Location
The land is located south east of the village of Lockington which is situated off the A164, 6.4miles north of Beverley and 8.4 miles south of Driffield.
Description
The Hotham Family Trust are offering bare arable land to let which has become availablefollwing a change in farming policy from the current occupiers JSR Farming Ltd . The land ismainly loamy and clayey soils and extends to 319.51 acres (129.3 hectares). The land isoffered, as a whole or in two lots, on a 10 year Farm Business Tenancy (FBT). The land liessouth east of the village of Lockington, and is accessible from Bealeys Lane, in Lockington aswell as via Station Road, as marked as a blue dotted line on the attached plan.
The holding compromises of mainly Grade 2 land with some Grade 3 land as classified byRegional Agricultural Land Classification Maps. Lot 1 totals 127.38 acres (51 hectares) andLot 2 totals 192.59 acres (78 hectares), please see the schedule overleaf.
Lot 1 is mainly Grade 2 land with some Grade 3 to the southern end. The soil is described aspartly “slight acid loam and clayey soils with impeded drainage” and partly “slowlypermeable seasonally wet slightly acid but base-rich loamy and clayey soils.”
Lot 2 is mainly Grade 2 with some Grade 3 to the northern end. The soil is descirbed as“slowly permeable seasonally wet slightly acid but base-rich loamy and clayey soils.”

Particulars
1. Basic Payment Scheme
The land is registered on the Rural Payments Agency Rural Land Register. The currenttenant has claimed Basic Payment Scheme upon the land. The 2020 claim is reserved inits entirety to the current tenant. The new tenant is able to purchase at market valueapproximately 129 hectares Non SDA entitlements from the current Landlor. The RLRplans will be available upon request. Any statement within these particulars is given ingood faith but carries no warranty.
2. Previous Cropping and Yields
Please find attached to the back of these particulars the previous cropping on the land.The current tenant has provided the following yeild averages achieved for the lastfive years. The Landlord cannot guareentee the accuracy of the averages provided.

3. Environmental Schemes
The holding is not subject to any Stewardship Schemes, however the current tenant hasestablished 6 meter margins around fields next to water courses.These do not have to beretained. The Estate would look favourably on any future proposal for EnvironmentalLand Management Scheme which would be appropriate for the farm.
4. Tenant Right and Ingoing Valuation
It is not anticipated there will be an ingoing valuation. All ditches and hedges will be cleaned/trimmed as necessary.
5. Soil IndicesA detailed soil survey was last undertaken in 2014 by SOYL. The farm will be re-surveyedduring the autumn at the Landlords expense with the results being made available to theincoming tenant and form part of the record of condition.
6. Nitrate Vulnerable ZoneThe land all lies within the Nitrate Vulnerable Zone.
7. Early EntryEarly entry for crop establishment following harvest will be available. The incoming tenant(s)will be granted possession from 11th October 2020, following execution of the Farm BusinessTenancy agreement and payment for the first instalment of rent.
8. Easements, Wayleaves and Rights of WayThe farm is let subject to all easements, wayleaves and rights of way whether mentioned inthese particulars or not.
9. ViewingViewing is strictly during daylight hours only. Due to Covid 19 restrictions, viewing isstrictly only available during the week commencing 1st June 2020 by appointment throughthe Dalton Estate Office, where viewing guidelines will be provided. Potential tenants arerequired to take a set of particulars with them whilst viewing the farm. Viewing the farm isdone entirely at the risk of the potential tenant and must be done without any dogs, and theEstate shall not be held liable for any injury sustained during viewing.

10. Method of LettingThe holding is offered to let by Informal Tender. Best and final offers of rent expressed as alump sum per annum (not per acre) should be sent in writing on the attached tender form toThe Agent, Dalton Estate Office, West End, South Dalton, Beverley, East Yorkshire HU177PN in a sealed envelope marked “Rent Tender - Hall Garth and Gomary HallFarmland” by no later than 12 noon on Friday 19th June 2020. Under the currentcircumstances, emails tender forms will be accepted, but please clearly mark the email “RentTender” to ensure the email email is not opened in error prior to the tender date. To avoidduplications of offers it is suggested that the tenders submitted should be for an unevenamount of money. The Landlord reserves the right not to accept the highest or any offer,furthermore, escalating bids or offers made by reference to other bids are not acceptable
11. Repairs and Insurance
The property is to be let on a Full Repairing Liability to the Tenant. A detailed photographicRecord of Condition will be taken at the start of the Tenancy.
12. Sporting, Mineral Rights, Timber Rights and Access
The Owner reserves the Sporting, Fishing, Mineral and Timber Rights from the letting. TheLandlord also permits hounds to be exercised and legal hunting to take place over the land.The Owner or their Representatives reserve the right to access the land at all times.
13. Rent Review
The Owner reserves the right to review the rent every 3 years if appropriate throughout theterm of the tenancy in accordance with the Agricultural Tenancies Act 1995. The rent shall bereviewed on a comparable basis with other open market rents.
14. Avaiability of Farmhouses
If a prospective tenants are interested in renting either the recently rennovated Hall Garth(5bedroom farmhouse) and/or New Farmhouse (4 bedroom farnhouse), these properties arecurrently available on a under a seperate Assured Shorthold Tenancy agreement.

15. Heads of Terms of the Tenancy
1. The Arable Land at Hall Garth and is to be let on a 10 year fixed term Farm BusinessTenancy, with effect from 11th October 2020 and terminating on the 10th October2030. The rent shall be payable half yearly in advance on 6th April and 11th Octoberin any given year.
2. The Tenant shall be responsible for all outgoings3. The Tenant shall keep and leave in good repair all fences, gates, ditches, drains etc.4. The Tenant shall be responsible for all maintenance of hedges5. The Tenant may not assign the tenancy6. The Tenant may not sub-let the land without the Landlord’s prior consent7. The Tenant will use the land for agricultural purposes only.8. The landlord will not allow any land to be used for outdoor pig production.9. The Landlord will not allow any genetically modified crops to be grown on the
Holding10. The Tenant will not grow potatoes more than one in seven years and vining peas one
in six years on any individual field enclosures11. The Tenant may not use any sewage sludge on the holding without the Landlord’s
prior consent.12. The Tenant must not spray within 1 metre of any field boundary.13. Possession will be available from 11thOctober 2020.14. The Tenant(s) shall be required to sign a tenancy agreement and pay the first half
yearly rent in advance prior to taking possession.15. A record of condition shall be taken by the Landlord prior to the tenant taking
occupation of the holding and a copy of which shall be made available upon requestfrom the Landlord.
16. The Landlord shall retain the right to actively run, maintain and carry out gameshooting over the land.
17. The Landlord reserves the right to include a short notice break clause which would beinvoked should a major change in capital taxation occur, the appropiate compensationwould be paid to the tenant.
