Important Information for Buyers All Lots are offered subject to Charles Miller Ltd.’s Conditions of Business and to reserves. The Conditions of Business for Buyers are published at the end of the catalogue.

Estimates are published as a guide only and are subject to review. The actual hammer price of a lot may well be higher or lower than the range of figures given and there are no fixed “starting prices”.

A Buyer’s Premium of 20% is applicable to all lots in this sale. Excepting lots sold under Temporary Import Rules which are marked with the symbol ‡ (see below), the Buyer’s Premium is subject to VAT at the standard rate (currently 20%). Lots offered for sale under the auctioneer’s margin scheme and VAT on the Buyer’s Premium is payable by all buyers.

Lots marked with the symbol ‡ have been imported from outside the European Union (EU) to be sold at auction under Temporary Import Rules. When released to buyers within the EU, including the UK, the buyer will become the importer and must pay VAT at the rate of 5% on the hammer price. The Buyer’s Premium will be subject to the standard VAT rate at 20%. Buyers outside the EU will normally be eligible to obtain a refund in respect of VAT, upon satisfactory documentary evidence of exportation. Further information on this matter is available on request.

Charles Miller Ltd. will be pleased to execute bids on behalf of those clients unable to attend the sale in person, subject to our Conditions of Business. All bids must be submitted in writing in good time and lots will always be purchased as cheaply as possible (depending on any other bids received, reserves and competition in the saleroom.) This service is offered free of charge.

Charles Miller Ltd. can supply quotations for shipping of purchases, including transit insurance and VAT refund administration fees, and will assist in the application for any export licences which may be required. Buyers are reminded that it is their responsibility to comply with UK export regulations and with any local import requirements.

ARTIST’S RESALE RIGHT (“DROIT DE SUITE”)

If a lot is affected by this right it will be identified with the symbol δ next to the lot number. The buyer agrees to pay to Charles Miller an amount equal to the resale royalty and we will pay such amount to the artist’s collecting agent. Resale royalty applies where the Hammer Price is 1,000 Euro or more and the amount cannot be more than 12,500 Euro per lot. The amount is calculated as follows:

4.00% up to 50,000 3.00% between 50,000.01 and 200,000 1.00% between 200,000.01 and 350,000 0.50% between 350,000.01 and 500,000 0.25% in excess of 500,000

Invoices will, as usual, be issued in Pounds Sterling. For the purposes of calculating the resale royalty the Pounds Sterling/Euro rate of exchange will be the European Central Bank reference rate on the day of the sale. Since 1st January 2012 Droit de Suite extends to the estates of artists deceased for up to 70 years

For lots imported from outside the EU, the following VAT symbols are used:-

All statements provided by Charles Miller Ltd. are honestly given, however our staff are not trained conservators or restorers and accordingly any statement given will not be exhaustive.

Ø PROPERTY INCORPORATING MATERIALS FROM ENDANGERED SPECIES (CITES) An export licence issued by the Department of the Environment will be required for the export of any item made of or incorporating (irrespective of percentage) animal material such as ivory, whalebone, tortoiseshell, rhinoceros horn, rosewood and lignum vitæ etc., and this may take up to eight weeks to obtain. Clients are advised to check with the regulating body in the country of importation regarding any possible restrictions on the importation of items within this category – some countries have an absolute ban on the importation of certain materials. For example, the U.S. generally prohibits the importation of articles containing species that it has designated endangered or threatened if those articles are less than 100 years of age.

Built at Chatham and commissioned at Flagship Mediterranean in 1877, Alexandra (named after the new Princess of Wales) was the last ship to mount full broadside armament below deck, and the first to deploy high-pressure cylindrical boilers which drove her 9,490 tons equipped with 21-foot screws to 14.5 knots - the fastest warship in the world at the time. In 1891 she became flagship to the R.N. reserve at Portsmouth, then a mechanical training ship in 1903 and was sold in 1908.

Inglefield led one of the earliest expeditions to discover the fate of the missing arctic explorer, Sir John Franklin, setting out in July 1852 in command of Lady Franklin’s private steamer, Isabel. Upon reaching the Arctic, he took the opportunity to survey Greenland’s west coast and much of Baffin Island’s eastern coast. He retired in 1885 and devoted his time to paintings and watercolours, becoming Chairman of the Arts Section of the Chelsea Naval Exhibition of 1891, at which he also exhibited.

This interesting miniature watercolour appears to have been removed from a midshipman’s log and details the two lines of ships present at this review, each craft numbered corresponding to a key below, and which included many of the principal ships of the day, including Victory, Cumberland, Vanguard etc.

THE ANGLO-DUTCH FLEET

A Journal Of The English and Dutch Fleet, Commanded By Admiral Russel. “From June 23rd, the time of their sailing from Torbay, to August the 10th, the time of their returning to said Bay, 1691...In a letter from an Officer on board the Lenox in Torbay, to a Person of Quality in Chelsea…”. A very rare booklet comprising the full account of the Officer, relating the events of pursuing the French Fleet for seven weeks along the coasts, and describing an action near Ushant, where 8 of the 40 French ships were taken. Lot also includes two small, original, separate and maps of the town of Brest and adjacent coasts, dated 1693, which were visited during the voyage. The account comprises the entire booklet, consisting of 4 pages (29” of Column Space in total), in a complete and genuine issue of A JOURNAL OF THE ENGLISH AND DUTCH FLEET, dated August, 21st, 1691

THE VOYAGES AND DEATH OF CAPTAIN COOK

“ A Voyage to the Pacific Ocean, performed undr the Directions of Captains Cook, Clerke, and Gore, in his Majesty’s Ships. The Resolution and Discovery, in 1776, 1777, 1778, and 1780...”. an excellent and lengthy article, in three volumes, covering the epic, and at the time secretive voyages to the Pacific, upon where at the end in 1799, he meets his death in Hawaii. The report is full of details regarding the voyages themselves as well as the discovered lands, flora,fauna and natives. Upon the death of Cook himself, full details are given of the surrounding events of the day, based on the reports of Captain Clerke. In all, 88” of Column Space, in three complete and genuine issues of THE LONDON CHRONICLE, dated the 13th and 18th of July, and 9th of September, 1784

THE FIRST FLEET

A Series Of Articles, All Relating To Transportation To Botany Bay. “It is said, that ships are to proceed annually to Botany Bay with convicts from several gaols in the kingdom. Those, who are in the high road to this new settlement, should be reminded that there are no ale-houses and no gin-flops are to be found there. To work or starve will be the only alternative…”. The article continues, as well as notification of a sentencing to transportation (in all, 3” of Column Space), and a bonus descriptive article on Cook’s voyage to America on the Adventure (4” of Column Space), in a complete and genuine issue of THE MORNING POST AND DAILY ADVERTISER, dated November 1st, 1786; together with “The Botany Bay scheme is by no means given up, nor is the departure of the ships that are to carry over the convicts retarded. They are to sail about Christmas, as first proposed by the Government. The greatest difficulty the Government has to contend with, in prosecuting the undertaking, is the expense…”. Some articles relating to the Governmental side of transportation, the domestic difficulties contended with relating to felons, as well as a new code of laws laid before the King for the new settlement. Also an article relating to a challenge by the Dutch to the settlement at Botany Bay, as well as a sailing notice for the ships to prepare at Spithead. In all 7¾” of Column Space, in two genuine and complete issues of THE SALISBURY AND WINCHESTER JOURNAL, dated October 30th, and November 27th, 1786

“ …On the 28th, the Cabin of Captain Bligh, who commanded the Bounty, was forcibly entered by the Officer of the Watch, assisted by three others, who dragged him instantly to the Deck, menacing his life, if he attempted to speak. His Endeavours to bring back the Conspirators to their Duty proved of no avail. Each of the Desperadoes was armed with a drawn Cutlass, or fixed Bayonet; and all their Musquets were avowed to be charged!….” A most detailed and excellent lengthy article describing the details of the mutiny on board the Bounty, as well as Captain Bligh and the Officers’ epic voyage to Timor. The account also extends to the survivors’ consequent passages, and some background on the chief mutineer, Fletcher Christian. An extensive and newsworthy article (Page 2, Columns 1-2, 15” of Column Space), all in a complete and genuine issue of JACKSON’S OXFORD JOURNAL, dated March, 20th, 1790; together with “…Extract of a Letter from a midshipman, aged sixteen, on board His Majesty’s ship Bounty, commanded by Captain Bligh, now on her voyage to Otaheite…” A lengthy article describing the outward bound voyage of the Bounty, sent from the Cape of Good Hope, before departing to Van Diemen’s Land, 10 months prior to the mutiny. Jones Charring Crofs, with 2½in. objective lens, 42in. lacquered-brass main tube inscribed Thomas Graves R.N., eyepiece with rack-and-pinion focus, interchangeable tubes with astronomical shade accessories, dew cuff, tripod stand with endless tangent screw circumferential adjustment, contained within original fitted case with substantial carrying handles to ends and lid, overall measurements -- 5¾ x 45½ x 9½in. (14.5 x 115.5 x 24cm.)

An apprentice, then employee of Jesse Ramsden,Thomas Jones moved to his Charing Cross premises (No.62) in 1816 and remained there until 1850. He was also telescope maker by Appointment to the Duke of Clarence, later William IV. From 1831 he was signing his instruments ‘Jones & Sons’ when his son, also Thomas, joined the business, indicating that this lot was sold between 1816 and 1830 - precisely when Graves would have been looking for a good quality and versatile instrument for his work.

Capt. Thomas Graves (1804-1856) entered the navy in 1816, obtained his first commission on 30th April 1827 and joined the survey ship H.M.S. Adventure under Captain Philip Parker King, that August bound for South America. A talented seaman as well as naturalist, five years later he had risen sufficiently to be given his own command (first the Mastiff; then Meteor and Beacon) and spent the rest of his career surveying the Mediterranean. In 1846 he joined the Ceylon at Malta and advanced to the rank of Captain where he assembled a formidable team of scientists around him including Edward Forbes, Professor of Natural History at Edinburgh University. They completed surveys at up to 230 fathoms - the deepest undertaken at the time, and also conveyed to England a collection of carved and inscribed ancient marbles recovered from the ruins of Xanthus by Sir Charles Fellows. In 1853 Graves was made Superintendent of the Ports at Malta, however it seems he had some altercation with a local boatman that left him so incapacitated he was placed on half pay and died of his wounds on 28th August 1856 - whilst the boatman was tried for murder, the navy lost one of its most talented surveyors. His name however lives on in several species named in his honour, including Pompilus gravesi and Cascellius gravesi.

BENJAMIN LEIGH SMITH: A QUANTITY OF EARLY ARCTIC EXPLORATION PHOTOGRAPHS, CIRCA 1881-2

comprising eight 5 x 7½in. sepia prints secured to annotated album leaves and including a view of the Dutch arctic exploration schooner Wilhelm Barents; views of Smith and the crew aboard the Eira and Hope; landing party views of Eira’s boats with ‘table cloth sails’; together with a further nine images from the West Indies and views aboard H.M.S. Fantome, laid to paper pages within an unused accounts book for 1885-6 -- 9 x 14¾in. (23 x 37.5cm.)

Benjamin Leigh-Smith (1828-1913) born to wealthy non-conformist parents, he trained as a lawyer but was wealthy enough to indulge his fascination with the Arctic. In 1880 Smith built the auxiliary brigantine Eira in which he sailed from Peterhead, but because of mist and pack ice failed to make Jan Mayen or east Greenland. Learning that ice on the north coast of Spitsbergen made it impossible to pass Amsterdam Island, he made for Franz Josef Land, recently discovered (in 1873-4) and only partly mapped. He reached and named May Island in August, adding the south-west coast of the new land to the chart. He also made some additions to the chart of the east coast of Spitsbergen. For these discoveries he was awarded the Patron’s Medal of the Royal Geographical Society in 1881. His paper on the voyage of 1880 was read at a meeting of the society and its importance agreed. In 1881 the Eira sailed from Peterhead and sighted Novaya Zemlya and Franz Josef Land, but on 21 August the yacht was nipped between pack ice and land floe off Cape Flora, and sank within two hours. The crew lived in a makeshift hut, built from materials they had previously deposited on Bell Island, for ten months, before taking to their boats in June 1882 for the homeward passage. They reached Novaya Zemlya where they met the Hope, commanded by Sir Allen W. Young, who had been sent to find them following considerable speculation in England as to their whereabouts. The whole crew landed safely at Aberdeen at the end of August 1882, having survived the winter because lack of provisions led them to live on a much healthier diet of fresh meat, and because of Smith’s quiet leadership. Back in England, Smith gave £1000 to the Royal Geographical Society in gratitude for the mounting of the search party. In 1882 he was made an honorary fellow of Jesus College, Cambridge. He made no further Arctic expeditions, and revoked the bequest of £80,000 he had left to the Royal Geographical Society in 1887, in frustration at their neglect of polar exploration. Nonetheless, in 1892 he worked with the Society to promote scientific investigation of the Antarctic.

[NATIONAL ANTARCTIC EXPEDITION 1901-4:] AN HISTORICALLY INTERESTING BULKHEAD CLOCK BELIEVED TO BE FROM THE S.S. DISCOVERY

with 7in. enamel dial, black steel hands, subsidiary seconds and slow/fast lever over ‘XII’, single winding arbor to chain fusee movement, contained within a shagreen-covered brass bulkhead case with repairer’s scratch-marks for ‘RRS Discovery 36’ inside, with hinged port, stamped around the recess ring H.M.S. DISCOVERY / R.F. SCOTT. 6 AUG. 1901, mounted on a circular wooden plaque for wall hanging, the top of the clock with white metal plate engraved H.M.S. DISCOVERY CAPTAIN SCOTT TERRA NOVA EXPEDITION 1910 -- 10½in. (27cm.) diameter

Discovery had several designations over the years and was ‘S.Y.’ when acquired by Scott, who then used ‘S.S.’ (having failed to get the Royal Navy to officially sanction the expedition, he couldn’t use ‘H.M.S.’, but confusingly managed to fly the R.N. white ensign by being a member of the Royal Yacht Squadron - the only yacht club granted this privilege); King George V conferred ‘R.R.S.’ in 1925 which she carries to the present date. The earlier exploration vessel Discovery (ex-Bloodhound) was designated H.M.S. as it was an R.N.-lead expedition, so it’s hardly surprising this clock, thought to have been removed as a souvenir, has incorrect punch marks. The scratch-markings inside are perhaps more telling insofar as they are very faint and are typical of the type used by clock repairers who, faced with a bench of similar movements, needed to record which case went with which movement, the ‘36’ being the year it was serviced.

The ‘T’ Class submarine Tigris was launched shortly after War broke out in October 1939 at Chatham Dockyard. She enjoyed a busy career and sank a number of Axis merchantmen (including the Norwegian Richard With which was lost with 101 Norwegian lives) and the Italian submarine Michele Bianchi. She left Malta on 18th February 1943 and was last sighted on the 24th and believed to have been sunk in a depth charge attack on the 27th by the German submarine chaser UJ2210. C.A. Dawe was an engineering officer aboard Tigris who achieved seniority on 1st February 1941 - his shipmates giving him this sword. By December that year he had transferred to Sturgeon and two years later was located at the Scottish submarine base Ambrose in Dundee, home of the 2nd/9th Submarine Flotillas.

THE SHIP’S BELL FROM THE FLOWER CLASS CORVETTE H.M.S. CONVOLVULUS (1940)

cast in brass with iron clapper, moulded rim, black-filled lettering, moulded shoulder with crown and remnant part of suspension bracket -- 13¾in. (35cm.) high

Ordered just before the declaration of War in 1939, Convolvulus was built at Bristol by Charles Hill & Sons. Launched in 1940, she was commissioned on 26th February 1941, issued with the pennant number K45, and served with the 36th Escort Group under the command of Lieutenant Richard Sinclair Connell RNR. She formed part of Convoy HG-76 from Gibraltar to the UK, in which four U-Boats were sunk for the loss of four ships (from a total of 32) and which is now regarded as a turning point for the allies in the Battle of the Atlantic. She was scrapped at Newport on 5th October 1947.

cast in brass and depicting a harpooned submarine with the legend Aut Victor Aut Victus HMS Wastwater, mounted on a lozenge-shaped wooden display board for wall hanging; together with a manuscript book of standing orders commencing 1st June 1943 and proceeding through the ranks, countersigned and stamped as read by the officers, and also containing a typed sheet with instructions for disposal of ‘secret matter’ if captured by the enemy, bound in cloth boards with HMSO label to front inscribed Standing Orders / For Officers Only, together with a letter of provenance to Capt. John Storey (Capt. from April 1943) for both items

Wastwater assisted with the capture of U570 in August 1941. Although the submarine had destroyed her code books and enigma machine, these had already been acquired from U501. The submarine was in such good condition that it was absorbed into the Royal Navy as HMS Graph. The distinctive ship’s badge included with this lot must have been a one-off commissioned by the Captain to celebrate this brush with fame. According to the letter of provenance, this and the book were with the family of Capt. Storey until recently.

Eagland and comprising a diary with entries from January 1st to February 18th 1941, detailing times of blackout, daily routine, weather conditions etc., and a service book with loose enclosures comprising an unsent letter home in the event of loss, a copy of The Times of Malta, 5th August 1943, a quantity of copy naval signals on pink copy papers concerning submarine sightings, torpedoes, engagements with the enemy, vessels burning, etc., mostly dated between 1942 and 1943, with other associated ephemera and a framed official copy signal from Mountbatten announcing the surrender of Japan, dated 14 September 1945

It is understood that Eagland was a Signal Lieutenant aboard the carrier Formidable and so had access to interesting signals, which he appears to have kept for his own diversion post war. Operation ‘Pedestal’ was the British operation to re-supply Malta, 9-15th August, 1942; Operation ‘Torch’ was the British-American invasion of North Africa 8-16 November, 1942.

Probably the result of a private commission - the box appearing to be a good quality example, converted and lined by the prisoners. It is known commissions were undertaken - the Governor of Norman Cross near Peterborough had his telescope covered and it remains on display in the town’s museum.

Leonard Peskett, O.B.E. (1861-1924) was an apprentice shipwright at H.M. Dockyard, Chatham where he concentrated on design. Joining Cunard in 1884, he remained in their service until his death and was involved with many of their ground breaking projects, the acme of which were the designs for R.M.Ships Lusitania and Mauretania in 1907, and Aquitania in 1913. Considered a leading authority on liner design, he was a Councillor of the Institution of Naval Architects where he presented an award-winning paper Design of Steamships from the Owners’ Point of View in August 1914.

AN HISTORICALLY INTERESTING ENGINE ROOM PLATE FROM THE P&O LINES PASSENGER/CARGO SHIP T.S.S. CATHAY (1924)

the brass plate engraved with black-filled lettering and bulkhead securing holes -- 12 x 18in. (30.5 x 46cm.)

Ordered in 1923 from Barclay, Curle & Co. Ltd. for the Australia run, the Cathay was launched on 31st October 1924 by Lady Inchcape - the same day as one her daughters launched Cathay’s sister ship Comorin at the same yard. Registered at just over 15,000 tons, she could steam at 16 knots but was never in fact fitted with the exhaust turbines that are suggested in the designation of this engine plate. With her sisters, she maintained a fortnightly service to Australia, adding a stop at Bombay in 1932, supplemented with the occasional Far Eastern run. On 25th August 1939 she was requisitioned by the Admiralty and refitted in Bombay as an armed merchant cruiser serving between Bombay and Durban. In July 1941 she rescued 900 survivors of the torpedoed RAF transport Anselm. She was converted to a troopship in early 1942 and it was whilst discharging troops at Bougie for Montgomery’s North African campaign on 11th November the same year that she was bombed by the Luftwaffe at 1.30pm. Abandoned at 7pm, a delayed-action bomb exploded in her galley starting a serious fire which, when it reached her magazine, blew her stern off and she sank on her starboard side, completely gutted. It is unknown when her engine plate was removed, but it has resided in the UK for many years with the vendor’s family.

Capt. Richard Travers Dixon (1866-1949) left the army in the late 1890s and is understood to have taken up professional yacht helming for the rest of his life. He participated in the 1908 Olympics at which he won a gold medal for his part in the team winning the 7 metre class racing.

A LOG BOOK FROM THE FOUR-MASTED BARQUE JUTEOPOLIS, 1918

kept by J.P. William, Chief Mate, on passage bewteen New York and Sydney between 12 October 1918 and 3rd June 1919 and including descriptions of preparatory work carried out prior to sailing, weather reports and typical daily observations, pilots’ activity, lists of crew and men on watches, the last few pages kept in new new name Garthpool in a different hand, bound between decorative printed card boards -- 13 x 11in. (33 x 28cm.)

Built in 1891 by W.B. Thompson, Dundee, the Juteopolis registered an impressive 2842 tons. She was built, as her name suggests, for the Jute trade between Calcutta and Dundee. In 1921 she was re-named Garthpool and continued in the twilight of sailing traders for another eight years before she ran aground on November 11th, 1929, at Boavista Island, Cape Verde, and became a total loss. All her crew survived. She is often credited with having been the last British deep-water sailing ship - sailing under the Canadian merchant ensign.

Lots 169 & 170 were recovered from the wreck of the Tek Sing (1822)

The Tek Sing (‘True Star’) was a large three-masted Chinese junk that sank on February 6, 1822 in the South China Sea area of Belvidere Shoals. It was 50 metres in length, 10 meters wide, and weighed a thousand tons. Sailing from the port of Amoy with 200 crew and 1600 passengers, it sank after attempting a shortcut through the Gaspar Strait and running aground on a reef. Only a small number of survivors were rescued the following morning by an English East Indiaman captained by James Pearl. This great loss of life has led to the Tek Sing being called the “Titanic of the East”. In May 1999 the British marine salvor Michael Hatcher discovered the Tek Sing and he and his crew subsequently raised an astonishing 350,000 pieces, making it the largest haul of Chinese porcelain ever recovered from a wreck.

Built by Richardson, Duck & Co. for the German firm of Freitas & Co, the 2200 ton Athen was carrying fuel oil when she collided with the S.S. Thor on 18th March 1906 about 10 miles south east of Portland Bill and sank in fifty metres of water.

The Trito was a Dutch cargo ship by Boele’s, she was bombed in passage with coal between Port Talbot and Shoreham on 20 September, 1940.

Surface Demand Diving Equipment provided a safe, transitional-type of diving suit. Whilst the main oxygen supply was provided by hoses from the surface, in the event of that being cut off, the diver had small front-carried cylinders which provided a few minutes air to return to the surface. This set was last used about five years ago, but is now sold for historic purposes.

A FINE 18TH-CENTURY MARINER’S COMPASS BY P.N. BRENNØE, COPENHAGEN, CIRCA 1750

with 4in. etched card signed around centre P.N. Brennøe / Kiøbenhavn contained within a carved wooden bowl lined with laid paper painted white and countermarked and dated ‘1805’ by the inked ‘North’ line, the exterior finished in gesso and paint, top glass retained with sealing wax -- 3 x 5½in. A specialist compass maker, Peder Nielson Brennøe is recorded as working from the late 1740s until 1767 when the business was handed to his son Christian Pedersen Brennøe. He in turn continued until 1800 when his son, Peter Christian Brennøe, succeeded and possibly made the adjusters’ marks found inside. This example was discovered recently in Scotland and its remarkable state of preservation suggests it was little used after its 1805 refurbishment.

A RARE PORTUGUESE MARINER’S ASTROLABE BY FRANCISCO DE GOES, 1595

cast from bronze in a wedge section with shaped base ballast signed GOIS 1595 and impressed with Manueline armillary sphere approval mark, divided over the top half 90º-0-90º and surmounted with a suspension loop on universal joint; the alidade with countersunk pierced pinnules in the sighting vanes, secured with decorative threaded axis pin and wing nut -- 73⁄8in. At the time the above survey was completed in 1987, sixty-five astrolabes were recorded. Since then, the list has been maintained informally and now numbers around 100 examples. As might be expected, many of these are wreck finds in poor-modest condition and most found as a result of improvements in diving technology. This example is a rare survivor and one which is in fine and original condition.

Most mariners’ astrolabes are the products of either Spain or Portugal (a tiny proportion have been attributed to British, Dutch or French makers) where the industry became highly evolved with, according to Stimson, seven distinct patterns emerging between 1500 and 1700, which is believed to be their approximate period of use at sea - this example is Type I(a), a cast wheel with base ballast. Early in the sixteenth century, the Spanish authorities required all navigational instruments to be examined by the Pilot Major of the Casa e Contratación for accuracy, with successful instruments being stamped with an approval mark. The regulation was much ignored, to the extent that it was re-issued in 1545, however it is presumed that in the period when Portugal was a province of Spain (1580-1640) these regulations also applied, and the armillary sphere (a symbol adopted from King Henry the Navigator, 1394-1460, by Manuel I, 1469-1521, and still used on the Portuguese flag) was used as the approval mark.

Francisco de Goes flourished between 1587-1632 and worked from Lisbon, signing his instruments variously as ‘Gois’; ‘Goes’ and ‘Goys’. His son Agostinho de Raposo succeeded him, and also his grandson João de Raposo who took the family business into the third quarter of the seventeenth century.

comprising three examples: 1. 1½in. marine-type, signed on the single draw Dollond London, with 25in. tapering mahogany leather-covered tube with dust cap; 2. 1½in. achromatic-type with 24in. parallel brass leather-covered tube with lacquered-brass shade slide, lacquered-brass dust cap inscribed D’Arcy Preston with instructions inside for changing the ‘object glass’, signed and inscribed on the single draw Dollond London Achromatic Sight / D’Arcy Preston; 3. 2in. large marine-type, with 37in. tapering leather-covered wooden tube signed on the single draw tube Dollond London / D’Arcy Preston, lacquered-brass dust cap engraved with owner’s name and containing main lens instructions inside, all contained within original fitted wooden case with securing hooks -- 3¾ x 39½ x 9¾in. (9.5 x 100.4 x 25cm.)

D’Arcy Preston (1765-1847) the son of a clergyman, entered the navy as a sixteen year old volunteer. Promoted to Lieutenant in 1790 he served in American as well as Mediterranean and Home waters. At the start of the Napoleonic Wars he was on the Royal Sovereign (100) and Boyne (98), flagships to Admirals Graves and John Jervis, and commanded the seamen of the Boyne when they stormed Fort Royal, Martinique, then later assisted in the Reduction of St. Lucia. Promoted Commander, he was appointed to the Rattlesnake, sloop of war, whose officer provided the Official Account of these actions. After this, he was on half pay for two years before being given command of the Termagant Sloop and attained Post Rank in June 1796. On 19th December 1796 he was aboard the Blanche (32) in company with La Minerve, under Commodore Nelson when they took on the superior 40-gun Spanish frigates Sabina and Ceres. After a short action, Ceres surrendered to Preston, but as he was about to secure his capture, a Spanish 3-decker bore down on them and he withdrew. Nelson managed to capture Sabina, but she was soon re-captured. Between 1803 and 1810, Preston commanded the Sea Fencibles (a crack naval militia which, in conjunction with the network of Martello Towers, provided the second line of defence against invasion by the French, should they break through the first line of defence, the tight blockade of French ports) between Flamborough and the Tees and possibly when he bought this magazine of telescopes as a useful aide. The Sea Fencibles were disbanded in 1810 and from 1813 he was placed in charge of Prison Ships at Plymouth. He became a Superannuated Rear Admiral in 1819, marking the effective start of his retirement. He died an Admiral of the White on 21st January 1847 aged 82.

A RARE, POSSIBLY UNIQUE, 18TH-CENTURY SINGLE DRAW MAHOGANY AND BRASS SIX-FOOT CAMPAIGN TELESCOPE BY HENRY PYEFINCH, LONDON

constructed in four 18½in. sections with substantial brass threads, tapered eyepiece with dust slide, signed on removable double main lens assembly Pyefinch London No.194 with adjustable focal length indicator slide numbered ‘7 / 6’, closed length assembled -- 75in. (190.5cm.)

Henry Pyefinch (fl. 1739-90) advertised a full range of instruments from Cornhill, London, but is generally associated with his optical instruments. He was prosecuted by Peter Dollond in 1765 for infringing the Dollond-owned achromatic lens patent, which Dollond won. This interesting telescope displays an image the correct way up which suggests terrestrial rather than astronomical use and was, presumably, once contained in a travelling box. Whether it was intended for surveying, military or recreational purposes is not clear.

unsigned, the main tube bound in three sections of coloured baleen, fine-focus adjustment wheel, eyepiece with removable sun filter and lens cap, mounted on a tripod base with folding legs. Overall measurements -- 12½ x 27in. (32 x 68.5cm.)

Little is known about the German emigré, Georg Steinberg, who seems to have developed the process of wrapping sticks and telescopes in stained baleen. Although some were stamped Steinberg Patent, no patent was lodged in his name, and it seems likely it was done to deter imitators. Although he basically acted as a subcontractor to instrument makers, several examples of his work have been seen on much older early 18th Century instruments. It seems the process was used between approximately 1815-1840.

AN UNUSUAL AND HISTORICALLY INTERESTING EARLY-MID 19TH-CENTURY FRAUNHOFER-TYPE TELESCOPE FROM DOLLOND

the 2in. objective lens with flared ebony cuff, brass cap engraved externally Dollond and internally Purchased by John West, Opticians of Fleet Street at the last Sale of Dollonds effects of Ludgate Hill, mahogany tube with stand connector and fine-focus wheel, the eyepiece set within ebony cuff. Closed length -- 39½in. (100.4cm.). Wooden storage box

The last family member to own Dollond was William Dollond (1834-1893) who succeeded to the business on the death of his father, George, in 1866. Although comparatively young, by 1871 he was too ill to continue and sold the business to his former employee J.R. Chant who promptly held an auction at the long-established 59 St. Paul’s Churchyard address lasting several days from the 8th August 1871. An advert placed in The Times on the 27th July by Winstanley & Horwood lists a vast range of scientific instrument types, including ..a large variety of astronomical, marine and portable telescopes.. of which the present lot would appear to be one example. John West Opticians are recorded in the London trade directory as trading from 92-93 Fleet Street, about 7 minutes’ walk from Dollond’s premises.

A RARE SPYGLASS COMPENDIUM ETUI ATTRIBUTED TO THOMAS RIBRIGHT, CIRCA 1765

with Bilston enamel gilt tube decorated with four Arcadian rural scenes over a pink ground with gilt scrolls and white trellising, lens and eyepieces with dust slides, fitted internally with compartments for silver-gilt accessories comprising folding fruit knife with Rococo handle, tweezers, ivory aide-memoire, snuff spoon and pin tool, and embroidery needle -- 4¾in. (12cm.) high

Thomas Ribright (w.1735-1772) patented this form of ‘perspective glass’ on 7th February, 1749 (No. 640) and fitted them with many different accessories to suit a variety of clients, and even one which doubled up as a microscope - this, where the folding gilt fruit-knife with Rococo casting is identical to that in Fig.F in Patents connected with the Microscope 1666-1800 by W.H. Brown, published in the Journal of the Royal Microscopical Society, 1895, p.6 plate V.

A RARE EARLY 19TH-CENTURY MODEL FOR A BRIGHTON HOG-BOAT

with black-painted clinker hull, paint to frames, the buoy stencilled B102, rudder, planked decks and fittings including covered hatches, coiled ropes, anchor, Venetian red bulwarks, capstan, two masts with stitched linen sails, yards and rigging, mounted on two brass columns within glazed wooden case -- overall measurements 17¼ x 25½ x 9½in. (44 x 65 x 24cm.)

Brighton hog-boats (or ‘hoggies’), were common fishing boats of the South Coast between Eastbourne and Shoreham during the 18th and 19th Centuries, and usually had lee boards fitted. Gradually replaced by two-masted luggers, no original examples are believed to exist.

H.M.S. Leopard was a Portland Class Fourth Rate ordered in 1785, but only completed in 1790. She enjoyed a busy and quite illustrious career and served as a flag ship on three occasions, the last to Vice Admiral Sir George Berkley on the Halifax Station during which time she captured - and released - the U.S.S. Chesapeake in June 1807. She was wrecked in the Gulf of St. Lawrence in 1814.

built by R. Philips, of lime, holly, spruce and mahogany, fully framed and with clinker-built planking, bottom boards, foot rests, thwarts and rowlocks for six oarsmen, finished in blue, white and varnish and mounted on two turned columns, display base with six oars and plate. Built by Peters of St. Mawes for the Pilots of Bryher, Isles of Scilly, this gig attended many wrecks. As late as 1955 Sussex was the first gig to reach the wreck of the Mando, aground on Golden Ball reef. Before the R.N.L.I. was firmly established these were the principal vessels used for saving lives - and could out-pace a Customs Cutter if the need arose.

with laminated and carved wooden hull finished in red, grey and black, with twin propeller shaft and rudders, superstructure with painted fittings including deck rails, ventilation shafts, balustrades, life buoys, quick release life rafts, bridge landing craft, quick firing guns, communication turret with radar lamps, range finder, bridge with binnacle over, funnel stack with crest, crane on slide, flight deck with helicopter and other details, mounted on two brass columns within Plexiglas display base with builder’s plate -- overall measurements 15½ x 41 x 11in. (39 x 104 x 28cm.)

A sturdy all-rounder, the 3,000 ton Al Munassir had a crew of 45 (plus space for 188 troops) and was able to carry 550 tons of cargo - or eight heavy tanks, which could be unloaded via a bow ramp. The crane was able to lift 16 tons and the heli-pad suitable for a Westland Sea King machine. Her Sperry Sea Archer optical fire system made her a suitable command vessel. Placed in reserve by 1995, she was sunk as an artificial reef in 2003 and is popular with divers.

Built by Alexander Stephens & Sons for the British India SS Co. to replace an earlier namesake sunk in 1942, the new Karanja registered 10,294 tons and could accommodate 60-1st, 180-2nd and 1,400-deck passengers cruising at 17.5 knots. Owned by P&O between 1971-75, she reverted to BI ownership briefly before being sold to an Indian company and renamed Nancowry. She was broken at Bombay in 1988.

AN HISTORICALLY IMPORTANT 1:48 SCALE ADMIRALTY BOARD FRAME MODEL, PROBABLY FOR THE ‘LIVELY’ CLASS 38-GUN FRIGATE, CIRCA 1800

constructed in steamed boxwood with pinned stringing and mounted within a contemporary glazed case with mahogany tracing, the cover secured by threaded bun feet. Measurements overall --18 x 45½ x 14½in. (46 x 115.5 x 37cm.)

The name ship of a new class of 18-pounder fifth rates designed by Sir William Rule in 1799, Lively was the prototype of what soon came to be regarded as the most successful frigate design of her era, so much so that a further fifteen were ordered for the fleet between 1803 and 1812. In order to allow Admiralty officials ready access to observe her progress ‘on the stocks’, she was laid down in the royal dockyard at Woolwich in November 1801 and built under the direction of Master Shipwright Edward Sison. Broadly similar to all her subsequent sisters, she was measured at 1,075 tons bm. and was 154 feet long overall (130 feet at the waterline) with a 39 foot beam. Mounting 38 guns in total, her main armament comprised 28-18pdrs. on her upper deck although this was augmented by several 32pdr. carronades on both fo’c’sle and quarter deck.

Launched on 23rd July 1804 and completed for sea the following month on 27th August, she was commissioned under Captain Graham Hamond and initially dispatched to cruise off the coasts of French-occupied Spain and Portugal. First in action off Cadiz on 5th October 1804, she - in company with three other frigates, Indefatigable, Medusa and Amphion - engaged and captured a Spanish ‘treasure fleet’ of four frigates (although one was sunk) whose cargo netted almost one million pounds sterling when it was sold back at home. On 29th May 1805, she was briefly in action with the Spanish ‘74’ Glorioso, again off Cadiz, and in March the next year she formed part of the naval escort for General Craig’s expeditionary force to Naples. In June 1806, Captain Hamond was replaced by George McKinley under whom, on 18th September 1809, she - along with H.M.S. Plover - captured the 16-gun French privateer L’Aurore. Ordered into the Mediterranean in June 1810, Lively was wrecked on 10th August (1810) when she ran ashore near St. Paul’s Bay, Malta, due to the incompetence of her Master, Michael Richard. Despite every man being saved along with everything of value aboard her, Lively herself was a total loss and, at the subsequent Court Martial, the Master was “dismissed the ship and ordered to serve before the mast.”

Whilst this model was most likely constructed to assist the building of Lively herself, the notable success of her design could have occasioned its provision for another yard where one of her consorts was being laid down.

Model measurements -- 46 x 61in. (117 x 155cm.); cased measurements -- 84½ x 72 x 30in. (214.5 x 183 x 76cm.)

Despite the large number of US-built vessels named ‘Liberty’ during the post-revolutionary era, this model is believed to be that of the 10-gun privateer Liberty built for Mr. Francis Adams in John Henry’s Yard at Cathance Landing, Bowdoinham, Maine, and launched in 1810. Rigged as a brig and measured at 121 tons, her main deck was 77 feet long and she had a 22.3 foot beam with an 8.1 foot draught. Although no other information about her is readily available, her smart lines and useful armament would surely indicate that she was probably employed as a privateer during the Anglo-American War of 1812-14.

A RARE LATE 19TH-CENTURY FINELY PRESENTED BUILDER’S MODEL FOR THE STEAM LAUNCH TENDER TO THE S .Y. WINTONIA, 1894

with plank on frame carvel hull with brass propeller, brass backed rudder with wooden handle tiller attached to steering chains, centrally mounted triple expansion steam engine with wood lagged cylinder heads and polished brass fittings mounted abaft of boiler plant housing, complete with dials, water level gauge, whistles, rake funnel and grab rails, launch fitted internally with seats and gratings, mounted on two brass pedestals on raised plush-lined base within original glazed oak case -- overall measurements 10 x 28½ x 10in. (25.5 x 72.5 x 25.5cm.)

Launched as the Ladye Maisry in 1894, Wintonia was designed and built by Day, Summers & Co. at Southampton and rigged as a schooner. Registered at 168½ tons gross (109 net & 233 Thames), she measured 138 feet in length with a 19 foot beam and was powered by one of her builder’s own compound 2-cylinder engines. Purchased by F.H. Punton of Aberlady, Longniddry, Scotland in 1896 and renamed Wintonia, he kept her throughout the Edwardian era although, by 1914, she was owned by the yacht builders J.G. Fay & Co. of Southampton. Hired briefly by the Admiralty as a harbour tender between November 1914 and April 1915, she was afterwards sold to Captain W.J. Herivel and Lt.-Cdr. S.P. Herivel who owned her jointly until the mid-1920s when she was sold to T.B.F. & W.E. Rees of Athens where she remained until the late 1930s when she disappears from record, believed scrapped.

A BUILDER’S HALF BLOCK MODEL FOR THE S.Y. ARIES, BUILT FOR SIR JAMES RAMSDEN BY BARROW SHIPBUILDING CO., 1873

carved from laminated yellow pine and lined with boot top, rudder, main and steering propeller shafts, mounted on an ebonised display board inscribed s.s yacht Aries -- 6 x 38in. (15 x 96.5cm.)

Aries was built for Sir James Ramsden, one of the industrial magnates of Victorian England, in 1873. Designed as a three-masted iron screw schooner by Ramsden himself, Aries was constructed by the Barrow Ship Building Company at Barrow-in-Furness where Sir James was a pivotal figure. Registered at 186½ tons gross (107¼ net). Aries measured 145 feet in length with a 20 foot beam and her screw (and the distinctive small steering screw) were driven by a compound two-cylinder engine of 50h.p. Subsequently passing into the ownership of the 10th Duke of Leeds, one of the most distinguished yachtsmen of his day and later Commodore of the Royal Yacht Squadron, Aries became a familiar sight at Cowes throughout the 1890s and the golden summers of the Edwardian era. Still flying the Leeds colours when war was declared in August 1914, Aries was immediately offered to the Admiralty for wartime duties and, armed with two 3-pounders, was accepted into service as an Auxilliary Patrol Yacht on 12th September. The fifty-three year old Duke skippered her for almost a year during which she led a small patrol flotilla initially off the Tyne and later in the Dover and Downs area. Shortly after the Duke was transferred to another command however, Aries was sunk by a mine on 31st October 1915 whilst patrolling near the South Goodwin Lightship with the loss of five officers and seventeen men.

the carved and laminated hull with deck fittings including lowered dredging cutter, silvered fittings including winches, anchors etc., deck house ventilators, engine room with lights, two fitted boats in davits, spot lamp, piping, twin stayed funnels, with safety valve extension pipes, bedding posts attached to mechanism and other details, mounted on three silvered columns within original mahogany, glazed case with four dual language builder’s plates in French and English, complete with table stand. Measurements including stand -- 61 x 28½ x 61in. (155 x 72.5 x 155cm.)

A.F. Smulders of Schiedam was established in 1905 and closed down in 1978. These two unusual dredgers, Yard Numbers 457 and 458 respectively, were 37 meters long, and capable of displacing 1000 cubic meters per hour from a depth of twelve meters. They were delivered to the Tsar in April 1914.

with carved and laminated hull with bilge keels, port holes, silvered propellers and A-brackets with twin rudders flanking bucket ramp, the hull with detailed fittings including awning stanchions, bitts, studded anchor chain, wooden companionway housing, silvered and grey-painted dredging components, open bridge with telegraphs and steering motor, engine room lights, twin stayed funnels with markings, two fitted lifeboats in davits and other details, mounted on silvered columns within original glazed mahogany display base, complete with four dual language builder’s plates in French, Italian and English and mounted on original stand. Measurements including stand -- 61¼ x 29 x 65½in. (155.5 x 74 x 166.5cm.)

Fitted with suction and pressure-discharge systems, the Venezia was capable of displacing 700 tons per hour using buckets, or 1000 tons per hour with the suction pipe. She was 65.5 meters long with a breath of 10.5 meters and was able to steam at 8 knots when fully loaded to a depth of 4.4 meters.

Provenance: Given by the Board of Harland & Wolff, Belfast to retiring Member, Alex Ferry, 1994, and thence by descent.

This vessel was part of a convoy attacked off Puri, India, by the Japanese Northern Force lead by Rear Admiral Kurita Takeo. Silksworth, carrying coal between Calcutta and Aden, was one of five merchants sunk by the gunfire from the heavy cruisers Kumano and Suzuya and the destroyer Shirakumo on 6th April, 1942. Her eight officers and crew and forty-nine Chinese workers were all saved.

the laminated and carved hull finished in red and black with lacquered and lined decking replete with detailed gold-plated fittings as appropriate, masts with derricks, lined wooden superstructure with open over bridge, liveried funnel, fitted boats in davits and much other fine detailing, contained in original light oak display case with twin ivorine plates. Cased measurements -- 18¼ x 59½ x 11½in. (46.5 x 151 x 29cm.)

Provenance: With Broströms, Sweden, until recently de-accessed.

A large vessel of over 5,200 tons, the Atland was on passage to London from Pepel carrying ore when she collided with the S.S. Carso on March 25th, 1943 and sank with the loss of nineteen lives. The Carso (a captured Italian cargo ship of 1922) went on to achieve fame of a sort by being scuttled on the 9th June, 1944 to form part of the Mulberry Harbour used by the Allies for the Normandy Landings, and was eventually broken up in 1947.

1. Introduction (a) The contractual relationship of Charles Miller Ltd. and Sellers with

prospective Buyers is governed by:- (i) these Conditions of Business for Buyers; (ii) the Conditions of Business for Sellers displayed in the saleroom

and available from Charles Miller Ltd.; (iii) Charles Miller Ltd.’s Authenticity Guarantee; (iv) Any additional notices and terms printed in the sale catalogue,

in each case as amended by any saleroom notice or auctioneer’s announcement.

(v) As auctioneer, Charles Miller Ltd. acts as agent for the Seller. Occasionally, Charles Miller Ltd. may own or have a financial interest in a lot.

2. Definitions “Bidder” is any person making, attempting or considering making

a bid, including Buyers; “Buyer” is the person who makes the highest bid or offer

accepted by the auctioneer, including a Buyer’s principal when bidding as agent;

“Seller” is the person offering a lot for sale, including their agent or executors;

“CM” means Charles Miller Ltd., Auctioneers, 6 Imperial Studios, 3/11 Imperial Road, London SW6 2AG, company number 6282355.

“Buyer’s Expenses” are any costs or expenses due to Charles Miller Ltd. from the Buyer;

“Buyer’s Premium” is the commission payable by the Buyer on the Hammer Price at the rates set out in the Guide for Prospective Buyers;

“Hammer Price” is the highest bid for the property accepted by the auctioneer at the auction or the post auction sale price;

“Purchase Price” is the Hammer Price plus applicable Buyer’s Premium and Buyer’s Expenses;

“Reserve Price” (where applicable) is the minimum Hammer Price at which the Seller has agreed to sell the lot.

The Buyer’s Premium, Buyer’s Expenses and Hammer Price are subject to VAT, where applicable.

3. Examination of Lots (a) CM’s knowledge of lots is partly dependent on information

provided by the Seller and CM is unable to exercise exhaustive due diligence on each lot. Each lot is available for examination before sale. Bidders are responsible for carrying out examinations and research before sale to satisfy themselves over the condition of lots and accuracy of descriptions.

(b) All oral and/or written information provided to Bidders relating to lots, including descriptions in the catalogue, condition reports or elsewhere are statements of CM’s opinion and not representations of fact. Estimates may not be relied on as a prediction of the selling price or value of the lot and may be revised from time to time at CM’s absolute discretion.

4. Exclusions and limitations of liability to Buyers (a) CM shall refund the Purchase Price to the Buyer in circumstances

where it deems that the lot is a counterfeit, subject to the terms of CM’s Authenticity Guarantee.

(b) Subject to Condition 4(a), neither CM nor the Seller:- (i) is liable for any errors or omissions in any oral or written

information provided to Bidders by CM, whether negligent or otherwise;

(ii) gives any guarantee or warranty to Bidders and any implied warranties and conditions are excluded (save in so far as such obligations can not be excluded by English law), other than the express warranties given by the Seller to the Buyer (for which the Seller is solely responsible) under the Conditions of Business for Sellers;

Conditions of Business for Buyers(iii) accepts responsibility to Bidders for acts or omissions (whether

negligent or otherwise) by CM in connection with the conduct of auctions or for any matter relating to the sale of any lot.

(c) Without prejudice to Condition 4(b), any claim against CM and/or the Seller by a Bidder is limited to the Purchase Price for the relevant lot. Neither CM nor the Seller shall be liable for any indirect or consequential losses.

(d) Nothing in Condition 4 shall exclude or limit the liability of CM or the Seller for death or personal injury caused by the negligent acts or omissions of CM or the Seller.

5. Bidding at Auction (a) CM has absolute discretion to refuse admission to the auction.

Before sale, Bidders must complete a Registration Form and supply such information and references as CM requires. Bidders are personally liable for their bid and are jointly and severally liable with their principal, if bidding as agent (in which case CM’s prior and express consent must be obtained).

(b) CM advises Bidders to attend the auction, but CM will endeavour to execute absentee written bids provided that they are, in CM’s opinion, received in sufficient time and in legible form.

(c) When available, written and telephone bidding is offered as a free service at the Bidder’s risk and subject to CM’s other commitments; CM is therefore not liable for failure to execute such bids. Telephone bidding may be recorded.

6. Import, Export and Copyright Restrictions CM and the Seller make no representations or warranties as

to whether any lot is subject to import, export or copyright restrictions. It is the Buyer’s sole responsibility to obtain any copyright clearance or any necessary import, export or other licence required by law, including licences required under the Convention on the International Trade in Endangered Species (CITES).

7. Conduct of the Auction (a) The auctioneer has discretion to refuse bids, withdraw or re-offer

lots for sale (including after the fall of the hammer) if (s)he believes that there may be an error or dispute, and may also take such other action as (s)he reasonably deems necessary.

(b) The auctioneer will commence and advance the bidding in such increments as (s)he considers appropriate and is entitled to place bids on the Seller’s behalf up to the Reserve Price for the lot, where applicable.

(c) Subject to Condition 7(a), the contract between the Buyer and the Seller is concluded on the striking of the auctioneer’s hammer.

(d) Any post-auction sale of lots shall incorporate these Conditions of Business.

8. Payment and Collection (a) Unless otherwise agreed in advance, payment of the Purchase

Price is due in pounds sterling immediately after the auction (the “Payment Date”).

(b) Title in a lot will not pass to the Buyer until CM has received the Purchase Price in cleared funds. CM will generally not release a lot to a Buyer before payment. Earlier release shall not affect passing of title or the Buyer’s obligation to pay the Purchase Price, as above.

(c) The refusal of any licence or permit required by law, as outlined in Condition 6, shall not affect the Buyer’s obligation to pay for the lot, as per Condition 8(a).

(d) The buyer must arrange collection of lots within 10 working days of the auction. Purchased lots are at the Buyer’s risk from the earlier of (i) collection or (ii) 10 working days after the auction. Until risk passes, CM will compensate the Buyer for any loss or damage to the lot up to a maximum of the Purchase Price actually paid by the Buyer. CM’s assumption of risk is subjected to the exclusions detailed in Condition 5(d) of the Conditions of Business Sellers

(e) All packing and handling of lots is at the Buyer’s risk. CM will not be liable for any acts or omissions of third party packers or shippers.

9. Remedies for non-payment Without prejudice to any rights that the Seller may have, if the

Buyer without prior agreement fails to make payment for the lot within 5 working days of the auction, CM may in its sole discretion exercise 1 or more of the following remedies:-

(a) store the lot at its premises or elsewhere at the Buyer’s sole risk and expense;

(b) Cancel the sale of the lot; (c) Set off any amounts owed to the Buyer by CM against any

amounts owed to CM by the Buyer for the lot; (d) Reject future bids from the Buyer; (e) Charge interest at 4% per annum above HSBC Bank Plc base

Rate from the Payment Date to the date that the Purchase Price is received in cleared funds;

(f) Re-sell the lot by auction or privately, with estimates and reserves at CM’s discretion, in which case the Buyer will be liable for any shortfall between the original Purchase Price and the amount achieved on re-sale, including all costs incurred in such re-sale;

(g) Exercise a lien over any Buyer’s Property in CM’s possession, applying the sale proceeds to any amounts owed by the Buyer to CM. CM shall give the Buyer 14 days written notice before exercising such lien;

(h) Commence legal proceedings to recover the Purchase Price for the lot, plus interest and legal costs;

(i) Disclose the Buyer’s details to the Seller to enable the Seller to commence legal proceedings.

10. Failure to collect purchases (a) If the Buyer pays the Purchase Price but does not collect the lot

within 20 working days of the auction, the lot will be stored at the buyer’s expense and risk at CM’s premises or in independent storage.

(b) If a lot is paid for but uncollected within 6 months of the auction, following 60 days written notice to the buyer, CM will re-sell the lot by auction or privately, with estimates and reserves at CM’s discretion. The sale proceeds, less all CM’s costs, will be forfeited unless collected by the Buyer within 2 years of the original auction.

11. Data Protection (a) CM will use information supplied by bidders or otherwise obtained

lawfully by CM for the provision of auction related services, client administration, marketing and as otherwise required by law.

(b) By agreeing to these Conditions of Business, the Bidder agrees to the processing of their personal information and to the disclosure of such information to third parties worldwide for the purpose outlined in Condition 11(a) and to Sellers as per Condition 9(i)

12. Miscellaneous (a) All images of lots, catalogue descriptions and all other materials

produced by CM are the copyright of CM. (b) These Conditions of Business are not assignable by any

Buyer without CM’s prior consent, but are binding on Bidders’ successors, assignees and representatives.

(c) The materials listed in Condition 1(a) set out the entire agreement between the parties.

(d) If any part of these Conditions of Business be held unenforceable, the remaining parts shall remain in full force and effect.

(e) These Conditions of Business shall be interpreted in accordance with English Law, under the exclusive jurisdiction of the English Courts, in favour of CM.

If Charles Miller Ltd sells an item of Property which is later shown to be a “counterfeit”, subject to the terms below Charles Miller Ltd. will rescind the sale and return the Buyer the total amount paid by the Buyer to Charles Miller Ltd. for that Property, up to a maximum of the Purchase Price.

The guarantee lasts for one (1) year after the date of the relevant auction, is for the benefit of the Buyer only and is non-transferable.

“Counterfeit” means an item of Property that in Charles Miller Ltd.’s reasonable opinion is an imitation created with the intent to deceive over the authorship, origin, date, age, period, culture or source, where the correct description of such matters is not included in the catalogue description for the Property.

Property shall not be considered Counterfeit solely because of any damage and/or restoration and/or modification work (including, but not limited to, recolouring, tooling or repainting).

Please note that this guarantee does not apply if either:- (i) the catalogue description was in accordance with the generally

accepted opinions of scholars and experts at the date of the sale, or the catalogue description indicated that there was a conflict of such opinions; or

(ii) the only method of establishing at the date of the sale that the item was a counterfeit would have been by means of processes not then generally available or accepted, unreasonably expensive or impractical; or likely to have caused damage to or loss in value to the Property (in Charles Miller Ltd.’s reasonable opinion); or

(iii) there has been no material loss in value of the Property from its value had it accorded with its catalogue description.

To claim under this guarantee the Buyer must:- (i) notify Charles Miller Ltd. in writing within one (1) month of

receiving any information that causes the Buyer to question the authenticity or attribution of the Property, specifying the lot number, date of the auction at which it was purchased and the reasons why it is believed to be Counterfeit; and

(ii) return the Property to Charles Miller Ltd. in the same condition as at the date of sale and be able to transfer good title in the Property, free from any third party claims arising after the date of the sale.

Charles Miller Ltd. has discretion to waive any of the above requirements. Charles Miller Ltd. may require the Buyer to obtain at the Buyer’s cost the reports of two independent and recognised experts in the relevant field and acceptable to Charles Miller Ltd. Charles Miller Ltd. shall not be bound by any reports produced by the Buyer, and reserves the right to seek additional expert advice at its own expense. In the event Charles Miller Ltd. decides to rescind the sale under this Guarantee, it may refund to the Buyer the reasonable costs of up to two mutually approved independent expert reports, provided always that the costs of such reports have been approved in advance and in writing by Charles Miller Ltd.
