  • SITE INSPECTION REPORT BY THE REGIONAL OFFICE (WCZ) NAGPUR FOR PROPOSALINVOLVING DIVERSION OF 141.99 HA OF FOREST LAND IN FAVOUR OF M/S ADANI POWERMAHARASHTRA FOR SETTING UP ASH UTILIZATION, PROMOTION, AND RESEARCH PARKFACILITIES AT VILLAGE KACHEWANI AND MENDIPUR IN TIRODA TEHSIL OF GONDIADISTRICT IN THE STATE OF MAHARASHTRA.

    1. Legal status of the forest land proposed for diversion.Legal status of the land proposed for diversion is Protected Forests and Zudupi Jungle land. Thearea proposed for diversion comprised of two blocks viz. Kachewani and Mendipur blockscomprising of 117.040 ha and 0.890 ha of Zudupi Jungle land in Kachewani and Mendipur blocks,respectively and 24.060 ha of Protected Forests land in Mendipur Block. The area proposed fordiversion constitutes the part of Afforestation work circle of the Gondia Forest Division.

    2. Item-wise break-up details of the forest land proposed for diversion.

    In addition to above, an area of 5.1 ha of non-forest land has also been proposed to be acquiredunder the project. The non-forest land of 5.1 ha has been proposed to be kept under green beltdevelopment.

  • It was also observed that two patches of 4.51 ha and 0.81 ha of forest land are sandwiched betweenthe area proposed for diversion. An area of 0.81 earmarked for graveyard of village Mendipur islocated in between the area of 24.93 ha proposed for diversion. Similarly, an area of 4.51 ha of localpond, stated to be under no use except local wild animals and dries up in summer season, is alsosandwiched between the Zudupi Jungle area of 117.040 ha in Kachewani village. These twopatches involving an area of 5.32 ha have been excluded from the current proposal. Therepresentative of the User Agency have informed that area of 4.51 ha (proposed to be developed aswater body as it is in its natural state) was earlier proposed to be the part of their diversion proposal,however subsequently on the stance of District Administrative authorities the same has beenexcluded from the proposal. It was also informed by the representative of the User Agency that areaof 0.81 ha earmarked for graveyard has also been excluded from the proposal and necessaryprovisions to provide access by way of approach road to the graveyards to the villagers have beenmade in their project.Further with regards to requirement of 46.85 ha of forest land earmarked for raw material storageyard facility, the User Agency informed that ash, collected in the hoppers of ESP will bepneumatically conveyed to the proposed Ash Park where ash will be classified through AshClassifiers into different sizes, as the properties and usage of ash are largely dependent on theparticle size of the ash. Based on such size based classification on ash, four to five grades of ashwill be obtained which need to be stored separately in the raw material storage area. This hasincreased the area requirement for storage and their battery limits to about 46.85 ha. The UserAgency has also informed that requirement of area under this component will further be optimized touse upto 40 ha of forest land for the purpose while the remaining area will be utilized in developmentof green belt in the storage yard facility.

    3. Whether proposal involves any construction of buildings (including residential) or not. If yes,details thereof.Yes as per details given under para 2 above. As per the provision of the Para 4.2 (ii) of theGuidelines wherein inter-alia it is stated that diversion of forest land for construction of otherbuildings also will not be normally considered. In the instant case also the construction of buildingshas been proposed over 3.0 ha and 0.50 ha of forest land for Research Institute for Fly AshUtilization Programme and Central Laboratory, respectively. The User Agency has been advised toshift the construction of buildings to the non-forest land of 5.1 ha which has been proposed to bekept under the green belt. The User Agency has expressed its consent to shift the aforementionedactivities to the non-forest land and optimize the land requirement accordingly. The User Agencyhas also been advised to develop and maintain the forest area earmarked for construction ofbuildings as green belt.

    4. Total cost of the project at present rates.Total cost of project is Rs. 100/- Crore

    5. WildlifeWhether forest area proposed for diversion is important from wildlife point of view or not.

    The representative from the Forest Department has informed that area proposed for diversiondoes not fa" in the buffer zone/eco-sensitive zone of the PAs. It was also informed that areaproposed for diversion falls at an aerial distance of around 6.8 km from the Nagzira WildlifeSanctuary (outside the notified Eco-sensitive zone of the Sanctuary) and it does not form the partof Nagzira Navegaon Tiger ReservelWildlife Corridor. It is also reported that project of the UserAgency is located outside the buffer zone of Navegaon Nagzira Tiger Reserve and Notified Eco-

  • sensitive Zone area Nagzira Wildlife Sanctuary, New Nagzira Wildlife Sanctuary, Koka WildlifeSanctuary, Navegaaon Wildlife Sanctuary and Navegaon national Park.

    The representative from the State Forest Department has informed that no significant wildlife isfound in the area. Common species found in the area include monkey, common hare, hyena, wildboar, deer, etc. However, DCF, Gondia has mentioned that a Wildlife Conservation Plan need tobe prepared in line with Plan already prepared to mitigate the impact on the Wildlife Corridor thatare located in the area.

    6. Vegetation:·The density of the area proposed for diversion ranges between 0.2 to 0.3 i.e. density of forest inZudupi Jungle land in Kachewani has been reported to be 0.3 while density of the PF in Medipurvillage is 0.2. Important species found in the area include Pferocarpus marsupium, Terminaliatomentosa, T. Bel/erica, Tectona grandis, Azadirachta indica, Acacia catechu, Syzizium cumuni,Albizzia lebbeck, Diospyros melanoxylon, and other miscellaneous species.i. Total number of trees to be felled· 1408

    Above 60 cm girth - 106 treesBelow 60 cm girth - 1302 trees

    ii. Effect of removal of trees on the general ecosystem in the area.The representatives of the User Agency have informed that entire trees in the areaproposed for diversion will not be felled. Trees (193) located in Protected Forest land inMendipur village will be kept intact as the area will be used as research plot for exploringthe forestry application of fly ash utilization. Similarly, entire trees (1215) standing in thezudupi jungle land will be required to be felled as an area of 44.80 ha in Kachewani villagewill be developed as green belt. In addition to this, it was also informed that most of thetrees from the remaining area will be kept intact. Bare minimum felling of trees will beundertaken by the User Agency. Keeping in view the aforementioned facts and poor densityof the forest area proposed for diversion, the measure proposed by the User Agency forstocking of certain area with afforestation measures will compensate ecological impacts ofthe removal of the trees from the area. The representative has also informed that out of thetotal trees enumerated in the area, felling will be restricted to 25% to 30% trees only whilethe rest of the trees will be kept intact and will be utilized in the development of green belt.It is also observed that a local perennial nallah traverses the Protected Forests proposed fordiversion in Mendipur village. The said nallah, with good volume of water, originates fromthe nearby Zudupi Jungle land proposed for diversion in Kachewani village. The officials ofthe State Forest Department have informed that course of the Nallah was earlier diverted (inthe section connecting the Kachewani Zudupi Junge to PF of Mendipur village) during theconstruction of Ash Dyke Pond of the User Agency. Water quality of the local nallah wasobserved to 'be in good conditions as the same is inhabited by the fauna (fish) and supportsluxuriant shrubs growth (Acorus calamus) all along its bank. The representatives from theUser Agency have informed that said nallah will be kept intact and no alteration or diversionin the water course of the said nallah will be undertaken as the PF area has been proposedto be kept intact under the research plot for exploring the forestry application of the fly ash.The User Agency has been advised to monitor the water quality of the nallah at regularintervals to assess the impact, if any, on the water quality from their proposed and existingfacilities.

  • 7. Background note on the proposal.Ash utilization is one of the biggest challenge being faced by the Power Sector in the country. Totalinstalled capacity of coal based thermal power in the country is about 186 GW, which is about 72%of India's power generation capacity of 303 GW. In coming decades, thermal generation capacity inIndia will increase Significantly. Even in the least scenario, it is expected that installed thermalgeneration capacity will go up to 290 GW in 2047. Fly ash generation was 172.87 MT in 2014, andlikely to increase to 221 MT by 2017. Current levels of efforts of ash utilization have resulted inachieving just 58% by year ending 2015 and India is nowhere near its target of utilising 100% of flyash generated by the coal based power plants.Adani Power Limited has already established 10,440 MW of coal based Thermal Power Plants inthe country and aims for generating 20,000 MW of power by 2020. Adani Power MaharashtraLimited (APML) is a subsidiary company of Adani Power Limited. The company has established acoal based Thermal Power Plant of 3300 (5x660) MW capacity at MIDC, Tiroda, Gondia district.Ash production from their Thermal Power Plant is approximately 4 Million Tonnes and out of thetotal Ash generated of 4 million tonnes, so far the User Agency, utilizing available technolgies, canutilize only 50% of the total fly ash generated from there thermal plant. The User Agency has alsosetup small agricultural research plot in their premises where growth/production of agricultural cropis being tested using a mixture if manure with fly ash. Similarly, the experiments for preparation ofthe vermicompost using fly ash have also been setup on pilot basis in the premises of the UserAgency.The present proposal is for developing an Ash Utilization Promotion and Research Park, whichinvolves diversion of 141.99 ha of forest land for non-forestry purposes. The park will be a centre ofexcellence for fly ahs utilization, promotion and research, not only for the User Agency, but also todevice the methods for effective utilization of fly ash generated by the thermal power sector of thecountry.The proposal is to develop a centralized Ash Utilization Promotion and Research Park at TirodaThermal Power Plant as a central facility for Adani Group Power Plants and a demonstration centrefor the country. The proposed park will have an integrated facility for research in fly ash utilizationfor development of new technologies and utilization avenues. The technologies such developed willundergo pilot scale trials. The successful technologies will be tried at full plant scale and will bedemonstrated for its adaptation elsewhere in the country.

    Justification for locating the project in the forest area

    As per the provisions contained in the Para 2.1 (vii) (3) of the Guidelines issued under the Forest(Conservation) Act, 1980 in respect of proposal involving diversion of forest land for non-sitespecific activity, it is inter-alia stated that normally, there should not be any justification for locatingnon site-specific projects on forest land. Therefore, the State Government should scrutinize thealternatives in more details and must give complete justification establishing its inescapabi/ity forlocating the project in forest area. With regards to the justification for locating the project in theforest area and alternative explored following was revealed during the inspection and interactionswith the officials of the User Agency and the State Forest Department:The representatives of the User Agency have informed that transportation of fly ash from theirthermal power plant to the location of its proposed utilization can be transported using pneumaticconveying technology. Pneumatic conveying is the preferred transport which has the capability tocontain the fly ash and other hazardous material preventing Significant dust generation andassociated pollution. It has been also informed by the User Agency that proposed facility needs tobe located close to the Thermal Power Plant for pneumatic transfer of fly ash in environmentfriendly manner as the said technology is effective for transportation upto a maximum distance of 5

  • kms. It was further informed that within a radius of 5 km from the existing plant of the User Agencyno other suitable land is available for the proposed facility.With regards to alternative sites, the officials from the State Forest Department have informed thatlocation of their Thermal Power Plant is such that it is limited by State Highway 249 and habitationthereafter on the northern side, Eco Sensitive Zone of Nagzira Wildlife Sanctuary on the southernside, and by Tiroda town and villages on the western side. Therefore, proposed facility has beenproposed towards the eastern side of their Thermal Power Plant. The land proposed for diversionis adjacent/contiguous to the Thermal Power Plant and given the aforementioned facts andlimitation so the pneumatic technology, the land proposed land has been reported to best suited forthe proposed research and development facility.It is also informed by the User Agency that with a view to develop the facility for fly ash utilization, apre feasibility study was assigned to the Center for Fly Ash Research and Management (C-FARM),New Delhi and based on the feasibility report and available technology for ash utilization, the C-FARM has selected the proposed site for the development of proposed facility.The authorities in the State Government and the State Forest Department have submittedand affirmed the fact that such facilities needs to be located in the close proximity of theThermal Power Plant for pneumatic transfer of fly ash in environment friendly matter.

    S. Compensatory afforestation:Compensatory afforestation land has been proposed over an area of 172.57 ha of non-forestland in Chiplun Forest Division in Ratnagiri District in the State of Maharashtra. In addition to CAland proposed to be handed over to the State Forest Department, an equivalent area ofdegraded forest land has been proposed for afforestation as the non-forest land has goodvegetation density.

    i. Whether land for compensatory afforestation is suitable from plantation andmanagementpoint of view or not.

    As per the certificate of the DFO, Chiplun, the land identified for raising CA is contiguous tothe forest land and is suitable for management view point and is free from encroachment andother encumbrances. The DFO has also certified that afforestation over the said land cannotbe taken as the land has already vegetation. The DFO, Chiplun has also mentioned that landproposed for CA can be taken over by the State Forest Department as the same is located inthe Eco-sensitive zone of Koyna Wildlife Sanctuary.The DCF, Chiplun has also certified that land identified for CA has not been included in thecategory of areas identified as forests by the expert Committee appointed under theJudgement of Hon'ble Supreme Court, not acquired under the provisions of the MaharashtraPrivate Forest (Acquisition) Act. 1975 by virtue of Section 35 of the Indian Forest Act. 1927and is not recognized as deemed forest.

    ii. Whether land for compensatory afforestation is free from encroachmentsl otherencumbrances.As per certificates issued by the DFO, Chiplun and DFO Gondia, both patches of 172. 57 haof non-forest land in Ratnagiri District and equivalent degraded forest identified forafforestation in Gondia District are free from encroachment and other encumbrances.

    iii. Whether land for compensatory afforestation is important from ReligiouslArchaeological point of view.Representative from the Forest Department has informed that CA land is not important fromthe religious/archaeological view point.

  • iv. Land identified for raising compensatory afforestation is in how many patches,whether patches are compact or not.An area of 172.57 ha of non-forest land identified in Ratnagiri District is in single compactpatch while equivalent area of 141.99 ha of degraded forest land identified for rasingafforestation in Gondia District involves 21 patches in Gondia Range of Gondia ForestDivision.

    v. Map with detailsSubmitted. However, differential GPS map for the non-forest land identified for CA andequivalent degraded forest land has not been submitted.

    vi. Total financial outlayRs. 5,07,77,5001- has been submitted in respect of equivalent degraded forest land. However,cost estimates for the various protection measures such as fencing, soil conservationmeasures, etc., if any, required to be undertaken in the non-forest land to handed over to theState Forest Department have not been submitted.

    9. Whether proposal involves violation of Forest (Conservation) Act, 1980 or not. If yes, adetailed report on violation including action taken against the concerned officials.No violations of the Forest (Conservation) Act, 1980 have been reported by the DCF, Gondia.During inspection also no violation of the Forest (Conservation) Act, 1980 were observed in thearea proposed for diversion.

    10. Whether proposal involves rehabilitation of displaced persons. If yes, whether rehabilitationplan has been prepared by the State Government or not. Detail be furnished specifically ifrehabilitation plan would affect any other forest area by trans-locating outstees in andaround the said forest.

    No rehabilitation is involved in the proposal.11. Reclamation Plan: Not applicable

    i. Details and financial allocation. NA

    12. Details on catchment and command area under the project. NA

    13. Cost benefit ratio.Total benefits - Rs. 613.86 croresTotal Cost - Rs. 107.10 crore.Cost -Benefit ratio - 1:5.73

    14. Recommendations of the Principal Conservator of Forests/State Government.The Principal Chief Conservator of Forest, Government of Maharashtra has recommended theproposal for grant of approval under Section 2 (ii) of the Forest Conservation) Act, 1980 subject tofulfilment of general, standard and following additional conditions:i. The User Agency will demarcate the proposed forest area as desired by the Forest Department

    and provide retaining walls, breast walls for protection of human beings;

  • ii. In order to contain the ash spreading over nearby forest areas, the shelter belt would becreated by planting two rows of trees along the forest boundary of the proposed area to bediverted excluding roads and structures at the cost of the User Agency;

    iii. Proposed diversion of forest land for the project shall be confined to the 141.99 ha only.15. Recommendations of Regional Chief Conservator of Forests along with detail reasons.

    Recommendations of the Addl. PCCF (Central) have been appended separately.

    16. Addl. Principal Chief Conservator of Forests (Central) shall give detailed comments onwhether there are any alternatives routes/alignments for locating the project on the non-forest land.Comments of the Addl. PCCF (Central) have been amended separately.

    17. Utility of the project. Numbers of Scheduled Castes/Scheduled Tribes to be benefited by theproject.

    Project of the User Agency has been conceived with a view to develop technologies and protocolsthereof for the ash utilization to cope up with the increasing coal based power generation in thecountry. Proposed facility of the User Agency will serve as a Centre of Excellence for fly ahsutilization, promotion and research, not only for the User Agency, but also to device the methods foreffective utilization of fly ahs generated by the thermal power sector of the country.

    18. Whether land being diverted has any socio-cultural/religious value. Whether any sacredgrove or very old grown trees/forests exists in the areas proposed for diversion.No as per information provided by the User Agency and the representative of the State ForestDepartment, the area is not important from the socio cultural/religious view point. However, an areaof 0.81 earmarked for graveyard is located in between the area of 24.93 ha proposed for diversion inMendipur village.

    19. Situation w.r.t. any P.A.The representative from the Forest Department has informed that area proposed for diversion fallsat an aerial distance of around 6.8 km from the Nagzira Wildlife Sanctuary and it does not form thepart of Nagzira Navegaon Tiger ReservelWildlife Corridor. It is also reported that project of the UserAgency is located outside the buffer zone of Navegaon Nagzira Tiger Reserve and Notified Eco-sensitive Zone area Nagzira Wildlife Sanctuary, New Nagzira Wildlife Sanctuary, Koka WildlifeSanctuary, Navegaaon Wildlife Sanctuary and Navegaon National Park.

    20. Any other information relating to the project.i. Compliance of Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of

    Forest Rights) Act, 2006 has been submitted. The District Collector, Gondia, vide hiscertificate dated 31.10.2014 issued for an area of 141.99 ha has certified all clausesstipulated in the MoEF&CC's advsory dated 5.07.2013. Documentary evidence in supportof settlement of rights viz. copies of the resolution of the Gram Sabha (s) of Mendipur andKachewani villages have also been submitted.

  • ii. The forest area in two blocks proposed for diversion is contiguous to the area being utilizedby the User Agency for their Thermal Power Plan. Area in Kachewani Block is located onnorth eastern side and contiguous to the Ash Dye Pond of the User Agency. Similarly, areaof Mendipur Block is located between the water reservoir and thermal Power Plant of theUser Agency.

    ili. Stretch of area in Mendipur block runs adjacent and parallel to the railway line and coalstock yards of the User Agency. Ttie User Agency should ensure no discharge of waterfrom their coal stock yards into the area proposed for diversion in this block.

    iv. An irrigation canal used by local villagers of the Kachewani village for irrigation passesalong the Northern boundary of the area proposed for diversion. The User Agency shouldensure uninterrupted utilization of the canal by the villagers and if needed appropriatemeasures may be taken to prevent flow of any unwarranted material into the canal.

    v. The User Agency has consented to optimize the requirement of forest land by shifting thecomponent of proposed construction of buildings into the non-forest land and furtheroptimizing the requirement of forest land for storage yard for raw material and to developthe saved forest area as green belt.

    vi. Two patches of 4.51 ha and 0.81 ha of forest land containing pond in Kachewani village andgraveyard in Mendipur village respectively are sandwiched between the area proposed fordiversion. The area of 4.51 ha has been proposed to be developed as pond by the useragency in consultation with State Forest Department. Necessary provisions to provideaccess by way of approach road to the graveyards to the villagers needs to be provided inthe project.

    vii. The authorities in the State Government and the State Forest Department have submitted andaffirmed the fact that such facilities needs to be located in the close proximity of the ThermalPower Plant for pneumatic transfer of fly ash in environment friendly matter.

    viii. Area proposed for diversion has vegetation density between 0.2 to 0.3. Out of the totalproject affected trees of 1408 trees, only 25% to 30% trees (out of total trees) will be felledas trees in the Mendipur block will be kept intact and considerable area in the Kachewanivillage has been proposed to de developed under Green Belt.

    ix. Compensatory afforestation land has been proposed over an area of 172.57 ha of non-forest land in Chiplun Forest Division in Ratnagiri District in the State of Maharashtra. Inaddition to CA land proposed to be handed over to the State Forest Department, anequivalent area of degraded forest land has been proposed for afforestation as the non-forest land has good vegetation density.

    x. Area proposed for diversion falls at an aerial distance of around 6.8 km from the NagziraWildlife Sanctuary and it does not form the part of Nagzira Navegaon Tiger ReservelWildlifeCorridor. Area is located outside the buffer zone of Navegaon Nagzira Tiger Reserve andNotified Eco-sensitive Zone area Nagzira Wildlife Sanctuary, New Nagzira WildlifeSanctuary, Koka Wildlife Sanctuary, Navegaaon Wildlife Sanctuary and Navegaon NationalPark.

    xi. No significant wildlife has been reported in the area. The DCF, Gondia has mentioned that aWildlife Conservation Plan need to be prepared in line with Plan already prepared tomitigate the impact on the Wildlife Corridor that are located in the area.

    xiii. Special measures for the protection and conservation of the water regimes in the area,including local nallah traversing thorough the area proposed for diversion, should be takenby the User Agency. Water quality of the nallah at regular intervals should be monitored toassess the impact, if any, on the water quality from their proposed and existing facilities.

    xiv. As per the examination of the area proposed for diversion using DSS tools in light of draftparameters for identification of inviolate forest area, it is revealed that area does not fall intothe category of inviolate forest areas.

  • COMMENTS AND RECOMMENDATIONS OF THE ADDITIONAL PRINCIPAL CHIEFCONSERVATOR OF FORESTS (CENTRAL)The detailed observations on the proposal have already been made in the inspection report by theinspecting officer. The area proposed for diversion has vegetation density between 0.2 to 0.3. As perthe details submitted in the proposal, the area is not important from the wildlife view point and it doesnot form the part of any PAs or Tiger Corridor. Further, as per the DSS examination in light of draftparameters for identification of inviolate forest area, the area is not an inviolate forest area. Given dueconsideration to the fact that project of the User Agency has been conceived with a view to developtechnologies and protocols thereof for the ash utilization to cope up with the increasing coal basedpower generation in the country,the proposal is recommended and the Central Government mayconsider the proposal for diversion of forest land under the Forest (Conservation) Act, 1980 subject tofulfilment of following conditions:

    i. The User Agency should optimize requirement of forest area proposed for raw material storageyard and component of the project proposed construction of buildings should be shifted into thenon-forest land and forest land so saved should be developed and maintained as green belt.

    ii. Plan for the protection and conservation measures for 4.51 ha of land containing pond shouldbe prepared and implemented in consultation with the State Forest Department. Similarly,necessary provisions to provide access to 0.81 ha of land containing graveyard in Mendipurvillage should be provided by constructing an approach road to the graveyards. Use of the roadby the local villagers should not be constrained in any way by the proposed diversion in favourof the User Agency. An undertaking to this effect should be submitted by the User Agency;

    iii. The State Government should assess the requirement of Wildlife Management Plan, if requiredto be implemented, in consultation with the Chief Wildlife Warden of the State Government.

    iv. The User Agency should formulate a plan clearly delineating the areas to be developed undergreen belt and medicinal plantation.

    v. Special measures for the protection and conservation of the water regimes in the area,including local nallah traversing thorough the area proposed for diversion, should be taken bythe User Agency. Water quality of the nallah at regular intervals should be monitored to assessthe impact, if any, on the water quality from their proposed and existing facilities.

    vi. The User Agency should ensure uninterrupted utilization of the canal passing through thenorthern boundary of the area proposed for diversion in Kachewani block by the villagers and ifneeded appropriate measures may be taken to prevent flow of any unwarranted material intothe canal.
