sa1isfied lhat the vacancy is no t likely 10 last for appointment 10 service.

(2) fl shall no t ordinarily be necessary to consuh the Commission before appointment of a person whose name is included in the Select list to lhe Service unless during the period intervening between the inclusion of his name in lhe select List and t.he date of the proposal appointment !here occurs any deterioration in his work which. in the opinion o f the Government is such as 10 render him unsuirnbk for appointment 10 service.

19. Proba tion :-Every person directly recruited to the serv ic.e shall be appointed on probation for a period of . two years.

20. Inte rpretatio n :- If any question arises relating to the interpretation of these rules ii shall be referred 10 Go,·ernmen1 whose decision there on shal l be final.

21. RdaxMion :-Nothing in 1hesc Rules shall be cons1ruc1ed to limit or abridge the power of the govcrnmcm deal with the case of any person 10 whom these rules apply in such manner as may appear 10 it be j us t and equitable.

22. Repeal and saving :-(a) All rules conresponding to these rules o ther rules and enforce immediately before their commcncc­

meni of lhcse rules are hereby repealed in respect of matters covered by these rules.

Provided that any order made or ac1ion taken under 1hesc rules so repealed shall be deemed 10 have been made or taken under the corresponding provisions of these rules.
