Dear Fellow Conservatives,

We are pleased to present the American Conservative Union Foundation’s ratings for the 2016 meeting of the Vermont General Assembly. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Vermont legislators with the highest scores voted most consistently with the ideals articulated in the U.S. Constitution: limited and transparent government, individual rights, personal responsibility, and lasting cultural values.

In 2015, ACU Foundation was proud to make history by being the first organization to rate every single state legislature across the full spectrum of issues, helping each voter understand how his or her state ranks among the rest.

Ultimately, we are trying to help people understand what conservatism is and how it improves the lives of everyday Americans. Conservatism is the political philosophy that sovereignty resides in the person. We think that understanding this idea is essential if Americans are to successfully govern themselves again.

Working with our policy centers and fellows, the ACU Foundation engages in deep policy analysis to help create our annual state scorecards. We have enhanced the vote descriptions this year to show this effort more clearly.

By examining all 50 of our State Ratings, we can see which states have most effectively promoted conservative solutions and which have struggled. Our ratings also help identify legislators who have courageously fought against liberal majorities. We hope that this guide helps you learn how well, or poorly, your legislators work to preserve the values we share.

SELECTING THE VOTES

ACU researched and selected a range of bills before the Vermont General Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Vermont’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. S 233 Education Spending Caps. This bill repeals the spending cap limits placed on school district in 2015. The caps are meant to restrain property tax increases and limit the annual growth in education spending to two percent per a year. ACU opposes this spending increase that may force an increase in taxes to pay for it and opposed this bill. The Senate passed the bill on January 20, 2016 by a vote of 28-1.

2. H 187 Paid Sick Leave Mandate. This bill mandates that an employer provide one hour of paid sick leave for every 52 hours of work. An employee can accrue up to 24 hours per year through 2018, and 40 hours per year after 2019. The bill provides no exemptions for small businesses. ACU opposes these mandates that interfere with the right of employees and employers to negotiate benefits and opposed this bill. The Senate initially passed the bill on February 3, 2016 by a vote of 21-8.

3. H 611 Supplemental Spending for 2016. This bill increases spending for Fiscal Year 2016 by $91.8 million, which represents a total spending increase five percent over Fiscal Year 2015, far more than the increase in population plus inflation. ACU opposes this irresponsible fiscal policy that increases spending over actual revenue, thus causing a structural deficit, and opposed this bill. The Senate passed the bill on February 10, 2016 by a vote of 25-4.

4. H 187 Campion Amendment Paid Sick Leave Mandate. The Campion amendment to the paid sick leave mandate bill establishes that there would be no exemption for businesses of five or fewer employees while a study is conducted to determine the impact of the bill on those businesses. When entrepreneurship is suppressed, the resulting decline in economic growth leads to a reduction in family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes these mandates that are particularly harmful to small businesses and opposed this amendment. The Senate passed the amendment on February 10, 2016 by a vote of 15-14.

5. H 875 2017 Budget Bill. This bill represents a 4.8 percent increase in the General Fund budget for Fiscal Year 2017, even though revenue is projected to increase only 2.2 percent. This bill is expected to create a $30 million deficit for the next fiscal year. ACU opposes this irresponsible fiscal policy and opposed this bill. The Senate passed the bill on March 26, 2016 by a vote of 23-5.

6. H 458 Automatic Voter Registration. This bill automatically registers people to vote when they either renew or apply for a new motor vehicle driver’s license or non-driver’s identification card. People will have to state they do not want to use the application for voter registration purposes in order to opt-out. ACU opposes automatic voter registration that makes it easier to commit voter fraud and opposed this bill. The Senate passed the bill on April 7, 2016 by a vote of 28-0.

7. H 171 E-Cigarette Ban. This bill prohibits the use of electronic cigarettes in all places where Vermont laws ban smoking tobacco cigarettes, including private workplaces and cars where a young child is present. ACU opposes banning a product that can be used as an alternative to cigarettes and is likely to improve the health outcome of users. ACU believes that both tobacco and e-cigarettes are a personal liberty issue and government regulations are only appropriate when they are substantially impacting others and opposed this bill. The Senate passed the bill on April 21, 2016 by a vote of 24-5.

8. H 873 Tax Increases. This bill increases and expands taxes on a number of items in various industries. Some of the highlights include the expansion of the nine percent rooms and meals tax to private short term rentals, such as those provided through Airbnb, and a tax increase on employers who don’t provide health insurance for their employees. A heating fuels tax and the bank franchise tax were also hiked. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes tax increases to cover increased spending and opposed this bill. The Senate passed the bill on April 26, 2016 by a vote of 22-6.

The caps are meant to restrain property tax increases and limit the annual growth in education spending. ACU opposes this spending increase that may force an increase in taxes to pay for it and opposed this bill. The House passed the bill on January 27, 2016 by a vote of 94-52.

3. H 187 Paid Sick Leave Mandate. This bill mandates that an employer provide one hour of paid sick leave for every 52 hours of work. An employee can accrue up to 24 hours per year through 2018 and 40 hours per year after 2019. The bill provides no exemptions for small businesses. ACU opposes these mandates that interfere with the right of employees and employers to negotiate benefits and opposed this bill. The House passed the bill on February 17, 2016 by a vote of 81-64.

4. H 861 Pesticide Regulations. This bill allows the state government to regulate a “treated article,” a class of pesticide products exempt from certain federal regulations. Examples include consumer goods like anti-microbial shower curtains or agricultural products, such as seeds. ACU opposes expanding burdensome and costly regulations and opposed this bill. The House passed the bill on March 17, 2016 by a vote of 123-16.

5. H 873 Tax Increases. This bill increases and expands taxes on a number of items in various industries. Some of the highlights include the expansion of the nine percent rooms and meals tax to private short term rentals, such as those provided through Airbnb, and a tax increase on employers who don’t provide health insurance for their employees. ACU opposes tax increases to cover increased spending and opposed this bill. The House passed the bill on March 23, 2016 by a vote of 86-59.

6. S 872 Fee Increases. This bill, known as “the Fee Bill,” raises fees on numerous government services to fund general revenue projects. Services that receive fee hikes include marriage licenses, building codes, and tobacco licenses. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes setting the precedent of using fee increases for increased spending, rather than paying for the service provided, and opposed this bill. The House passed the bill on March 23, 2016 by a vote of 98-46.

7. H 620 Health Insurance Mandate. This bill requires health insurance plans to provide coverage for contraceptives and prohibits any co-payment or any other cost share. ACU opposes these mandates that drive up the cost of health insurance for everyone and opposed this bill. The House passed the bill on March 23, 2016 by a vote of 128-15.

This bill is expected to create a $30 million deficit for the next fiscal year. ACU opposes this irresponsible fiscal policy and opposed this bill. 9. H 877 Motor Vehicle Fee Increases. This bill increases numerous fees associated with motor vehicles by a total of $11 million, including registration and ownership change fees, vehicle and emission inspection fees, and driver’s license fees. ACU opposes fee increases used to cover increased spending and opposed this bill. The House passed the bill on March 30, 2016 by a vote of 104-40.

10. H 879 E-Cigarette Tax. This bill places a 92 percent tax on e-cigarettes. ACU believes that tobacco and e-cigarettes are a personal liberty issue and opposes placing a prohibitive tax on a safe, non-tobacco product that many people use as a substitute for smoking tobacco and opposed this bill. The House passed the bill on March 30, 2016 by a vote of 83-54.

11. H 93 Tobacco Tax Increase and Age Limit Increase. This bill adds another tax increase of 39 cents for cigarettes and 32 cents for other tobacco products. It also raises the minimum smoking age from 18 to 21 over three years. ACU believes tobacco and e-cigarettes are a personal liberty issue and government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The House passed the bill on April 5, 2016 by a vote of 84-61.

12. H 865 Government Housing Projects. This bill calls for $1 million to fund two government housing projects, labeled “affordable housing,” and expands other government tax credits and no-interest loan housing programs. ACU believes that government should not be in the housing construction business competing with private enterprise and opposed this bill. The House passed the bill on April 6, 2016 by a vote of 139-3.

13. H 870 Turner Amendment Telephone Tax Increase. The Turner amendment to the telecom bill eliminates a $1.6 million dollar increase in the telephone tax to pay for taxpayer-funded broadband service. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposed this tax increase, one of many passed in 2016, to pay for government services that can be provided by private enterprise and supported this amendment. The House defeated the amendment on April 13, 2016 by a vote of 48-79.

15. S 20 Dental Regulations. This bill creates a new category for dental work, “dental therapist,” that will fall between a dentist and a dental hygienist so individuals may perform routine dental work. ACU supports common-sense regulatory reform and supported this bill. The House passed the bill on April 22, 2016 by a vote of 109-32.
