Preliminary discussions to participate in a State Field Clinic that will be held with GMAC in October (22-23 Tentative).

Proposed Amendments

1)        Located in Constitution.  Propose move to by-laws.Constitution: Article VI Booking CommissionerSection 1  The Broward County Athletic Association (BCAA) may select the Booking Commissioner(s) from the names submitted by the Executive Board while reserving the right to select an alternative individual whose name is not submitted by the Executive Board.  The office of Booking Commissioner(s) will assign members to officiate all interscholastic games that are to be officiated by the BCBOA.

Reason:The Booking Commissioner is in all three (by-laws, constitution, and guidelines).  Combine all Booking Commissioner activity to one only.  Delete this amendment and move to by-laws.

2)        Located in Constitution.  Delete Article VI Booking CommissionerSection 2  The Booking Commissioner(s) will assist the President in the general operations of the Association.

Reason:This is why we have an Executive Board.  The Booking Commissioner does not need to assist the President.  The Booking Commissioner can

provide information about the individuals and the status of games.

3)  Located in Constitution.  Change Article V Elections and Appointments:  Current Section 1  The Executive Board will be elected bi-annually.  The election will be held at the last scheduled meeting of the Association during the odd numbered years.  The Board will assume duties April of that year.

Change to: Officers shall be elected by secret ballot every two (2) years on the date of the last BCBOA general meeting of the season;  OR by electronic voting via the internet--protocol established by the current Executive Board.  The offices of President, 2nd Vice-President, and Sergeant at

Arms shall be voted on during the odd years.  The offices of 1st Vice-President, Secretary, and the Treasurer will be voted on during the even years.  New officers will assume duties on April 1st of the election year.

NOTE:  For the 2011 election, for the first term under this new proposal, the President, 2nd Vice President and Sergeant of Arms will be elected for a two year term.  The 1st Vice President, Secretary and Treasurer will be elected for a one-year term.

Reason: This will let Board members carry on the current projects without starting over.

Article I PresidentSection 1  The President shall act as the Chief Executive Officer of the Broward County Basketball Officials Association (BCBOA).  The President shall preside at all meetings of the BCBOA general membership and the Executive Board.  The President shall carry out all usual duties of this office and has authority to suspend members temporarily when events warrant such pending review and action by the Executive Board.

6)  Located in By-Laws:  Article VI Sergeant At ArmsAddSection 2   Enforce rules of civil conduct when so ordered by the presiding officer.  He shall prevent any person from speaking, unless recognized by the Chair.  Keep a timer/clock to prevent abuse of time as directed by the chair of the meeting.  And also know and understand the “Robert Rules of Order”.

7)  Located in By-Laws: Article IX RankingsSection 1 All members of the BCBOA will be ranked by a ranking system consistent with that of the FHSAA.

Add See Appendix A in the Guidelines for the current ranking system.

8) Located in By-Laws:  Article XIII  Playoff Recommendations Change

Section 2   The Recommendation Committee will present the details of their planned recommendations to the general membership for approval no later than the last scheduled meeting in December.  If any member selected for the playoff assignment cannot (does not) accept, their playoff assignment, the Recommendation Committee  will select a replacement prior to the final submission to the FHSAA.  The Committee will adhere to all stated FHSAA and the BCBOA selection criteria in choosing the state series play-off crews.

Change Section 2The Recommendation Committee will present the details of their criteria for selection to the general membership for approval no later than the first scheduled meeting in September.  The Committee must also follow the guidelines set forth by the Executive Board.  See the Guidelines for the criteria.

SIDE NOTE:  It is my opinion that Section 4 should be covered by the change to Section 2.  If membership does not agree with this opinion, the following additions can be voted on.

Section 4Must attend general meetings and mandatory field clinics, the dates to be determined by the Executive Board.  Members must attend two of three consecutive general meetings and all mandatory training sessions to be eligible to receive game assignments.

11)        Add To By-LawsArticle VIII Booking Commissioner

Section 3 The Broward County Athletic Association (BCAA) may select the Booking Commissioner from the names submitted by the Executive Board while reserving the right to select an alternative individual whose name is not submitted by the Executive Board.  The Office of Booking Commissioner will assign members to officiate all interscholastic games that are to be officiated by the BCBOA.

The Executive Board has voted to change and/or add the following fines and penalties.  Currently fines are located in the Guidelines.  

There is a proposed amendment to add Penalties and Fines to the By-Laws under Article VI Penalties and Fines.

There is another point of view to keep fines and penalties in the Guidelines section of our Governance.

If Penalties and Fines are located in Guidelines the Executive Board can change them by majority vote.  If Penalties and Fines are in the By-Laws, changing fines and penalties requires a vote and adoption by two-thirds (2/3) vote of a quorum of those member officials present, in good standing and voting.

There is a procedure to Appeal the process that follows the Penalty Section.  If you receive a Penalty and disagree, file an Appeal.

Add Appeals Process to Guidelines:

A.   Due Process:  Fines and penalties as listed in these bylaws are automatically imposed upon written notification to the official regarding the specifics of the violation and its/their penalty/penalties.  The official can then agree to accept the penalty/penalties or state his/her intention to appeal the penalty to the Board.  Until the appeal is resolved, the member remains in good standing,  may continue to work assigned contests and to receive new assignments. (a).   Appeals to the Board must be made in writing within 24 hours of notification to the official.

(b).   A hearing to consider the official’s appeal must be scheduled and held by the Board within two weeks of receipt of the appeal unless both the member and the Board agree to a different schedule.

(c ).   Once assessed, fines must be received by the Treasurer not later than seven (7) days after the fine is assessed by the board.  Fines shall be paid by credit card, cash or money order or cashier’s check made out to BCBOA.  An official who fails to pay a fine within the prescribed time period shall be ineligible to officiate any further contests until the fine is paid and the check clears.

(d).   An official who submits a check to BCBOA which is then returned unpaid shall be assessed the returned check fee and shall make good on the returned check.  Once an official is assessed a return check charge, that official must make all further payments to BCBOA in cash, by postal money order, or by cashier’s check, or credit card.

(e).   Members may appeal any penalty imposed by the BCBOA Board to the Grievance Committee according to the procedures established by the Grievance Committee.                      (1).   In cases where the Board has imposed a fine, the member official shall pay the fine as prescribed in order to remain in good standing.  If the appeal is upheld, the fine shall be rescinded and monies promptly returned to the member.                       (2).   In cases where the Board has imposed a suspension, a member official may appeal the suspension to the Grievance Committee.  In such cases, the suspension shall be held in abeyance pending the outcome of the appeal.  Shouldthe appeal fail or the suspension be partially upheld, the entire or partial suspension shall take effect immediately and carry over into the next season if it cannot be completely fulfilled in the current season

Appeals Process

(f).   If a member desires to file a subsequent appeal, he/she must do so in writing, first to:                       (1).   the Grievance Committee; pending adjudication then to                       (2).   the General membership; pending adjudication then to                       (3).   the Secretary for Athletics of BCAA.  No further appeals past this stage will be accepted.

(g).   The Grievance Committee, general membership, and Secretary for Athletics must respond in writing  to the appeal within ten days of each one’s receipt of the appeal unless a different time frame is mutually agreed to by the member and the agency to whom he/she has appealed.

(h).   A member who does not follow the above grievance procedure is to be considered not to be in good standing and shall be ineligible to work any further assignments.
