We have advertised events and meetings, called members to action on legislative issues, empowered the industry with timely topics on operations, Fair Housing and maintenance, congratulated members on accomplishments, partnered with other organizations and charities to assist our community, and looked forward to the future by sharing goals, visions, and industry trends. ~ A Note From the AAFW-NEI ~ A letter from our AAFW-NEI Board Member

Just like the doctors who get asked “does this cough sound bad?” while they are in the grocery store, attorneys get questions all of the time as well. I love helping out and answering questions. These are the top four questions we are frequently asked:

1. Ten Day Notice- Do I or Don’t I have to send it?

Landlords are often wondering “Do I need to give a ten day notice to quit? When do I need to give a ten day notice?” We know it can be confusing because there is an Indiana Law (I.C. 32-31-1-6) that says a ten day notice is required before filing an eviction for non-payment of rent. This does not apply if the rent is paid in advance! (I.C. 32-31-1-8). Tenants pay in advance if their rent is due at the beginning of the month for the month following. For example, March 1st rent is due for the month of March. In fact there is no Indiana statutory notice requirement if the tenant pays in advance. However, if your lease has a requirement to give a notice prior to filing an eviction you must comply with your lease.

2. Disposition of abandoned Property - It does not matter if the tenant was evicted, skipped or left voluntarily

Allen County has local rules regarding abandoned property, but you may be in another county so check with your local court. When it appears a tenant has abandoned property the landlord must take reasonable care to store it. You can leave the property in the apartment or remove it and store elsewhere. The tenant must be notified at their last known address that their property is being stored and storage charges are accruing (if you are actually accruing true storage charges). You must also notify them the property will be held for two weeks from date of the letter, providing your contact

information so that the former tenant can make arrangements to get their property. Once the two weeks have passed you may dispose of the property, giving credit for anything of value against the balance owed by the tenant. Yes, value can be debated, so take pictures and give the property a “reasonable value”. Property can be sold or donated, but if donated give it to a charity, NOT an employee or friend. If two weeks have passed and the tenant asks for the return of their property, you must give it to them if you still have it.

3. Do I need to send a 45 day letter?

This is a question we still get frequently, and the law is very clear on this matter. You must send a 45 day letter if you have a security deposit from the tenant. You must! It’s a good practice to send the letter even without a security deposit. When a landlord fails to send the letter the landlord will not be able to recover damages or rent owed, and the tenant can recover from the landlord their security deposit and their attorney fees incurred if they hired an attorney to recover the security deposit! The 45 day letter must be in writing and sent to the last known address for the tenant. Yes, the last known address can be the apartment they vacated if they did not provide you with a new address. If and when you determine a new address for the tenant you must resend the 45 day letter! Include detailed charges for damages and rent owed and show how the deposit was applied. Many landlords rightfully fear their damages may get reduced if you go to court, but you still must not inflate the damage costs.

4. Tenant has filed bankruptcy, what can I do?

You cannot contact the tenant in anyway regarding back rent while the bankruptcy is pending. You cannot file or threaten eviction without permission from the bankruptcy court. You can ask the bankruptcy attorney for the tenants if they plan on staying at the property. If they do, you should attempt to get them to sign a new lease AND do an inspection of the property. A landlord cannot force them to sign the new lease. Inspection of the property is a good idea because any damage done before the bankruptcy cannot be pursued, but you can pursue damages or rent that occur after the bankruptcy was filed. After the tenant receives a discharge of their debts you can pursue rent and damages that were incurred or caused after the date the bankruptcy was filed. If the bankruptcy was dismissed you can pursue all rent and all damages owed. The bankruptcy discharge order also negates the lease so any terms of the lease such as late fees or attorney fees cannot be collected.

I have so many fond memories of the great networking events, making great friends and just enjoying the company of those in our apartment industry that it’s hard to select just a few memories to share, but here are a few that stand out in my mind:

Some of my fondest memories were the elaborate and funny skits that we used to do at the breakfast general membership (Bacon & Bits) meetings. Usually this was to promote some upcoming event like Casino Night or Educational functions.

* There was one skit where Ron Lucas was dressed as a ghost and he was chasing James “Buck” Buckhardt around the room. I think it was to promote the upcoming casino night with a spooky/scary theme that year.

* Another funny skit was when Rose Newman-Clevenger and I dressed up in very tacky and 70’s style clothes to promote a professional business attire fashion show that was being held later that month. I was dressed up like Herb Tarleck of WKRP with plaid coat & pants, white belt and white shoes. Rose was dressed up like a floozy, almost flapper style garb and we were up front saying how we heard there was a professional attire fashion show later and that we might want to check it out.

I also have fond memories of when the Association office was located in Stoney Creek Office Park. It was the first office space that we actually owned the building versus renting. This was a milestone for us since I remember that owning our own building gave our Association a sense of permanency and stability. We originally bought one suite and then purchased the adjacent suite next to it a couple years later to make into a maintenance training facility. I remember Scott Robinson, Linda Binford and I tearing out walls on a weekend to open up the two suites into one. It was a scene right out of “Fixer Upper” with Linda ordering Scott and myself around like Joanna Gaines does to her husband Chip. We had a great time playing demolition team and we were so excited to help make our dream of having our own maintenance training center. There was such a shortage of qualified maintenance technicians at the time and we hoped that this would enhance those skills already in the maintenance field as well as get more technicians to get into a maintenance career.

Discrimination in advertising is prohibited by the Fair Housing Act, but “advertising” doesn’t just apply to traditional advertising, such as newspaper and Internet ads. Social media communications are often considered advertisements. Here are 5 tips to ensure your social media complies with Fair Housing laws:

1) Train everyone in fair housing. Before being given access to your social media accounts, each person should complete fair housing training and acknowledge your company’s policies and procedures. Do the same for any agency or service that has access to your social media.

2) Show diversity in images. Consider all federal, state, and locally protected classes. For example, show males and females, people of different races, people with disabilities, a variety of ages, and families with and without children. Show

diversity when using avatars, animated characters, and illustrations, too.

3) Use welcoming language. Social media messages must not position your community as more or less suitable for someone based on membership in a protected class. Avoid things like racial or ethnic terms, references to religion, exclusions based on disability, and limitations based on familial status. A good rule of thumb is to describe the community, not the people.

4) Designate a point person to regularly review all social media posts. Reviews should look for words or images that discriminate, limit or deny equal access to your community based on membership in any federally, state or locally protected class. Also look for posts in which prospective or current residents indicate they feel they’ve been treated unfairly, don’t feel welcome in your community, feel they are being discouraged from living in your community.

5) Display the Equal Housing Opportunity Logo. Always show the Equal Housing Opportunity slogan, logo or statement on your social media pages and on your website.

Millennials and their Impact on Multifamily:

Doing Business Without Talking

Millennials generally expect a digital component to most experiences, whether it’s social planning, paying bills, dating, shopping or work. After all, few Millennials can remember a time before the Internet, and for most of their adult lives, they have only needed to reach into their pocket or purse to access it. But even though we call these pocket devices “smart phones,” for Millennials (and increasingly for older generations as well), the part of this device they use the least is the phone app.

By and large, Millennials don’t want to talk to people. It’s rare that I get a phone call from anyone under 40 years old, both in my personal and professional life,

unless that call was scheduled or they’re trying to sell me something. Today, Millennials want to use an app, a mobile website, texting, Snapchat, or any of a multitude of other means to communicate digitally. And who can blame them? You don’t get put on hold or find yourself trapped in a long, unproductive conversation. While waiting for the other party to respond, you can work on other tasks, and there’s typically a complete record of the conversation saved if you need to refer back to it. Texting is simply much more efficient.

What’s more, Millennials don’t necessarily need a physical place to have a connected community. For instance, my youngest son (post-millennial generation Z) is happy to stay in his bedroom and connect with his friends via his texting apps. No hours-long phone calls with the girlfriend, just a never-ending stream of snaps.

Tech over talk is the new norm, and this norm is making its way through commercial real estate. It’s starting with student housing, moving into traditional multifamily and eventually will change how commercial deals will be done.

Economic trends suggest that Millennials will put off home buying and remain renters for longer than previous generations, and, as renters, they expect much more than just high-quality Internet access and a gym on site. Features such as the ability to take a virtual tour of the apartment before signing a lease, online billing and electronic work requests are now expectations.

For example, according to a 2017 report from Zillow on consumer housing trends, 55 percent of Millennials want to submit rental applications online and one-third want to pay rent electronically. They don’t want to make a phone call or write a paper check to get things done, and organizations that stubbornly cling to the old way of doing things will suffer. According to that same Zillow report, Millennials expect a quick response to their digital inquiries: 73 percent say they expect a reply in a day or less, 35 percent will give up and go to the next option if they don’t hear back in that time frame. Multifamily operators must strive to service and engage Millennials digitally because they aren’t likely to stroll in to meet the team in the leasing office. If real estate companies aren’t set up to communicate efficiently using digital means, they will miss out completely on a large part of the available market.

But Millennials aren’t just reshaping multifamily real estate; they’re transforming corporate real estate, as well. Their expectation for a digital experience in their personal lives carries over into the professional sphere, and as they rise through the ranks of their employers, their preferences will come to define the table-stakes for desirable office space. In fact, on the deal side, we’re just starting to see accelerated technology adoption. And in smaller organizations like medical or a law offices, Millennials are likely to manage their business in a similar way to how they manage their home life. So, over time, as Millennials move into the management layer, they’re going to expect to get most real estate business done without needing to jump onto a conference call.

By and large, real estate has traditionally revolved around personal relationships. This aspect of the business will not change. However, the methods we use to create and maintain those relationships and the tools with which we do business are rapidly changing. Real estate companies that resist adopting a digital approach will find themselves left behind,

trying to talk to prospects, but finding that no one is listening.

National Night Out is an annual community-building campaign that promotes police-community partnerships and neighborhood camaraderie to make our neighborhoods safer, more caring places to live. National Night Out enhances the relationship between neighbors and law enforcement while bringing back a true sense of community. Furthermore, it provides a great opportunity to bring police and neighbors together under positive circumstances.

Millions of neighbors take part in National Night Out across thousands of communities from all fifty states, U.S. territories and military bases worldwide on the first Tuesday in August. Neighborhoods host block parties, festivals, parades, cookouts and various other community events with safety demonstrations, seminars, youth events, visits from emergency personnel, exhibits and much, much more.
