The Great Barrier Reef is an outstanding natural ecosystem that supports a world-class array of species and habitats. More than two million tourists visit this World Heritage Area every year, motivated primarily by the chance to see, experience and learn about the Great Barrier Reef.

We can all play a role in protecting the Great Barrier Reef and preserving the tourism experiences it offers.

As an important stakeholder, you contribute to the management of the Great Barrier Reef Marine Park by responsibly operating under your Marine Parks permit, and collecting and submitting the environmental management charge (EMC) and visitation records. You can further contribute by working in partnership with the Great Barrier Reef Marine Park Authority (GBRMPA) in Marine Park management.

The use of permits helps GBRMPA and the Queensland Parks and Wildlife Service (QPWS) ensure the conservation of the Great Barrier Reef’s Commonwealth and state Marine Parks. Marine Parks permits allow these organisations to:

• reduceimpactsonhigh-useandsensitiveareas• separatepotentiallyconflictingactivities• encourageresponsiblebehaviourbyMarineParksusers• collectdataforplanningofMarineParks• monitoractivitieswhichmaybecomedamagingtotheMarineParks.

The funds the Australian Government receives from the EMC are vital for the day-to-day management of the Great Barrier Reef Marine Park and in improving its long-term resilience.

You are encouraged to carefully read this guide to permits and the EMC, as it contains information relevant to the 2016 calendar year. It will help you understand your permit and EMC obligations and guide you through the steps to meeting them.

1.2 How to be a responsible permitteeWhen operating in the Great Barrier Reef Marine Park and Queensland State Marine Parks, you must comply with legal requirements contained in the relevant Acts, Regulations, zoning plans, plans of management and your permit. You should be familiar with the requirements that relate to your activities in the places you are visiting, and are encouraged to adopt best environmental practices. For more information visit www.gbrmpa.gov.au.

Know your permitPermits are legal documents. It is your responsibility to ensure you understand and comply with all parts of your permit. To help you better understand the document, start reading your permit by checking the sections titled ‘Interpretation’ and‘Definitions’towardstheendofthepermit.Ifyourequireclarificationordon’tunderstandyourpermitconditions,contact [email protected].

Theexpirydatecanbefoundinthetopleft-handcornerofthefirstpageofyourpermit.Ifyouwishtocontinueoperations beyond the expiry date, you must submit a new application before the expiry date. This allows you to continue operating in accordance with your existing permit until a decision is made on your application for another permit.

Your permit number can be found on the top right-hand corner of your permit. Quote this number in all correspondence with GBRMPA and the Queensland Parks and Wildlife Service (QPWS).

1 About Marine Parks permits

1.1 What is a Marine Parks permit?MarineParkspermitsarelegaldocumentswhichreflectthedecisiontograntapermittoacompanyorindividual,giving them permission/s to operate or carry out activities within the Marine Parks. A Marine Parks permit is generally two permits in one — a permit to operate in the Commonwealth Great Barrier Reef Marine Park and a permit to operate in the Queensland State Marine Parks, located within or adjacent to the Great Barrier Reef Marine Park.

A permit describes:

• theCommonwealthandstatepermission/sgranted• whatactivitiesarepermitted• theconditionsunderwhichtheactivitiescanoccur(theseareinadditiontowhatisalreadylaidoutinlaw including the Great Barrier Reef Marine Park Act 1975 (the Marine Park Act), Great Barrier Reef Marine Park Regulations 1983 (the Regulations), the Great Barrier Reef Marine Parks Zoning Plan 2003, relevant plans of management and any relevant state legislation)• exactlywheretheactivitiescanoccur• forwhatlengthoftimetheactivitiescanbeundertaken.

Know who holds responsibility for the permitMarineParkspermitsaregrantedtoa‘permittee’.Thenameofthepermitteeisstatedonthefirstpageofyourpermit, and may be a company, institution or individual. The permittee is ultimately responsible for permit and EMC compliance. The permission/s on your permit can be suspended or revoked if you fail to comply with a permit condition, fail to pay any EMC charge due, or if it is necessary to do so to protect the environment or the Marine Park’s living resources.

Marine Parks permits extend to all employees of the permittee, or other persons acting on behalf of, or at the direction of,thepermitteeforthepurposesspecifiedinthepermit.Inaddition,thepermitmaycontainconditionsallowingthe permittee to grant an authority that allows other people to conduct operations under the permit, not necessarily on behalf of the permittee. The permittee remains responsible for any actions undertaken by those they authorise, includingcompliancewithpermitconditionsandfulfillingEMCobligations.

Know where you can go and what you can and should doTheactivitiesyoumayconductandthegeneralareasyoucanaccessareidentifiedonthefirstpageofyourpermit.Specificrequirementsforindividuallocationsmaybedescribedinthepermitconditions.

Along with the Regulations, Zoning Plan and plans of management, your permit conditions are the ‘road rules’ for your use of the Marine Parks, and may include conditions on:

• exclusionareas• thewayyouconductactivities• bookingrequirementspriortoaccessingspecificareaswithintheMarineParks• thenumberoftimesyoumayaccessanarea• maintenancerequirementsformooringsandstructures• yourdutytonotifyauthoritiesintheeventofanincidentthatmaycauseharmtotheenvironment(oilspillor emergency advice hotline 07 3830 4919)• yourdutytonotifyusintheeventofanydeath,injury,lossordamage(emailpermitscompliance@gbrmpa. gov.au).

We recommend that you and your staff regularly review permit requirements, as these may change each time the permit is changed or continued.

Changing or continuing your permitIf you wish to change aspects of your permit, an application must be lodged with GBRMPA or QPWS, clearly stating the desired changes. Some common changes are:

• addingorchangingavessel• increasingthenumberofpassengers• changingthetypesofactivitiesundertaken• addingorchanginglocations.

In most cases, an assessment or administrative fee will be charged. A schedule of fees is available on GBRMPA’s website at www.gbrmpa.gov.au.

Before your existing permit expires, a new permit application must be made. This application is assessed by GBRMPA and QPWS in the same way as an initial application. Operators can continue to operate in accordance with their existing permit if their new application was lodged with GBRMPA or QPWS prior to their existing permit’s expiry date. This remains the case until the application is granted, refused, withdrawn or lapses.

Permit application assessment fees apply. Please refer to our schedule of fees.

In most cases, GBRMPA will send you a reminder letter when your current permit is about to expire. However, the onus is on you to lodge an application to continue your permit. Not receiving a reminder notice is not accepted as a reason for conducting an unpermitted operation, and you will have to cease operations immediately if you do not apply to continue your permit in time.

2 Completing your post-permit requirements

2.1 Deed of agreement, bond and insuranceMost standard tourism permits do not require a deed of agreement. Permits that contain a structure/facility, or are classifiedasmediumtohighrisk,maycontainaconditionrequiringthepermitteetoenterintoadeedofagreementbetween the permittee, GBRMPA and sometimes QPWS. This deed binds the permittee to certain obligations, such as:

• indemnifyingGBRMPAorQPWS• maintainingadequateinsurance• ensuringremovalofstructuresandclean-upofthesiteofoperations,ifdirected• insomecasesthepaymentofabond.

ThedeedmustbeenteredintoandreturnedtoGBRMPAwithinthetimeframespecifiedinyourpermit.

IfyourdeedincludesarequirementtolodgeabondwithGBRMPA,thebondamountwillbespecifiedinthedeedand should be in the form of a cash bond or bank guarantee. The bond must be lodged with GBRMPA within the timeframespecifiedinthedeed.

The deed of agreement or permit conditions also contain insurance requirements, however you should not rely upon GBRMPA’sinsurancerequirementsunderthedeedtoindicatewhatissufficientinsuranceforyouroperation.Thisisaminimum requirement, and you should seek independent insurance advice on the level and type of cover appropriate foryourspecificoperationanditsassociatedactivities.

2.2 Making use of your permit

Commencing operationsThe Great Barrier Reef Marine Park Regulations 1983 requires the permittee to commence operations under a permit within 120 days of the commencement date of the permit. However, GBRMPA’s policy, Managing tourism permissions to operate in the Great Barrier Reef Marine Park, requires permittees to start operations under their tourism permits withinthefirsttwoyearsofthestartdateofthepermitoryourpermitmayberevoked.Thisappliestoeachtourismpermit you are granted, even if it is a continuation of an existing permit.

Please note some permit conditions (for example, installation of a mooring) may have other timeframes for commencing.

Reasonable useSome Marine Parks tourism permits are ‘special tourism permissions’ because they allow you to conduct a tourism activitythathasbeencappedorlimitedbytheRegulationsoraplanofmanagement.Youwillretainfirstoptiononyour special tourism permission, providing you have made reasonable use of that permission (and ensured that you applied for your next permit before your current one expires). For current special tourism permissions, reasonable use is deemed to be an average of 50 days use per year for each vessel or aircraft that is endorsed to undertake capped activities. The number of passengers carried will not be reviewed.

If you hold a‘special tourism permission’, GBRMPA will check whether you have undertaken reasonable use when you apply for your next permit. The agency will make a separate decision about each endorsed vessel or aircraft. Use of ancillary vessels, such as glass-bottom boats, semi-submersibles and dive tenders, will not be reviewed.

Use of your ‘special tourism permission’ will be reviewed over the entire term of the permit, except if your permit has been transferred, in which case you may request that only use since the transfer be reviewed.

2.3 Environmental site supervisionAs part of the permit process you may incur site supervision fees for cost recovery purposes if environmental site supervisors are required to supervise or inspect your works or audit your activities. Site supervision is an essential component of managing projects that have the capacity to have impacts on the Marine Parks and its users. GBRMPA will inform the applicant at least 48 hours beforehand if costs are to be recovered.

As a guide, site supervision costs may consist of:

• airfares,accommodationandtransporttoandfromthesitetobeinspected(forexample,byboat,helicopter etc). Where possible the cheapest fares and base accommodation with be sought, subject to availability. • salarycostsandtravelallowancefortheenvironmentalsitesupervisor(s)supervisingandinspectingyour activity. Information about the daily rate for environmental site supervisors may be obtained by contacting GBRMPA.

2.4 Structure maintenance requirements

Vessel/aircraft mooringsGBRMPA and QPWS manage moorings in the Marine Parks consistent with the Policy on moorings in the Great Barrier Reef Marine Park. A mooring permittee is required to have permitted moorings inspected annually by an ‘appropriately qualifiedperson’toensuremooringsaremaintainedtodesignspecifications.GBRMPA,inconsultationwithQPWSandtheAssociationofMarineParkTourismOperators,hasapprovedadefinitionfor‘appropriatelyqualifiedperson’.For more information, refer to the moorings policy at www.gbrmpa.gov.au/zoning-permits-and-plans/legislation-regulations-and-policies/policies-and-position-statements

Facilities/structures (such as jetties, tourist pontoons, marinas, pipelines)GBRMPA and QPWS manage facilities in the Marine Parks consistent with the Structures Policy. Permittees are required toprovideanannualmaintenancecompliancecertificate,dulycertifiedbyaRegisteredProfessionalEngineerofQueensland,thatverifiesthestructureshavebeeninstalledandmaintainedinaccordancewiththeapproveddrawings,andarefitforpurpose.

3 About the environmental management charge (EMC)

3.1 What is the EMC?The EMC is a charge associated with some commercial activities, including tourism operations, non-tourist charter operations and facilities, operated under a permit granted by GBRMPA.

For most tourism operations, visitors to the Great Barrier Reef Marine Park participating in a tourist activity are liable to pay the charge to the permittee, who then remits the charge to the agency.

For other operations in the Great Barrier Reef Marine Park, such as those involving the hire of equipment, installation and operation of tourist facilities, underwater observatories, sewage outfalls and vending operations, the permittee mustpayfixedquarterlychargestoGBRMPA.

3.2 How is the EMC used?The funds collected through the EMC are vital to protecting and managing the Great Barrier Reef Marine Park, one of the largest and best known World Heritage Areas. All funds received as EMC payments are applied directly to management of the Great Barrier Reef Marine Park, including education and research, compliance patrols, site planning, public moorings, reef protection markers, information signs and maps.

3.3 What are your obligations?The role of the permittee is to collect the appropriate EMC and remit the charge to GBRMPA by the due date, in accordance with Part 8 of the Regulations.

As a permittee, you are responsible for:

• collectingthecorrectamountoftheEMCfromindividualvisitorsfortouristrelatedoperationsandfrom non-tourist charter passengers• keepingaccurateandup-to-daterecordsoftheEMC• formostoperations,submittingtheEMCreturnquarterlybytheduedate,evenwherethereisnoactivity• remittingallpaymentsquarterlybytheduedate• accuratelyadvertisingtheEMC.

Please note that regardless of private business arrangements you may make, as the permittee you have the responsibility to ensure compliance with the conditions of your permit and to ensure the full and timely lodgement of all EMC returns and payments.

3.4 Does the GST apply?You are not required to pay GST on any EMC payments.

4 Collecting the EMC

4.1 Who must pay?

Visitors in a tourist programMost commonly, it is Great Barrier Reef Marine Park visitors participating in a tourist activity who must pay the EMC. This charge is collected by the permittee and remitted to GBRMPA on a quarterly basis.

Theterm‘visitor’isdefinedintheRegulationsasmeaning:

• atourist• anyotherpersonwhoisprovidedwithaserviceintheGreatBarrierReefMarineParkunderatouristprogram.

IncalculatingtheamountofEMCdueandowing,youarerequiredbytheRegulationstocountvisitorsasdefinedabove. See Section 4.2 for exemptions.

Staff or crew who are on duty should not be counted as visitors. However, if they are off duty and taking part in your tourist program, they are considered to be visitors and must be included.

EMC must be collected for visitors travelling on discounted fares, including children and pensioners.

Non-tourist charter passengersEMC must be collected from passengers on non-tourist vessel charters, such as researchers, and remitted to the agency on a quarterly basis.

Permittees who provide services, structures and facilities Permitteesmustpayfixedquarterlychargesfortheoperationslistedbelow:

• beachhire• underwaterobservatory• land-basedsewageoutfalldischarge• vending• mariculture• pontoon• marina.

4.2 Are there exemptions? EMC should not be collected from visitors who are carried free-of-charge (FOC) and are:

• childrenlessthanfouryearsold• beneficiariesofregisteredcharities• supervisedschoolgroups• participatingintourismindustrytradefamiliarisations• mediacrewsreportingonGreatBarrierReefMarineParkissues.

EMC should not be collected from:

• visitorswhohavealreadypaidthefull EMC for that day to another operator • visitorswhoareontheirfourthandsubsequentdaysofanextendedtripwithoneoperator,providingthe visitor has paid the maximum charge ($18.00 (1 January to 31 March) or $19.50 (1 April to 31 December)) • transferpassengerswhotransittheGreatBarrierReefMarineParkviathemostdirectrouteandfor whom the permittee does not provide any tourism activities for two hours after disembarkation • passengerswhovisittheQueenslandGreatBarrierReefCoastMarineParkONLY.

You are required to keep records of any exemptions for at least two years.

4.3 How much is the EMC?To understand exactly how much EMC you need to collect and pay, please carefully check the fee schedule.

This is a summary of the relevant provisions of Part VA of the Marine Park Act and Part 8 of the Regulations. Any person affected by the EMC should consult the Marine Park Act and Regulations and/or seek advice in relation to their liability.

EMC fee schedule 2016

Tourist related visitors – daily charges Full-day visitors

Permittee to collect from each visitor $6 per day (1 January to 31 March) or $6.50 per day (1 April to 31 December) for:

• tripsofthreehoursormore • tripsenteringtheGreatBarrierReefMarineParkbefore5.00pm • tripsleavingtheGreatBarrierReefMarineParkafter6.00am • firstthreedaysofanextendedcharter • anyvisitorswhoareonthefourthorsubsequentdaysofanextendedcharterwithadifferentoperator and who then participates in your tourist operation.

Part-day visitors

Permittee to collect from each visitor $3 (1 January to 31 March) or $3. 25 (1 April to 31 December) for:

• tripslessthanthreehours • thefirstoronlydayofatripenteringtheGreatBarrierReefMarineParkafter5.00pm • thelastoronlydayofatripleavingtheGreatBarrierReefMarineParkbefore6.00am.

Semi-submersible and glass-bottomed boat excursions

A trip to conduct a coral viewing program provides for a stand-alone activity involving an excursion for visitors to view marine life from a semi-submersible or glass-bottomed boat. Please note that this does not include glass-bottomed and semi-submersible excursions which are ancillary to another tourist program.

Permittee to collect from each visitor 40 cents per excursion.

If a visitor participates in more than one excursion on the same day and all the excursions are provided under thesamepermit,thevisitoronlypaysforthefirstexcursion.

Sight-seeingflights

Permittee to collect from each visitor 40 cents per excursion.

If a visitor participates in more than one excursion on the same day and all the excursions are provided under thesamepermit,thevisitoronlypaysforthefirstexcursion.

Touristrelatedservicesandstructures–fixedquarterlycharges Beach hire

Charges are based on the equipment listed on the permit and the permittee must pay the EMC even when there was no activity.

Non-motorised beach hire

• fewerthansixpiecesofequipment:$12 per quarter • sixormorepiecesofequipment:$25 per quarter.

Dinghy hire

A dinghy is a small open boat having no designed sleeping accommodation. It does not include half-cabin boats.

The general mode of operation of such vessels is for the sale of goods or services from a vessel. No visitors are carried. • $30 per metre of the length of the vessel per quarter.

Marina

• $380 per quarter (for construction or operation).

Mariculture

• $500 per quarterforthefirst10hectaresplus $200 per quarter for each additional 10 hectares.

The charge applies to the establishment or operation of farming facilities for the culture of pearls and clams.

Land-based sewage outfall discharge

This charge applies to marine outfalls only.

• Sewageistakentohavereceivedtertiarytreatmentiftheeffluentcomplieswithstandardsdescribedin the Point Source Sewage Discharge return. If sewage has received tertiary treatment, the charge is $400 per quarter.

• Ifsewagehasnotreceivedtertiarytreatmentthechargeis$400 per quarter, plus a charge based on a cost per unit nutrient formula: $4 x V x (N + P).

Where: V is the total volume of sewage discharged to the Marine Park in the quarter, expressed as megalitres. N is the average concentration of total nitrogen, expressed as milligrams per litre.

P is the average concentration of total phosphorous, expressed as milligrams per litre.

For further information regarding the requirements for tertiary, secondary and primary treatment, please refer to the Regulations.

4.4 Information for your customers

AdvertisingAs a Great Barrier Reef Marine Park permittee, your obligation to collect the EMC from visitors includes correctly representing the amount of the EMC when advertising your tour prices.

It is your responsibility to ensure consistency across all media including websites, brochures, television advertising, tax invoices and receipts.

Where additional fees and charges are advertised you must ensure that a consumer can readily identify the correct EMC component.

Examples of correct EMC advertising include:

• totalprice-$….includingtheenvironmentalmanagementcharge,oralternately• totalprice-$….includingtheenvironmentalmanagementchargeof$6.50.

NB. $6.50 after 1 April 2016

You need to be aware that it is a criminal offence under the Marine Park Act to make a false or misleading representation of the EMC.

You should refer to the Trade Practices Amendment (Clarity in Pricing) Act 2008 for other requirements of price advertising.

Educating your visitorsWhen collecting the EMC from your visitors you are encouraged to inform them about the EMC, how much they are required to pay and what the money is used for.

By paying the EMC, your visitors are helping to protect, conserve and ensure the ecologically sustainable use of this unique and amazing coral reef environment.

You can help them understand the positive contribution they are making to the sustainable future of the Great Barrier Reef Marine Park and the World Heritage Area.

5 Completing your logbooks You may submit your EMC data via EMC Online, which is the preferred way to complete your quarterly returns. To set up a user account, please contact [email protected] or (07) 4750 0700.

Alternatively, information can be submitted by electronic logbooks (excel spreadsheet for vessel, bareboat and aircraft operators). The information you collect includes the number of visitors carried, the amount of EMC payable and all the reefs, islands, and bays visited.

You must complete a separate logbook for each operation permitted.

Please take care to complete the logbook accurately, paying particular attention to:

• providingcorrectinformationaboutthepermityouareoperatingunder• ensuringinformationforeachoperationonapermitisrecorded,eveniftherewasnoactivity• providingcorrectdetailsofthelocationsyouvisited.AppendixAofthisguidecontainsa comprehensive list of locations within the Great Barrier Reef Marine Park. Further information on locations can be found at www.gbrmpa.gov.au.

5.1 How do I provide the required information?

EMC OnlineEMC Online is an easy-to-use system which allows operators to submit EMC information and pay the required amount straight away.

Key features that reduce business processing times include:

• Favourites – you can establish favourites to accommodate regular trips and reduce data entry time.• Reports – you can create customised reports which can be used to track the number of visitors you take into the Great Barrier Reef Marine Park.• Payment gateway – you can pay EMC through a secure gateway.• Submitting nil returns for future quarters – you can submit nil returns for up to a year in advance.

Electronic logbooks

If you are not registered with EMC Online, the agency provides you with EMC logbooks when your permit is granted and at the beginning of each calendar year. This is a summary of logbook information on the amount of EMC due.

5.2 What happens if I did not operate?Log books must be submitted for operations even if you did not operate during the relevant quarter. When you did not operate during a quarter, nil activity must be submitted for each operation for which there was no activity. EMC Online provides you with the ability to submit nil activity several quarters in advance.

If you did not operate because you have hired your vessel to another permittee who is conducting their own tourist program under their own permit, you should submit nil activity. The other permittee is required to collect any EMC and submit their own returns.

6 How to submit EMC data and payment

6.1 Due datesEMC data and payment (where applicable) must be submitted quarterly to GBRMPA. At the end of each quarter, you have the next month to collate your data and where applicable submit your payment. To allow easy processing of payments, a payment gateway is incorporated into EMC Online.

The due dates are:

7 Permit compliance and penalties You are legally required to comply with all your permit conditions. This includes providing a signed deed ofagreement,bond,insuranceormaintenancecertificate,withinthetimeframesspecifiedbyyourpermitconditions.

Permitteeswhofailtomeetobligationsundertheirpermitmayfacefinancialpenaltiesoradministrativecompliance actions, including having their permit suspended and ultimately revoked. Failure to comply with state legislation may incur additional compliance actions.

7.1 Permit suspension and revocationPermits and permission(s) may be suspended if it is necessary to do so to protect the environment, or if GBRMPA has reason to believe that the permittee has contravened, or is likely to contravene, the permit conditions, subject to an investigation.

It is illegal for you to operate in the Marine Parks while suspended.

You will be required to resolve all obligations to end the suspension.

Permits and permissions may be revoked within 10 business days after the agency completes its investigation, meaning you no longer have permission to operate in the Marine Parks.

7.2 Financial penaltiesIn addition to administrative compliance actions such as suspending and revoking permits and permissions, permittees thatdonotcomplywiththeirpermitconditionsmayincurfinancialpenaltiesthroughthecourtsorbeissuedwithapenalty infringement notice by Marine Parks inspectors. The most common offences may incur the following penalties:

• Conduct contravening condition of permission or authority (refer to the Marine Park Act section 38EA(1)) Maximum penalty $180,000 for an aggravated offence and $90,000 in any other case.• Conduct contravening a condition of permission or authority civil penalty provision (refer to the Marine Park Act section 38EB) Maximum penalty $360,000 for an aggravated contravention by an individual, $180,000 for an individual in any other case, $3,600,000 for an aggravated contravention by a corporation and $1,800,000 for a corporation in any other case.• Requirement to produce a permission for inspection (refer to the Regulations 88ZW) Maximum penalty $9,000.• Contravening order or direction (refer to the Marine Park Act section 38DC) Maximum penalty $90,000.

7.3 Infringement noticesBreaches of permits can attract an infringement notice. However, you may elect to have the matter dealt with by the court.

8 EMC compliance and penalties You are legally required to meet all your EMC obligations, such as maintaining appropriate records and providing information and payments, by the due dates. Permittees who fail to meet their EMC obligations mayfacefinancialpenaltiesormayhavetheirpermitsuspendedandultimatelyrevoked.

8.1 EMC timelinesPermittees are allowed one month after the end of the quarter to collate data and submit it to GBRMPA, along with the required remitted charges.

ThefinaldateforsubmittingEMCdataandpaymentisthelastdayofthemonthaftertheendofthequarter.Toavoida $250 penalty, permittees should meet their EMC obligations prior to this date.

EMC data and payments received after the due date immediately incur a late payment penalty (as outlined in 8.2). Failure to meet EMC obligations may lead to your permissions being suspended and subsequently revoked.

If payment of EMC is not successful (for example, a cheque is dishonoured on presentation or a credit provider declines to authorise the payment), payment is taken not to have been made until:

• thepaymentbychequeishonouredonpresentation;or• thepaymentissuccessfullymadeinanotherway(asoutlinedin6.2).

Where payments are made and not honoured (that is, cheques), criminal or civil action may result.

8.2 Late payment penaltyIf you fail to pay the EMC by the due date you will be liable to pay a late payment penalty.

The late payment penalty is calculated as the greater of either $250 or 20 per cent per annum of the amount owing, calculated from the due date.

8.3 Permission suspension and revocationPermissions may be suspended if the permittee fails to comply with the Regulations requiring the provision of EMC information and remittance of applicable payments.

It is illegal for you to operate in the Great Barrier Reef Marine Park under suspended permissions.

If the permissions you have on your permit have been suspended because you failed to meet your EMC obligations, you will be required to resolve all obligations and pay a reinstatement fee of $120 per permission to end the suspension.

Permissions may be revoked 10 business days after a permission is suspended if the outstanding EMC requirements have not been met. This would mean you no longer have permission to operate in the Great Barrier Reef Marine Park.

It is illegal for you to operate in the Great Barrier Reef Marine Park under revoked permissions.

8.4 Court-imposed penaltiesIf you fail to meet other relevant legal requirements, the court may impose the following penalties:

• Failure to give information or returns (refer to the Marine Park Act section 39Q) Maximum penalty $7200 for an individual.• Failure to pay collected amount on time (refer to the Marine Park Act section 39FB) Maximum penalty $1800 per day for an individual and $9000 per day for a corporation up to a maximum of 20 days. The maximum penalty that can be imposed is $36,000 for an individual and $180,000 for a corporation (in addition to a penalty amount equal to the amount of the charge payable and the associated late payment penalty).

Environmental management charge privacy notice Personal information provided by you on your environmental management charge (EMC) electronic logbooks is collected by the Great Barrier Reef Marine Park Authority and protected by the Privacy Act 1988. The Privacy Act 1988 provides for 13 Australian Privacy Principles that regulate how we must handle your information.

Why we collect your personal informationThe Great Barrier Reef Marine Park Act 1975 requires the agency to assess and collect charges imposed by the Great Barrier Reef Marine Park (Environmental Management Charge – General) Act 1993 and the Great Barrier Reef Marine Park (Environmental Management Charge – Excise) Act 1993.

The information you provide on the EMC logbooks will be used to assess your liability to pay an EMC. It is a requirement under the Great Barrier Reef Marine Park Regulations 1983 (the Regulations) for holders of chargeable permissions to give copies of the EMC logbook entries at quarterly intervals to the agency (see regulation 167 of the Regulations).

If you apply to us for a relevant permission, the information you provide on your EMC logbook entries may also be used to assess your application, by enabling the agency to determine whether you have outstanding EMC payments (see regulation 88R of the Regulations). We may also use this information to determine whether to suspend any relevant permission (see regulation 88ZT of the Regulations).

If we are unable to collect personal information on your EMC logbooks, we will be unable to assess your liability to pay EMC. You may also be subject to a penalty for failing to comply with the Act and Regulations.

Who we give your personal information toWe do not disclose personal information collected on the EMC logbook entries to any third party or overseas entity.
