2012 Nomination Criteria – Synchronised Swimming 1 2012 AUSTRALIAN OLYMPIC TEAM Synchronized Swimming Australia (“SSAI”) NOMINATION CRITERIA NOTE: The AOC reserves the right to require amendments to the Nomination Criteria and amend its Selection Criteria as necessary, particularly where there is a change to the Qualification System or significant circumstances affecting the nomination process. 1 Shadow Team (1) SSAI will choose Athletes from within its sport to be members of the AOC’s Shadow Team. The AOC may also recognise other Athletes from within this sport to be members of the Shadow Team. (2) SSAI may only nominate members of the Shadow Team to the AOC for selection in the 2012 Australian Olympic Team. (3) In order to be chosen by the SSAI as a member of the Shadow Team for the Team Event, each athlete must be ranked in the top 12 at the conclusion of Round 3 of the SSAI Trials based on an accumulative total of scores from Rounds 1, 2 and 3 of the SSAI Trials assessed in accordance with Attachment 3. Rounds 1 to 3 of the SSAI Trials will be: (a) held as follows: Round 1 – Brisbane, 4 December 2010; Round 2 – Brisbane, 25 April 2011; Round 3 – Brisbane, 18 September 2011. (b) weighted in the following percentages: Round 1 – 10%; Round 2 – 40%; and Round 3 – 50%. (4) Athletes will be ranked in conclusion of each round based on the aggregate score achieved in accordance with the assessments set out in the Attachment 3. Additional Athletes invited by SSAI to compete in the Round 4 Trials pursuant to clause 2.3(1)(b) below will also be included in the Shadow Team for the Team Event. (5) In order to be chosen by SSAI as a member of the Shadow Team for a Duet an Athlete must: (a) have placed in the top 3 Open Duets at the 2011 SSAI Open Championships held from 23 to 25 April 2011 in Brisbane, based on an assessment of the routine as marked in accordance with Attachment 4; and (b) have been included as a member of the Shadow Team for the Team Event pursuant to subclause (3) above. (6) In order to be recognised as a member of the Shadow Team the Athlete must have signed the Consent to Shadow Team Membership Form (Attachment 1) and in the case of minors, the Parents/Guardians Acknowledgment for Minors Form (Attachment 2) and provided it to SSAI, Attention: Kerrie Hammett, 32 Bellflower Place, Calamvale QLD 4116. (7) SSAI will provide all Athletes chosen or recognised as members of the Shadow Team with the Guide to Selection, the Selection Criteria and this Nomination Criteria. The AOC Olympic

2012 AUSTRALIAN OLYMPIC TEAM Synchronized Swimming Australia (“SSAI”)

NOMINATION CRITERIA NOTE: The AOC reserves the right to require amendments to the Nomination Criteria and amend its Selection Criteria as necessary, particularly where there is a change to the Qualification System or significant circumstances affecting the nomination process.

1 Shadow Team

(1) SSAI will choose Athletes from within its sport to be members of the AOC’s Shadow Team. The AOC may also recognise other Athletes from within this sport to be members of the Shadow Team.

(2) SSAI may only nominate members of the Shadow Team to the AOC for selection in the 2012 Australian Olympic Team.

(3) In order to be chosen by the SSAI as a member of the Shadow Team for the Team Event, each athlete must be ranked in the top 12 at the conclusion of Round 3 of the SSAI Trials based on an accumulative total of scores from Rounds 1, 2 and 3 of the SSAI Trials assessed in accordance with Attachment 3. Rounds 1 to 3 of the SSAI Trials will be:

(a) held as follows:

Round 1 – Brisbane, 4 December 2010;

Round 2 – Brisbane, 25 April 2011;

Round 3 – Brisbane, 18 September 2011.

(b) weighted in the following percentages:

Round 1 – 10%;

Round 2 – 40%; and

Round 3 – 50%.

(4) Athletes will be ranked in conclusion of each round based on the aggregate score achieved in accordance with the assessments set out in the Attachment 3. Additional Athletes invited by SSAI to compete in the Round 4 Trials pursuant to clause 2.3(1)(b) below will also be included in the Shadow Team for the Team Event.

(5) In order to be chosen by SSAI as a member of the Shadow Team for a Duet an Athlete must:

(a) have placed in the top 3 Open Duets at the 2011 SSAI Open Championships held from 23 to 25 April 2011 in Brisbane, based on an assessment of the routine as marked in accordance with Attachment 4; and

(b) have been included as a member of the Shadow Team for the Team Event pursuant to subclause (3) above.

(6) In order to be recognised as a member of the Shadow Team the Athlete must have signed the Consent to Shadow Team Membership Form (Attachment 1) and in the case of minors, the Parents/Guardians Acknowledgment for Minors Form (Attachment 2) and provided it to SSAI, Attention: Kerrie Hammett, 32 Bellflower Place, Calamvale QLD 4116.

(7) SSAI will provide all Athletes chosen or recognised as members of the Shadow Team with the Guide to Selection, the Selection Criteria and this Nomination Criteria. The AOC Olympic

Team Selection By-Law and the Qualification System will be made available on the AOC’s website (www.olympics.com.au).

(8) SSAI will advise the AOC of the Athletes that it has chosen as members of the Shadow Team at such time as required by the AOC.

(9) If an Athlete breaches the requirements of the Nomination Criteria, the Selection Criteria or the AOC Olympic Team Selection By-Law, SSAI or the AOC may suspend or terminate the Athlete’s membership of the Shadow Team.

2 Nomination of Athletes

2.1. General Criteria

For the purposes of nomination to the AOC of Athletes for selection to the 2012 Australian Olympic Team, SSAI will:

(1) only nominate Athletes who are, or are recognised by the AOC as, members of the Shadow Team for the relevant event (Team Event or Duet);

(2) only nominate those Athletes it honestly believes have met the requirements described in the Selection Criteria;

(3) only nominate those Athletes who have signed the Athlete Nomination Form as issued by the AOC from time to time;

(4) not nominate more Athletes (including reserves) than the maximum number permitted under the Qualification System; and

(5) not nominate Athletes who have breached the AOC Anti-Doping By-Law unless the Athlete has already been sanctioned for the breach and has completed the sanction imposed.

2.2. Nomination of Athletes for a Duet

(1) Participation in Nomination Events

(a) Shadow Team members for the Duet who rank in the top 5 Athletes at the conclusion of Round 3 of the SSAI Trials will be eligible for direct entry in to, and must compete with a result (i.e. should the athlete be disqualified from the competition, no result will be awarded) at the Duet Trials (to be held in on 14 to 15 January 2012 in Brisbane).

(b) Shadow Team members for the Duet who do not rank in the top 5 Athletes at the conclusion of Round 3 of the SSAI Trials will be required to compete in Round 4 of the SSAI Trials (to be held on 14 and 15 January 2012 in Brisbane) and rank in the top 9 (or less, where any Shadow Team members for a Duet qualify for direct entry to, and compete at, the Duet Trials pursuant to clause (a) above) Athletes from that event. Such Athletes will then be eligible to compete in the Duet Trials.

(2) SSAI will nominate Athletes to the AOC for the Duet who:

(a) have participated in the following SSAI training camps:

Camp 1 – 19 September to 1 October 2011;

Camp 2 – 7-15 November 2011 – Gold Coast;

Camp 3 – 30 November to 9 December 2011 – Gold Coast and

(b) participated in Duet Trials and as a duet, are the highest placed duet from that event according to the aggregate score from their technical and free routine scores, assessed in accordance with Attachment 4 and weighted as follows:

Technical routine 50%

Free routine 50 %

2.3. Nomination of Athletes for the Team Event

(1) Participation in Nomination Events

(a) Shadow Team athletes for the Team Event and any Duet Athlete covered by clause 2.2(1)(b) above will be eligible to compete in Round 4 of the SSAI Trials.

(b) In the event that any Athlete who ranks in the Top 12 at the conclusion of the Round 3 Trials achieves a routine score of less than 6.9, SSAI may in its absolute discretion invite additional athletes to compete in Round 4 of the SSAI Trials. In this case, SSAI will notify Athletes of its intention to do so by placing a notice through the State Secretaries no later than 6 October 2011 and inviting expressions of interest from any Athlete who has:

(i) competed in any previous FINA World Championship event for synchronized swimming; or

(ii) participated in any of Rounds 1, 2 or 3 of the SSAI Trials.

Any Athlete wishing to participate in Round 4 of the SSAI Trials must notify SSAI of their interest by no later than 17 October 2011.

(c) The weighting for Round 4 of the SSAI Trials will be 100%.

(2) SSAI will nominate those Athletes for the Team Event who to the satisfaction of the SSAI have met the following requirements:

(a) as members of the Shadow Team selected after conclusion of Round 3 Trials have participated in the following SSAI training camps:

Camp 1 – 19 September to 1 October 2011;

Camp 2 – 7-15 November 2011 Gold Cost; and

Camp 3 - 30 November to 9 December 2011 Gold Coast.

Swimmers who are seeking nomination under clause 2.3(1)(b) will not be required to fulfil the requirements set in this clause 2.3.(2)(a).

(b) have satisfied requirements set in a subclause 2.2 (1) (a) above regardless of being successful in gaining nomination for a Duet Event; or

(c) have participated in Round 4 of the SSAI Trials and have placed in the top 9 (or less, subject to the number of athletes who are eligible for nomination pursuant to sub-clause 2.3(2)(b) above ) athletes at that event based on an assessment of the performance in accordance with Attachment 3 and weighted as follows:

General synchro skills 30%

Routine skills 70%:

3 Illness/Misadventure/Extenuating Circumstances

This clause will only apply in determining whether an Athlete has met the additional criteria imposed by SSAI pursuant to clauses 1(3), 2.2(2) (a) and 2.3(2)(a).

(1) In considering the performances of Athletes at events, trials, training camps or other attendances required under clauses1(3), 2.2(2)(a) and 2.3(2)(a) of this Nomination Criteria the SSAI Selection Panel may in their discretion give weight to extenuating circumstances. For the avoidance of doubt, Athletes still need to participate in Rounds 1, 2 and 3 of the SSAI Trials.

(2) For the purposes of this clause 3, “extenuating circumstances” means an inability to compete and/or attend events, trials, training camps or other attendances arising from:

(a) injury or illness;

(b) equipment failure (where applicable);

(c) travel delays;

(d) bereavement or disability arising from death or serious illness of an immediate family member; and/or

(e) any other factors reasonably considered by the SSAI to constitute extenuating circumstances.

(3) Athletes unable to compete at events, trials, training camps or other attendances required under clauses1(3, 2.2(2)(a) and 2.3 (2) (a) of this Nomination Criteria must advise the SSAI Executive Officer in writing of this fact and the reasons before the commencement of the such events, trials, training camps or other attendances.

(4) In the case of illness or injury, Athletes will be required to undergo a medical examination by a doctor or doctors nominated by the SSAI Selection Panel.

(5) A decision in each case of extenuating circumstances will be made by the SSAI Selection Panel on an individual basis. Any such decision will not be binding on the AOC.

4 Reserve Athletes

(1) The SSAI Selection Panel may, in their discretion, identify one athlete as a reserve athlete for the Duet. The reserve athlete must:

(a) be a member of the Shadow Team for the Duet; and

(b) achieve the highest combined total score in both technical and free routine swum with each of the nominated duet members (total of four routines) at the Duet Trials.

(2) SSAI, in consultation with the SSAI Selection Committee, may, in their discretion, identify additional athletes for the Team event as reserve athletes. Athletes identified as reserve athletes for the Team event must:

(a) be members of the Shadow Team for the Team event; and

(b) be ranked as the next highest placed athlete(s) from Round 4 of the SSAI Trials, as per clause 2.3(2)(c), in that order of priority.

(3) Athletes identified as reserve athletes for either the Duet or Team event will not be nominated to the AOC and therefore will not be part of the 2012 Australian Olympic Team, unless replacing an athlete as outlined in clause 5 below.

5 Replacement of Nominated Athletes

(1) Athletes nominated in the Duet and Team event will only be replaced if, in the opinion of the SSAI nominated medical professional, the following circumstances exist:

(a) the Athlete will not be capable of performing in the 2012 Olympic Games, London, to the level at which the Athlete would be expected to perform if not affected by the illness/injury in question; or

(b) by competing with the illness or injury in question at the 2012 Olympic Games, London, the Athlete may suffer significant short or long term medical complications that pose an unacceptable risk to the Athlete.

(2) The SSAI Selection Panel must follow the recommendation of the SSAI nominated medical professional when determining whether an athlete should be replaced.

(3) If SSAI determine to replace an athlete, SSAI will recommend to the AOC that the Athlete be replaced by a reserve athlete in accordance with clause 4 above.

(4) The AOC will determine whether a selected Athlete should be replaced, in its absolute discretion. In exercising its discretion, the AOC will be subject to any conditions that apply in relation to entry for the 2012 Olympic Games.

(5) The final date of replacement will be determined by the LOCOG Late Athlete Replacement Policy,

6 Making of Nominations

Nominations by SSAI must be received by the AOC by 10:00 am AEST on Friday 22 June 2012. Nominations made after this deadline (or within such further deadline as the AOC may allow) will be invalid unless made pursuant to a direction or award in respect of an appeal against non-nomination to the SSAI Appeals Tribunal or the Court of Arbitration for Sport pursuant to the AOC’s Olympic Team Selection By-Law and which appeal had been commenced prior to the deadline for receipt of nominations by the AOC.

The 10:00am AEST on Friday 22 June 2012 deadline for the making of nominations by the SSAI applies irrespective of any deadline prescribed under the Qualification System or by the Organising Committee for the 2012 Olympic Games.

7 Amendments to Nomination Criteria

This Nomination Criteria may be amended by SSAI with the prior written approval of the AOC. Any amended Nomination Criteria will be distributed by SSAI by email to all Shadow Team members and placed on www.synchro.org.au.

14 Interpretation

(1) Words used in this Nomination Criteria have the same meaning ascribed to them in the AOC’s Olympic Team Selection By-Law unless a contrary meaning appears from the context.

(2) In this Nomination Criteria the following words and phrases have the following meanings:

“Duet Trials” means the trial to be held by SSAI in conjunction with Round 4 of the SSAI Trials, held 14-15 January 2012

“SSAI” – Synchronized Swimming Australia Inc

“SSAI Selection Panel” - means the panel appointed by SSAI at the time comprising the following individuals:

“SSAI Trials” - means Rounds 1 to 4 of the Trials to be held by SSAI as part of the nomination process for the 2012 Olympic Games (Team Event and Duet)

“Team Events” - Team Technical and Free Events

The term “swimmer” and “athlete” have the same meaning and can be used interchangeably.

15 Law

This document is governed by the laws applicable in the State of New South Wales.

2012 AUSTRALIAN OLYMPIC TEAM CONSENT TO SHADOW TEAM MEMBERSHIP

Synchronized Swimming Australia

I consent to being a member of the Shadow Team for nomination by the above NF for selection to the 2012 Australian Olympic Team. I make this acknowledgement honestly and fully and confirm that this acknowledgement is not false or misleading:

1 I have been provided with, or been given access to, and will be bound by and observe the terms of the AOC Olympic Team Selection By-Law, the AOC Selection Criteria applicable to my sport and my NF’s Nomination Criteria in force and as amended from time to time. I acknowledge that all members of the Shadow Team will likewise be bound by and must observe the same terms.

2 The AOC’s Olympic Team Selection By-Law and the Selection Criteria may be amended by the AOC from time to time. I will be bound by and observe the AOC’s Olympic Team Selection By-Law and the Selection Criteria as amended, and acknowledge that any amendments to the AOC’s Olympic Team Selection By-Law and Selection Criteria will be posted to the AOC’s website (www.olympics.com.au) along with the Qualification System applicable to my event.

3 The decision whether or not to nominate me to the AOC for selection in the 2012 Australian Olympic Team is subject to the Nomination Criteria and is at the discretion of my NF.

4 If my NF decides to nominate me for selection to the 2012 Australian Olympic Team I will be required to complete an Athlete Acknowledgement as determined by the AOC from time to time.

5 In the event that my NF nominates me to the AOC for selection in the 2012 Australian Olympic Team I am not guaranteed to be selected in the 2012 Australian Olympic Team. The decision whether or not to select me as a member of the 2012 Australian Olympic Team is subject to the AOC’s Olympic Team Selection By-Law and Selection Criteria and is at the absolute discretion of the AOC.

6 (1) I have not at any time engaged in conduct (whether publicly known or not and whether before or after the date of my selection), which has brought, brings or would have the tendency to bring me or my sport into disrepute or censure, or which is or would have the tendency to be inconsistent with, contrary to or prejudicial to the best interests, image or values of the AOC or Team Sponsors, or as a result of which my membership would not be or would not likely be in the best interests of the 2012 Australian Olympic Team or the Shadow Team;

(2) I have not at any time (whether before or after the date of my selection) been convicted of, or charged with, any serious offence involving violence, alcohol or drugs, or any sex offence, or any offence relating to any betting or gambling activities on sport, or any offence which is punishable by imprisonment;

(3) I have and will continue to honestly and fully disclose information to my NF and the AOC concerning any conduct that might be in breach of (1) or (2) above or concerning any criminal offence of whatever nature, with which I have been charged, or of which the I have been convicted, and consent to my NF and the AOC making enquiries to relevant authorities for any details of my criminal record (if any), including details of any charges pending or any spent convictions disclosable by law, and consent to those authorities providing that information in answer to those enquiries;

(4) any matter arising under (1), (2) or (3) above is to be determined, or breach thereof excused, by the AOC in its sole and absolute discretion.

8 I will notify my NF in writing of any change in the above contact details. Any failure by me to advise my NF in writing of a change in my contact details may be to my detriment. Any announcement to be made or notice required to be sent pursuant to the AOC’s Olympic Team Selection By-Law may be sent to one or more of the above contacts, or such other contact as notified in writing by me, and in the case of:

(1) post, the announcement or notice is deemed to have been received by me by properly addressing, prepaying and posting a letter containing the announcement or notice, and to have been received by me on the third business day after the date of its posting. Any announcement or notice sent by post to me overseas will be forwarded by air mail;

(2) facsimile transmission, the announcement or notice is deemed to have been received by me by properly addressing the facsimile transmission and transmitting it to the number supplied by me and to have been received by me the next business day after the date of its transmission; and

(3) email, the announcement or notice is deemed to have been received by me by properly addressing the email address and transmitting it to the address supplied by me and to have been received by me on the next business day after the date of transmission unless the AOC or NF is advised that the transmission failed to send to the addressee.

9 If I wish to utilise Specialised Equipment at the Games, I will submit a request in writing to the AOC Director of Sport no later than 6 months prior to the Games. This request is subject to the approval of the AOC in accordance with the 2012 Australian Olympic Team Membership Agreement – Athletes.

10 This consent is governed by the laws applicable in the State of New South Wales.

PARENTS/GUARDIANS ACKNOWLEDGEMENT FOR MINORS

1. the Athlete is under the age of 18 years as at the date of signing the Consent to Shadow Team Membership;

I/we have read and understood the AOC Olympic Team Selection By-Law and the AOC Selection Criteria applicable to the sport of Synchronized Swimming (“the Selection Terms”) and have fully explained to the Athlete the Selection Terms. To this end I/we have obtained independent legal advice as to the Selection Terms in order to clarify any doubts or concerns I/we may have had in this regard;

3. the Athlete has read the Selection Terms and, together with the benefit of our full explanation, understands their meaning and effect;

4. the Selection Terms are for the benefit of the Athlete;

5. the Athlete's eligibility for being considered for nomination by the above NF for selection to the 2012 Australian Olympic Team, may be terminated in the event of any breach of the Selection Terms; and

6. this acknowledgement is governed by the laws applicable in the State of New South Wales.

TEAM ASSESSMENTS AT SSAI TRIALS

Round 1

4 December 2010, Brisbane Swimmers will be ranked based on the following parts:

• Dry land – flexibility and strength (Schedule A) 25% • General synchro skills (Schedule B) 25% • Routine skills (Schedule C) 50%

Total 100%

Scoring for each of the above will be as set out in Schedule D. Schedule A Dry Land – Flexibility & Strength (25%) To be assessed by the National Coach and SSAI Selection Panel 1. Right Split (cm) front foot elevated (preferable) 2. Left Split (cm) front foot elevated (preferable) 3. Side Split (cm) one foot elevated (preferable) 4. Bridge (cm) 5. Shoulder Rotation (cm) 6. Leg shape 1 - distance (cm) between heel and the floor when sitting on the floor with both legs straight 7. Leg shape 2 – distance (cm) between big toe and the floor when sitting on the floor with both legs

straight 8. Push ups - number of repetitions in 30 sec 9. Frog Jumps – number of jumps in 30 sec 10. Chin ups – maximum number of repetitions 11. From a hanging position on a high bar, straight legs lift over head. Both legs to be elevated

simultaneously with both knees to remain extended until both feet touch the bar. – number of repetitions in 30 sec.

12. From a hanging position on a high bar, straight legs are lifted to 90 degree position. – maximum time position is maintained while angle and legs remain straight.

13. Right leg squats (each leg). From a standing position with the right hand holding on to the bar a squat is performed on the right leg while the left leg is lifted up until parallel to the floor on the way down. – number of repetitions in 30 sec.

14. Left leg squats (each leg). From a standing position with the left hand holding onto the bar a squat is performed on left leg while the right leg is lifted up until parallel to the floor on the way down. – number of repetitions in 30 sec.

Schedule B General Synchro Skills (25%) To be assessed by the National Coach and the SSAI Selection Panel 1. 50m freestyle time trial 2. 100m individual medley time trial 3. 300m freestyle time trial with every third 25 m under the water

Each lap (except for the final 25m) to be followed by a tumble turn into the next lap. Swimmers are required to take a breath before conducting the tumble turn leading into every third 25m lap and remain under the water for the duration of the entire 25m including the tumble turn at the completion of that lap. 5 sec Penalty will be added to the final time for each lap under water not completed. Only 1 penalty per lap will be added (max 4x5sec = 20 sec)

4. 100m synchro set:

− 25 m Torpedo under

requirements: remain under the water for the duration of 25m (touch the wall)* heels to remain on the surface of the water or higher at all times* leg extension to be maintained at all times*

− 25m single ballet leg to 12.5 m mark, double ballet leg to the end of the lap. On reaching half way

The assessors will assess each swimmer as follows: SSAI Selector 1 - execution of technical elements (20%) SSAI Selector 2 – overall execution (20%) SSAI Selector 3 – overall presentation (20%) National Coach – synchronization (40%)

Schedule D Commitment and work ethics (10%) Swimmers will be assessed and ranked by the National Coach based on the following: 1. Attendance at training sessions 2. Participation 3. Attempt to improve 4. Positive attitude 5. Teamwork 6. Compliance with the rules set by the National Coach and the SSAI Athlete Agreement. The composition of the team will be as follows: Permanent swimmers (when subject to assessment) will be assessed on one of the attempts only. The order will be determined by the draw, but will not be communicated to the swimmers to preserve integrity (i.e. to ensure equal amount of effort in each of the three attempts). In total, each group will have a maximum of four swimmers undergoing assessment at one time. Swimmers will be scored as follows: Selection Committee – execution, patterns and presentation (50%) National Coach – synchronization (50%)
