    Ladies and Gentlemen,

    I write to thank enormously all those who offered comment and suggestion on the latestrevise of the Green Book; UK MoD guidelines for the procedures to be adopted whenworking with media organisations. I now attach the final draft of the document whichincludes almost all the suggestions/amendments requested. You should note that I havehighlighted the specific text areas that have been altered. In particular:

    Confirmation that liability insurance remains strongly recommended rather thanmandatory.

    Clarity on wider safety issues and responsibilities.

    Acknowledgement that new medical and safety standards are provided asguidelines and there remains an element of flexibility in the accreditation processthrough discussion with MOD.

    I do genuinely now hope that this latest version better serves the needs of correspondentswhen working with the MOD, is more relevant and as we had originally hoped, aides in themanagement of correspondent expectation and most importantly continues to ensure thecontinued safety of media visits to operational environments. The final working version willbe posted on the MoD Web hopefully by this weekend.

    We will continue to review the document on a rolling basis, with an option to reprint, shouldthe need arise, in approximately 12-18 months. Should you wish to raise any additionalcomments, please do so by directing them to me.

    Firstly, I am pleased to see Annex F reinstated although my strong preference would have been a return tothe former position with a column specifically identifying Scottish Press which would take into account thestrength of the indigenous press compared to the circulation of UK broadsheets in Scotland and the highproportion of Scots in the Army. However, I will look to the MoD to ensure that SDNS titles have fullopportunity to participate in media assignments.

    My one other comment relates to para.14 where I find the inclusion of the last sentence rather strange to saythe least. I am sure nobody would wish to see UK forces target, deliberately or otherwise, mediacorrespondents or facilities. I suggest that the sentence is deleted.

    Will you be printing the final version?

    I was wondering if it were possible to meet next week in order to finetune the issues you raise. I do not believe there is any thing overlycontentious but I believe it would be useful to hopefully place thereview aims/revisions into context and hopefully through amendment anddiscussion achieve mutual agreement. We would be delighted to see youhere in the MoD or wherever is most convenient. I am however under atime constraint and am keen to get the review process completed by theend on next week.

    Thank you for copying me in to the email from the BBC CMO. The medical guidelines I provided are a guide(i.e. there is some flexibility). Actually testing tasks which the individual is likely to have to perform are verygood (and possibly the best way to test actual fitness for the role). However, existing health conditions thatthe individual may have that put them at increased risk also need to be screened out (e.g. susceptibility toheat illness), so there also needs to be a health questionnaire. A combination of a health questionnaireand role orientated tasks will give the best all round option.

    We had already been thinking about fitness of journalists covering hostileenvironments, and had developed a set of tasked based criteria (see below) -this applies prior to attending our hostile environments course which all thosedeployed to such environments will have to undertake.

    In addition we do check the health of our regular travellers, includingjournalists, but not to the extent recommended in your guidance. Top be frank Ithink there would be a danger that a number of journalists would not meet themark set in your medical guidance, but nevertheless would be perfectly able tocarry out their duties. The problem is as soon as you set medical standardssomeone is bound to fail.

    I would like to proposes that our system (of course I'm bound to say that)is farpreferable especially in the civilian world, and being task orientated ispractical in the field and also is more likely to be adopted by organisationsrather than medical criteria.

    * Run 100m in body armour and helmet without stopping

    * Drag a similar size/weight casualty 30m

    * Exit a vehicle by the front passenger door from the rear seat wearingbody armour

    * Change wheel on a 4WD vehicle unaided

    * Climb unaided into the back of a 4WD/pick up type vehicle

    * Move from standing to kneeling position in order to render first aid toa casualty"

    Many thanks for your helpful comments. What I intend doing know is to corral all the respectiveresponses and issues before circulating internally within DGMC. I hope to have all comments in bythe end of the month and thus should have our final version out at the beginning of November.

    By way of initial thoughts on your specific points:

    IDMA at MoD briefings: we see no reasons prohibiting IDMA inclusion. Freelancers: Yes. If a freelance correspondent, this needs to be clearly indicated as is the

    need to indicate whether they have a commission or not. They will be considered very lowpriority without one.

    Public Liability: we are having another look at this. But there has to be a balance. The

    insurance requirement is based on protecting the interests of both embeddedcorrespondent and equally as importantly, those who look after them. The requirement isnot as you suggest a mechanism to restrict access. It is clearly an issue based onprohibitively expensive premiums; not an MoD issue or responsibility. From a militaryperspective I have to add, that to support any correspondent deployment withoutappropriate cover is in our eyes negligent.

    We will speak later in the month but again, many thanks for your input. It is much valued.

    Many thanks for sending INSI the new draft for the latest edition of the Green Book. I'm afraid itlanded whilst I was on vacation, but I am quickly polling colleagues on the Broadcast NewsSecurity Group to gather any comments or suggestions.

    Meanwhile, I have to say I am concerned that the new version drops a key sentence from theSafety section at the start of clause 10, as follows:

    "10. It is also important to understand that UK Forces on operations will neverdeliberately target either individual correspondents or civil media facilities."

    INSI made much of this commitment -- unique in the military world -- by the UK armed forces in

    our news release welcoming the previous version of the Green Book, which included a section on journalist safety for the first time (largely at the behest of INSI and our friends in the BroadcastNews Security Group).

    To back off from this commendable statement not only creates obvious cause for alarm, butleaves the section on safety focused entirely on the responsibilities of the news media, withouteven a nod in the direction of the responsibilities of the armed forces.

    It would be a pity given the UK's lead on this issue, but INSI would be obliged to point out thissignificant change for the worse in our comments on the latest version.

    One other point I would raise, which also reminds of the responsibilities of armed forces duringconflict: you make no mention of the landmark UN Security Council Resolution 1738 of December2006 -- a key development regarding the safety of journalists since the last edition of the GreenBook.

    R1738 (2006) stresses, amongst other things: "...the Council recalled its demand that all partiesto armed conflict comply with their obligations under international law to protect civilians in armedconflict. It also emphasized the responsibility of States in that regard, as well as their obligation toend impunity and to prosecute those responsible for serious violations. All parties in situations ofarmed conflict were urged to respect the professional independence and rights of journalists,media professionals and associated personnel as civilians."

    I suggest the Green Book could usefully refer to this vitally important Resolution in Part 8 andrelated footnotes of the Introduction.

    Agreed. I will again modify the text to clarify that there is/always has been discretion in thesystem to accommodate specific needs and that an individuals medical, mental and fitnesswill be taken into consideration when considering the specifics of the assignment. Our pointis that in future we will be considerably more scrutinising of applications to ensure we donot have a repeat of the ||||||||||| ||||||||||||| Afghan incident this year (thankfully an isolatedcase but nevertheless a timely reminder).

    Finally, Yes to your points on BMI; staggering! I sense that this method will be reviewedover time by the medical black belts but at least it provides an initial benchmark.     Thanks for the draft of the Green book. The vast majority of it is fine. Two specific points: jump out:

    In relation to some of the section on Prone to Capture personnel (para 67), I fear some of it might be unrealistic or atleast only applied sometimes. I'm pretty sure that the BBC's local service will cover their local bases such as RAFLyneham and make clear connections between crews and home bases and aircraft types. I and this is acceptable to theMOD. I think the guide is referring to inter-state conflict but I wonder if it needs to be more nuanced?

    While there is clearly a need for a "medical standard", I think there needs to be a recongition that exceptionalcircumstances may apply - eg |||||||||||| ||||||||||||||||| went with UAE special forces to Afghanistan, and was based at Bagram -despite being in a wheelchair. They - and we - made special arrangements. There may be circumstances where we bothwish to facilitate something similar. While clearly we appreciate the responsibility we have to assign people who are

    capable, I wonder if there should be a "normally" in the reference to fitness. One final thought - BMI is an odd way of gauging fitness, as most of the England rugby team would be classed as clinically obese, yet they finish the multi stagefitness test.

    Dear ||||||||||||| |||||||||||I have just read through your Green Book draft and I am sure it will generatea great deal of feed back from our members and the wider media. One point,however, jumps out hits me as bound to get our members attention.

    There appears to have been a major change in policy regarding insurancecover for visits to operational theatres. You may not be aware that ourorganisation conducted a lobbying campaign aimed at changing the MODspolicy on insurance. This included meetings with ministers, MPs, servicechiefs and senior DGCM officials. The successful outcome of this wasreflected in the version of the Green Book which is currently posted on theMOD website. In effect we secured the inclusion of the insurance disclaimerfound in the APPLICATION PROCEDURE FOR MEDIA VISITS TOOPERATIONAL THEATRES form.

    Your new draft, the paragraph 75, appears to reverse the previous policy, bydeclaring that All deploying correspondents are required to possess fullhealth and Public Liability Insurance. Yet in the current APPLICATIONPROCEDURE FOR MEDIA VISITS TO OPERATIONAL THEATRES form youretain the old wording that we agree with. These two sentences seem tocontradict each other.

    I would be grateful if you could clarify which sentence is the proposed MODpolicy?

    As you may be aware, our organisation regards this issue as a matter ofsome seriousness because of its impact on our member ability to conduct animportant part of their work. We campaigned against the blanket requirement

    for war insurance because only representatives of major news organisationscould afford this cover. Freelancers, local and regional press, and even manyFleet Street newspapers cannot afford war insurance and the MOD is at astroke excluding them from operational theatres. If the MOD has indeedreverted to its old blanket insurance requirement as a condition of access tooperational theatres we would consider it a matter of some concern. Wewould therefore welcome a comment from the MOD as to why it might havereversed its position.

    This is only my first reaction and I am sure other members will come up withmore issues that I will compile into a consider document.

    TY for sight of the 1* draft of the Green Book. It is well crafted, really clear and informative and will be ofgreat benefit both for the media and our people.

    I have only a few suggestions. It covers the accreditation process well but it would be useful to includeadvice on encountering non accredited media too. The folk who may pitch up to the pic or a front line unitwithout accreditation. Media Ops and units staff need to understand the difference.

    It could do with a bit more detail on restricted access - with some examples. Does this includes briefingrooms, ops rooms, comms centres/room etc? The answer is that it may but local procedures may need tobe done blanking out boards removing callsigns etc to sanitise a restricted area..

    It is (understandably) pretty land centric in language. We prob need a bit more reference to maritime and airissues. We want this to ensure for all kinds of op without the need for a maritime or air supplement (asexisted in Telic1).

    There is still a flavour that it is configured for major contingency ops rather than recognising the long termsustained ops eg Herrick. Perhaps more ref of the documentaries/ internal projects are worth explaining in abit more detail in para 28 b.

    But overall this is pretty good and almost there. Have made a few detailed points in my copy- writing not brillas in a car!
