Pursuant to Fed. R. Civ.P. 65 and Local Rule 65-l, Plaintiffs Jumbo Bright
Trading Limited ("JBTL") and Charles Anthony Philip Pozzi ("Charles Philip"), by

enjoin the Defendants from further acts of trademark infringement, patent infringement
and right to publicity infringement.
This amended motion ("Motion") is made on the grounds that:
1. JBTL is the sole owner of the CP CHARLES PHILIP trademark, U.S.
Trademark App. No. 85476692. This Trademark application is pending at the U.S.
Patent and Trademark Office, and has been continuously and exclusively used in
commerce by Charles Anthony Philip Pozzi since at least August 1, 2010. Charles
Philip and JBTL are the owner of the common law trademark CHARLES PHILIP
which has also been used on shoes since at least August 1, 2010.
2. JBTL is the sole owner of the distinctive Striped Design on the Inside of a
Shoe trademarks, U.S. Trademark App. Nos. 85602476 and 85602452. These
Trademarks are pending at the U.S. Patent and Trademark Office, and have been
continuously and exclusively used in commerce by JBTL since at least August 1, 2010.
3. Plaintiffs have spent significant time and resources in the advettising and
promotion of the CHARLES PHILIP, CP CHARLES PHILIP trademarks and the
distinctive Striped Design on the Inside of a Shoe trademark (hereinafter collectively
referred to as the "Jumbo Bright Trademarks") which have been used in conjunction
with Charles Philip loafers.
4. JBTL is the sole owner of two design patents on the distinctive Striped
27 Design on the Inside of a Shoe, U.S. Patent Reg. Nos. D668849 and D668850. U.S.

Patent Reg. No. D668849 was issued by the United States Patent and Trademark
Office on October 16, 2012. U.S. Patent Reg. No. D668850 was issued by the United
States Patent and Trademark Office on October 16, 2012. ("Jumbo Bright Designs")
5. Charles Philip is an internationally known shoe designer.
6. Charles Philip has attained an extraordinary level of popularity and fame
in the United States and around the world, and is the subject of public interest in the
fashion world.
7. Upon information and belief, Defendants offer for sale and sell products
using the Jumbo Bright Designs, CHARLES PHILIP and CP CHARLES PHILIP
trademarks and the distinctive Striped Design on the Inside of a Shoe trademark or a
substantially similar confusing mark ("Defendants' Unauthorized Products").
8. Upon information and belief, notwithstanding the lack of authorization
from JBTL and the fact that said Defendants' Unauthorized Products otherwise are not
authorized to be sold utilizing the Jumbo Bright Designs and Jumbo Bright
Trademarks, Defendants have made repeated unauthorized use of the Jumbo Bright
Trademarks and Jumbo Bright Designs in connection with said products, as described
below, with the intent to mislead and confuse consumers into believing that said
Defendants' Unauthorized Products are made directly by JBTL pursuant to JBTL's
strict quality control standards or that said Defendants' Unauthorized Products are
otherwise authorized or licensed by JBTL and with the intent of misappropriating, for

their own benefit, the tremendous goodwill built up by JBTL in the Jumbo Bright
Trademarks.
9. Based on information and belief, Defendants infringed and continue to
5 infringe the Jumbo Bright Designs within the meaning of35 U.S.C. §271(a) at least by

selling and offering to sell the Defendants' Unauthorized Products without JBTL's
authorization or license.
10. On or before August 2012, Defendants began selling loafers containing
the Charles Philip distinctive Striped Design on the Inside of a Shoe. In addition to
this design, the Defendants' loafers contained a stamp on the inside identifYing the
loafers as "PHILLIP Moccasin Slipper" and 'PHILLIP Slipper" respectively. This
Phillip stamp used the name-likeness, identity and persona of Charles Philip for
commercial purposes without his consent.
II. The misuse of the Jumbo Bright Designs and Jumbo Bright Trademarks
by Defendants was intended to cause, has caused and is likely to continue to cause
consumer confusion, mistake or deception including the misleading of consumers into
mistakenly believing that the Defendants' Unauthorized Products are made directly by
JBTL pursuant to JBTL's strict quality control standards or JBTL has authorized or
licensed the use by Defendants of the Jumbo Bright Trademarks and Jumbo Bright
Designs for those Unauthorized Products.

Defendants is damaging to the reputation and goodwill of JBTL and the Jumbo Bright
Trademarks.
5 13. Based on information and belief, Defendants infringed and continue to

infringe the Jumbo Bright Designs within the meaning of35 U.S.C. §271(a) at least by
selling and offering to sell the Defendants' Unauthorized Products without JBTL's
authorization or license.
14. The Defendants' Unauthorized Products are likely to cause confusion, and
have caused actual confusion, in the minds of the consuming public as to an
association of Charles Philip with Defendants' loafers. Defendants knowingly and
intentionally took steps to exacerbate and perpetuate the likelihood of confusion and
actual confusion in the minds of the consuming public, and to perpetuate their
unlawful exploitation of Charles Philip's name, likeness, identity and persona for
Defendants' commercial gain, through Defendants' unlawful use of Charles Philip's
name.
15. Defendants' Unauthorized Products continue to broadcast publically

16. The Defendants' Unauthorized Products falsely represent that Charles
Philip sponsors, endorses, or is associated with, Defendants.

Plaintiffs request that the Preliminary Injunction issue with minimal bond or no
bond based on Plaintiffs' showing of a strong likelihood of success on the merits, and
on the anticipated low amount of the enjoined Defendants' possible losses should it
later turn out that the injunction should not have been granted (Fed. R. Civ.P. 65).
· This Motion is based on the Complaint filed in this action and all the records
and files in this action and such further oral and documentary matters as may be
prope1iy placed before the court.

I. INTRODUCTION
Plaintiffs Jumbo Bright Trading Limited (hereinafter "JBTL") and Charles
4 Anthony Philip Pozzi (hereinafter "Charles Philip") are collectively engaged in the
5 business of selling loafers designed by Charles Anthony Philip Pozzi under the trade

name of Charles Philip . Loafers designed by Charles Philip are sold worldwide.
The Charles Philip loafers have gained worldwide recognition and reputation.
JBTL is the sole and exclusive owner of the following trademarks in the United
States: ( 1) CP CHARLES PHILIP trademark, U.S. Trademark App. No. 8546692;
and (2) the distinctive Striped Design on the Inside of a Shoe trademarks, U.S .
Trademark App. Nos. 85602476 and 85602452. JBTL is also the owner of the
common law shoe trademark CHARLES PHILIP. See Exhibits F-H to the Decl. of
Andrea Bates, (Dkt. 1 0.) (collectively "JBTL Trademarks"). JBTL is also the sole
and exclusive owner of the following design patents issued in the United States: ( 1)
U .S. Patent Reg. No. D668849; and (2) U .S. Patent Reg. No. D668850. See Exhibits
1-J to the Decl. of Andrea Bates, (Dkt. 10.) (collectively "JBTL Patents"). Charles
Philip is an internationally known shoe designer and has attained an extraordinary
level of popularity and fame in the United States and around the world, and is the
subject of public interest in the fashion world. Charles Philip's name, likeness,
identity and persona have come to be associated in the minds of the consuming public
with his unique loafers.

Plaintiffs have recently learned that Defendants The GAP, Inc. and DOES 1
through 10 (hereinafter "GAP") are selling Phillip loafers worldwide, including the
United States, that infringe upon the JBTL Trademarks, the JBTL Patents and the
5 . Charles Philip name ("Unauthorized Products" or "Phillip Loafers"). See Exhibits

K-N to the Decl. of Andrea Bates, (Dkt. 10.) Defendant GAP is the distributor of the
Phillip Loafers and offers those items for sale either online, in physical locations, or
both.
Thus, Plaintiffs are seeking a preliminary injunction via this motion in order to
stop the infringing activities as soon as possible and prevent further irreparable harm
to Plaintiffs.
Personal jurisdiction over GAP is proper because among other things they have
sold and distributed the Unauthorized Products in the Central District of California
both in their physical locations as well as through their websites (See Brunner v.
Bawcom, U.S. Dist. LEXIS 96341,2010 WL 3724436, *4 (D.Mont. , Sept. 15, 2010)
(holding that the defendant's single sale of goods to the plaintiff in the forum satisfied
the "purposeful availment" requirement for personal jurisdiction, insofar as the
defendant had "purposefully availed himself of the privilege of conducting business
[in the forum]") (citing McGee v. International Life Ins. Co., 355 U.S. 220, 223, 78
S.Ct. 199,2 L.Ed.2d 223 (1957)).

Although Plaintiffs have sent cease and desist letters to GAP, the Defendant
has refused to cease selling the Phillip Loafers. Based on the foregoing, Plaintiff will
suffer immediate irreparable harm if GAP is not immediately enjoined from
manufacturing, marketing, offering to sell or selling the Phillip Loafers.
II. STATEMENT OF FACTS
The facts are substantially the same as in Plaintiffs' Memorandum of Points
and Authorities in Support of Ex Parte Application for a Temporary Restraining
Order and an Order to Show Cause Re: Preliminary Injunction, (Dkt. 10, pp. 9-12.)
Plaintiffs incorporate those facts by reference. An Order Denying Plaintiffs'
Application for Temporary Restraining Order and an Order to Show Cause Re:
Preliminary Injunction on October 25,2012, (Dkt. 21.) In its Order, the Court stated
that Plaintiffs failed to demonstrate an immediate tlu·eatened injury with clear
evidence of irreparable harm. Id. In light of additional evidence regarding the
19 issuance of an injunction, Plaintiffs submit this motion.

III. A PRELIMINARY INJUNCTION IS NECESSARY TO PREVENT THE IRREPARABLE HARM OF DEFENDANT'S TRADEMARK INFRINGEMENT, PATENT INFRINGEMENT AND VIOLATION OF THE RIGHT TO PUBLICITY
With the additional evidence, Plaintiffs satisfy the standard for granting a preliminary
injunction. Plaintiffs are entitled to preliminary injunctive relief when they show: (1)
a likelihood of success on the merits; (2) a likelihood of irreparable harm absent a
preliminary injunction; (3) that the balance of equities tips in favor of issuing an

injunction; and ( 4) that an injunction is in the public interest. Network Automation,
Inc. v. Advanced Sys. Concepts, Inc., 638 F.3d 1137, 1144 (9th Cir._2011) (citing
Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 20 129 S. Ct. 365, 172 L.Ecl.2d
249 (2008). The same test is applied for determining whether to grant a temporary
restraining order and a preliminary injunction. Stuhlbarg Int'l Sales Co. v. John D.
Brishy & Co., 240 F.3d 832, 839 n.7 (9th Cir. 200 1). Accordingly, Plaintiffs
incorporate the arguments set forth in Plaintiffs' Memorandum of Points and
Authorities in Support of Ex Parte Application for a Temporary Restraining Order
and an Order to Show Cause Re: Preliminary Injunction, (Dkt. 10.) This
memorandum will focus on the additional arguments and evidence that has come to
light in the time after the TRO documents were prepared.
A. Plaintiffs have Demonstrated An Indisputable Likelihood of Success On the Merits Of Its Trademark Infringement, Patent Infringement and Right to Publicity Claims
1. GAP Has Committed Trademark Infringement
To be liable for trademark infringement, an infringer must: "( 1) use in
commerce (2) any word, false designation of origin, false or misleading description,
or representation of fact , which (3) is likely to cause confusion or misrepresents the
characteristics of his or another person's goods or services." Freecycle Network, Inc.
y . Oey, 505 F.3d 898, 901 (9th Cir. 2007).

To prove trademark infringement by GAP, JBTL must satisfy two basic
elements: ( 1) a valid protectable mark; and (2) a likelihood of confusion, mistake, or
deception in Defendant's use ofthe trademark (15 U.S.C. §1114). In its Opposition
to Application for TRO and Preliminary Injunction (Dkt. 15), GAP argued that
Plaintiffs have fa iled to show they have any valid trademarks. Contrary to this
position, Plaintiffs have provided ample evidence of market penetration and
recognition of the JBTL Trademarks. See Charles Anthony Philip Pozzi Decl.,
Exhibit 2 to Plaintiffs' Memorandum of Points and Authorities in Support of Ex Parte
Application for a Temporary Restraining Order and an Order to Show Cause Re:
Preliminary Injunction, (Dkt. 10.) Defendant also argues that the magazine articles
provided to the Court are not accompanied by self-authenticating materials such as
covers or issue dates. Opposition to Application for TRO and Preliminary Injunction,
(Dkt. 15 at p. 14.) Attached as Exhibit A to the Decl. of Andrea Bates are the
requested details of the magazine ads . Defendant also expressed concern that some
of the magazines were foreign. While this is true, the fashion industry is global and
consumers in the U.S . will often look to foreign trends when deciding what to
purchase. The evidence shows that all of the JBTL Trademarks are valid protectable
marks.
As stated in the Plaintiffs' Memorandum of Points and Authorities in Support
of Ex Parte Application for a Temporary Restraining Order and an Order to Show

Cause Re: Preliminary Injunction (Dkt. 1 0) the Court analyzes the 8-prong Sleekcraft
test to determine a likelihood of confusion (AMF, Inc. v. Sleekcraft Boats, 599 F. 2d
341 , 348-49 (9th Cir. 1979)), which is a pliant test used for trademarks in which some
factors are more important than others. Goto.com, Inc. v. Walt Disney Co. 202 F.3d
1199, 1205 (9th Cir. 2000). In the current scenario, most of the Sleekcraft factors
support Plaintiff JBTL 's request for injunctive relief. There is a substantial likelihood
that JBTL will succeed on the merits that GAP has committed trademark
infringement of the JBTL Trademarks.
I. Strength Of The Marl<s
The strength of a trademark is evaluated in terms of its conceptual strength and
commercial strength. Goto.com, Inc. v. Walt Disney Co., 202 F.3d at 1207. The
CHARLES PHILIP and CP CHARLES PHILIP trademarks represent the strongest
category of trademarks, arbitrary marks, marks that bear no logical relationship to the
underlying product. See Plaintiffs' Memorandum of Points and Authorities in Support
of Ex Parte Application for a Temporary Restraining Order and an Order to Show
Cause Re: Preliminary Injunction (Dkt. 10 at p. 10.) Because of the strength of the
JBTL Trademarks, this factor weighs heavily towards a finding of a likelihood of
confusion.

ii. Similarity Of The Marl{s
Similarity of the marks is considered a critical question in the likelihood-of-
confusion analysis. Goto .com, Inc., 202 F.3d at 1205-1206. The Ninth Circuit in
Goto.com announced that: ( 1) the marks must be considered in their entirety and as
they appear in the marketplace; (2) similarity is adjudged in terms of appearance,
sound, and meaning; and (3) similarities are weighed more heavily than differences.
Id. at 1206.
Here there can be no question that the JBTL Trademarks are quite unique.
This uniqueness has been misappropriated by the Defendants, v .. rith an exact copy of
the distinctive striped design and the Phillip stamp. When compared to Charles
Philip loafers, the GAP Phillip loafers contain nearly identical stripes on the inside of
the shoe. Especially with regard to the Striped Design on the Inside of the Shoe
trademark, because the marks are nearly indistinguishable, this factor should weigh
heavily in a likelihood of consumer confusion. Further, the similarities between CP
CHARLES PHILIP, CHARLES PHILIP and GAP using the "PHILLIP Moccasin
Slipper" and "PHILLIP Slipper" stamp on their infringing loafers (which are
substantially similar to the CHARLES PHILIP line of loafers) is too obvious to

towards a likelihood of confusion between CHARLES PHILIP and CP CHARLES
PHILIP and GAP's use of PHILLIP Moccasin Slipper and PHILLIP Slipper. Below

iii. The Trademari{S Are Used On Identical Goods
Charles Philip designs are a new take on classic English style slippers/loafers.
The Unauthorized Products in question are classic English style slipper/loafers. The
goods are essentially identical and this factor should be weighed heavily towards a
finding of a likelihood of consumer confusion.
1v. The Mad{eting Channels Used Are The Same
Marketing channels are another factor that weigh heavily towards a finding of a
likelihood of confusion. While GAP may claim that its loafers are only sold through
a GAP store or website, this GAP store is likely in a shopping mall next to the
department stores that carry CHARLES PHILIP loafers . There is ample opportunity
for a consumer browsing in their local shopping mall to get confused as to the origin
of the GAP Phillip loafers.
v. There Is Evidence Of Actual Confusion In The Marl{etplace
"Evidence of actual confusion is strong evidence that futu re confusion is
likely .... " Official Airline Guides, Inc. v . Goss, 6F.3d 1385, 1393 (9111 Cir. 1993). In
addition to the initial instances first set forth at Plaintiffs' Memorandum of Points and
Authorities in Support of Ex Parte Application for a Temporary Restraining Order
and an Order to Show Cause Re: Preliminary Injunction (Dkt. 10 at p . 13.) Plaintiff
includes further instances of actual confusion with resulting harm. See Exhibit C &
PLAINTIFFS' AMENDED MEMORANDUM TN SUPPORT OF A PRELIMINARY INJUNCTION

likelihood of finding consumer confusion.
VI. GAP Intended To Confuse Consumet·s When Selecting The Marl{
It is clear that GAP intended to use the extensive fame and goodwill of the
JBTL Trademarks when it designed, named and marketed the GAP Phillip loafers.
Even the public has noted the intended "significant similarities." See Decl. of Andrea
Bates Exhibit D. "When an alleged infringer knowingly adopts a mark similar to
another's, courts will presume an intent to deceive the public." Official Airlines, 6
F.3d at 1394. Once discovery has initiated, it is likely information will surface that
GAP intentionally copied the Charles Philip loafers with the presumed attempt to
confuse consumers that Charles Philip was somehow associated with the GAP. The
Lanham Act protects the holders of trademarks from infringement and protects the
public at large from confusion in the marketplace due to the existence of infringing
trademarks. Therefore, this Sleekcraft factor also balances heavily in finding a strong
likelihood of consumer confusion.
Six out of the eight Sleekcraft factors will be found to contribute to a finding of
a likelihood of consumer confusion ((1) strength of the plaintiffs trademark; (2) the
similarity between defendant's design and the plaintiffs trademarks; (3) the
trademarks are used on identical goods; ( 4) the similarities between the marketing
channels used by the plaintiff and the defendant; (5) evidence of actual confusion;

and (6) the intent of the defendant). The only two factors not weighing towards a
likelihood of confusion, the likelihood of expansion of product lines is not appl icable
to identical products and the consumer sophistication is at least neutral.
2. GAP Has Committed Patent Infringement
A design patent is infringed by " [ w ]hoever during the term of a patent for a
design, without license of the owner, (I) applies the patented design, or any colorable
imitation thereof, to any article of manufacture for the purpose of sale, or (2) sells or
exposes for sale any article of manufacture to which such design or colorable
imitation has been applied .. . . " 35 U.S.C. § 289. The JBTL design patents issued on
October 16, 2012.
. I. GAP's Use Of JBTL's Patented Design On Its PHILLIP
Branded Shoes
17 The test for design patent infringement is "whether an ordinary observer,
18 familiar with the prior art, would be deceived into thinking that the accused design

was the same as the patented design .... " Egyptian Goddess, Inc. v. Swisa, Inc., 543
F.3d 665, 676 (Fed. Cir. 2008). The JBTL design patents claim the striped design on
the inside of a shoe as well as the look and feel of the slipper and tassel shoe design.

comparison of the CHARLES PHILIP loafers and the patent-infringing GAP Phillip

II. GAP Makes, Uses, Sells And Offers For Sale PHILLIP Branded Shoes In Violation Of The JBTL Patent Rights
The manufacture, marketing and sale of the PHILLIP branded GAP loafer
bearing claimed design(s) covered by the JBTL Patents is a clear example of patent
infringement. See Exhibit L to the Decl. of Andrea Bates (Dkt. 1 0.)
This Court has the jurisdiction to grant an injunction to prevent the violation of
the rights JBTL has secured in the JBTL design patents. 35 U.S.C. § 283. GAP

claims the JBTL Design Patents are invalid; however, do not approach the details
necessary to overcome the strong presumption of validity afforded by registration.
See Plaintiffs Reply Memorandum in Support of a Temporary Restraining Order and
an Order to Show Cause Re: Preliminary Injunction (Dkt. 23 at pp. 7-9.)
3. GAP Has Violated Charles Philip's Right Of Publicity
By using "PHILLIP Moccasin Slipper" and 'PHILLIP Slipper" on its loafers,
GAP intentionally violated Charles Philip's right of publicity in contravention of
California Civil Code§ 3344. To prove a misappropriation of the right of publicity in
California, Plaintiff must show: "( 1) defendant's use of plaintiffs identity; (2) the
appropriation of plaintiffs name or likeness to defendant's advantage, commercially
or otherwise; (3) lack of consent; and ( 4) resulting injury." Cal. Civ. Code§ 3344.
In addition, a plaintiff must also prove a knowing use of the plaintiffs name or
likeness by defendant and a direct connection between the alleged use and the
commercial purpose. Id. GAP claims the use of"Phillip" is just a production style
designation and had nothing to do with Charles Philip. Opposition to Application for
TRO and Preliminary Injunction (Dkt. 15 at pp. 21-22.) It is hard to believe that the
Phillip name was used other than intentionally and willfully chosen by GAP to
capitalize on the goodwill built up by Plaintiffs in the Charles Philip name.
Charles Philip has suffered irreparable harm to his reputation and incurred
emotional distress by Defendant's use of his name and likeness. Unless temporarily

and permanently enjoined from using his name and likeness on its Unauthorized
Products, Charles Philip will continue to suffer irreparable harm at the hands of
Defendant.
B. Plaintiffs Will Suffer Irreparable Harm In The Absence of Preliminary Injunctive Relief
The second of the four criteria for injunctive relief as set forth in Winter is that
the plaintiff establish that it is likely to suffer irreparable harm in the absence of
preliminary relief. Winter, 129 S.Ct. 365, 375-376. In its Order Denying the TRO,
this Court made it clear that Plaintiffs could not rely on the presumption of
irreparable harm on a finding of a likelihood of success on the merits of a trademark
infringement case. Instead, the Court requires that Plaintiffs demonstrate that there is
an immediate threatened injmy by clear evidence, not speculation. Order (Dkt. 21 at
17 p. 5·)

control over their business reputation, loss of trade and loss of goodwill" Maxim
Integrated Products, Inc. v. Quintana, 654 F. Supp. 2d 1024, 1035 (N.D. Cal. 2009);
Cases hold that evidence of "[i]ntangible injuries such as damage to . . . goodwill
qualify as irreparable harm" Rent-A-Center Inc. v. Canyon Television & Appliance
Rent'!L Inc., 944 F. 2d 597, 603 (9111 Cir. 2001 ). Evidence examined of irreparable
harm in the trademark infringement context by the district courts governed by the 9111
circuit has included: (1) actual consumer confusion; (2) loss of sales; (3) loss of

reputation and goodwill; and ( 4) loss of control over the trademarks. See CytoSport,
Inc. v. Vital Pharm., Inc., 617 F. Supp. 2cl 1051, 1080-1081 (E.D. Cal. 2009), affd,
348 F. App. 288 (9th Cir. 2009) (finding that flooding the marketplace with infringing
products and advertising will cause plaintiffs irreparable harm); Apple Computer, Inc.
v. Formula Int'l Inc., 725 F.2d 521, 526 (9111 Cir. 1984) (finding that continued
infringement would result in loss of control over Apple's reputation and loss of
goodwill constituting irreparable injury); Herb Reed Enters., LLC v. Florida Entm 't

evidence of actual confusion sufficient to show irreparable harm justifying injunctive

2009 WL 928130 (N.D. Cal. Apr. 3, 2009) (same); SunEarth, Inc. v. Sun Earth Solar

owner' s lack of control over Defendants' products and quality a significant factor in
granting a preliminary injunction). Other jurisdictions have reached similar results.
See e.g. U.S. Polo Ass'n, Inc. v . PRL USA Holdings, Inc., 800 F.Supp.2d 515, 540
(S.D.N.Y. 2011) (finding irreparable harm exists when plaintiff shows it will lose
control over the reputation of its trademark).
Similar to these cases, there is a strong likelihood that Plaintiffs will be
irreparably harmed by the trademark and patent infringement. The goodwill, brand
and over-all business of JBTL and Charles Philip is at stake. The JBTL Trademarks
and JBTL Patents are being used across the US by GAP without license or ability to
apply quality control. Every day consumers are buying these GAP loafers assuming
they meet Plaintiffs ' quality standards and they do not. If these unauthorized
products are not immediately taken off the marketplace, Plaintiffs will suffer
irreparable harm. See Decl. of Andrea Bates Exhibits C& E.
There is also a strong likelihood of irreparable harm created by GAP's use of
Charles Philip's name on its Phillip loafers. Shoppers purchasing designer shoes
from high end department stores like Saks Fifth Avenue and Bloomingdale's expect
the quality to meet the price point. Being associated with the GAP will hurt Charles
Philip 's reputation as a high end designer as the GAP marketing campaign is aimed at
the more price conscious consumer. See Decl. of Andrea Bates Exhibits C- E.

C. The Balance of Equities Tips In Favor of Plaintiff
A court balancing the equities will look to the possible harm that could befall
the various parties. Cytosport, Inc. v. Vital Pharm., Inc., 617 F .Supp.2d 1051, 1081-
1082 (E.D. Cal.2009). In this case, Plaintiffs are likely to suffer irreparable harm to
their business and the goodwill it has built in the JBTL Trademarks and the Charles
Philip name, particularly in the United States.
Unless enjoined, the proliferation of the unlicensed use of the JBTL
Trademarks will irreparably harm Plaintiffs by: (1) undermining Plaintiffs'
substantial investment in the JBTL Trademarks and Charles Philip name; (2)
eliminating Plaintiffs control over distribution of its trademarks; (3) harming
Plaintiffs' reputation with third party licensees; and ( 4) diminishing the sales of future
products displaying the JBTL Trademarks and Charles Philip name by Plaintiff and
their authorized retailers.
Plaintiffs have invested substantial resources into designing, developing,
promoting and advertising goods that bear the JBTL Trademarks and Charles Philip
name. In the absence of injunctive relief, Defendants will continue to profit from the
sales of the illegal goods while Plaintiffs and the public will be harmed by the
continued distribution ofthese infringing items. Refusal of injunctive reliefwill result
in the loss of goodwill and encourage infringers to increase operations. It would also
discourage anti-piracy enforcement. All of these are great and irreparable harm.

In contrast, if an injunction is granted, Defendants will only suffer the loss of
the revenue from the sales of illicit Unauthorized Products utilizing the JBTL Patents,
JBTL Trademarks and Charles Philip name. But GAP assumed that risk when they
decided to participate actively in an illegal business activity. The law is clear that the
economic harm that befalls a pirate is not cognizable in the balance of hardships.
Cadence Design Systems, Inc. v. Avant! Corp., 125 F.3d 824, 829 (9th Cir. 1997)
(profit lost from enjoined sales of infringing goods not cognizable harm); Triad S~
Corp. v. Southeastern Express Co., 64 F. 3d 1330, 1338 (9th Cir. 1995) ("Where the
only hardship that the defendants will suffer is lost profits from an activity which has
been shown likely to be infringing, such an argument in defense merits little equitable
c'onsideration. ")
Moreover, the Defendants retail businesses appear to involve the supply of
many types of products, of which the items infringing the JBTL Patents, JBTL
Trademarks and Charles Philip name are but a few. GAP will, presumably, continue
to supply these other products, despite the granting of any injunctive relief preventing
the sale and distribution of the GAP Phillip loafers. On the other hand, the
CHARLES PHILIP loafers are Plaintiffs only product. Because of the irreparable
harm to Plaintiffs and because the balance of hardships tips strongly in favor of
Plaintiffs, Plaintiffs are entitled to a temporary restraining order and preliminary
injunction.

D. An Injunction Is In The Public Intet·est

the public not to be deceived or confused. Moroccanoil, Inc. v. Moroccan Gold, LLC,
590 F. Supp.2d 1271, 1282 (C.D. Cal. 2008) (quoting OQticians Ass'n of Am. v.
Indep. Opticians of Am., 920 F.2d 187, 198 (3d. Cir. 1990)). Courts also recognize
that the public interest favors injunctive relief in trademark infringement cases. See,
e.g., Promatek Industries, Ltd. v. Eguitrac Corp., 300 F. 3d 808, 813 (7th Cir. 2002);
Yash Raj Films (USA), Inc. v. Sidhu, 2010 U.S. Dist. LEXIS 25988, *17-18, 2010
WL 1032792, *7 (E.D. Cal. 201 0).
On the other hand, no public benefit results from Defendants' activities. Public
policy certainly does not support trademark infringement, patent infringement and
violation of the right of publicity.
If the Comt finds a likelihood of confusion between the marks, it may also find
that the public interest weighs in favor of granting injunctive relief (Maxim Integrated
Products, Inc. v. Richard Quintana, et al. , 654 F.Supp.2d 1024, 1036 (N.D. Cal.2009).
In this case, not only is there a likelihood of confusion; rather, there has been at least
one example of"actual" confusion by one of Plaintiffs' own customers. Thus,
injunctive relief is warranted.

IV. REQUIRED INJUNCTION BOND AMOUNT
Plaintiffs are willing to post a bond to protect Defendants' interests pending the
outcome of this litigation, although Plaintiffs strongly believe that the bond should be
minimal based on the strong likelihood Plaintiffs will prevail on the merits.
Fed. R. Civ. P . 65 (c) provides that a bond be posted "in an amount that the
court considers proper to pay the costs and damages sustained by any party found to
have been wrongfully enjoined or restrained." A bond "may not be required, or may
be minimal, when the harm to the enjoined patty is slight or where the movant has
demonstrated a likelihood of success." Ticketmaster L.L.C. v. RMG Technologies,
Inc., 507 F. Supp. 2d 1096, 1116 (C.D. Cal. 2007); see also Connecticut Gen. Life
Ins. Co. v. New Images of Beverly Hills, 321 F. 3d 878, 882 (9th Cir. 2003) ("bond
amount may be zero if there is no evidence the party will suffer damages from the
injunction.").
Here, there is little prospect that any of Defendants' legitimate interests would
be impinged by an order requiring them to cease distribution of the infringing goods.
Nevertheless, if the Court requires, that a bond be posted, Plaintiffs submit that the
bond should not exceed $10,000 as that amount is more than sufficient to account for
the unlikely possibility that Defendants would be "wrongly enjoined or restrained,"
from selling these plainly illegal products. Fed. R. Civ. P. 65 (c); see, e.g., Iconix
Inc. v. Tokuda, 457 F. Supp. 2d 969, I 002 (N.D. Cal. 2006) (setting bond at$1 0,000

v. CONCLUSION
Pursuant to the factors set forth by the U.S. Supreme Court in Winter, 129
S.Ct. at 375-376, Plaintiffs have established: (1) that it is likely to succeed on the
merits; (2) that it is likely to suffer irreparable harm in the absence of preliminary
relief; (3) that the balance of equities tip in its favor; and ( 4) that an injunction is in
the public interest.
A Preliminary Injunction will ensure protection of Plaintiffs from further
infringement of their trademarks, patent and rights to publicity as well as the public's
right to distinguish between competing sources of goods and services. Accordingly,
Plaintiffs respectfully request that the court enjoin Defendants' infringement in the
form of the order proposed and filed concurrently herewith.

2. I am an attorney licensed to practice law before the courts in the State of
California and the federal Central District of California. I am a partner in the law firm
of Bates & Bates, LLC, which is counsel of record for Plaintiffs JUMBO BRIGHT
TRADING LIMITED, a Hong Kong corporation and CHARLES ANTHONY PHILIP
POZZI, and individual (collectively "Plaintiffs"). As one of the attorneys in this case,

For retro types Suzhou Cobblers Shanghai-born designer Denise Huang takes inspiration from the city's fashion-capital past. She uses local folk crafts to embellish a wide range of accessories, from lanterns and wall hangings to fabrics, clothes and jewellery, but it's her evening slippers that will have you truly tripping the light fantastic.
Riffing on the shape of the ubiquitous Mary Janes worn by legions of Chinese workers in the past, Huang breaks the ethnic template with her use of sumptuous fabrics and subtle shades of embroidered silk. True, some of her evening slippers contain the usual China motifs: dragons, butterflies, peacocks and peonies, but she has taken

iconic images from old fabrics and reinterpreted them in an angular, more modern style.
Each design by Huang works closely with a group of handicraft experts who are keeping their craft alive. I am writing to express our deep concern regarding GAP, Inc's release, marketing and sale of the PHILIP loafer. As the GAP shoes are :(i) nearly identical to the CHARLES PHILIP shoes, (ii) sold under the name PHILIP and (iii) sold at a price point more than 70% lower than the genuine CHARLES PHILIP shoes; our customer stores, such as Bloomingdale's, Saks and Neiman Marcus as well as many others are concerned that this blatant copy of a unique design or The CHARLES PHILIP loafer will infringe on their sales of the original Charles Philp loafer . The GAP PHILIP loafers are causing confusion in the marketplace as customers are buying a cheaper and lower quality near identical copy of the CHARLES PHILIP loafer as a PHILIP branded shoe, thinking its endorsed and created by CHARLES PHILIP. This confusion in the marketplace is reducing the sale of the high end CHARLES PHILIP shoes within our customer stores and in turn our company's sales.

I am the officer of Jumbo Bright Trading Limited ("JBTL"). JBTL has been irreparably damaged by GAP's release of the PHILLIP shoes. Charles Philip only creates and sells high end loafers, available in stores like SAKS FIFTH AVE, BERGDORF GOODMAN, NEIMAN MARCUS and BLOOMINGDALE'S. Having the JBTL shoes affiliated with a low end store such as the GAP has irreparably damaged this high end designers reputation and name. Further, the presence of these cheap GAP PHILLIP loafers has harmed the goodwill surrounding his brand. The GAP PHILLIP shoes have been a best seller in many of the GAP stores worldwide, every sale of the counterfeit shoes by GAP is representative of a lost sale by Jumbo Bright, this equates to hundreds of thousands of dollars in lost sales. To that end, many of the distributors have stated that their stores have threatened to pull the legitimate CHARLES PHILIP shoes as a result. In faith,
