Plaintiffs’ Exhibit List
Plaintiffs United States Fidelity and Guaranty Company and St. Paul Fire and
Marine Insurance Company (together, “USF&G”) annex hereto as Exhibit A a list of exhibits
that it may seek to introduce in its case in chief to which Defendants have not objected. In
addition, USF&G annexes hereto as Exhibit B a list of exhibits that it may seek to introduce in
its case in chief to which Defendants have objected.
USF&G reserves the right to use any document included on the exhibit list of any
Defendant.
USF&G reserves the right to introduce as exhibits at trial any pleadings, briefs,
affidavits/affirmations and discovery responses served or filed in this action.
USF&G reserves the right to offer an enlarged or highlighted version of any
exhibit on USF&G’s Exhibit List.
USF&G reserves the right to use additional documents for impeachment purposes
and on rebuttal.
USF&G reserves the right to supplement and/or amend this list, including in
response to any rulings at trial.
USF&G’s Exhibit List does not include: (i) demonstrative exhibits; (ii) materials
that may be used on cross examination; or (iii) all statutes, case law, rules of professional
conduct or learned treatises USF&G may use when examining or cross-examining witnesses.
By listing a document as an exhibit on USF&G’s Exhibit List, USF&G does not
agree that it is admissible for any purpose or without redaction. Accordingly, the inclusion of a
document on this list does not waive any objections USF&G may have to the introduction of any

item listed if such document is offered by any other party. Finally, the inclusion of a document
on this list does not constitute a commitment by USF&G to offer any such document at trial.
As to USF&G’s objections to Defendants’ exhibit lists, USF&G reserves the right
to object at trial with respect to the admission of any exhibit for which a proper foundation has
not been provided. Furthermore, USF&G reserves the right to object to the admission of any
exhibit on hearsay grounds to the extent not specifically objected to herein depending on the
purposes for which the exhibit is being offered. USF&G also reserves the right to object at trial
to the admission of any exhibit on cumulativeness grounds. Finally, USF&G reserves the right
to supplement, amend or revise its list of objections. To the extent there is more than one version
of a document listed on Defendants’ exhibit lists, USF&G’s objections apply to all versions and
variations of the document.

Furthermore, defendants reserve all rights based upon the position that introduction of evidence by USF&G on certain matter such as,
for example, asbestos values and counts or communications with the reinsurers, will open the door to other evidence on such subjects
at the behest of the reinsurers.
In the event the that the trial proceeds without one or more of the current defendants, the remaining defendant(s) reserve the right to
assert hearsay objections with respect to documents created or produced by the absent defendant(s), except to the extent that all of the
remaining parties have reached a contrary agreement in connection with the dismissal of the absent defendant(s).
