EXECUTIVE SUMMARY
The Western Visayas Regional Research, Policy and Legislative Agenda, 2013-2016 is a list of researchable areas that will guide researchers, the academe, graduate students and research institutions in identifying researchable topics that would be useful for planning and improving current public sector programs and projects. It also contains a list of proposed policies and legislations that are addressed to public executive and lawmakers for them to consider in their policy and legislative work. The studies and researches that would be undertaken based on the Agenda are expected to support all aspects of the development process. Moreover, researches and studies, if well disseminated, can assist decision-makers, local government officials, legislators and potential users in coming up with more informed decisions and actions. The workshop outputs were categorized based on the 11 chapters of the Regional Development Plan (Western Visayas), 2011-2016, These 11 chapters are: macroeconomy and poverty alleviation, competitive industry and services sector, sustainable agriculture and fisheries, tourism development, infrastructure support, human resource development, research and development, bio-fuels and renewable energy development, good governance and the rule of law, peace and security and environment and natural resources. Researchable topics include industry studies and situational/area analyses, commodity flows and market studies, impact studies, application studies, program and project proposals. This Documentation Report on the Formulation of the Western Visayas Regional Research, Policy and Legislative Agenda highlights the participatory process involved in the formulation of the Agenda, particularly among the regional line agencies, academe and private sectors and the coordinating agencies, namely: National Economic and Development Authority (NEDA), Department of Science and Technology (DOST) and the Philippine Association of State Universities and Colleges (PASUC), Region VI. The involvement of the private higher education institutions, regional line agencies and non-government organizations in the formulation of the Agenda is expected to address data, research and policy gaps in the Plan and to insure its utilization. To have common understanding of the desired goal and the processes involved, dialogues and meetings were conducted among the coordinating agencies and the various actors. Pre-workshop activities include the conduct of Coordinators’ meetings of agencies involved to thresh out issues concerning the

conduct of the workshop, including the delineation of their roles and responsibilities. A Steering Committee meeting, involving the regional heads of NEDA, DOST and PASUC-VI, was also undertaken to seal the agreements made by the technical working group, especially on budgetary concerns and division of responsibilities. During the actual conduct of workshops, roles were delineated among the facilitators from the regional line agencies, co-facilitators from state universities and colleges and documenters from NEDA and DOST. These entities play an important role in determining the quality of the workshop outputs, on how well they were able to draw out the participants’ creative ideas and how well these are documented. Facilitators were heads or technical staff of agencies whose mandate correspond to sector concerns, e.g., tourism, agriculture, etc.. On the other hand, co-facilitators are research directors of the 11 state universities and colleges in Western Visayas. Facilitators’ and documenters’ meetings were conducted to orient the facilitators/co-facilitators and documenters from NEDA and DOST of their roles and the desired outputs, as well as respond to issues proactively. Post workshop activities were conducted to refine the workshop outputs. Two consistency workshops with facilitators and regional line agencies were conducted during the last quarter of 2012 and first quarter of 2013. The final product will be packaged and furnished to regional line agencies, academic and research institutions, non-government organizations, local government units, legislators and major research institutions. This will serve as guide to researchers, the academe, graduate students and research institutions in identifying researchable topics.

DOCUMENTATION REPORT FORMULATION OF WESTERN VISAYAS REGIONAL RESEARCH, POLICY AND LEGISLATIVE AGENDA
CY 2013 – 2016
I. Rationale
The Regional Development Plan (Western Visayas), 2011-2016 serves as the blueprint of all development efforts in Western Visayas Region for the next five years. The RDP supports the goal of the Aquino administration of increasing economic and social opportunities towards inclusive growth.
The importance of researches cannot be overemphasized as it
supports all aspects of the development process. Completed researches and studies provide the needed data in doing the situational analysis to assess the region’s past performance as well as in identifying current issues, gaps and development constraints that prevent the region from moving forward rapidly and achieve its desired outcomes. Moreover, researches and studies, if well disseminated, assist decision-makers, local government officials, legislators and potential users in coming up with more informed decisions and actions.
In coming up with a good research agenda, the participation of the
academic community is necessary to merit a more integrated and supportive researches. The regional research agenda will serve as bases for the conduct of studies by researchers that appropriately respond to the development issues raised in the Plan. Thus, the involvement of, not only the state universities and colleges, but also the private higher education institutions, as well as the regional line agencies and non-government organizations in the formulation of the regional research, policy and legislative agenda, is expected to address the data, research and policy gaps in the Plan and ensures its usefulness.
The conduct of the workshops on the formulation of the Regional
Research, Policy and Legislative Agenda is a collaborative effort among NEDA, DOST and PASUC, Region VI.

II. Objectives
The series of workshops on the formulation of the Regional Research, Policy and Legislative Agenda have addressed the following objectives: A. To generate research topics that will be useful as references in
coming up with solutions to development issues raised in the Regional Development Plan (Western Visayas), 2011-2016, Area Development Plan, 2011-2020, Regional Development Agenda, 2010-2020; and
B. To identify policy/legislative measures needed to help resolve
problems and issues specified in the Plan or to help spur development in certain areas and sectors.
III. Scope
The Regional Development Framework looked at the ultimate goal
of the regional development efforts, which is improved quality of life in Western Visayas, and manifested by an empowered people and a globally-competitive economy.
The list of researchable topics was generated, taking into account the intervention areas which could help achieve the region’s ultimate goal. These development areas, which correspond to the 11 chapters of the RDP, are:

Researchable topics, under each development area, covered, were
classified as follows:
1. Industry Studies and Situational/Area Analyses that will study the situation of sectors, industries, vulnerable groups, economic and environmental areas, etc. that will be useful in determining what

else needs to be done to improve the situation of things, based on actual happenings on the ground;
2. Commodity Flows and Market Studies that will be useful in
determining the types of agricultural commodities, fishery products, or SME goods that are in demand; the cost of transporting goods; the flow of goods from producer to consumer;
3. Impact Studies that will determine the effect and transformation of
areas and people as a result of government intervention in the form of policies, programs and projects;
4. Application Studies that will surface the effect and benefits of new
technologies, tools, methodologies and approaches introduced by government in various sector fields;
5. Program/Project Proposals that will present new solutions,
intervention schemes and generation of new technologies that will help address public welfare issues, market failures, and other development problems and issues.
On the other hand, the list of policy and legislative proposals
included those that are addressed to program implementers, local sanggunians, or Congress.
IV. Activities Conducted
Activities were divided into: pre-workshop activities, workshop
proper and post-workshop activities to ensure the smooth implementation of the activity. A. Pre-workshop activities
Crucial to the actual conduct of the workshop were the preliminary activities undertaken. These included the following activities:
1. Levelling of expectations and proper delineation of tasks and
roles among sponsoring agencies
Several coordination meetings among sponsoring agencies, namely NEDA, DOST and PASUC and its technical working group were conducted so that workshop actors, such as the facilitators, co-facilitators and documenters, could level-off, and properly delineate and understand their roles and tasks.

a. Coordination meetings among sponsoring agencies, NEDA, DOST with PASUC, were conducted to finalize tasks and budgets. Two coordination meetings were held on:
July 31, 2012 at RD’s Room, DOST VI, Iloilo City with Director Rowen Gelonga and ARD Emelyn Flores (DOST), Mr. Noeni Nepomuceno (WESVARRDEC), Ms. Estela Paredes, Ms. Ma. Lourdes Miado, Ms. Ma. Leah Letrero and Ms. Ma. Isabel Blancia (NEDA)
September 3, 2012, DOST Training Room, DOST VI, Iloilo City with ARD Emelyn Flores and provincial staff (DOST), Ms. Cynthia Lumampao, Ms. Ma. Lourdes Miado, Ms. Ma. Leah Letrero, Ms. Juvelyn Boniba, and Ms. Ma. Isabel Blancia (NEDA) and Dr. Geronimo Gregorio of CAPSU representing PASUC.
The proposed activity design for the conduct of
the Workshop on the Formulation of the Western Visayas Regional Research, Policy and Legislative Agenda was reviewed and revised based on the comments and agreements reached during the coordination meetings. Changes were made, in terms of the sequencing of the Program, roles during the workshop proper, as well as assignment of the SUCs on particular chapters. Revisions on the budget were likewise made, to correspond to the number of additional participants identified to the activity. The tasks of each sponsoring agency were, likewise, finalized. (Annex 1- Agency Tasks/Assignments).
b. Facilitators’ Meetings
Partner agencies with SUCs met prior to
workshop proper. There were two Facilitators’ Meetings conducted:

Facilitators were the key players in the research formulation workshop. How they generate participation from the participants while culling out inputs and ideas on research areas and topics, were crucial elements in coming up with a good research agenda. The facilitators’ meetings served as venues to level expectations between facilitators, co-facilitators and documenters. They were oriented on the purpose, expected outputs and outcomes of the activity. They, in turn, raised clarifying issues and concerns, which might be encountered in the workshop proper.
The roles of facilitators, co-facilitators and
documenters were defined. (Annex 2 - Roles of Facilitators, Co-facilitators and Documenters) This ensured common appreciation and understanding of the scope of their tasks during the workshop proper. Also, the names of facilitators and co-facilitators with the documenters were finalized, right there and then.
There were 11 facilitators and 11 co-facilitators
to spearhead discussions in the workshop groupings, which corresponded to the 11 chapters of the RDP. Agencies, whose mandates are relevant to the RDP Chapters served as facilitators, with the research directors of the State Universities and Colleges as co-facilitators. Documenters were from NEDA and DOST.

2. Generating support from many key players in the region as
possible in the formulation of the research agenda
Unlike the previous activities on research agenda formulation where participation was limited to line agencies and SUCs, the current activity had broader participation with the academic community represented by both public and private schools. In addition, the non-government organizations, LGUs, business groups and regional line agencies, participated in the series of activities. Considering that government agencies do not have the monopoly of

knowledge and expertise in research and policy formulation, the involvement of the academe from both public and private tertiary schools, LGUs and the NGOs has generated more substantial inputs resulting to more enriched and relevant outputs as both users and implementers were involved.
The current process followed a more integrated
approach, looking at key players in society for a more responsive research agenda.
The pre-identified participants to the workshop were presented for comments and finalization. Suggestions as to additional participants, mostly coming from the non-government organizations and business groups, were included in the final list. (Annex 3- Workshop Groups)
3. Securing approval/confirmation by Regional Heads of
cooperating institutions (NEDA, DOST, and PASUC)
The agreements reached during the series of meetings with facilitators, co-facilitators and documenters as well as the technical working group from NEDA and DOST were presented for confirmation by the regional heads during the Steering Committee meeting held on August 17, 2012 at the Office of the NEDA-VI Regional Director. The Steering Committee is composed of NEDA Regional Director Ro-Ann Bacal and DOST Regional Director Rowen Gelonga. The PASUC head, President Luis Sorollaof WVCST, was represented by Dr. Carmelo Ambut of WVCST. DA Assistant Regional Director Dr. Joyce Wendam was present to support the RA activities and provide inputs to the Research Utilization activity which was held in October.

Finalized from this meeting were the mechanics that would be employed by the facilitators and co-facilitators during the workshop proper, the scope of the research agenda and the sharing of expenses among the sponsoring agencies. DOST-VI would shoulder the food during the two-day workshop, while NEDA took care of the supplies and the overall supervision of the whole activity. PASUC would take care of the tokens and honoraria of invited resource persons.
4. Generating preliminary list of researchable areas/topics
Recognizing the limited time given for discussion
during the workshop proper, preliminary list of research areas or topics were gathered from the regional line agencies, local government units, private sector representatives and research consortia using the matrix below. This served as inputs during the Workshop Proper where the participants could take off. Agencies and LGUs were requested to accomplish the matrix for easier consolidation:

B. Workshop Proper
The workshop proper was conducted on September 12-13,
2012 at the RDC Conference Hall, NEDA VI, Iloilo City. (Annex 5 – Program of Activities) There were 138 participants in attendance, coming from regional line agencies, public and private higher education institutions, non-government organizations, business sector and local government units.

Day 1 (September 12, 2012) Opening Ceremony
In the opening program, Director Ro-Ann A. Bacal, CESO III of NEDA and RDC-VI Vice-Chairperson delivered the message on behalf of the RDC-VI Chairperson, Governor Victor Tanco, Sr. She pointed out the lack of statistics and studies and/or importance of up-to-date statistics, researches and independent studies as basis for planners, implementers, and policy makers to come up with more evidence-based decisions as a result of better analysis of the regional situation. She encouraged the active participation of the participants in order to come up with a Regional Research, Policy and Legislative Agenda, that is significant and relevant. Moreover, she reminded the participants to also come up with list of proposed policies and legislations that can be forwarded to executives and lawmakers for their consideration.
Workshop on identifying research areas and topics
The first day workshop was focused on identifying research areas and topics. Director Bacal and Director Rowen R. Gelonga of DOST provided inputs to set the direction for which the participants were guided upon in the identification of researchable areas or topics.
Prepping up the tasks ahead, presentations were made by
Director Bacal, where she highlighted the salient points of the Regional Development Plan. (Annex 6 – RDP Powerpoint Presentation) She presented the vision of the RDP, its development framework and the areas that require intervention and support from Research and Development.
This was followed by the presentation of Director Rowen R.
Gelonga, CESO III of DOST VI on the Research Priorities and Thrusts in Western Visayas. (Annex 7 – Research Priorities and Thrusts in Western Visayas)
Director Gelonga called attention on the need to rationalize
and optimize resources towards research and development (R&D). For one, he underscored that research and development is the most “hungry” part of the technology value chain. He also pointed out that technology diffusion has many stakeholders but R&D has few although the Philippines is capable of coming up with good quality R&D. However, records showed that from 2000 to 2010, the annual research publications increased by 250 percent but patent filings by

Philippine Institutions did not change much. Among these publications, 27 percent contained potentially patentable subject matter. Patent applications for the Philippines increased to over 3,500, while countries like Korea and China have over 100,000 patent applications.
Director Gelonga further explained that there are three Ts of
Economic Development/Factors of Creativity Index, namely: technology, talent and tolerance. In terms of Global Technology Ranking, the Philippines ranked at 52, for Global Talent Ranking (64); and for Global Tolerance Ranking (41). Of the 83 countries ranked, the over-all Global Creativity Index Rating of the Philippines is at 54. He said that these rankings showed that Philippines is capable of coming up with good quality R&D. He maintained that there is a need to channel resources to R&D. Accordingly, in terms of financial resources devoted to R&D as share of total economic output, Philippines ranked 80; for share of human resources devoted to R&D, as measured by the share of total labor force made up of researchers, the Philippines ranked 60 and for patents granted per capita, the Philippines ranked 80.
DOST, as a mandated agency for science and technology,
should provide central direction, leadership and coordination of all science and technology activities in the country. Its priority areas are: developing solutions to pressing national problems like dengue control and malnutrition; developing appropriate technologies to create growth in the countryside through programs like SETUP or Small Enterprise Technology Upgrading Program; harnessing technology to improve industry competitiveness such as support to BPO industry or pilot plants and testing facilities; using science and technology to enhance delivery of government and social services like tablet PC and government broadband network; and harnessing emerging technologies to boost national competitiveness such as nanotechnology, genomics, transport systems, among others.
He also acknowledged that there are other government
agencies in the region that are significantly and directly involved in R&D, as follows: DENR, DA, CHED and consortia like WVCIERD, WVCHRD and Western Visayas Agriculture and Resources Research and Development Consortium (WESVARRDEC).
For Western Visayas, there is that need to work on a common
agenda. As pointed out, this ensures that research and development will be responsive to regional development concerns while optimizing its limited resources in terms of funds, expertise, laboratory facilities, and time, among others. Moreover, it

rationalizes and prioritizes R&D activities while building on each others’ success, taking hold of Gestalt’s perspective, that the whole is more than just the sum of its parts.
As emphasized, R&D stakeholders include the government
research institutes, academe or higher education institutions, private sector, business and industry and researchers and scientists. Together, they can create new technologies, studies and recommend policy inputs. And that is what the workshop would want to capture as it updates its Regional Research, Policy and Legislative Agenda.
Workshops
Before the participants broke up into their respective workshop groups, ARD Joyce Wendam of the Department of Agriculture explained the mechanics of the workshop. For each workshop group, the group members were predetermined and rooms they were assigned. Dr. Wendam, explained the matrices the groups need to work on.
For Matrix 2, the groups need to review the preliminary list
provided. Using the metacards prepared by the secretariat, the participants can add, delete or revise the list of topics, depending on their discussion. Columns 1 to 3 were filled-up beforehand, based on the RDP, ADP and RDA.

As the outputs were expected to be displayed in the RDC
Hall the next day for the gallery walk and critiquing of members by other workshop groups, the participants exerted efforts in finishing their outputs, which in many cases, extended beyond 5:00 PM. The documenters refined the outputs for display and critiquing until 9:00 PM.
Day 2 (September 13, 2012) Critiquing of Workshop Outputs
The second part of the activity was on critiquing of workshop outputs. The day started with the recap of the 1st day’s activity by ARD Emelyn Flores of DOST VI. The participants were then given the opportunity to move around the conference hall and go over the workshop outputs of other groups. For two hours, the participants indicated in the metacards their additional comments which they deemed important to be considered in the finalization of the outputs. The documen-ters gathered these inputs, for incorporation in the first draft Agenda for further review during the consistency workshop. Technology Transfer presentations
Aside from the gallery walk, the second day was also devoted
to presentations on relevant topics that would further orient the participants on the importance of research and technology in spurring economic development in the region and the country.

These three major presentations pertain to technology transfer, commercialization and accessing network for foreign funding sources for research.
1. Republic Act 10055: Philippine Technology Transfer Act of
2009
In his presentation, Director Gelonga gave a
background on how RA 10055 or Technology Transfer Act of 2009 became a law. This was signed by President Gloria Arroyo on March 23 into RA10055 which took effect on May 8, 2010.
The objective of the Philippine Technology Transfer
Act of 2009 is to promote and facilitate the transfer, dissemination, effective use, management and commercialization of intellectual properties (IPs), technology and knowledge resulting from R&D funded by government for the benefit of the national economy and taxpayers.
The Act is in response to the challenges faced by
techno-logy transfer and commercialization as it seek enabling environment to promote the fruits of research and creative efforts from laboratories to market. It harnesses the potentials and creates wealth from government-funded R&D through intellectual property rights (IPR) protection and increased stakeholders’ benefits and encourages further innovation.
The presentation covered aspects on intellectual
property rights ownership, revenue sharing, commercialization of IPRs by the researcher, use by government, compulsory licensing and assumption of potential IPRs, use of income establishment and maintenance of revolving fund for R&D and technology transfer, and establishment and maintenance of revolving fund for R&D and technology transfer, and institutional mechanisms as well as dispute resolution. 2. Accessing Network for Foreign Funding Sources for
Research

A total of EUR51 billion FP7 budget is available in a
span of five years and these cover the following areas: cooperation, ideas, people, capacities, and JRC.

A case study was likewise presented to highlight the success of DOST’s intervention, “Commercialization of Medicinal Plant Products: A Success Story?”(Annex 11) The R&D period and investment, in this particular project spanned 25 years with about P85 million expended for the 10 medicinal plants prioritized by the National Integrated Research Program on Medicinal Plants (NIRPROMP).
IP and IPR Protection were provided for Sambong
Tablet (Patent No. 1-1997-57575), Lagundi Pediatric Syrup (UM No. 2-1999-00164), Yerba Buena Tablet (UM No. 2-2003-000427) and Atis Lotion (UM No. 2-1995-15504), with two medicinal items have pending Patent/UM applications.
Partnership with corporation was also facilitated. In
this case, Pascual Laboratories, Inc. took on the technologies licensed with trademarks: Ascof (for Lagundi) and ReLeaf (for Sambong). From initial remittance of P164,018.85 for royalties and license fees on Lagundi and Sambong products in 1997, it increased to P13,856,915.13 in 2010. Total remittance for royalties and license fees amounted to P50,046,894.79 from 1997 to 2010 with 60 percent going to DOST and 40 percent to IP owner.

Next Steps
The workshop was just the first step in the formulation of the Regional Research, Policy and Legislative Agenda. Ms. Ma. Lourdes Miado, OIC-Chief, PPFD, NEDA VI elaborated on the next steps.
1. Consistency Workshop
The outputs of the 11 workshop groups will be subjected to further review and refinement through a Consistency Workshop with NEDA, DOST in coordination with concerned facilitators/co-facilitators and mandated agencies. The harmonization and complementation of outputs of various workshop groups will be major considerations in the refinement of outputs.
2. RDC-VI Approval
The RDC will pass a resolution approving the Regional Research, Policy and Legislative Agenda, 2013-2016, which would reflect the research needs of planners, policy-makers and program implementers.
3. Advocacy and Dissemination
The RDC-approved Research, Policy and Legislative
Agenda will be shared to the academe and research institutions with the hope that they then can use this as their reference when deciding on research topics or studies they intend to pursue.
The RDC will request the SUCs and HEIs to use the
document as a reference of graduate students doing their thesis work so that their outputs are responsive and relevant in address development issues and concerns.
The list of proposed policies and legislations will be
referred to public executives and lawmakers for consideration in their policy and legislative work.
Copies of the Agenda will also be provided to major
research institutions in the country, including foreign donors for their reference in providing possible funding support.

Closing Program
After a grueling 2-day activity, Dr. Luis M. Sorolla, Jr., PASUC VI President, delivered the closing remarks where he thanked the participants for their active participation. This was followed by the giving of certificates of participation by the coordinating agencies heads - Director Ro-Ann A. Bacal of NEDA, Director Rowen R. Gelonga of DOST and Dr. Luis M. Sorolla of PASUC-VI.
C. Post-Workshop Activities
A Consistency Workshop was initiated by NEDA with
facilitators, co-facilitators and mandated agencies were conducted on October 17, 2012 at Jalaur Hall, NEDA VI, Iloilo City. The purpose of this activity is to review the workshop outputs for harmonization and complementation. The facilitators and co-facilitators with mandated agencies, meticulously went through each of the research areas and topics presented. Out of 11 workshop outputs, 6 were edited based on the deliberations and comments forwarded: Macroeconomy and Poverty Alleviation, Competitive Industry and Services Sector, Sustainable Agriculture and Fisheries, Human Resource Development, Research and Development and Peace and Security.
Another Consistency Workshop was conducted on January
30, 2013 for the remaining outputs: Tourism Development, Infrastructure Development, Biofuels and Renewable Energy Development, Good Governance and the Rule of Law and Environment and Natural Resources.

Role of
Facilitators/Co-Facilitators
Lead the discussion by explaining that the main objective of the activity is to generate a list of research/policy/ legislative
topics that would address the information/ research gaps in the plans (RDP, ADP, RDA) which could support the Plans’ effective implementation;
Clarify that the activity is intended to “harvest ideas” and everyone is free to share;
Ensure that the topics are responsive to the areas of concern identified in the RDP chapters and the research policies and legislative ideas could be realistically undertaken;
The participants will be guided by the list of research topics generated by DOST and NEDA staff from the national research consortia and the participants themselves. This does not preclude them from generating additional topics which may arise during the group discussion;
Traffic the discussion and ensure that the workshop is concluded on time;
Ensure that the documentation correctly captures the discussion
Role of Documenters Document the proceedings and ensure that all inputs, including the list of long ideas presented by the participants are documented;
Ensure that the visualization rule is followed:
One idea per card;
Use capital letters; no script
Maximum of 3 lines per card;
Write in brief but concise statements (no vague ideas)
Take the outsider’s perspective when writing (i.e. ensure that the cards are understandable even to an outsider;
Print out outputs and submit to Facilitator/Co-facilitator for review;
Display outputs in the Conference Room for critiquing by participants on the next day. (Walls or pin boards may be used for display);

COMMERCIALZIATION OF INTELLECTUAL PROPERTY GENERATED FROM RESEARCH AND DEVELOPMENT FUNDED BY GOVERNMENT
AND FOR OTHER PURPOSES”

To promote and facilitate the transfer, dissemination, effective use, management and commercialization of IPs, technology and knowledge resulting from R&D funded by government for the benefit of the national economy and taxpayers.
(Article I, Section 3)
OBJECTIVE
All R&D activities carried out on behalf and for the interest of the government by RDIs receiving grants directly from the GFA; all IPRs derived from R&D funded by government, all government agencies that fund R&D, and all institutions that implement government funded R&D.
(Article I, Section 5)
COVERAGE
Ownership of IPRs derived from research funded in whole or in part by GFA shall be assigned to the RDI that actually implemented the research.
In case of collaborative research where two or more RDIsconducted the research funded by the GFA, the RDIs shallown the IPRs jointly or as otherwise stipulated in theresearch agreement between them.

All revenues from the commercialization of IPs and IPRs shall accrue to the RDI, unless there is a revenue sharing provision in the research funding agreement.
In no case will the total share of the GFA(s) be greater than the share of the RDI.
In case of joint funding, where research is funded by a GFA in part, and by other entity or entities in part, the RDI may enter into contractual agreements with the other entity or entities providing funding.

REVENUE SHARING
Sharing of revenues between RDI and researcher shall begoverned by an employer-employee contract or other relatedagreements; without prejudice to the rights of the researcherunder RA 8439 or the “Magna Carta for Scientists, Engineers,Researchers, and other S&T Personnel in Government”.

REVENUE SHARING
An RDI may allow its researcher-employee to create/join (detail/secondment) a spin-off company, provided that the researcher-employee takes a leave of absence without pay for a period of one year, renewable for another year.

The grounds, terms and conditions of the use by government and/or compulsory licensing stated in the IP Code shall be adopted for all IPRs generated under this law.
The GFA and/or Parent Agency may assume ownership of anypotential IPR in cases of national emergency or othercircumstances of extreme urgency.

USE BY GOVERNMENT, COMPULSORY LICENSING AND ASSUMPTION OF POTENTIAL IPRs
Public RDIs undertaking technology transfer shall be vested with the authority to use its share of the revenues derived from IP commercialization. All income from IPR commercialization shall be constituted to a revolving fund for use by the RDI undertaking tech transfer, subject to accounting and auditing rules.

Public RDIs shall be allowed to use revenues derived from transfer of IPRs for but not limited to the following:
• Defray IP management costs/expenses• Fund R&D, S&T capacity building, and technology transfer
activities• Operation of TLOs

In case the revenues after payment of all costs and expenses for IPR management, including the payment of royalties to other parties, shall exceed 10% of the annual budget of the RDI, then a minimum of 70% of the excess revenues shall be remitted to the Bureau of Treasury, provided, that the GFA has solely funded the research.
However, this shall not apply to SUCs and GOCCs by virtue of their fiscal autonomy.

DOST shall establish a system for the cost-effective sharing of and access to technologies and knowledge by developing appropriate public access policies and procedures which shall be made known to the public.
(Article IX, Section 19)
INSTITUTIONAL MECHANISMS
The DOST shall call for a regular national conference of all GFAs and RDIs in order to: (a) promote multi-disciplinary, joint and cross collaboration in research and development; (b) coordinate and rationalize the research and development agenda; and (c) harmonize all research and development agenda and priorities.

All RDIs are encouraged to establish their own TLOs in whatever form, and to adopt their own policies on IPR management and technology transfer, in accordance with this act and other existing laws and in support of the policies of the IPO and the national policy and the mandate of their Parent Agency.

INSTITUTIONAL MECHANISMS
The DOST, DTI and IPO, in consultation with GFAs such as CHED, DA, DOH, DOE, DENR, and DND, shall undertake activities geared towards building the capacity of GFAs and RDIs in commercializing IPs.
The DOST, DTI and IPO shall jointly issue the necessary guidelines on IP valuation, commercialization, and information sharing, which may include, but not be limited to, the following considerations: public benefit and national interest, market size, cost and income

The IRR shall provide for the administrative procedure for resolving any disputes on the determination for government ownership.

• Intellectual Property Rights (IPR) Assistance Program
provides assistance to Filipino inventors in securing intellectual property protection for their inventions and utility models. The assistance covers advisory/consultancy services and funding support for fees attendant to the preparation, filing and prosecution of applications for patent and utility model registration.
• Academe/Industry Prototype Development Assistance Program
provides financial support for the fabrication and testing of commercial prototypes in order to shorten the interval between the development stage and actual use of available technologies.

• Industry-based Invention Development (IBID) Program
funds inventions that have industrial application. It is implemented through a partnership between the inventor and a private enterprise. In this collaboration, the private firm finances the fabrication of one prototype of the invention that will undergo testing, debugging, and refining while it is being run in an actual industrial environment.
• Invention-based Enterprise Development (IBED) Program
aids an inventor in developing his or her invention into an enterprise commodity to make it available to the consumers by financing the pilot production including the purchase or fabrication of the equipment needed to manufacture the invented technologies.
