Emmanuel Wade, Inez Kimbrell, Wanda Griffith, Sherman Baldwin, Nancy B. Komp, SandyBaldwin Cranmer, Donna Foote, Pamela Case, Rufus Baldwin, David Baldwin, David Baldwin,Tammy Muir, Sharon Baldwin, Eddie Baldwin, Kathy Whitt, Lisa Shaver, Patti Gilbert, Michael T.Boyd, Eleanor Hagy, Venia Newberry, Virginia Edith Smith, Scotty Bond, David Smith, DonaldSmith, Judy Tiedemann, Joann Smith, Peggy Smith, Pauline Casey, Chad M. That CNX Gas Company LLC has given the notice(s) required by fJ 45.1-361.22:2.Ato allconflicting claimants identified in the above referenced pooling Order and any supplementalOrders pertaining thereto.d. That none of the conflicting claimants noticed have provided, within 45 days of the notice(s)given as provided in b. above, the Board, its designated agent the Director of the Division of Gasand Oil, the Operator and/or the Applicant evidence of either an agreement regarding theescrowed funds/royalties or a proceeding regarding same.

e. That a detailed accounting in accordance with the applicable provisions of fJ 45.1-361.22 issubmitted herewith and identified as Exhibit J.f. Upon the representation of Defendant Torch Oil 4, Gas Company ("Torch" ), by counsel,

that:

a) it has no claim to coalbcd methane on certain tracts of land in Buchanan County

where gas operators and the Virginia, Gas and Oil Board ("VGOB") have listed Torch and the

Plaintiffs, Kendris Herman, Henry Herman and Walter Keen (as heirs to A.3. Herman), as

conflicting claimants to coalbed methane, due to the recent decision of the Supreme Court of

Virginia, Swardr Creek Land Partnership u Selcher, Case No. 131590 (Sep. 12, 2014); and

b) '1'orch has no knowledge of, and makes no representation as to, the plaintiff s chain of

title or claim of ownership of the gas interest other than as admitted or denied in response to

And upon evidence presented by Plaintiffs as to /heir ownership of the gas interests on

the properties described in the complaints; and with the consent of Defendant Hugh MacRae

Land Trust; and for good cause shown, it ls therefore ADJUDGED and ORDERED:

a) Torch is not in conflict with the plaintiffs as to ownership of coalbed methane on those

properties on which they had previously been listed as conflicting claimants in pooling orders

issued by VGOB; and

b) that Plaintiffs, claiming as heirs of A,J, Herman, are therefore entitled to any royalties

relating to the extraction of coalbed methane gas on those properties in which VGOB pooling

orders have listed them as conflicting claimants with Torch to coalbed methane ("the Conflict

Properties" ), in proportion Io their ownership inteiests in the gas estate on those real property

tracts; and

c) upon petition to VGOB, any funds held in escrow attributable to theplaintiffs'wnership

interests of coalbed methane in the Conflict Properties, on account of perceived

conflict with Torch, shall be released to the plaintiffs; and

d) any future royalty amounts to which they may be entitled, based on this Order, shall be

paid directly to them by any gas operator responsible for making such payments,

All other claims asserted by any party against the other(s) are demed, and this action is

dismissed with prejudice to the plaintiffs and defendants as to any such other claims and made

part of this Order, with each party to pay his/her/its own costs.

The Clerk is directed to forward a certified copy of the Foregoing to all counsel of record,

to remove this matter from the active docket of this Court and to place thc same among the ended

actions before this Court.

House Bill 2058 was signed by the Governor and became law effective July 1,2015. This new law requires the Virginia Gas and Oil Board to disburse monies placedin escrow because of conflicting claims (between coal owners and oil and gas owners)to coalbed methane gas royalties to the oil and gas owners of the tracts in this Unit.

In aeneral. under this new law escrowed funds are to be caid to oil and aasowners unless the coal owner(s) orovides the ooerator CNX and the Division of Gasand Oil "with evidence of a oroceedina" Ias in a court easel "or an aareement." Thenew law aives coal owners/coal claimants 45 davs from the date vou aet this letter toorovide that evidence.
