2017 Edmondson Village Farmers Market

Rules and Regulations

Applications for the 2017 season can be accessed online here and will be accepted until the market is full for the season. A waiting list will be maintained in the event that a space opens during the season. All applications will be reviewed by the Edmondson Village Farmers Market Advisory Committee.

I. ELIGIBILITY REQUIREMENTS: Producer Only: Edmondson Village Farmers Market (EVFM) is a producer only market. Vendors must grow, produce, or make the fruits, vegetables, plants, herbs, flowers, baked goods, prepared beverages, jellies, jams, honey, prepared foods, handicrafts and/or other products they intend to sell at the EVFM. Vendor’s Location: All vendors must be headquartered in the Chesapeake Bay Watershed. Applications Preference will be given to vendors in the Baltimore Metropolitan area.

Debit/Credit/SNAP Card Service Program: The EVFM implements a SNAP (Supplemental Nutrition Assistance Program) Debit and Credit Service Program to offer fresh fruits and vegetables to low-income families who are on SNAP (formerly food stamps) and credit and debit services to all customers.

For consistency in the program and clarity for the market customer, we require that all vendors that sell food that can be purchased with SNAP benefits participate in the program

All vendors must agree to accept EVFM-issued $5 (credit/debit) tokens. All vendors must read and agree to the separate EVFM Vendor Agreement for Debit/Credit/SNAP Card Service Program

Specific requirements by vendor category Farmers

Goods must be grown or produced on their farm or garden – or a partnering farm or garden. Goods include, fruits, vegetables, plants, herbs, jellies, jams, honey, meat, poultry, eggs, dairy, and, other biological non-produce items such as flowers.

Produce should be mature but not overripe and must be free of contaminants. All goods must be of fresh quality, insect-free, and have no residue such as dirt or mud that cannot be removed by normal washing. Produce of lesser quality for use in preserving, canning or jam making may be sold if clearly labeled as such.

Bakers and other value-added producers (jams, salsas, fruit butters)

Goods must be produced from scratch, by the vendor, their direct family members or employees -- using locally sourced ingredients when possible. Bakers may accept $1 tokens only for food items intended for home consumption.

Artisans

Goods must be the design of the vendor and produced by the artisan, their direct family members or employees. Goods should be handmade and reflect the excellence and the unique vision of its maker. Work assembled (wholly or in part) from commercially available kits, or goods made up of embellished commercially-made objects (e.g., T-shirts, notecards, etc.) are not accepted.

Foods must be produced from scratch, by the vendor, their direct family members or employees -- using locally sourced ingredients when possible. These items must be prepared in a licensed commercial kitchen or food cart. Prepared food vendors are required to show evidence of Health Permit prior to being allowed to participate in the EVFM

II. GENERAL RULES:

A. Definition of a Vendor: A person who has completed an application, agreed to the market guidelines and been accepted for participation in EVFM. A “vendor” is the grower or producer of products sold, and includes family members or employees of the applicant listed on the application.

B. Permitted Items for Sale: Vendors may only sell items listed in their vendor application. All processed/cured/baked items, including preserves, honey, cheese and meat, must be properly labeled to clearly identify processor, grower or producer and ingredients

C. Permits and Insurance: All vendors must comply with any applicable sanitary rules and regulations of the Baltimore City Health Department. Vendors are responsible for obtaining and paying for all required permits. Call the Baltimore City Health Department at (410) 396-4398 for more information.

The EVFM does not provide insurance to the participants in the market. It is recommended that each vendor obtain his/her own insurance

Vendor should have all applicable license, permits, certificates and insurance documentation on hand at the market.

D. Regular Participation in Market: It is important that we as a team behave professionally, always show up with our A-game, and leave a positive feeling with customers and the community. Every Saturday we are a team; if one fails we all fail.

To foster consistent vendor attendance and develop a consistent customer base early in the season, we request that all 2017 vendors be present at market -without absence - during the first four weeks of the season.

After the fourth week, market absences must be approved by the EVFM Market Manager. Please contact the Market Manager if you are a regular vendor and are not able to attend market on any given day. More than three consecutive unexplained absences will constitute abandonment of booth space. No refunds.

Vendors may participate on an occasional basis with advance permission from the Market

Manager.

The EVFM reserves the right to adjust the time of operations if the city requires the market space for a civic/special event.

E. Adhering to Market Hours: We are open to the public from 9 am to 1 pm each Saturday – rain or shine

All vendors MUST be unloaded, set up, and ready to sell by 8:45 am. Vendor vehicles must also be parked in the designated vendor parking area. No vehicles will be allowed in the market area after 8:45 am. Vendors may not leave early unless approved by the Market Manager.

LATE ARRIVALS – vendors who are not set up by 8:45 may lose their regular spot for that day. They will also be required to hand carry their booth and goods into the market area.

-First offense will result in an oral warning

-Second offense will result in a written warning

-Third and further offenses can result, at the Market Manager’s discretion, a $10 penalty per lateness.

F. Inclement Weather: The EVFM is open rain or shine. To maintain a viable market, it is important that each vendor has a consistent and strong presence each and every week, and all vendors are expected to attend -- even in poor or rainy weather.

However, on market days where weather reports call for severe inclement weather, such as high winds, severe thunderstorm, tornado warning, etc. vendors may opt to not participate. Vendors must notify the EVFM market manager of their decision as soon as possible.

On days where there is a call for severe inclement weather, EVFM management reserves the right to cancel the market for the safety of the vendors and customers. The EVFM market management will notify vendors of the closure as soon as possible by telephone and/or email where possible.

G. Booth Requirements: The Market Manager will assign a space to each vendor given what the manager determines the best layout. Vendors must occupy only the space assigned unless otherwise directed by the Market Manager.

EVFM does not supply vendors with equipment. Each vendor will be responsible for providing canopies, tents, tables, weights, tablecloths, certified scales, signs, containers, chairs, and change as needed.

All vendors must operate under a tent. Each vendor occupying a 10’x10’ or larger space must

use a sturdy tent that is properly secured for windy conditions.

Signage: Vendors must clearly display signs that show the name of their business, products, prices, and their enrollment in any Federal nutrition assistance programs. Prices must be legible and visible for customers to see. Prices of items for sale must utilize one or more of the following techniques:

• Individual price stickers on each item • Individual price signs for each type of item • A list of prices on a large sign or board

Every effort is made to minimize market vendor movement, but space adjustments can be made at the discretion of EVFM management, if deemed necessary.

Vendors must park their vehicles in the area designated by the Market Manager.

All vendors are to maintain the cleanliness of their area during market hours including public walkways in front of their space(s) and remove all trash at the completion of each market day.

Electrical Outlets: There is no vendor access to electricity at the EVFM. Generators are permitted for use only with prior EVFM management approval. If extension cords are used, they must be safely secured and out of the way of consumer foot traffic. Check with EVFM management to ensure that you are using an approved outdoor cord.

H. Cooperative Marketing: Vendors are permitted to share space with another EVFM vendor or sell another vendor’s product if EVFM management deems the arrangement beneficial to the market Such cooperative market arrangements MUST be pre-approved by EVFM management before they are implemented. The only products that will be considered for sale under cooperative market arrangements are those that are not currently being sold by existing vendors in the EVFM. Products must be clearly labeled with the business name and location.

I. Media Communications, Marketing, and Advertising: The EVFM is on public property and is sometimes the subject of articles by media, and bloggers. It is reasonable for each vendor to expect that he/she may be photographed our interviewed at some point over a market season.

Additionally, EVFM works hard to promote the market and each individual vendor. Each regular vendor will be given a page on the EVFM website (edmondsonvillagefarmersmarket.com) and included in ongoing marketing, advertising, and media outreach intended to promote the market. Each vendor will be asked to provide image files: should provide several images– of their logo, some product image, or a personal snapshot,

advertising, and media outreach.

If a vendor does communicate with the public/media, he or she is required to inform EVFM personnel immediately, so that appropriate personnel can be informed and prepared to take any follow-up action to benefit the market.

J. Fees: EVFM is dedicated to the support of our vendors. We do all that we can to make participating in the market economically feasible for new and small farmers and other vendors.

We offer two vender tiers and three payment options:

Payment: Payment must be made by cash or check. Checks should be made payable to the Edmondson Village Community Health Alliance. They can given to the Market Manager or mailed to:

Rebate: To demonstrate our appreciation to the vendors who show up consistently and professionally, we offer a seasonal rebate of $50.

To qualify for the rebate, vendors must make a seasonal payment and must attend 16 of the 18 scheduled market days. Each of the two absences must have been communicated to the Market Manager at least three days in advance. Rebates will be paid on the last day of the 2017 market season, September 30, 2017

Hardship Waiver: A limited number of barter spots are available. For 2017, EVFM is providing two of these. The exchange must benefit the market as whole – as determined by the EVFM Advisory Committee. Weekly market labor will not be considered. Any vendor is eligible to apply. Interested vendors should send an email to [email protected] . These will be awarded on a first-come basis.

K. Participation in Gleaning Program

EVFM participates in a “gleaning” program that makes it easy for vendors to donate fresh, useable produce and other food products that have not been sold at the end of the market. Participation is voluntary but encouraged.

L. Decorum: Products shall be attractively displayed. Business shall be conducted in an orderly and businesslike manner; no shouting or other objectionable means of soliciting trade will be tolerated. No distress pricing will be allowed. No waste water or oil are to be placed/dumped in the parking lot, all waste must be removed from the site by the vendor.

No live animals, pets or otherwise are permitted, except by special arrangement with market management.

The following are banned:

• Alcoholic beverage consumption at the EVFM

• Smoking at the EVFM • Hosting raffles, selling tickets, etc. (except by and for the EVFM)

The selling, distribution, or possession of drugs or drug paraphernalia is prohibited and will be grounds for immediate and permanent expulsion from the market.

III. VIOLATIONS

A. Any complaints against a vendor are the responsibility of the EVFM advisory council and will be investigated.

B. When the EVFM determines, in its sole discretion, that a vendor has violated any provision of these guidelines, it will issue a warning. If the vendor fails to comply by the next market day, it will result in termination of this agreement and the vendor may no longer sell at the market. If a vendor is terminated by EVFM from the market for violation of the 2017 Guidelines, there are no refunds on the space fee and submission of application for the following year may be disqualified.

IV. HOLD HARMLESS CLAUSE AND INSURANCE

Each authorized vendor participating in the Farmers Market shall be individually responsible to the EVFM and Baltimore City Public School System for any loss, personal injury, deaths, and/or any other damage to persons or property that may occur as a result of the vendor's acts or omissions or that of its servants, agents, and employees, and each vendor hereby agrees to indemnify and hold the EVFM and Baltimore City Public School System harmless from any loss, cost, damages, and other expenses, including reasonable attorney's fees, suffered or incurred by the EVFM and/or the Baltimore City Public School System by reason of the vendor's acts or omissions or that of its servants, agents and employees; provided that the vendor shall not be responsible nor required to indemnify the employees.

The EVFM does not provide insurance to the participants of the Edmondson Village Farmers Market. It is recommended that each vendor obtain his/her own insurance.

V. MODIFICATIONS The EVFM reserves the right to revise guidelines at any time as deemed appropriate. Revisions will be posted on edmondsonvillagefarmersmarket,com and shared with vendors.
