DemocraticPartyoftheUnitedStates,theDelegateSelectionRulesforthe2020DemocraticNationalConvention(“Rules”),theCallforthe2020DemocraticNationalConvention(“Call”),theRegulationsoftheRulesandBylawsCommitteeforthe2020DemocraticNationalConvention(“Regs.”),therulesoftheDelawareDemocraticParty,theDelawareelectioncode,andthisDelegateSelectionPlan.(CallII.A)

3. FollowingtheDelawareDemocraticPartyExecutiveCommittee’sadoptionofthis

DelegateSelectionPlan,theDelawareDemocraticPartyshallsubmitthePlanforreviewandapprovalbytheDNCRulesandBylawsCommittee(“RBC”).TheStatePartyChairshallbeempoweredtomakeanytechnicalrevisionstothisdocumentasrequiredbytheRBCtocorrectanyomissionsand/ordeficienciesasfoundbytheRBCtoensureitsfullcompliancewithPartyRules.SuchcorrectionsshallbemadebytheStatePartyChairandthePlanresubmittedtotheRBCwithin30daysofreceiptofnoticeoftheRBC’sfindings.(Reg.2.5,Reg.2.6&Reg.2.7)

4. OncethisPlanhasbeenfoundinCompliancebytheRBC,anyamendmenttothe

1. ParticipationinDelaware’sdelegateselectionprocessisopentoallDelawarevoterswhowishtoparticipateasDemocrats.(Rule2.AandRule2.C.)

a. ThedeadlinetofornewvoterstoregisterasDemocratstovoteinthe

PresidentialPrimaryandtherebyparticipateinthefirstdeterminingstepofthedelegateselectionprocessisApril4,2020;

b. Anypreviously-registeredDelawarevoterwhowishestoparticipateinthe

DemocraticPresidentialPrimarymustchangetheirvoterregistrationto“Democratic”withDelawareDepartmentofElectionsonorbeforeFebruary27,2020:

i. DelawareresidentsmayregistertovoteasDemocratsontheStateof

Delaware’swebsite:ivote.de.govorcanrequestvoterregistrationformsbycallingtheDelawareDepartmentofElectionsat(302)739-4277.

ii. VoterswhoarenotregisteredasDemocratsareineligibletoparticipateintheDemocraticPresidentialPrimary;(Rule2.A&Reg.4.3.B)

iii. VoterregistrationreflectedinthevoterrollsmadepubliclyavailablebytheDelawareSecretaryofStateshallbeconsideredapublicdeclarationofPartypreference.(Rule2.A&Reg.4.3.A)

c. Toencourageparticipationbyyouthinthedelegateselectionprocess,any

individualwhowillhaveturned18bythedateofthe2020generalelectionwillbeallowedtoparticipateinDelaware’sdelegateselectionprocess.(Reg.4.3.C)

d. AtnostageofDelaware’sdelegateselectionprocessshallanypersonbe

required,directlyorindirectly,topayacostorfeeasaconditionforparticipating.VoluntarycontributionstothePartymaybemade,butundernocircumstancesshallacontributionbemandatoryforparticipation.AnyvoluntarycontributionsmadetotheDelawareDemocraticPartybypotentialdelegatesoralternatesduringthisprocessshallbeusedtohelpdefraypossibleconventioncostsforlow-incomedelegateswhoseapplicationsforassistanceareapprovedbytheAffirmativeActionCommittee. e. Nopersonshallparticipateorvoteinthenominatingprocessforthe

thedelegateselectionprocess.(Rule3.E&Reg.4.7) 2. TheDelawareDemocraticPartyhaspromotedvotersecurityandelectionsecurityin

recentyears,includingpassingaresolutiondirectingstateofficialstoconsiderelectionsecuritybestpracticesintheprocurementofnewvotingsystems.TheStatePartyhasalsoestablishedanelectionprotectionhotlinemannedbyteamofvolunteerattorneystotroubleshootanyreportedincidentsofdisenfranchisement–realorperceived–acrossthestate.TheStatePartyisalsopubliclysupportingapackageofelectionreformbillslike“earlyvoting”and“noexcuseabsenteevoting”thatwouldeaselinesonElectionDayandtheaccompanyingstrainonelectionworkers.Takentogether,oureffortsareaimedataccomplishingthefollowingsevengoals:

a. Maintainsecureandaccuratestatevoterregistrationrolls,sothatevery

eligibleAmericanwhoregisterstovotehastheirpersonalinformationprotectedandsecure;(Rule2.H.1)

b. Implementtransparentandaccuratevoterregistrationlistmaintenance

proceduresthatcomplywithfederalrequirementsandensurethateveryeligiblevoterstaysontherolls;(Rule2.H.2)

c. Promotetheacquisition,maintenance,andregularreplacementofprecinct

basedopticalscanvotingsystems;(Rule2.H.3) d. Ensurethatanydirectrecordingelectronicsystemsinplacehaveavoter

verifiedpaperrecord;(Rule2.H.4) e. Implementrisklimitingpost-electionauditssuchasmanualauditscomparing

paperrecordstoelectronicrecords;(Rule2.H.5) f. Ensurethatallvotingsystemshaverecognizedsecuritymeasures;(Rule2.H.6)

3. InaccordancewiththeDemocraticParty’srequirementtoassessandimprove

participationwithrespecttopresidentialpreferenceandthedelegateselectionprocess,Delawarehasappointedanetworkofprobonoattorneystoserveonavoterprotectionpanelandhasmetwithelectionofficialstoconveyandaddresskeyconcernsregardingelectionprotectionandpollingplaceaccessibility.TheDelawareDemocraticPartyisworkingwithourmembersintheGeneralAssemblytoexpandadvancefourpiecesoflegislationtheStatePartyisconfidentwillincreasevoter

participationandimproveourdemocracy.TheDelawareDemocraticPartyispubliclysupportingthislegislationandisoptimisticthateachbillwillbecomelawduringthe150thGeneralAssembly:a. HouseBill38(Earlyvoting)b. HouseBill39(Same-dayregistration)c. HouseBill41(Movingstateprimarytospringandcouplingitinpresidential

years)d. HouseBill73(No-excuseabsenteevoting)

Takentogether,theseeffortsareaimedataccomplishingthefollowingsixgoals:

a. Expandaccesstovoting,includingbyearlyvoting,noexcuseabsentee,same-

dayvoterregistration,andvotingbymail;(Rule2.I.1.a) b. Ensurethatvotinglocationsareaccessible,fairlyplaced,andadequatein

number,andhaveasufficientnumberofvotingmachines;(Rule2.I.1.b) c. Speedupthevotingprocessandminimizelonglines;(Rule2.I.1.c) d. Eliminateonerousanddiscriminatoryvoteridentificationrequirements;(Rule

2.I.1.d) e. Countandincludeinthefinaltotalballotsfromvoterswhoareeligibletovote

butcasttheirballotsinthewrongprecinct,forofficesforwhichtheyareeligibletovote;and(Rule2.I.1.e)

f. Facilitatemilitaryandoverseasvoting.(Rule2.I.1.f)

Undercurrentlaw,voterscanbeginrequestingabsenteeballotsonJanuary29,2020forthePresidentialPrimary,withtheDepartmentofElectionsrequiredtomailallabsenteeballotsbyApril20,2020.Militaryandoverseasvoterscanapplyforabsenteeballotsatanypointduringtheelectioncycle.(Rule2.Iand2.I.1)

4. Aspartofencouragingparticipationinthedelegateselectionprocessbyregistered

voters,theDelawareDemocraticPartyhasundertakeneffortstomakevoterregistrationeasier,includingengaginginvoterregistrationdrivesinkeycommunitiesandconstituencygroups,andincreasingourinvestmentincandidate-agnosticGOTVefforts(fieldandpaidcommunications)tosuccessfullyincreaseturnout.TheStatePartyhasalsosupported:

a. Voterregistrationmodernization,includingonlinevoterregistrationat

ivote.de.govandadvocatingforautomaticvoterregistration,whilecurrentlypursuingsame-dayregistrationlegislation(HouseBill39),whichislikelytotakeeffectin2022;(Rule2.I.2.a)

b. Allowingforthepre-registrationofhighschoolstudentsattheDelawareDepartmentofMotorVehiclewhowillturn18priortothenextgeneralelection;(Rule2.I.2.b)

c. Restorationofvotingrightstoallpeoplewhohaveservedthetimefortheir

criminalconviction,withoutrequiringthepaymentofcourtfeesorfinesorawaitingperiod(SenateBill242,2016);(Rule2.I.2.c)and

d. Same-dayorautomaticregistrationofvotersfortheDemocraticpresidential

nominatingprocess.(Rule2.I.2.d)

5. Delawareisparticipatinginagovernment-runpresidentialpreferenceprimarythatwillutilizestate-operatedvotingsystems.TheDelawareDemocraticPartyhastakenstepstoreducetheriskofvoterfraudbypromotinginvestmentinnew,state-of-the-artvotingtechnologiesthatincludeacorrespondingpaperballot.Wewillcontinuetoseekenactmentoflegislation;rulesandpoliciesatthestateandlocalleveltoensurethatemphasizerecognizedsecuritymeasures,includingmanualauditscomparingpaperrecordstoelectronicrecordsfollowingeveryelectionandpriortocertificationorresultswherepossible;paralleltestingonelectionday;physicalandelectronicsecurityforequipment;banninguseofwirelesscomponentsandconnectionsexceptwhererequiredtoprovideavoterwithadisabilityasecureandapprovedmeanstoaccessvotingmaterialsandexercisetherighttovote;publicdisclosureofsoftwaredesign;useoftransparentandrandomselectionforallauditingprocedures;andeffectiveproceduresforaddressingevidenceoffraudorerror.

6. TheDelawareDemocraticPartysupportsfurthereffortstoreduce

disenfranchisementinthepresidentialprimaryprocessbysupportingthealignmentoftheregistrationdeadlinewiththedeadlineforswitchingpartyaffiliation,andarepursuinglegislativebuy-inforthiscodechange.(Rule2.JandRule2.J.1)

7. SchedulingofDelegateSelectionMeetings

Thedates,timesandplacesforallofficialPartymeetingsandeventsrelatedtoDelaware’sdelegateselectionprocesshaveandwillbescheduledtoencouragetheparticipationofallDemocrats.Suchmeetingswillbeginandendatreasonablehours.TheDelawareDemocraticPartyisresponsibleforselectingthedatesandtimesandprovidingfacilitiesforallofficialmeetingsandeventsrelatedtothisprocess.Assuch,thePartyiscommittedtoholdingallmeetingsinADAcompliantlocations.Inaddition,theschedulingofmeetingsshallconsideranyreligiousobservationsthatcouldsignificantlyaffectparticipation.(Rule3.A&Reg.4.)

A. BallotAccess

PursuanttoDelawareCodeTitle15,Chapter31,SubsectionV,§3183and§3184,apresidentialcandidategainsaccesstotheDelawarepresidentialpreferenceprimaryballotbyqualifyingforfederalmatchingfunds;orbysubmittingapetitionofcandidacywith500validsignaturesofregisteredDemocratsintheStateofDelawaretotheStateElectionsCommissionerbyFebruary27,2020.Foradditionalinformation,candidatesshouldcontacttheDelawareCommissionerofElectionsviaphoneat(302)739-4277,viafaxat(302)739-6794,orviamailattheOfficeoftheStateElectionCommissioner,905S.GovernorsAve.,Suite170,Dover,DE19904.

1.Matchingfunds

a. TheDelawareDemocraticPartyChairshallhaveseven(7)workingdaysafterFebruary27,2020toprovidetheStateElectionsCommissionerwithalistofallDemocraticPresidentialcandidates,whohavenotalreadyfiledapetitionforballotaccess,andwhohavebecomeeligiblebythecloseofbusinessontheprecedingdaytoreceivepaymentsfromthePresidentialPrimaryMatchingPaymentAccountoftheInternalRevenueCode;andwhohavenotpreviouslyannouncedtheirwithdrawalfromthenationalpresidentialrace;and/orwhohavenotannouncedthesuspensionoftheirpresidentialcampaign.TheStateElectionCommissionershallplaceallsuchpersonsonthepresidentialprimaryballotfortheirrespectiveparty.

b. TheDelawareDemocraticPartyChairandtheDelawareCommissionerofElectionswillonlyutilizetheFederalElectionsCommission(FEC)websitetodeterminewhichcandidateshavequalifiedformatchingfunds.

c. Priorto,orconcurrentlywith,thefilingoftheabove-mentionedlistwiththeStateElectionCommissioner,theDelawareDemocraticPartyChairshallnotifythecandidateorthecandidate'scampaign,thatthecandidate'snamehasbeen(orwillbe)providedtotheStateElectionCommissioner.

d. Acandidateplacedontheballotpursuanttothismanner,oracandidatealreadyontheballotviaapetition,mayhavethatcandidate'sownnameremovedfromtheballotprovidedthatnolaterthanthecloseofthebusinessdayfollowingthedayonwhichtheabove-mentionedlistwasprovidedtotheStateElectionsCommissioner,thecandidatefilesanaffidavitwiththeStateElectionsCommissionerstatingthatthecandidateisnotcurrentlyanddoesnotintendtobecomeacandidateinanyotherstate'spresidentialprimaryandthatthe

candidateisnotcurrently(orisnolonger),anddoesnotintendtobecome,acandidateforthepresidentialnominationofthecandidate'sparty.

2. PursuanttoDelawareStateLaw,iftheDelawareDemocraticPartysubmitsthenameofonlyonePresidentialCandidate,andnoothercandidatesfilefortheballot,thestaterunpresidentialprimaryshallbecancelled.Write-incandidatesarenotpermittedinDelaware’spresidentialprimary.

2. Eachpresidentialcandidate(includinguncommittedstatus)shallusetheirbest

effortstoensurethattheirrespectivedelegationwithinthestatedelegationachievestheaffirmativeaction,outreachandinclusiongoalsestablishedbythisPlanandisequallydividedbetweenmenandwomen.(Rule6.I)

c.AllDelawareresidentswhoareregisteredDemocratasofJanuary1,2020areeligibletoparticipateintheRepresentativeDistrictcaucusinwhichtheylive.

i. ThetimeandplaceforeachRepresentativeDistrict’scaucuswillbeannouncedpubliclybytheDelawareDemocraticPartyonitswebsiteandviaitsemaillistandsocialmediachannels.AnnouncementsofthetimeandplaceofeachdistrictmeetingwillbepublishedintheWilmingtonNewsJournalandtheDelawareStateNewsaswellaslocalandcommunitynewspaper,websites,andblogs.ThepartywillalsoengageindirectoutreachtoDemocraticclubs,alliedorganizations,andotherinterestedorganizationstosharethetimeandplaceoftherepresentativedistrictmeetingsleadinguptothecaucuses.

ii. RepresentativeDistrictLevelcaucuseswilltakeplacepriortotheApril28,2020presidentialprimary,betweenMarch1andMarch31,2020,inpubliclyaccessiblelocations.LocationsandtimesforthesecaucusesmustbesubmittedtoDelawareDemocraticPartyHeadquartersnolaterthanFebruary9,2020,meaningallRepresentativeDistrict-Levelcaucusesmusthaveatleasttwenty-one(21)daysnotice.

iii. RepresentativeDistrictchairsandmeetingofficialsmustverifythatallparticipantsintheirRepresentativeDistrictLevelCaucusareregisteredDemocratslivingwithinthegeographicalconfinesofthatdistrict,andthattheyhavefiledastatementofcandidacydesignatingtheirsingularpresidential(oruncommitted)preferenceandasignedpledgeofsupportforthepresidentialcandidate(includinguncommittedstatus)withtheStatePartyby5p.m.onFebruary28,2020.

iv. RepresentativeDistrictLevelcaucusesshalleachselectfour(4)delegatestotheDDSCtobeheldonMay9,2020inDover,Del.

v. AttheconclusionofeachRepresentativeDistrictCaucus,eachRepresentativeDistrictmustsubmitthefullname,address,andtelephonenumberofeachofthefour(4)peopleelectedtoattendtheDelawareDelegateSelectionCaucusrepresentingtheirDistrict.Thedeadlinetosubmitthisinformationis5p.m.onApril3,2020.

d.DelawareDelegateSelectionCaucus(May9,2020).

i. TheDelawareDelegateSelectionCaucus(DDSC)willbeheldonMay9,2020inDover.TheDDSC’ssoleagendaitemshallbetheselectionoftheDelawareDelegatestotheDemocraticNationalConventioninMilwaukee.

ii. AllparticipantsintheDDSCmustshowproperidentificationandbeabletosubstantiatepartyregistrationinordertoparticipateintheDDSC.

iii. SubdivisionChairsshallserveaschairoftheirrespectivesubdivisioncaucusesattheDDSC.

3. ApportionmentofDistrict-Level(Subdivision-Level)DelegatesandAlternates a. Delaware’ssubdivision-leveldelegatesareapportionedacrossthefour

subdivisionsbasedontheequalweighttotheaverageofthevotefortheDemocraticcandidatesinthe2012and2016presidentialelectionsandtoDemocraticPartyregistrationorenrollmentasofJanuary1,2020.(Rule8.A,Reg.4.12,Reg.4.11&AppendixA)

Thismethodwasselectedbecauseityieldsthemostinclusivemethodforallocatingdelegates,inthatitcapturesthegrowthofourPartythroughthenearly13,000andcountingnewlyregisteredDemocratssincethe2016election.

Ifapresidentialcandidatehasonlyone(1)alternate,andthatalternatepermanentlyreplacesadelegateofadifferentgender,therebycausingthedelegationtonolongerbeequallydivided,thedelegationshallnotbeconsideredinviolationofRule6.C.Insuchacase,notwithstandingRule19.D.2,theDelawarePartyCommitteeshall,atthetimeofasubsequentpermanentreplacement,replaceadelegatewithapersonofadifferentgender,inordertoreturnthedelegationtoequaldivisionofmenandwomen.(Reg.4.36)

iii.IfadelegateoralternatecandidatewhohasbeenelectedbutnotcertifiedtotheDNCSecretaryresigns,dies,orisnolongereligibletoserve,theyshallbereplaced,afterconsultationwiththeStateParty,bytheauthorizedrepresentativeofthepresidentialcandidatetowhomtheyarepledged.(Rule19.D.2)

b. TemporaryReplacementofaDelegate:(Rule19.D.4)

i. Atemporaryreplacementoccurswhenadelegateistobeabsentforalimitedperiodoftimeduringtheconventionandanalternatetemporarilyactsinthedelegate’splace.

ii.Anyalternatewhotemporarilyreplacesadelegatemustbeofthesamepresidentialpreference(includinguncommittedstatus)asthedelegatetheyreplace,andtotheextentpossibleshallbeofthesamegenderandfromthesamepoliticalsubdivisionwithinthestateasthedelegate.

c. Thefollowingsystemwillbeusedtoselectpermanentandtemporary

ii. Permanentreplacementofadelegate(asspecifiedabove)byanalternateandreplacementofavacantalternatepositionshallbecertifiedinwritingbytheDelawareDemocraticChairtotheSecretaryoftheDemocraticNationalCommitteewithinthree(3)daysafterthereplacementisselected.(CallIV.D.1)

iii. CertificationofpermanentreplacementswillbeacceptedbytheSecretaryupto72hoursbeforethefirstofficialsessionoftheConventionisscheduledtoconvene.(CallIV.D.1&Reg.4.35)

2. EachpresidentialcandidatemustsubmitawrittenstatementtotheState

3. Eachpresidentialcandidatemustsubmitdemographicinformationwithrespectto

allcandidatesfordelegateandalternatepledgedtothem.Suchinformationshallbesubmittedinconjunctionwiththelistofnamesapprovedforconsiderationasdelegateandalternatecandidatespledgedtothepresidentialcandidate.(Rule6.H.2)

4. Presidentialcandidatesshallusetheirbestefforttoensurethattheirrespective

delegates,alternatesandstandingcommitteemembersshallachievetheaffirmativeactiongoalsreflectedintheAffirmativeActionPlanandOutreachandInclusionProgramandthatthenumberofmenandthenumberofwomenintheirrespectivedelegationsshallnotdifferbymorethanone(asdeterminedbygenderself-

F. OutreachandInclusionProgram 1. TheDelawareDemocraticPartyiscommittedtohelpachievefullparticipationof

thosegroupsofAmericanswhohavehistoricallybeenexplicitlydeniedtherighttovoteorwhohavebeensubjectedtodiscriminatoryandexclusionarypracticesthathavedeniedthemvotingrightsandfullparticipationinthedelegateselectionprocessandotherPartymeetings,eventsandelections,alongwithothergroupsofAmericanswhoarealsounderrepresentedinPartyaffairs.

2. Assuch,theDelawareDemocraticPartyhasdevelopedoutreachandinclusion

programsandiscommittedtofullyimplementingtheprogramssothatallpersonswhowishtoparticipateasDemocratsunderstandtheyarewelcomeandencouragedtobeapartofthedelegateselectionprocessandinthePartyatthelocal,stateandnationallevels.

3. TheStatePartywillmakeaccommodationstofacilitategreaterparticipationby

peoplewithdisabilitiesbyholdingallinformationalmeetingsandcaucusesinaccessiblelocations,withconsiderationmadeofParatransitroutes.

4. Inadditiontothestepsdescribedabove,theDelawareDemocraticPartycommitstoundertakingthefollowingoutreacheffortspriortoJanuary1,2020:
