REGULATORY REFORM PACKAGE: REGULATORY

REPEAL THROUGH RESOLUTION | HB 430

Kerry Benninghoff

Grants the General Assembly the ability to repeal current regulations in effect with a concurrent resolution. Currently, the General Assembly only has the authority to block the implementation of new rules and regulations. This legislation would extend this process to regulations that are already in effect.

REGULATORY REFORM PACKAGE: PERMITTING

REFORM | HB 509

Greg Rothman

Reforms the administration of permits in the Commonwealth by requiring the creation of an online tracking system for permit applications to provide updates in the status of permits and for the requires more information to be provided on permits in annual reports.

REGULATORY COMPLIANCE OFFICER | HB 762

Timothy “Tim” O’Neal

Requires state agencies to appoint a Regulatory Compliance Advisor. The advisor is charged to work with regulators and businesses to issue advisory opinions on how to comply with regulations helping business avoid costly fees, fines, and penalties.

REINS Act language: Requires the General Assembly to approve regulations that have an impact of more than $1,000,000 annually.

REGULATORY REFORM PACKAGE: OFFICE OF

THE REPEALER | HB 1055

Kate Klunk

Creates an independent Office of the Repealer to review existing regulations and implements a 2-out-1-in standard for the creation of new rules.

MERIT SELECTION | HB 111

Paul Schemel

House Bill 111 creates an unaccountable commission to determine who can be selected for appellate and Supreme Court vacancies in Pennsylvania. The individuals appointed to this commission will limit the number of possible candidates to a list of five that the Governor will be required to choose from. That selection will then have to be confirmed by a two-thirds vote of the Pennsylvania Senate.

EDUCATIONAL IMPROVEMENT TAX CREDIT

EXPANSION | HB 800

Mike Turzai

Would increase the Educational Improvement Tax Credit (EITC) by $100 million and offer an automatic escalator if voluntary donations and demand for scholarships keep up with that cap.

JUSTICE REINVESTMENT INITIATIVE 2 | SB 500

Lisa Baker

This bill creates a County Adult Probation and Parole Advisory Committee to study and advise probation andparole departments about evidence-based practices for administering community supervision and assessing the risks and needs of participants. The bill creates a grant program to help county probation and parole departments develop validated risk-assessment tools. As part of Pennsylvania’s Justice Reinvestment Initiative package, SB 500 directs resulting savings to the Pennsylvania Sentencing Commission and county probation and parole boards—this will improve these reforms’ implementation, reducing recidivism and improving public safety.

JUSTICE REINVESTMENT INITIATIVE 2 | SB 501

Tom Killion

Among other reforms, this bill gives judges more flexibility during sentencing, including improved guidelines on probation and parole administration to better individually tailor supervision. The bill expands access to drug treatment and other diversionary programs; and streamlines parole and probation to ensure recidivism is reduced.It also directs the Pennsylvania Sentencing Commission to report and evaluate the progress of parole and probation reform strategies implemented under the Justice Reinvestment package.

JUSTICE REINVESTMENT INITIATIVE 2 | SB 502

Camera Bartolotta

In addition to improving communication between law enforcement and victims of crime, this bill would expand eligibility for victim losses compensation, and merges the Crime Victims Compensation Fund and Victim Witness Services Fund to better serve victims.

SCOPE OF PRACTICE | SB 25

Camera Bartolotta

Would allow licensed nurse practitioners to fully use all of their training and expertise without the requirement that they be overseen by a physician. Expanding the scope of practice for experienced nurse practitioners will increase Pennsylvanians’ access to healthcare, help relieve healthcare provider shortages in our state, and reduce healthcare costs. AFP-PA supports this legislation.

REGULATORY REVIEW ACT | SB 398

John Gordner

This bill is designed to give the General Assembly more oversight over the regulatory process. The bill requires proposed regulatory language to be immediately provided to the Independent Regulatory Review Commission and the relevant legislative committee the same day and provides a framework for the relevant legislative committee to review, dispute, and delay the implementation of proposed regulation if there are concerns with the impact of proposed regulations.

CHARTER SCHOOL REFORM PACKAGE:

CHARTER SCHOOL BUILDINGS | HB 356

Matthew Dowling

This would make it easier for charter schools to acquire new facilities, by providing charter schools the right of first refusal to public school property that is for sale. It would also make it easier for charter schools to use religious facilities (but would continue the current law requirements that charter schools be nonsectarian and not provide religious instruction or display religious objects) as long as the school provides a separate entrance to the school and removes or covers religious objects in the area used by the school.

CHARTER SCHOOL REFORM PACKAGE:

STANDARD CHARTER APPLICATION | HB 357

This would create a uniform application process for a charter school with the Department of Education. It

would specifically prohibit a local school board from imposing additional terms or applications. This bill is an important reform because local school districts can often be barriers to new charter schools (because they oppose competition).

CHARTER SCHOOL REFORM PACKAGE:

PER PUPIL FUNDING AND CONCURRENT

ENROLLMENT | HB 358

Jim Marshall

This would allow charter school and vocational-technical students to dual enroll in higher education institutions. This is an important reform that would provide the ability to further customize an education for charter school and vocational students (students in public schools enjoy this ability under current law).

TAXPAYER PROTECTION ACT | HB 1316

Ryan Warner

This bill proposes an amendment to the state constitution which will put in place an important spending reform that would ensure the state does not grow government spending unchecked. This amendment would limit annual increases in state spending. The cap in spending growth would account for factors like inflation and population growth, ensuring that the state will have the resources to continue providing its important core functions, while also protecting taxpayer dollars.

CRIMINAL HISTORY LICENSING ELIGIBILITY

| SB 637

John DiSanto

Senate Bill 637 amends Title 18 (Crimes and Offenses) to ensure that conviction of a crime will not automatically prevent Pennsylvanians from being issued a license, certificate, registration or permit. The bill also requires a board or commission that determines eligibility for licensure to only consider an applicant’s conviction of a crime and if the conviction directly relates to the duties, functions and responsibilities for that license, registration, certificate or permit’s profession or occupation.

SMALL BUSINESS TAX PACKAGE | HB 333

Eric Nelson

House Bill 333 addresses a distortion in the Pennsylvania tax code which allows expensing for corporations, but not passthrough businesses. This legislation would align the tax code to encourage investment of small businesses by allowing the full tax deduction for equipment under section 179 of the federal tax code.

OCCUPATIONAL LICENSURE REFORM

| HB 1477

Sheryl Delozier

House Bill 1477 requires that boards, commissions or departments of the Commonwealth apply one common set of rules when considering whether to deny, suspend, or revoke a license based on a criminal conviction. The bill would also require that boards

only withhold a license for convictions which are directly related to the practice of the occupation, and that the boards consider the nature of the offense, the amount of time that has passed since conviction, evidence of the applicant’s fitness to practice the occupation, and other relevant factors prior to withholding a license.

PROBATION REFORM | HB 1555

Sheryl Delozier

HB 1555 reforms Pennsylvania’s probation system by capping probation time for felonies and misdemeanors, disallowing the practice of “stacking” probation terms for multiple convictions, disallowing the practice of holding someone on supervision solely because they are unable to pay certain fines and costs and removing unnecessary conditions to supervision such as “refraining from frequenting unlawful or disreputable places or consorting with disreputable persons.”

EXPUNGEMENT UPON PARDON OR FULL

ACQUITTAL | HB 440

Tedd Nesbit

House Bill 440 ensures that Pennsylvanians who have been pardoned or fully acquitted of their charges are able to secure a streamlined, automatic expungement process. Someone who is legally innocent or pardoned should not face the burden of clearing their names, given the barriers to opportunity that criminal records present in housing, employment, and education.
