Why the Guide? As eaters, we love to dine out. But we dont love that one of the largestand fastest growing sectors of the United States economy, therestaurant industry, has 6 of the 10 lowest paying jobs in the US,
including the absolute lowest legally allowable wage. The federalminimum wage for tipped workers is a mere $2.13/hour. Tippedworkers are more than twice as likely (with servers almost three timesas likely) to fall under the federal poverty line. Worse yet, thats justone of the many low-road business practices prevalent in therestaurant industry.
This guide was created to help eaters find the restaurants that reflectour values, our basic beliefs of how others should be treated, and ourdreams of reimagining the US workplace. We are inspired to havefound High Road restaurants that prove another world is possibleand profitable. And we are grateful to be able to recognize them in thisguide, which we hope youll use for a regular dose of dininginspiration!
Another important tidbit, pun intended! This guide was alsocreated to show eaters how the Top 100 revenue-grossing restaurantsin the United States fared. We dont want you to use this list solely as ameans to choose where not to eat. In fact, we encourage you tocommunicate whenever you eat out at a restaurant thats not awardedin this guide that you, the consumer, care about the wages paid, benefits provided, and opportunities for advancement given to
workers in the restaurants in which you dine. Dont worry, we haventleft you hanging. In the How you can use this Guide section weveprovided some great and simple ways you can take action with yourforks, your signatures, and pocketbooks.

Before you get to the good stuff, heres a little
more to put into your knowledgebank...
Over the last twelve years, the Restaurant Opportunities Center hasgrown into a national restaurant workers organization seekingimproved wages and working conditions for one of the nations largestand fastest growing sectors.
What we seek to change:
1 POVERTY WAGESMore than half of all restaurant workers nationwide earn less than the
federal poverty line.
The Fair Minimum Wage Act which would raise the federal minimumwage from $7.25 to $10.10/hour over the next 3 years and the tippedminimum wage from $2.13 to 70% of the regular minimum wage. TheAct would lift millions out of poverty and cost consumers at most an
extra dime a day.
2 LACK OF EARNED SICK LEAVE
90% of restaurant workers surveyed nationally reported not having paid
sick days, and two-thirds report cooking, preparing, and serving our food
while sick.
The Healthy Families Act would guarantee workers a
minimum number of paid sick days, ensuring that workers are not sickwhile touching our food!
3 OCCUPATIONAL SEGREGATION
People of color, women, and immigrants largely occupy the lower-paid
positions in restaurants. Nearly 60% of restaurant workers surveyed
nationally report lack of training for internal promotions. Weve found a
$4 wage gap between white workers and workers of color.
ROC has won 17 campaigns winning over $8 million in back wages andpolicy changes to the restaurant companies, including internalpromotions policies creating career paths and ladders based on meritand seniority. In these campaigns, we have found that consumerdemand for racial equity in restaurants has significant impact on thisissue.

How this Guide worksBefore we tell you how it works, isnt it important to
know how we got all these restaurants on this guide?
Heres how we did it...
Working with students from Georgetown University and University ofDenver*, we asked restaurants about their practices with regard to:
a) wages for tipped workers and non-tipped workers,b) paid sick leave policy,c) advancement opportunities for workers to move up the ladder.
We asked this information from all of our high road restaurantpartners in our eleven current affiliate cities and from the top 100highest revenue-grossing restaurants in the United States. Data wastaken from the Nations Restaurant News Top 1001. Specifically wechose to use unit-level trends--a unit is identified as an individualrestaurant--which ranks top 100 highest revenue-grossing restaurantsin the United States.
Using this Top 100 list at the unit level, we first attempted to callcorporate offices; in the case of companies that did not respond at thecorporate level or companies that are franchised, we called individualrestaurant locations about the lowest paid wages, paid sick dayspolicy, and internal promotions policy**.
Some restaurants did not provide us with all requested information. If any of these restaurants -or any other in the United States- canprovide us with this information, we would be happy to updatethe Guide.
1. http://nrn.com/corporate/top-100-methodology2. http://nrn.com/us-top-100/2013-top-100-unit-level-trends
*We thank the students of Professor Aaron Schneider from the University of Denverand Professor Sarah Stiles from Georgetown University for all their hard work on this project. Specifically, JulieLeebove, Hans Schaler, Erin Orsley, Julia Lopez, and Denise Recinos.
**For restaurant chains with multiple locations, we asked about these practices fromrestaurants within the chain primarily in Alabama and Texas, Louisiana, Mississippi, South Carolina, Tennessee, and Georgia. In all of those states, there is no state labor law and only federal labor law applies; thus, wagespaid in establishments in those states would be the lowest wage paid by the restaurant chain anywhere in thecountry.

Time for some grading...
Restaurants can earn up to 5 points in the grading system. They receive
one point for every criterion met.
If the restaurant receives 2 out of 5 points, they are awarded a SILVER STAR.
If the restaurant receives 3 out of 5 points, they are awarded a GOLD STAR.
Based on the information gathered, when a restaurant earns a point, itis indicated with the following symbols:
RAISEOR RESTAURANT ROUNDTABLEMEMBERA restaurant that belongs to RAISE or one of ROCsRestaurant Industry Roundtables: a group of employersworking to promote the high road to profitability in theindustry.
TIPPED WORKER WAGES A restaurant receives a pointif their lowest starting wage for a tipped worker is atleast $5 an hour anywhere in the United States. Tippedworkers include servers, runners, bussers, bartenders, barbacks, and expeditors. Although there are manystates that do not have a tip penalty, this ROC NationalDiners Guide is based off increasing the federal wage of
$2.13 for tipped workers. The $5 subminimum wage as acriterion is meant to highlight our goal of phasing in theFair Minimum Wage Act over a 3-year period to 70% ofthe regular minimum wage, or eventually $7.
8/13/2019 2014 Diners Guide to Ethical Eating
8/40
5
NONTIPPED WORKER WAGES- A restaurant receives apoint if their lowest starting wage for a non-tippedworkers at least $9. Non-tipped workers include host/hostess, dishwashers, prep cooks, line cooks, and
porters. There are a few cities with higher wages such asSan Francisco, again, the premise is to raise the federalminimum wage currently at $7.25. The $9 wage as acriterion is meant to highlight our goal of phasing in theFair Minimum Wage Act over a 3-year period to $10.10.
PAID SICK DAYS- A restaurant receives a point if itprovides paid sick days to its part-time and full-timeemployees through a paid sick day policy or by policiesallowing for paid time off to be used for sick days.
INTERNAL PROMOTION- A restaurant receives a point ifat least 25% of all non-entry-level positions were filled byinternal promotion and at least 10% of non-
management employees have tenure of 4+ years
OR
50% of its current employees have been promotedinternally.

Restaurants who do not receive a point in any of these criteria insteadare marked with one of the following symbols:
NONAPPLICABLE The restaurant does not have thatposition or the criterion does not apply at this restaurant.
DOES NOT MEET CRITERION This restaurant does notmeet the criterion and does not provide the benefit.
DECLINED TO ANSWER Despite several attempts, this
restaurant refused to report on this criterion or does notknow if they provide the benefit.
In 2011, workers filed several federal lawsuits and legal
charges against Darden for workplace violations suchas discrimination and wage theft. This image is used todenote a restaurant that is from the Darden RestaurantGroup, the worlds largest full-service restaurantcompany.

How you can use this GuideYou can make a difference for the 10 million plus restaurant workersacross this nation in several simple ways. Your support of High Roadrestaurants is a great first step. Supporting our efforts to guide
restaurants into the High Road is a great second step. The final andsometimes more difficult step is holding Low Road employersaccountable and ensuring they see the light at the end of the tunnel. That light is one of dignity and respect by responsibly moving towardslivable wages, providing benefits, and increasing internal promotions. So enough talk, here are real actions you can take today.
1Eat Ethically at a High Road Restaurant!Support our High Road restaurants and dont forget to remind
them why you came in. High Road restaurants are listed in the
Awarded ROC Restaurant section.
2 Join an EatUp!
If you want to see more High Road restaurants in your neighbor-hood, join The Welcome Table, a national network of ethical
eaters who EatUp! for change. Visit TheWelcomeTable.net or
email [email protected] for more info.
3 Support the Fair Minimum Wage
and Healthy Families Acts
Sign onto our petitions demanding that Congress raise thefederal minimum wage for tipped workers, currently at $2.13/
hour, and provide paid sick days for all workers. You can send
these petitions by visiting our website, at www.rocunited.org.
4 Hold Low Road Employers AccountableYou can help by supporting workers with charges against
restaurant employers who are violating the law. You can call the
company to let them know that you wont support such illegal
practices or call your local ROC office to see how you can hold
employers accountable. If you are located in a city with an active
campaign against Darden Restaurants, such as the Capital Grille,
you can attend a local action in your city. Follow actions by
visiting the campaign website, www.dignityatdarden.org.

5 Give a TipWere talking about two kinds of tips here. First, always tip your
servers well, theyve been on their feet all day! Second,
everywhere you dine, share the tip cards located at the end of thisguide giving managment tips on how they can either be
recognized as a High Road employer or how they can get in
touch with ROC to help them create sustainable and equitable
workplace practices.
6 Share the love, donate to the cause
When you support ROC United, you are making an investment in:Promoting the high road to profitabilitythrough
education for workers and restaurant employers to effect
sustainable change in the restaurant industry
Fighting poverty of women and childrenby advocating
increasing the appallingly low $2.13 per hour tipped minimum
wage for restaurant workers
Advancing a restaurant-worker movementthrough changingthe restaurant industrys wage stealing practices and promoting
restaurants who are taking the high road to profitability.
Donate here:http://rocunited.org/about-us/donate/
7 Download the Diners Guide app and shareDownload our app here: http://rocunited.org/dinersguide/.Now you can take the guide with you. This nifty app uses
geolocators to map out restaurants in the Diners Guide
wherever you are in the United States! Share it with your friends
and show them how to eat ethically.

When you go out to eat, you shouldnt get wage theft, racism, and
sick cooks in the kitchen, along with your meal. How the food tastes at
a restaurant really doesnt matter, if the people who work there are
being mistreated. This guide will help you separatethe good guys from the bad.
ERIC SCHLOSSER, author of Fast Food Nation
...ROC-U produced a National Diners Guide that rates restaurants
based on how they treat their employees. (We have pocket guides forfish; finally, theres one for humans.)
MARK BITTMAN, NY Times columnist
