WSI Philosophy

Our stallion approval process is guided by our values:

1. WSI will approve a stallion only if the inspectors believe he has a very high probability of siring international showjumpers and/or eventing horses and/or dressage horses.

2. WSI will approve senior, middle-aged, and young stallions. Approving older, proven sires is important for a studbook and for its members, and especially those members who wish to sell their foals. But rapid genetic advancement can come only through the use of modern, young stallions bred to meet the demands of today’s sport requirements. So WSI is always on the look-out for superior young stallions and encourages their use.

3. WSI will disclose all data about a stallion to our members, including summaries of his health and radiographic examination results, to help breeders make the best choices for their mares. We believe transparency is very important.

4. Inspectors are governed by strict conflict of interest regulations published in WSI’s Rules. Inspectors may not inspect their own stallions; or stallions they have bred or previously owned; or stallions in whose sale or lease they have been involved in. And once an inspector has played a role in approving a stallion, he or she must stand back for five years from any commercial involvement with the stallion. (Sales and leases to IWNS are exempt.)

5. Horse welfare comes first with WSI. We expect stallions to be prepared for inspection in a sympathetic manner without training techniques designed to make the horse jump extravagantly or unnaturally. Stallions are subject to testing for prohibited substances. See WSI’s Rules for additional information.

Steps in the Approval Process

1. Complete a Stage 1 Stallion Inspection Application and send it to WSI along with a clean, clear copy of the stallion’s passport (registration page, marking chart, and extended pedigree). If your stallion is already Approved by a studbook that is a Full Member of the WBFSH he does not need to attend the Stage 1 inspection. In this case please contact WSI for a Stage 2 application.

2. Stage 1 inspections are held throughout the country in January, February, and March. The stallion will be seen in-hand and his loose movement and/or movement under saddle will be evaluated. You will be informed at the end of the Stage 1 inspection if your stallion has been selected for Stage 2. If you are not already a Member of WSI you need to join if your stallion is going to Stage 2.

3. Stallions invited to Stage 2 must have their DNA analysed to confirm their parentage (if not already done). They also must have a genomic profile created and have the DNA test done for genetic markers associated with osteochondrosis (DNA-OC test). There also is a clinical and radiographic examination at Troytown GreyAbbey Equine Hospital under the supervision of Michael Sadlier, Chairman of the WSI Veterinary Committee. Both examinations are focused on soundness for sport and breeding, and screening for moderately to highly heritable traits that WSI does not want to see consolidated in our population. Laboratory tests are also conducted for sexually-transmitted diseases. These tests and examinations may be done before or after Stage 2 / Stage 3 inspections - it is up to you.

4. Stage 2 is for stallions that progress from Stage 1 and for stallions already approved by a WBFSH member studbook. Stage 2 inspections will be conducted at the Millstreet Green Glens Arena in April during the CSI* Welcome Tour, 13 - 15 April. Depending on the age of the stallion and level of training and fitness he will be assessed loose-moving, loose-jumping, and/or jumping under saddle with your own rider. Young stallions (minimum age is two) do not have to be ridden. You will be informed at the end of the Stage 2 inspection if your stallion has been selected for Stage 3.

5. Stage 3 is for stallions that progress from Stage 2, and will be held on the next day. The stallions will perform similar activities as during the previous stage except stallions under saddle will be ridden by WSI’s test rider. The test rider will report his evaluation of the stallions to the inspectors.

6. Stage 4 is the best part: Notification that your stallion has been approved by WSI and now enjoys all the benefits and privileges that come with approval by Ireland’s only modern and progressive studbook that is a Full Member of the World Breeding Federation for Sport Horses. All you need to do for this stage is…Celebrate! (If your stallion has not had the parentage and health tests, and health and radiographic exams, performed yet this needs to be done before approval can be granted.)

7. Stage 5 is voluntary and no expectation will be placed on you to accept this invitation: Now that your stallion is a WSI Approved Stallion, following an additional review of his x-rays by the KWPN, he will be invited to do the KWPN Stallion Performance Test in Ermelo without having to go through the selection process in the Netherlands. No other European studbook can offer you this opportunity.

Inspection Teams

Stage 1 stallion inspections are done by the WSI Mare Inspection Committee, whose members are:

Inspection Preparation

Make sure your stallion is current with his flu and tetanus vaccinations and worm treatments. If he is not up to date take care of these things now, well before the Stage 2 and Stage 3 inspections at Millstreet.

Have a skilled farrier trim your stallion’s hooves but no sooner than a week or ten days before he is inspected.

Do not over-train your stallion. Young stallions should be given experience cantering down the loose-jumping chute so they are relaxed and moving forward. But do not jump them too often or they will become tired, bored, or unhappy with the pressure. Mind his mind as much as you mind his body.

Young stallions approved by WSI on the basis of their loose-movement and loose-jumping athleticism are required to attend an evaluation day in the period of January - March of their 4-year-old year so WSI and KWPN inspectors can assess their development and rideability. Inspectors hope to see a relaxed young stallion showing his natural athleticism as he moves and jumps under saddle.

4-, 5-, 6-, and 7-year-old WSI Approved Stallions are required to compete in two Dublin Qualifiers each year so WSI and KWPN inspectors can monitor their development in sport. If your stallion becomes sick or injured WSI will work with you to select alternative good shows to exhibit your stallion.

Stallions with progeny will have a sample of them inspected by WSI and KWPN inspectors. We do this to better understand what qualities your stallion transmits to his foals and what types of mares best suit him. You may select some foals to be assessed and others will be chosen randomly. Try to secure cooperation from owners of these progeny. Additional charges may apply for progeny evaluations.

General Terms & Conditions Genomic Breeding Values

Definitions

1. WSI: Irish Warmblood Studbook Ltd trading as Warmblood Studbook of Ireland in Ogonnelloe at 14 Carrowgar, further to be referred to as WSI.

2. Client: the natural person or legal entity, or company, who/which is the owner or party registered with WSI, of/for a stallion and with whom/which WSI has concluded an agreement, further to be referred to as the client.

3. Assignment: the assignment provided by the client to WSI to execute a DNA test of a stallion.

4. Agreement: the agreement reached by the client and WSI.

5. DNA test: an investigation into the hereditary constitution of a stallion for a specific characteristic on the basis of DNA material.

6. Genomic breeding value (GBV): the genomic breeding value provides a prediction of the potential of the stallion for a specific characteristic on the basis of a DNA test and other information. The GBV is expressed in a number with regard to the average of a group of WSI and KWNP horses. Stallions can be ranked according to potential for a specific characteristic on the basis of the GBV.

7. Reference population: a group of animals that serves as a frame of reference.

8. Reliability: the extent of the accuracy of the GBV. The reliability can vary from 0 to 100 percent.

9. Kinship: kinship between the horse to be tested and the reference population, calculated on the basis of at least four and a maximum of all available generations.

Applicability

10. These general terms and conditions apply to the calculation of genomic breeding values on the basis of DNA tests.

11. These general terms and conditions apply to the agreement between the client and WSI.

12. Only Members in Good Standing of WSI can enter into an agreement with WSI concerning the calculation of genomic breeding values on the basis of DNA tests.

13. The rules and regulations of WSI apply to the members.

14. Assignments provided to WSI exclusively engender an obligation to use best endeavours and not an obligation of result, unless it is otherwise evident from the agreement.

15. WSI also includes directors and employees of WSI and all persons working for it and on its behalf, who execute (parts of) the calculations or a DNA test, as instructed by WSI. WSI is responsible for the employees or persons engaged by it during the execution.

16. WSI has the right, without prior warning, to implement adjustments in these general terms and conditions for new assignments.

17. WSI has the right not to accept an assignment.

Objective

18. The objective of a genomic breeding value on the basis of a DNA test is to acquire (at a young age) a prediction of the potential of the stallion for specific characteristics.

Stallions

19. Stallions must be sufficiently closely related to the reference population used in the analysis.

20. It is preferable if the parentage of the horses is verified, or can be verified based on the data available at KWPN; this is possible if one or both of the parents already have a verified genotype that is known by KWPN.

21. New verification of parentage is not a standard part of this assignment.

22. If the client requires new verification of parentage an additional assignment must be provided for this purpose.

DNA sample

23. DNA samples will be collected in the form of hair (or blood) for the purpose of the calculation of the genomic breeding values on the basis of the DNA tests.

24. On request of the client, a DNA sample or genotype from the WSI or KWPN archive can be used, provided that this is held in stock. If this is not held in stock a hair sample will be taken by a WSI official or a veterinary surgeon. The client can personally provide a DNA sample to WSI, however this is exclusively with prior permission from WSI.

25. The DNA sample must meet the quality standards to be set out by KWPN.

Risk

26. WSI and KWPN endeavour to ensure that the completeness, accuracy and up-to-dateness of the data made available to the client are as great as possible. KWPN takes measures for this purpose with regard to the entering and processing of data and quality control of data and databases.

27. The client is aware of the fact that the genomic breeding value for a specific characteristic of the stallion can be estimated as lower than the client had previously thought or expected, and the client knows that the value of the stallion may decrease following this and the client accepts this risk.

28. The client knows that a prediction of the potential of an animal can in general contain estimation errors. Therefore, the reliability of the genomic breeding value is provided in addition to the genomic breeding value itself.

29. In the animal breeding sector, including horse breeding, reliabilities of (genomic) breeding values of 30% (useable) up to 80% (high) are normal and accepted.

30. It can occur in exceptional cases that no useable result can be acquired. In that case no result can be provided to the client. It will be decided in

consultation with the client whether a new investigation will be conducted.

Ownership

31. The material that is collected and saved for the purpose of a DNA test will be the property of the KWPN, the owner of the DNA test.

32. The data that are acquired and collected in the context of the DNA test is the property of and will be managed by the KWPN to advance the development of WSI and KWPN.

33. The client will receive, for personal use, the genomic breeding value and the accompanying reliability for a specific characteristic of the individual stallion concerned.

34. The client provides permission to WSI and the KWPN to record the acquired data in the horse register and to use this data in accordance with the objective of WSI under its rules and regulations and the KWPN under its articles of association, including the use for breeding, journalistic, historical, statistical, informational, and scientific purposes.

35. The data that is recorded during the execution of the DNA test will remain linked to the individual stallion. This data will be managed and used by WSI and the KWPN for various breeding purposes, including breeding value estimate(s) and selection of stallions.

36. All intellectual property rights to all material, data and databases, or knowledge and methods under development, or developed, pursuant to this agreement or otherwise, are exclusively vested in the KWPN.

Quality assurance

37. The objective of the quality assurance is to establish whether the collected samples and data sufficiently meet the quality requirements so as to be recognised.

38. WSI and the KWPN have the option to inspect (have inspected) the parentage in the context of the quality assurance.

39. A new DNA sample must be collected if the collected DNA does not meet the quality requirements.

Publication

41. It ensues from the objectives of WSI and the KWPN that for the purpose of and related to the breeding, all stallion data with the accompanying personal and company data can be provided and published, unless determined otherwise.

42. The genomic breeding values of approved and acknowledged stallions will be published so that the breeders can use this information when choosing a partner. The client provides express permission for this purpose to WSI and the KWPN by means of the assignment.

43. The genomic breeding values of mares and non-approved/non-acknowledged stallions are digitally accessible for the owner/registered party in MyWSI and/or MyKWPN and will be exclusively published after receipt of permission in writing from the client.

44. Publication can take place through the internet and/or in printed form.

Complaints

45. WSI will fulfil its obligations with the required due care and expertise.

46. Complaints from the client regarding the manner in which WSI fulfils its obligations must be reported promptly after noticing, in writing, to WSI.

47. In the event of a complaint WSI will assess the complaint and if WSI finds the complaint justified WSI can either proceed with a new execution of the DNA test or with payment of compensation, except for when this liability is excluded: see liability.

48. The processing of a complaint does not suspend the payment obligation of the client.

49. WSI can request that an independent third party investigates the level of any damage.

50. If requested the client will make all information, that WSI or the third party to be appointed by WSI requires for the establishing of any damage, available to WSI or to the third party referred to, all this subject to forfeiture of the right to complain of the client.

51. Complaints regarding the mode of action of officials of WSI and KWPN fall under the appeals procedure

in the WSI and KWPN rules and regulations, respectively.

Exclusion and limitation of liability of WSI

52. WSI and KWPN can only be held liable for an attributable failure after WSI and KWPN have been given notice of default promptly, properly, and in a detailed manner concerning this. The latter includes inter alia a reasonable period in which to still be able to fulfil the obligation. KWPN cannot be held liable for an attributable failure of WSI, and vice versa.

53. WSI and KWPN will not be liable for damage caused by the result of the DNA test and breeding value estimate.

Payment

54. All prices are in Euro and exclude VAT unless stated otherwise.

55. WSI retains the right to change the prices and rates.

56. Payment must be made to WSI’s bank account via bank transfer or credit/debit card payment without any deduction or setoff. Credit/debit card payments incur an additional five percent (5%) surcharge (€8).

57. The costs must be paid in advance (unless agreed otherwise) within the payment term set out without any reduction or setoff.

58. Legislative changes to the VAT rate will be charged on to the client.

59. The costs of the verification of parentage will be charged additionally.

Disputes and applicable law

60. The legal relationships between WSI and the client are exclusively governed by Dutch law, reflecting the fact that KWPN owns the intellectual property underpinning the test.

Force majeure

61. WSI will not be bound to the fulfilment of any obligation if this is not reasonably possible for WSI resulting from changes arisen, through no fault of WSI, in the circumstances existing at the entering into of the agreement.

62. A failure on the part of WSI will not be at its expense and risk if this is the result of an infectious illness or government interventions.

Other

63. The processing time depends on the delivery period of the DNA test and the capacity of the laboratory and the calculation time of the breeding values. The processing time can vary from a few weeks to several months.

GENOMIC BREEDING VALUE CONTRACT

The undersigned assigns the Warmblood Studbook of Ireland (WSI) to engage the KWPN to perform the DNA-OC test and estimate the genomic breeding value of the following stallion(s):

By submitting this Membership Application and paying membership dues I certify that I agree with the goals, objectives, standards, and breeding strategies of WSI. I agree to be bound by WSI’s Rules and Procedures (available for download at www.irish-warmblood.com). I permit WSI to use DNA from my horses to create genomic profiles and conduct tests using the profiles. I permit WSI to collect, store, analyze, publish, and disseminate aggregated data and test results about my mares and foals, and individual data and test results about my Approved Stallions, to advance our goal of helping members breed international showjumping, eventing, and dressage horses. I permit WSI to publish in print and on the internet my name and address. I permit WSI to share my name, address, telephone number, and email address with individuals who seek to contact me regarding my horses, unless I instruct WSI otherwise in writing. Annual membership fee is invoiced in November each year for the following calendar year. Individuals who join after January will pay a pro-rated membership fee based on the number of months remaining in the calendar year.

Terms and Conditions of Application and Process for Inspection of Stallions by the Warmblood Studbook of Ireland.

The following are the terms and conditions of the agreement between Irish Warmblood Studbook Limited – Company Number 465817 hereinafter referred to as “WSI”, and the horse/equine owner and his, her or its employees, invitees, accomplices, servants or agents hereafter collectively referred to as the “the owner” If you do not agree to these terms, you will not be able to the below referred to inspection or inspection process and/or assessment or assessment process. 1. INTRODUCTION The owner agrees to the terms and conditions outlined in this agreement. The owner has applied to WSI for admission of his, her or its equine into the Warmblood Studbook of Ireland and/or for professional assessment of the various qualities of his, her or its equine. WSI administers various inspections and assessments held on pre-published inspections dates at various equestrian centers owned, operated and managed by third parties, throughout the Republic of Ireland. This Contract constitutes the entire and only agreement between WSI and the owner, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract 2. REPRESENTATION AND WARRANTY The owner represents and warrants that he, she or it is both the equitable and registered owner of the equine the subject of this application. The owner hereby further represents and warrants that any equine that he, she or it presents provides and/or submits for assessment or inspection or admission to WSI and its studbook is properly and fully trained, is suitably well-handed for inspection purposes, and, is capable of being handled in a safe manner and is not a danger or is not reasonably likely to cause danger or damage to any other equine or person or property. Furthermore, the owner hereby further represents and warrants that it will at all times during the inspection process take, assume, ensure, and oversee full control and care of any equine in its ownership, that is presented and provided for assessment or inspection or admission to the Warmblood Studbook of Ireland. 3. RIGHT TO REFUSE WSI reserves the right in its sole discretion to refuse admission at any time to the inspection process. 4. INDEMNIFICATION The owner hereby agrees to indemnify, defend, and hold WSI and any of its affiliates, licensors, suppliers, associates, collaborators and its employees, servants and agents, and any of the third party equestrian premises owners and operators as above referred to, harmless from any direct or indirect, liability, loss or losses, claim, action or damage, arising from any injury or damage to a person, an equine, or property or any liability, or any special, incidental or consequential loss or losses, claim, damage arising directly or indirectly from any accidental death, and expense, including reasonable legal fees, related to the above. “Liabilities” for the purposes of this agreement, means liabilities, costs, charges and expenses, consequential or otherwise (including all liabilities for judgments, fines, penalties, amounts paid in settlement, legal fees and expenses), that the Individual suffers or incurs resulting from, any proposed or actual action, suit or other proceeding in which the Individual is or may become involved; any order

made or judgment awarded against the Individual, or any investigation or proceeding involving the Individual by any court, administrative or quasi-judicial official body, agency or tribunal. !"# $%&'()%*+,## WSI and any of its affiliates, licensors, suppliers, associates, collaborators and its employees, servants and agents, hereby disclaims and sets forth that WSI and any of its affiliates, licensors, suppliers, associates, collaborators and its employees, servants and agents are not and will not be liable for any direct or indirect, special, incidental, or consequential damages or losses, liability, loss or losses, claim, action damage, arising from any injury or damage to a person, an equine or property or any liability, or any special, incidental or consequential loss or losses, claim, damage arising directly or indirectly from any accidental death, whether any of the aforementioned is based on breach of contract, tort, or arising from legislation or under the common law. -"# )(.+,/).%0+#$%&12.+#,+&3(2.%3/

If any disagreements arise, the Parties will use their best efforts to negotiate to resolve all differences. The collaboration of Parties and their researchers is paramount. However if the dispute cannot be settled through inter-party negotiations, the Parties agree first to try in good faith to settle the dispute by mediation before resorting to any other dispute resolution procedure. The Parties agree to appoint an Independent Mediator to convene the mediation. The fees for mediation will be borne equally by the Parties. Should the parties fail to agree to resolve such dispute by Mediation then the parties agree to Arbitration as the second dispute resolution mechanism and before any other remaining dispute resolution options are decided upon.

4"# 530+,/%/5#()6## This agreement shall be governed by and construed, and interpreted and enforced in accordance with the laws of the Republic of Ireland, and the Courts of the Republic of Ireland shall have exclusive jurisdiction in relation to any dispute that requires to be litigated arising from this agreement. 1. I attest that the above-named horse is in a fit state to be presented for assessment or inspection

and is or will be sufficiently trained. A competent handler will at all times be present with the horse and the horse will be under his or her care and control at all times.

2. All the owners of the horse agree to indemnify WSI, KWPN, the venue owners, and their

employees and agents on demand in full against any loss, claim or damage before, during, or after the assessment sustained or perpetrated by any person, goods, or horses.

3. By submitting this Assessment Application I agree to be bound by the rules and procedures of the

Warmblood Studbook of Ireland. I permit the Studbook to collect, store, analyze, publish, and disseminate data about me and my horses; and to videotape and publish videotape on the internet.
