1. Shri. Sambhaji L. Patil - MLA, Belagavi (South) The Mayor at the outset welcomed the Hon’ble MLA, Belagavi South, Dy. Mayor,
Members, Officers and Press reporters present for the meeting. He said the subjects on the
Agenda will be taken up for discussion and before that there are proposals to congratulate
some Councillors and to pass condolence on sad demises of some persons and same will be
taken up.
Resolution No. 78
Sub : To congratulate (1) Shri. Deepak V. Jamakhandi (2) Shri. Ramesh M. Kalasannavar (3) Sarala S. Herekar (4) Anant V. Deshpande and (5) Shri. Vijay L. Patil Corporators regarding.
The Mayor stated that there are congratulation proposals to congratulate (1) Shri.
Deepak V. Jamakhandi, Corporator (2) Shri. Ramesh M. Kalasannavar, Corporator for having
elected as members of Zilla Yojana Samiti of Zilla Panchayat, Belagavi and (3) Smt. Sarala S.
Herekar, Corporator for having elected as member of the Board of Director to Basaveshwar
Co-op Bank, Belagavi and (4) Shri. Anant V. Deshpande, Corporator and (5) Shri. Vijay L.
Patil, Corporator for having elected as members of the Board of Directors to Tukaram Co-op
Bank, Belagavi.
The Council unanimously resolved to congratulate (1) Shri. Deepak V. Jamakhandi (2)
Shri. Ramesh M. Kalasannavar for having elected as members of Zilla Yojana Samiti of Zilla
Panchayat, Belagavi and (3) Smt. Sarala S. Herekar for having elected as member of the Board
of Director to Basaveshwar Co-op Bank, Belagavi and (4) Shri. Anant V. Deshpande and (5)
Shri. Vijay L. Patil for having elected as members of the Board of Directors to Tukaram Co-op
Bank, Belagavi.
Resolution No. 79
Sub : To pass condolence on the sad demise of (1) Shri. Vinayak Patkar, worker expired in the accident of collapsed shops in Shivaji Road, Belagavi. (2) Shri. R. R. Patil, Ex-Dy. Chief Minister of Maharashtra and (3) Shri. Govind Pansare.
Shri. Pandari Parab placed the proposal and said Shri. Vinayak Patkar a poor worker
has been expired in the accident of shop collapsed at Shivaji Road, Belagavi and this
Corporation expresses its sense of sorrow on the sad demise of Shri. Vinayak Patkar and
Corporation has already assured an amount of Rs. 1 lakh will be paid to the family of victim
as financial help. He further said Shri. R. R. Patil, Ex- Deputy Chief Minister of Maharashtra

has been expired and he was a leader who came up in the politics by his own efforts and
rendered his services particularly to the people of border area. He requested to pass
condolence on his sad demise. Further he requested to pass condolence on the sad demise of
Shri. Govindrao Pansare.
Shri. Sambhaji L. Patil, MLA Belagavi (South) seconded the proposal and said Shri.
R. R. Patil, Ex- Deputy Chief Minister and Shri. Govindrao Pansare both have rendered
service to the Nation. Shri. R. R. Patil was following the life style of Shri. Lalbahaddur
Shastriji. He requested to pass condolence after observing two minutes silence.
It was unanimously resolved that this Corporation of the City of Belagavi expresses its
deep sense of sorrow on the sad demise of (1) Shri. Vinayak Patkar, worker expired in the
accident of collapsed shops in Shivaji Road, Belagavi. (2) Shri. R. R. Patil, Ex-Dy. Chief
Minister of Maharashtra and (3) Comrade Shri. Govind Pansare and two minutes silence was
observed in honour of the departed souls.
Resolution No. 80
Sub: To read and confirm the proceedings of previous Council meeting dated: 21-01-2015.
The Mayor read out the subject and requested the members to discuss and put up
suggestions or corrections if any in the above said proceedings.
After discussion it was unanimously resolved by the Council that the proceedings of
the previous Council meeting dated: 21-01-2015 are read and confirmed. Resolution No. 81
Sub : To peruse the proceedings of the meetings of following Standing Committees. a) Standing Committee for Taxation, Finance & Appeals dt, 05-01-2015. b) Standing Committee for Public Health, Education & Social Justice dt, 05-01-2015. c) Standing Committee for Town Planning & City Improvements dt, 05-01-2015.
d) Standing Committee for Accounts dt, 05-01-2015.
Shri. Deepak Jamakhandi stated that the subject of Cantilevers has been already passed
in the Standing Committee vide Resolution No. 21 of T&F Committee and also passed in the
Council for calling E-Tendering. He asked again why it has been come to St. Committee for
another decision, how the work order was issued before confirmation of the Standing
Committee proceedings, it should be explained.
The Commissioner explained that the Council has resolved for calling E-Tender but
the contractor has not agreed to our conditions and hence his contract was not approved. But
later on he agreed to the said conditions and going to construct the remaining Cantilevers &
Gantries at his own cost by which Corporation will save about Rs. 1.5 crores. In this activity
Corporation or Govt. is not spending money. A private agency is investing money and
handing over the infrastructure to Corporation. Hence the request of the contractor for

further continuance of the contract period was placed before the Standing Committee for
decision.
Shri. Ramesh Sontakki stated that as per Govt. directions for every work E-Tendering
process is being started and for this work why E-Tendering is not called for though Council
has given approval. He suggested to take action against the defaulting contractor.
Shri. Deepak Jamakhandi asked whether the said contractor has given any written
statement and whether it is on bond paper it should be shown and read out before the Council.
The Commissioner stated that if any contractor comes forward the said work will be
entrusted. The present contractor has given a letter in writing. After recovery of arrears and
issue of work order MOU will be taken up on bond paper. Till today nobody has came
forward for the said work.
Shri. Kiran Saynak stated that since it is benefit to the Corporation the same may be
approved.
Shri. Sambhaji L. Patil, MLA Belagavi (South) stated that the decision taken in the
Standing Committee is placed before the Council for perusal. Hence if any suggestions/
corrections to be made may be given in writing to take decision.
Shri. Pandhari Parab stated that there is provision to consider a request of the present
contractor to continue the contract period and accordingly decision taken by the Standing
Committee and it may be approved.
After prolonged discussions, the Council unanimously resolved that the proceedings of
the Standing Committees a) Standing Committee for Taxation, Finance & Appeals dt, 05-01-2015,
b) Standing Committee for Public Health, Education & Social Justice dt, 05-01-2015, c) Standing
Committee for Town Planning & City Improvements dt, 05-01-2015 & d) Standing Committee for
Accounts dt, 05-01-2015 are perused.
Resolution No. 82
Sub: Proposal to lease or sell the Goaves petrol pump located at CTS No. 30, near Basaveshwar circle, Goaves Tilakwadi, Belagavi to Indian Oil Corporation limited, Tilakwadi, Belagavi.
The Commissioner read out the brief note and explained that the lease period of the
said petrol pump was expired in 1998 and it is not continued further. The Administrator has
also passed a Resolution and accordingly notice was issued to the party. The party approached
the District Court and High Court but Court decisions are in favour of Corporation. The party
has not replied to the notices and not paid the dues. Now Indian Oil Corporation Ltd. has
come forward and requested for grant of said site. If it is leased out the income of Rs. 25 lakhs
per year will come to the Corporation. If the dues are not paid by the present party it will be
converted and recovered as property tax and the property of the said party will be seized and

auctioned. Hence in the interest of income to the Corporation the said site may be leased out
to the Indian Oil Corporation Ltd. as per present market rate.
Shri. Sambhaji L. Patil, MLA Belagavi (South) stated that after the expiry of lease
period notices have been issued to the concerned and there is no response for the said notice
and hence action has been taken as per Court order by the Commissioner. The power of
granting lease by the Commissioner is 1 year, by the Standing Committee 3 years and by the
Council 5 years. For above 5 years lease the Govt. approval is necessary. The Council has
asked for giving list of all such type of lease cases but it has not been furnished till today.
Action on all such cases may be taken by the Commissioner. There are no records are found
about the lease holder and actual occupier in some cases. The records should be traced out
immediately to avoid wrong message to general public. At the time of taking action the loss
to the lease holder may also be taken into consideration. The constructions should not be
taken up on the sites leased for 1-3 years period but it is not known what Corporation
Engineers/Officers were doing at that time of illegal construction. No cases of 5 years lease
are coming before the Council. In the interest of income to the Corporation decision may be
taken in this subject.
Shri. Pandhari Parab stated that due to negligence on the part of officers there is loss to
Corporation. There are 473 commercial shops, 213 open spaces and in some open spaces
constructions have been made and lease holders have also constructed buildings. Further he
suggested to consider following points to improve income of Corporation.
1. To construct multistoried buildings for parking, auditorium, shopping complexes, vegetable markets, play grounds, swimming pools at the open spaces of the Corporation.
2. Rehabilitation arrangements for the affected persons while road widening in the City.
3. List of expiry of lease holders and list of shops occupied by subtenant.
4. List of old construction in dilapidated conditions and stability of new constructions.
The decisions taken in the Council may be implemented and details of development of
Kalamandir and parking places may be furnished in the next meeting.
Shri. Ramesh Sontakki stated that the officer responsible may be suspended as no
action has been taken though the lease period expired in 1998. The list of open spaces taken to
the possession may be furnished to the Council and all such type of cases may be put up for
taking decision in the Council. The details of commercial shops at Goaves shopping complex
may be furnished after inspection. The Council may take decision accordingly.
Shri. Kiran Sayank asked to read out the Resolution No. 400, dated: 03-03-2014.
Shri. Dinesh Nashipudi asked why action has not been taken for works on ward
budget whereas action on the letter dated: 13-02-2015 of the Indian Oil Corporation Ltd. is
being taken up immediately.

The Commissioner stated that 4 months time was given to lease holder but there is no
response and there is no loss to the petrol bunk, they have earned crores of income and
caused huge loss to Corporation. The Hon’ble High Court according to DMA guidelines has
rejected their petition. They have to pay out standing arrears of rent to the Corporation and
then their request will be considered otherwise action will be taken. There are so many
persons who will come forward to take the same on lease by which Corporation will get
crores of income. During my period no lease cases have been sanctioned. No lease cases for 5
years period have been received and hence not put up before the Council. According to
Hon’ble High Court’s decision the action to take possession of vacant sites is being taken and
the list of 1-3 years lease cases has been submitted to DC, Govt. and Court. To collect more
funds to Corporation and to take up the ward works this subject is placed. Before 31st March
all the 58 wards works will be taken up and completed. The UDD secretary has appreciated
and satisfied about the work of this Corporation and declared that Belagavi Corporation is
the Best Corporation in the state. The present elected body should complete 5 years period, so
no illegal works are being taken up and allowed to do during my period. The Council may
take decision accordingly.
Shri. Sambhaji L. Patil, MLA Belagavi (South) stated that to raise income and to sound
the financial possession of the Corporation multi storied buildings for shopping complexes
may be constructed either by giving it on B.O.T. basis or by raising bank loan and see that the
work should be started during the period of present Mayor. Shri. Deepak Jamkhandi
supported the same.
After discussion as above, it was unanimously resolved by the Council to take action
to recover outstanding arrears from the lessee of the Goaves petrol pump. Request of the
Indian Oil Corporation Ltd. Should be considered to lease out the site of the Goaves petrol
pump as per present market rate. Necessary MOU may be obtained from the party
mentioning the required terms and conditions to lease out the existing petrol pump to I.O.C.
Resolution No. 83
Sub: To discuss regarding leased property to Krushi Pattina Sahakari Sangh, Vadagavi, Belagavi.
Shri. Ratan Masekar suggested that the resolution passed above may be applicable in
this case and asked under what authority the name of Vadagaon has been shown in English
as Vadagavi in the agenda be explained.
The Commissioner read out the brief note and explained that the lease period of the
said Sangh has been expired in 1981 and since then as per the Administrator resolution,
Council Resolutions and Hon’ble High Court decisions the notices have been issued to the said
Sangh from time to time on 16-06-2014, 16-10-2014 for handing over the possession of the said site

to the Corporation but said site is not handed over to the Corporation. Hence the Corporation
took possession of the said site on 13-11-2014. But as per the Hon’ble Mayor’s instructions vide
letter dated: 09-02-2015 the lock was opened pending decision by the Council. A notice dated:
13-01-2015 has been issued and served on the same day to the said Sangh for payment of
outstanding rent of Rs. 14,76,992/- for the period from 1981 to 2013-14 but till today the Sangh
has not paid the outstanding arrears. The said Sangh has also sub-leased the said property to Shri.
Amol P. Desai and Shri. Jyotiba Laxman Bangodi who are the unauthorized occupiers which is
illegal and there is no such provision in the KMC Act. A complaint has also been registered in the
Shahapur Police station on 05-02-2015 against the said Sangh. According to Govt. order No.
£ÀCE/129/nJAr/2002 É̈AUÀ¼ÀÆgÀÄ, ¢£ÁAPÀ: 02-06-2003 sites are to be allotted by auction and
hence lease period cannot be extended. Hence this is placed before the Council for discussion
and decision.
Shri. Sambhaji L. Patil, MLA Belagavi (South) supporting the Commissioner’s opinion
stated that there is no provision in the law to sub-lease the sites allotted. Further he asked
what were our officers doing at that time of sub-leasing. The present officers should aware of
this fact and see that such things should not happen hereafter. The copies of the resolutions
passed be sent to all the concerned sections for implementation. The rent calculated and
shown as arrears is whether as per present market rate or from the date of lease. The said
Sangh may go for appeal, so all such type of properties may be listed out and action be taken.
Further he said that the affected persons to whom sites have been allotted at the time of road
widening should not be disturbed.
The Commissioner stated that the rates of rent are being fixed according to Govt.
guidelines and sub registrar’s present rate. The party may approach the Standing Committee
and Council which is Appellate authority and also may approach the Court. Total 186 shops
and 32 open spaces have been allotted for various purpose including educational institutions
and cremation grounds. If the allottees are ready to pay rent as per present market value their
lease will be continued otherwise action to take possession of the sites of lease expired cases
will be taken.
Shri. Ratan Masekar suggested that said Sangh may be given concession in the dues to
be collected, since it is being run by the agriculturist for the welfare of the agriculturist on no
loss no profit. This is not commercial Sangh and the rent to be collected will have to be
collected from the agriculturist i.e. existing members and hence the dues of Rs. 14,76,992/-
may be waived off.
The Commissioner explained that the Sangh is giving loan to agriculturist charging
interest on the loan. The amount may be collected from Shri. Amol P. Desai and Shri. Jyotiba
Laxman Bangodi who are the unauthorized occupants since there is no provision to waive the

rent. They have neither replied to our notice nor paid the rent, hence we have to take action
and decision may be taken in the Council.
Shri. Manohar L. Halagekar supported Shri. Ratan Masekar and said that the Sangh is
ready to handover the open space to the Corporation and the building in which the Sangh is
running office will be remain with them and they are ready to pay the rent, in this regard
they have given in writing, hence decision may be taken accordingly.
Shri. Deepak Jamkhandi stated that he has got a letter that it is a society Bank not a
Sangh it should be cleared and decision taken in petrol pump may be adopted here also.
After prolonged discussion, it was unanimously resolved that as per DMA guidelines
and DMA order, the site should be recovered by the Corporation.
Resolution No. 84
Sub: Allotment of site to Spandana Network of positive people Belagavi for
people living with HIV/ AIDS.
Shri. Nashipudi suggested to approve this subject since it is quite essential in the
interest of health of the people living with HIV/AIDS.
Shri. Anant Deshpande said that it is necessary to meet all the requirement of HIV/
AIDS patients on humanity grounds, so this subject may be passed.
Smt. Sarala Herekar stated that there are 40 Children in Spandana Network of positive
people who are HIV/AIDS patients and there living condition is very bad. It is shown to all
the VIP’s and it is very necessary to allot a suitable site to them and there request may be
kindly considered.
Shri. Pandri Parab suggested that a site be allotted from the Corporation and all
necessary facilities be extended to Spandana Institute.
Smt. Shanta Uppar supported the proposal and requested to pass the same.
The Commissioner read out the office note and explained that the Spandana Network
of positive people (R) is a network started in the year 2004 to provide services and Government
facilities to HIV/AIDS patients in Belagavi District. There are so many orphan children of
HIV/AIDS in the District who have no hostel facility. The Spandana Network is running a hostel
for these children. The Government woman and children welfare department has honoured
Spandana Nework by giving National Award in 2011. This hostel is running only with the
help of donors, so they have requested to allot a site. The D.C. Belagavi has issued directions
to identify a suitable site and to submit a proposal to Government.
Accordingly a site in CTS No. 4860/B-47 measuring 235.78 sq. mtr. in Rail colony
Sadashiv Nagar has been proposed and Smt. Sarala S Herekar and Shri. Deepak V Jamkhandi

have given request letters to allot a site. Hence this is placed before the Council to take
decision in view of Government notification – 1 No.RD/37/LGP/2002 Bangalore Dated: 23-
04-2005. He suggested that the BUDA is constructing a building for this purpose and said
children may be accommodated there.
Shri. Deepak Jamkhandi suggested to allot a site from the Corporation since the
children are orphans and HIV/AIDS patients and also they are psycho children and it is
necessary to provide free atmosphere to them.
Shri. Ramesh Sontakki said let BUDA construct their building but Corporation also should
give service and contribution to said children, hence a site be allotted by the Corporation.
The Commissioner BUDA who was present in the meeting explained that the BUDA
has taken decision in January 2015 to allot a site measuring 40’x 60’ to Mahesh Foundation.
The Mahesh Foundation has now about 40 children. They want all basic facilities for those
children. Now this Spandana Network has also 40 children, so it will be totally 80 children.
All these children cannot be accommodated in a site measuring 40’ x 60’, hence a decision be
taken in this council regarding request of Spandana Network.
Shri. Nashipudi suggested to allot a separate site to Spandana Network for HIV/AIDS
children.
Smt. Sarala Herekar suggested that there is a small site available near Spandana
Network, that site may be allotted or some other suitable site be allotted to them. The
children suffering from HIV/AIDS need help from the Corporation. So a corner site be
allotted by Corporation and Spandana Network will construct hostel building for those
children. A resolution may be passed and we may request the Government to allot proposed
site to them for HIV/AIDS children.
In view of the above, the council unanimously resolved to allot a site to Spandana
Network for construction of hostel building to HIV/AIDS children and to write a letter to the
Govt. for the approval of the proposal.
Resolution No. 85 Sub: Approval for action plan of the works under O & M of Belagavi City Water Supply Scheme for the year 2014-15.
The Commissioner read out office note and explained that Action plan for the
expenditure for maintains of both Bullk and Distribution for the year 2013-14 has been
already submitted. The KUWS and DB Belagavi Division has now requested for approval of
O&M, M&R estimate of Belagavi Water Supply Scheme for the year 2014-15. He said if water
Board submits Action plan for entire water supply scheme to Belagavi then we are ready to
take up the scheme with the approval of council.

The Executive Engineer KUWS & DB explained that the bulk maintenance of Water
Supply Scheme with Rakaskoppa Dam as source was handed over to the Board vide Govt.
Order No. UDD/43/UWS/2004 Dtd: 28-08-2004. Hence Board was maintaining only bullk
water supply from the both the sources from 2004 to 2008. The Administrator CCB vide
resolution No. 50 Dtd: 14-02-2006 resolved to handover the O&M of distribution network of
Belagavi city to K.U.W.S & D.B. Accordingly the Govt. issued the Order No. UDD/05/UWS/2006
Dtd: 23-06-2006 for Operation & Maintenance of distribution network of Belagavi city.
As per this Govt. Order, it is necessary to obtain prior approval of City Corporation,
Belagavi for carrying out works costing more than Rs. 4.00 Lakhs. Hence the estimates are
submitted to the City Corporation, Belagavi for countersignature.
As per instructions of higher authority the Annual Maintenance Estimates of Belagavi
Water Supply System for the year 2012-13 was submitted to the City Corporation, Belagavi
for Counter Signature. The estimate was countersigned by the Commissioner City
Corporation, Belagavi for Rs. 2424.77 Lakhs vide Commissioner Ltr Dtd : 07-01-2013. Even
though the estimate was countersigned for Rs. 2424.77 Lakhs the actual expenditure incurred
during the year 2012-13 is Rs. 1695.65 Lakhs.
The Water Supply Scheme to Belagavi City with Hidkal reservoir as source was
commissioned during 2000 and the Scheme consists of 3 stage pumping. As the pumping
machineries have served for 14 years, the pumping machineries and transformers are
frequently giving problems and leading to stoppage of water supply to the city. The starters,
Breakers etc., are of MEI make, which are obsolete and the spare parts are not available in the
market to carry out the repair works. To overcome the electrical problems, the proposals for
Supply, Erection and Commissioning of FCMA soft starters in lieu of existing MEI make
starters at all the three pumping stations of Belagavi Water Supply Scheme were prepared for
Rs. 107.00 Lakhs and Rs. 36.00 Lakhs respectively for Tummerguddi and Kanbargi pumping
stations and submitted to the Commissioner, City Corporation, Belagavi for countersignature.
The O&M estimate for the year 2013-14 including the urgent electrical works to be
taken up under Hidkal Water Supply Scheme was prepared and submitted for Rs. 3265.66
Lakhs to the City Corporation for countersignature. The estimate was restricted to Rs. 1260.00
Lakhs and countersigned vide Administrator City Corporation Belagavi vide Resolution No.
304 Dtd: 16.07.2013, whereas the actual expenditure for the year 2012-13 itself is Rs. 1695.00
Lakhs. This was limited by Corporation considering the revenue collection. The actual head
wise Expenditure incurred during 2013-14 is shown which shows that the major component
is Salaries i.e. Rs. 778.48 Lakhs.
The cost involved in routine maintenance of the Water supply system is increasing day
by day due to hike in establishment charges, chemicals and consumables, etc., But on the

contrary the annual M&R estimate cost is reduced and approved based on non technical
reasons.

The Revenue Collected is Rs. 1164.45 Lakhs as against the Demand of Rs.1402.89 Lakhs
during the year 2013-14. As per Govt. Order No. UDD/5/UWS/2006 Dtd: 23.06.2006, if there
is any difference between O&M charges & water tariff collection, the same should be paid by
City Corporation, Belagavi to the KUWS & D Board.
The estimates needs countersignature by the City Corporation, Belgaum for the
estimated amount for getting Technical Sanction by competent authority of the Board and
also approval is needed for O&M expenditure incurred during the year 2013-14. Many
correspondences were made by the Chief Engineer KUWS & DB and Executive Engineer
KUWS & D Board to convince the corporation authority to countersign the M&R estimate for
the estimated amount. During 2013-14 the Commissioner, CCB approved the estimate for

sinking of Borewells and erection of power pumps/hand pumps amounting to Rs. 125 lakhs.
The work has been completed successfully and payment has been made during 2013-14.
It is becoming difficult to carry out the routine maintenance works of the system, so as
to supply sufficient drinking water to the city, due to non approval of proposals and O&M
estimates, even though the Board has savings, out of the water charges collected from Bulk
Consumers to the tune of Rs. 40.00 Crores. Out of this savings, construction of WTP, storage
reservoirs and feeder mains etc., were proposed at Basavankolla near Kanabaragi under D.C.
works which will improve water supply position in the eastern part of the city. Tenders have
been floated for this work.
Meanwhile the upscaling of Water Supply Scheme to Belagavi city on 24x7 basis is
approved and taken up by KUIDFC, in which there is provision for supply, erection and
commissioning of pumping machineries with allied equipments at all the pumping
installations of 3rd Stage Water Supply with Hidkal dam as source are proposed and would
be taken up by the KUIDFC in phased manner. This project takes long time, more than 3
years. The existing pumping machineries worked continuously for the designed life span,
which are to be replaced at every 15 years interval. To keep the pumping machineries and
allied units still in working condition for the stop gap period, demands replacement of
Starters, Breakers and Manifold etc., this constrained the Board to include such items under
special works of O&M and M&R of Belagavi Water Supply Scheme for the year 2014-15. But
upscalling though decided in 2008 the same is not implemented so far. In addition the
K.U.W.S. & D. Board has also remitted Rs. 11.90 Crores to ESCROW Account of 24x7.

Further the O&M and M&R estimates of Belagavi Water Supply Scheme for the year
2014-15 for the estimated amount of Rs. 952.83 lakhs and Rs. 1557.27 lakhs respectively was
submitted to the Commissioner, City Corporation Belagavi for countersignature. The estimate
amount is restricted to Rs. 374.00 lakhs for Bulk Maintenance and Distribution maintenance
estimate is countersigned for Rs. 1164.00 lakhs vide Water Committee proceedings Dtd:
05.12.2014. It is also instructed to submit the Action Plan for the works to be taken up during
2014-15.
In response a letter has been addressed by Executive Engineer, K.U.W.S. & D. Board,
Division, Belagavi vide letter No. 4567-8 Dtd : 20.01.2015 informing that, the actual
expenditure incurred on Bulk Maintenance upto Dec - 2014 is Rs. 385.17 Lakhs and that of
Distribution maintenance is Rs. 586.07 Lakhs. Out of this the salary component itself is Rs. 432.53
lakhs. Further the Board has expressed difficulty in maintaining the bulk system within
sanctioned cost of Rs. 374.00 Lakhs, as such the expenditure upto Dec - 2014 has already crossed
the Sanctioned amount and also still the expenditure is to be incurred for General
Maintenance upto end of financial year, apart from major repairs to transformer. Hence it is
requested to increase and approve the Bulk Maintenance cost to minimum Rs. 600.00 lakhs.
Further the Action plan for the works to be taken up under maintenance of
Distribution network was submitted vide T.O. Ltr. No. 4567-8 Dtd: 20.01.2015 for approval.
The Action Plan is approved vide Commissioner’s Ltr. No. 42 Dtd: 11.02.2015.
The revenue collected on Bulk Maintenance upto Jan - 2015 is Rs. 681.42 Lakhs and
that of distribution maintenance is Rs. 1047.90 Lakhs (Annexure-8). Hence, there will be no
shortfall of revenue collection as compared with the actual expenditure. It is very much
necessary to take up repairs to transformers under Hidkal Water Supply Scheme as the
scheme is being run on transformers shifted from Vijayapur Division. It is also necessary to
take up repairs to starters and breakers. Hence, the Bulk Maintenance cost for the year 2014-
15 may be approved for the submitted estimated cost.
Hence, the subject is placed before the council for discussion and to approve the following.
1. To approve the Action plan submitted by the Executive Engineer, KUWS & D Board, for both O&M (Distribution) Rs. 292.74 Lakhs and M&R (Bulk) Rs. 277.50 Lakhs.
2. To approve the O&M (Distribution) Rs. 1164.00 Lakhs and M&R (Bulk) Rs. 600 Lakhs for the year 2014-15.
Shri. Deepak Jamkhandi said the Ward budget is not given so for to the councilors and
the corporation has not received salary grunts from the Govt. The brief not of this subject is

given now in the meeting, so it is to be studied and subject may be taken in next meeting. The
electricity bill is being paid by the Corporation, hence energy charges of Rs. 50 crores should
not be calculated by the Water Supply Board.
The Executive Engineer KUWS & DB Belagavi briefed that this estimate is prepared as
per requisitions given by ward Corporators. Now the collection of water tax is more than
expenditures. Arrears from other Agencies is also being recovered. Hence this subject may be
kindly approved.
Smt. Shanta Uppar complained that many applications for water tap connection in
Ujwal Nagar and Renuka Nagar are kept pending and so for water connection is not given
and one Shri. Joshi is harassing the applicants and he should be changed immediately.
The Executive Engineer KUWS & DB Belagavi explained about energy charges. He
said a resolution was passed in the Council of the Corporation and every year it will be about Rs.
3.5 crores. Now the scheme of 24/7 is coming up and an extra account may be opened in Bank
and this amount may be kept in that account, that is a separate account for energy charges may be
maintained. An amount of Rs. 11.30 crores has been already put in S.B Account.
Shri. Nashipudi said one Shri. Vinayak Chougule Contractor is not black listed and no
action is taken against him inspite of several complaints. He requested to change him from
his ward.
Smt. Meenxi Chigare suggested that wells in Veerbhadra Nagar be cleaned and
provided for drinking water to the public in summer season. Smt. Sarala Herekar supported
the views and requested to take action for cleaning of wells.
The Mayor issued directions to the Executive Engineer KUWS & DB Belagavi to attend all the complaints and works of the Corporators regarding Water Supply immediately.
After detail discussion, the council unanimously resolved to approve the Action plan
submitted by the Executive Engineer, KUWS & D Board, for both O&M (Distribution) Rs. 292.74
Lakhs and M&R (Bulk) Rs. 277.50 Lakhs. It was further unanimously resolved to 1) Open
separate Escrow account for energy charges savings. 2) To utilize complete amount collected
from water tax for development works and water supply works after submitting the action
plan to the Corporation. 3) Commissioner is authorized to give consent to the action plan.
Following subjects were taken up with permission of the chair.
Resolution No: 86
Sub: Proposal of Shri. Pandhari Parab Corporator (1) To open Passport Office in Belagavi City Corporation Limits. (2) To allot a site for construction of Stadium for Sports Men.
Shri. Pandhari Parab placed his proposal and said the citizens of Belagavi are facing
many difficulties to get Passport from the office established in Hubli. Hence it is quite

necessary to start Passport Office in Belagavi City and he requested to pass this proposal. He
further said it is also very essential to have a modern Stadium for Sports Men in Belagavi in the
interest of encouragement of outstanding Sports Men. He requested to approve the proposal.
Shri. Sambhaji Patil M.L.A Belagavi (South) seconded the proposal and said the
Passport Office in Belagavi and a Stadium for sports men in Belagavi both are essential and
he suggested to pass both the subjects.
The Council resolved unanimously to approve the subject.
Resolution No: 87
Sub: Compliant of Shri. Gunjatkar Regarding Pollution of drinking water due to leakage of UGD Pipe Line.
Shri Gunjatkar complianed that there is leakage of UGD pipeline in his ward and
causing pollution in drinking water which is dangerous to the public health. He said inspite
of several complaints and requests the water Board officers have not attended the complaint
and no action is taken. He demanded for immediate action to solve the problem of pollution
of drinking water. He said the District Minister and the Deputy Commissioner have issued
directions to provide drinking water to all areas but the Commissioner of Corporation says
that the water connection will not be given to unauthorized area.
The Commissioner briefed that in five wards of Angol and Bhagya Nagar area it was
decided to replace the pipeline and an estimate of Rs. 1 Crore is prepared and submitted
through the Chief Engineer KUWS & DB to the Govt. for the approval and it is yet to be
approved by the Govt. He said in Demo zones of 24/7 the tap connection cannot be given
directly from main Water Supply pipeline. The Hon’ble M.L.A (South) is aware of the fact
that the formers take drainage water flowing out side to their land in summer season but not
in rainy season. He said we may provide water tanker’s in that area but tap connection from
main pipeline of 24/7 water supply cannot be given.
Shri. Gunjatkar requested the Executive Engineer KUWS & DB Belagavi to explain the
matter.
The Executive Engineer KUWS & DB Belagavi replied that it is decided not to cross
capacity line while extending new tap connections in the interest of existing capacity of water
pipeline. In every area there is demand for connection of new taps and a solution is to be find
out.
Shri. Sambhaji Patil M.L.A (South) suggested that a water committee is formed in this
council and said committee to visit the area of Shri. Gunjatkars complaint and place its report
before the next meeting for taking decision. He opined that the problem of pollution in
drinking water should be solved in the interest of public health.

Resolution No: 88
Sub: Allotment of alternate site as per order of Hon’ble District Consumer Grievance Redressel Court Belagavi.
The Commissioner read out the office note and explained that a Plot bearing CTS
No/Plot No-7551/13, measuring 30’ x 40’ located in Mal Maruti Exention was allotted to Shri
Namdev Krishna Hiremani in the year 1999. The concerned allottee has paid the amount of
plot as per terms and conditions and the proposal was sent to the Govt. for approval. The
Govt. has directed not to allot the said plot as it is commercial one, hence the allotment was
cancelled. The Concerned allottee approached to the District Consumer Disputes Grievance
Redressal Court against cancellation order of allotment of the plot and lodged case under
No. 162/2006. The District Consumer disputes Court Ordered on 28-03-2007 to execute the
sale deed of above said plot in the name of allottee. The Corporation approached Hon’ble
Higher Court against the order of District Consumer Court but the Hon’ble Higher Court
uplifted the District Consumer Court order.
But before issue of judgment from the Hon’ble Higher Court, the plot in question was
auctioned by the Corporation. The allottee has already paid the entire amount of the plot and
Hon’ble Courts also have ordered to execute the sale deed of alternate plot in the same layout
in favour of Shri Namdev Krishna Hiremani. The Law Officer City Corporation Belagavi
have submitted a brief note stating that the Commissioner City Corporation Belagavi has
requested the Hon’ble Higher Court to give two months time to allot and execute the sale
deed of alternate site. The Hon’ble Higher Court agreed and postponed the date of hearing of
the case. The proposal for allotment of alternate plat to Shri Namdev Krishna Hiremani is
placed before the Council for Discussion and decision.
The council unanimously resolved to approve the proposal for allotment of alternate
plot to Shri Namdev Krishna Hiremani as per order of Hon’ble District Consumer Grievance
Redressel Court Belagavi and to move the matter to Govt. for approval.
Resolution No: 89
Sub: Implementation of Order Passed by the Hon’ble High Court in W P NO 338259-837/2004 Dated: 13-11-2013
The Commissioner read out the office note and stated that Shri Hirachand Lengade
and 8 others had filed Writ Pettion 33829-837/2004 alleging that their lands have been
acquired for widening of road at Khadebazar Shahapur Belagavi, the alternative land allotted
is not suitable, and they had obtained order for suitable alternative land. Accordingly subject

was placed before council seeking approval of alternative site allottement. The subject had
come up before council meeting held on 17-10-2014 and Resolution No 27 was passed
resolving to refer the matter to the master plan committee. Now the contempt petition has
been filed alleging that the orders passed by the Hon’ble High Court has not been complied
even after laps of stipulated period of 3 months. For formation of master plan committee and
taking decision there in may consume sum more time, hence it is requested to take suitable
decision in this council.
The Master Plan sufferers of Khade Bazar Shahapur were accommodated in Tilakwadi but
they approached Hon’ble High Court stating that allotted site is not suitable. This subject was
placed before the standing committee for taxation and finance and the said Committee has
referred this subject to lease committee. This subject is to be decided in Master Plan committee.
Shri. Sambhaji L Patil M.L.A Belagavi (South) suggested to see the proceedings of
previous Master Plan committee and action be taken for allotment of alternate site to the
applicant since it is already delayed. The party has approached the High Court, hence this
subject be taken in Master Plan committee for taking a decision.
The Mayor stated that as per directions of the Hon’ble High Court the compensation
be paid to Master Plan sufferers.
The Commissioner stated that there is a case of contempt of Court and arrest warrant
has come to this office since the party has approached competent Courts and Corporation
should allot the site of same dimention, which was lost during master plan. The Corporation
has auctioned the site which was allotted to said appellant.
After discussion it was unanimously resolved to allot the sites based on Court order.
The Commissioner explained that Shri. R.S Nayak Executive Engineer (North) of this
Corporation has made efforts to convince the Hon’ble Minister, M.L.A’s and KUWS
authorities regarding amount of Rs. 40 Crores to be repaid by the KUWS & DB Belagavi
division to City Corporation, Belagavi. The said amount of Rs. 40 Crores has been utilized for
construction of WTP at Kanbargi which is most useful for the supply of drinking water to that
area. Hence the Corporation is issuing a Certificate of appreciation to Shri. R.S Nayak
Executive Engineer (North). He requested the Mayor to give Certificate to Shri. R.S Nayak
Executive Engineer (North). Accordingly Hon’ble Mayor presented a certificate of
appreciation to Shri R.S. Nayak Executive Engineer (North) in the council.
Resolution No. 90
Sub: To allot alternative site or compensation in lieu of land/sites taken at the time of road widening.

Shri. Anant Deshpande stated that at the time of road widening at Kirloskar road, College
road and Khade Bazar road the affected persons have not been given any compensation or
alternative site though they have approached the Corporation so many times and given in writing
on Rs. 50/- bond paper and have also submitted their applications. They have also approached
the Lokayukta and the Lokayukta has directed to pay necessary compensation but till today no
action has been taken. It should be explained. This subject was also put up before the last Council
but no decision has been taken. This subject has also been discussed at Govt. level and it has
appeared in News papers also. Hence necessary decision may be taken.
Shri. Deepak Jamkhandi stated that the affected persons have approached so many times
to Corporation and approached the Lokayukta but no action has been taken and they are fade up.
Hence action may be taken by enquiry with officers and officials who are dealing with this
matter.
Shri. Ramesh Sontakki suggested that this subject may be discussed by conducting a
special meeting.
Shri. Sambhaji L. Patil, MLA Belagavi (South) stated that the affected persons have given
their lands at the time of road widening for public purpose. If the subject has not appeared in last
proceedings, it should be included now and decision taken.
The Commissioner stated that applications may be obtained or submitted by the affected
persons who have not paid any compensation or alternative site as discussed above and action
will be taken as decided by the Council. But without any application no action can be taken.
After discussion it was decided to take up the subject separately for discussion and
decision after due verification of the application, if submitted by the applicant.
Resolution No. 91
Sub: To approve the proposals for sanction of financial assistance under 24.10% & 7.25% fund scheme for Individual Beneficiaries.
The standing Committee for Public Health, Education and Social Justice held on 05-01-
2015 and 16-02-2015 has not taken decision on this subject. So in the interest of individual
beneficiaries this proposal has been directly placed before this Council since the financial year of
2014-15 is ending on 31-03-2015 and available fund has to be 100% utilized to the individual
beneficiaries. Hence the list of beneficiaries under 24.10% scheme for SC/ST and 7.25% scheme
for other backward classes fund schemes which is as under is placed for approval.

extend financial assistance to the individual beneficiaries as above under 24.10% scheme for
SC/ST and 7.25% scheme for other backward classes and the financial assistance should be
reached to the individual beneficiaries before 31-03-2015.
