RF:SOLUTION DECLARING AN INTENT TO ABANDON AND CLOSE a portien of 10" Street alleyway in the City of Charlotte, MmIdenburg County, North Carolina

Whereas, The City of Charlotte has filed a petition to close a portion of lo* Street atleywsy in the City of Charlotte; and

Whereas, the portion of 1 0 ~ Sheet alleyway to be closed lies beginning a p p m ~ l y 206 feet h m North Brevard Street continuing approximately 138 feet northweshmdly to its @minu8 at the property line of a pane1 owned by the City of Charlotte as shorn in the map marked "Exhibit A" and is more particularly described by metes and bow& in a document marked "Exhibit Bn both of which are available for inspection in the office of the City Clerk, City Ha& Charlotte, North Carolina.

Whereas, the procedure for closing stre& and alleys as outlined in North C a r o h General Statutes, Section 16QA-299, requires that City Council first adopt a

' resolution declaring it's intent to close the street street calling a public hearing on the question; said statue fuaher requires that the resolution shall be published o m a week for two s u & b v e weeks prior to the h d g , and a copy thereof be sent by registered or c-ed mail to all, owners of property adjoining the street as shown on ttu: county tax records, and a notice of the closing and public hearing shall be prominently posted in at least two plam along said street or alley and

RESOLUTION ADOPTING GUIDELINES FOR MUTUAL ASSISTANCE WITH NORTH CAROLINA STATE LAW

ENFORCEMENT AGENCIES

WHEREAS, pursuant to statutory amendments adopted by the 1981 General Assembly af North Carolina, the governing body of the city or county may adopt appropriate guidelines for the provision of mutual assistance between municipal law enforcement agencies and state law enforcement agencies, such authority being codified as Chapter 160A, Section 288.2, of the General Statutes of No& Carolina;

WHEREAS, pursuant to said law, the law enforcement assistance authorized to be rendered includes allowing officers to work temporarily with officers of a requesting agency (including in an undercover capacity) and lending equipment and supplies;

a+ wIBiREAS, pursuant to said law, the provision of mutual assistance must be in

accordance with guidelines officially adopted by this City Council;

WHEREAS, it is deemed in the best interest of the City of Charlotte to adopt a reasonable policy and guidelines whereby reciprocal law enforcement assistance can be both rendered to and obtained from other North Carolina state law enforcement agencies.

NOW, THEREFORE, IT IS RESOLVED BY TEIE CITY COUNCIL OF THE CITY OF CHARLOTTE:

1. That the Chief of Police is hereby authorized to enter into mutual assistance arrangements with North Carolina state law enforcement agencies, provided that the head of the requesting state law enforcement agency requests such assistance in writing.

2. That the Chief of Police is hereby authorized to permit officers of the Charloffe-Mecklenburg Police Department to work temporarily with officers of such requesting agency, including in an undercover capacity, and, to that extent, to lend equipment and supplies.

3. While working with the requesting agency, the Charlotte-Mecklenburg police officer shall have the same jurisdiction, powers, rights, privileges and immunities (including those relating to the defense of civil actions and payment of judgments) as the officers of the requesting agency.

WHEREAS, said agreement further provides for the Department of Transportation to reimburse the Municipality a lump sum amount of $225,000 toward the total cost of the project.

NOW, THEREFORE, BE IT RESOLVED that said project is hereby formally approved by the Ci Council of the City of Charlotte and that the Mayor and Clerk of this Municipality are hereby empowered to sign and execute the Agreement with the Department of Transportaiion.

A motion was made by -h and secondedby ilocembet S m w for the adoption of the following Resolution, and

upon being put to a vote was duly adopted:

WHEREAS, the North Carolina Department of Transportation and the C~ty of Charlotte prapose to make certain street and highway improvements within the Munbcipalky under said prajedtj sald plans to consist of the pavement re"ni1kation and reconstruction Of SR 3998 /Sauth.B~ulevasd) from 1-277 to Clanton Rmd and South Boulevard ffam Scaleyberk Road'to SR 3814 (Woodlawn Road), including milling existing roadway, base repair, spOt ~ u r b and gutter repair, overlay with 1.5 lncfies of ACSC Type S9.5 and paint marking8 in Charlotte; and,

WHER&S, said agreement providss for the Munic~paj~ty to prepare the environment&and/or planning document, including any environmental permits, and the plans, corntractor specifications and estimates (PS&E package), administer the mntract and supervise project construction, adjust and rebeate utilities and acqulre any necessaFy right of way; and,

WHEREAS, said agreement further provides for the Department of Transportation to reimburse the Municipality a lump sum amount of $1,300,000 tbward the totai cost of the project.

WHEREAS, said work shall be completed by June 30, 2005 and the Mun~clpality shall assume maintenance and liability responsibilities upon campletion of the project: and,

NOW, THEREFORE, BE IT RESOLVED that said project is hereby formally approved by the City Council of the City of Charlotte and that the Mayolr and Clerk of this Municipality are hereby empowered to sign and execute the Agreement with the Department of Transportation.

NOW, THEREFORE, BE IT RESOLVED that WBS Element 37171, MeckleRburg Caunty, is hereby formally approved by the City Council of the City of Charlotte and that the

Mayor and Clerk of this Municipality are hereby empowered to sign and execute the Agreement with the Department of Transportation.
