Naval Cadets sail into townby Bill and Norma Braun

On Thursday afternoon, August 5, five 44-footsailing vessels made their way majestically downWoodcleft Canal, Freeport, to be berthed at thenew Esplanade.

It was the seventh year in a row that midship-men from the Naval Academy at Annapolis havevisited Freeport as part of their training exercises.

Each ship, with a crew of 10, was treated to spe-cial events planned by Freeport Mayor BillGlacken, such as a barbecue and pool partyThursday, trip to Jones Beach and Roosevelt FieldMall Friday, to Yankee Stadium for a ball gameand several trips to New York City. Friday,Saturday and Sunday the vessels were on displayat the Esplanade and available for tours "belowdecks."

Conviction in 2002 Freeport murderNassau County District Attorney Denis

Dillon announced Monday that an Inwoodman has been convicted of murder in theJune, 2002 stabbing death of a Freeport manduring an attempted robbery.

William J. Potts, 32, was convicted by aNassau County Court jury Monday of onecount of Murder in the Second Degree, aClass A-I Felony punishable by up to 25years to life in prison.

According to Mr. Dillon, "The jury foundthat in the early morning hours of June 13,2002, the defendant went with an accom-plice to the home of Thomas Humphries, 37,at 252 Arthur Street, Freeport, with the intentof robbing him. During the course of the

attempted robbery, the victim was stabbed inthe chest, and succumbed to his injuries laterthat morning at the Nassau UniversityMedical Center. The jury found Potts guiltyof felony murder, which means during thecourse of the robbery a non-participant of therobbery was murdered."

He will be sentenced on September 20, byNassau County Court Judge William C.Donnino.

His accomplice, 41-year-old Virgil R.Booker of Wyandanch, was convicted by aNassau County jury in November of 2003 oftwo counts of Murder in the Second Degreeand two Counts of Attempted RobBery in thefirst Degree.

Baldwin Library construction updateAfter a brief hiatus relating to some

legal difficulties with its general contrac-tor, the Baldwin Public Library's con-struction project is again in full swing. OnJuly 28, the administrative staff of thelibrary and several staff members movedinto the new building following fireinspection and issuance of a temporarycertificate of occupancy by the StateEducation Department. The re-location ofthe six staff members was brought aboutby the need to begin laying foundationsfor the elevator, which will be located justinside the main entrance on the Town ofHempsead parking field side (behind thelibrary.) Excavation and pouring of foun-dations for the new elevator is alreadyunderway in the basement of the original1962 building. The atrium connecting thetwo buildings is almost complete withfinal finishes underway as this article

goes to press. "Terrazzo flooring and mill-work for the library's new circulation desk(i.e. the place where books are "checkedout and checked in") is due to be installedshortly," said Library Director BarbaraHopkins.

Kevin Kamen, president of the Board ofTrustees of the library, also commented:"We are really happy to be underway againand at full throttle. We are so grateful to thecommunity for its support; and patience:We're almost there - just a few moremonths and we'll be finished."

The Baldwin Public library began con-struction in January 2003 after undergoinga lengthy approval process by the NewYork State Department of Education. Theproject is anticipated to be finished at theend of the 2004 Fall season.

Possible lawsuit pending against Baldwin districtby Joan Delaney

An employee of the Baldwin SchoolDistrict and two former staff membersare intending to file suit against the dis-trict, according to attorney HaroldNewman of the law firm of Thomas T.Liotti of Garden City. Mr. Liotti is thelawyer of record and Mr. Newman is the.husband of one of the complainants.

Former Baldwin Middle Schooldeans Cheryl Farb and Alvis Brown,both untenured, as well as school psy-chologist Mark Lerner, a 16-yearemployee of the district, intend to fi lecomplaints against the district with theState Division of Human Rights,according to comments made to TheLeader by Mr. Newman.

The Leader contacted the school dis-trict, which declined to commentbecause of regulations involving theprivacy of personnel actions and pend-ing litigation.

Ms. Farb is alleging harassment and ahostile work environment. She alleges

that beginning in June, 2003, PrincipalJames Brown made several inappropri-ate comments to her and by November,2003 those comments became moreprevalent. She filed a formal complaintwith the district, which conducted aninvestigation.

That investigation and district report,which did not substantiate her claims,contained "misleading". testimony ofone witness, Mr. Newman said.According to Mr. Newman, Ms. Farbindicated that a "campaign to defameher" took place and the decision not torehire her was "retaliatory."

Alvis Brown, an African-American,is alleging discrimination. According toMr. Newman, Alvis Brown first inter-viewed for the position of assistant prin-cipal at the middle school and allegesthat Principal James Brown, who is alsoAfrican-American, said that he was toldthat "the people of the district wouldn'taccept three African-Americans at thetop." (Mr.. Newman acknowledged that

Mr. Newman said that Alvis Brownalleges that the principal told him thathe "had to he better than white adminis-trators so as not to ruin it for any otherbrothers in the school district."

According to Mr. Newman, the deci-sion not to rehire Alvis Brown "was acover up of their retaliation against Ms.Farb." He added. "He was hired (asdean and not assistant principal] andfired because of race."

Mr. Lerner's complaints, according toMr. Newman, focus on allegations thathe was disciplined because he commu-nicated recommendations directly toparents. Mr. Newman says that Mr.Lerner was told to keep his recommen-dations in "internal documents." Healleges that Mr. Lerner was brought tothe district office and given an office ina "glass enclosed room with a harpoonon the wall" causing him embarassmentand distress.

However, according to regulationswhich govern school districts, it is theCommittee on Special Education whichmakes recommendations regarding achild's educational placement and serv-ices. A booklet entitled "SpecialEducation in New York State for

Children Ages 3-12, A Parents Guide."published by the State EducationDepartment, notes that referrals, evalu-ations, determinat ion of e l ig ib i l i ty ,establishment of an individualized edu-cation program (IEP) and annualreviews and revaluation all proceedthrough the " imi l t id isc ip l inary teamcalled the Committee on SpecialEducation or the Committee onPreschool Special Educat ion." Thatcommittee consists of a school adminis-trator who chairs the committee, a spe-cial education teacher, a regular teacher,the school psychologist, a parent repre-sentative who must have or have had aspecial education child as well as anyother specialists with relevant inpu t .The committee's final recommendationmust consider all of their input as wellas state and federal regulations regard-ing placements and services. Parentshave the right to appeal recommenda-tions and to have addi t ional screening atschool district expense if they do notagree with the recommendations.

Last year, the district's special educa-tion program was reviewed in a routineaudit by state officials. At a publicboard meeting in July. State Education

Men of visionLast week, as Jones Beach's 75th birthday was cele-

brated, State Senator Charles Fuschillo, who representsthis area, made a surprise announcement. He had beenable to secure $100,000 in state funding for the masterplan for refurbishing one of the world's best-knownbeaches.

He will also help push for recognition of the beach asa National Historical Landmark, in support of an initia-tive by Bernadette Castro, Commissioner of New YorkState Office of Parks, Recreation and HistoricPreservation since 1995.

Jones Beach, which opened on August 4, 1929, reprer

sented'a Herculean effort by the late Robert Moses, whoalso, oversaw the" construction of bur parkways'. Thestate park on Fire Island is named for him.

The creation of the "Crown Jewel" in the state parkssystem was one of those examples in history where thevision of one strong-willed man made a difference. Andmillions of New Yorkers, sweltering in the heat of Sum-mers before air conditioning, remembered that man. Heopened a place of refreshment and relaxation for them.

The generations that followed also appreciated hav-ing access to this wonderful beach. And State SenatorCharles Fuschillo, remembering many family tripsthere, wants to make sure this will continue to be thecase in the future.

Two very different men, but each in his own way is aman of vision.

Let's not forget that part of the special charm of JonesBeach comes from the parkways leading there. Thisneeds to be taken into account in the state's master plansfor transportation, much needed because of the enor-mous increase in automobile traffic.

Fixing mass transportation, including north-south raillines, would help take pressure off of our roadways.Widening the parkways would cost so much in qualityof life. Instead, we should be constructing bikeways andtrails, and making forever wild those areas that are mostenvironmentally sensitive.

A jitney at the beach would also make some sense.Beachgoers could take in the nature museum, boardwalk, golf courses, pool and surf, and traffic would beless of a nightmare. Jitneys have helped in other crowd-ed beach areas around the country.

The dream: an even better Jones Beach in the futurethan in the past.

The Freeport Fire Department "WideAwake" Drill Team will be hosting itsthird annual Old Fashioned InvitationalTournament on Sunday, September 12.The Tournament is a charity event inmemory of Richard F. Muldowney, Jr.,who perished in the line of duty onSeptember 11, 2001. Richie was a NewYork City Fireman with Ladder 7 andEx-Captain of Wide Awake EngineCompany #1 of Freeport. Richie was alifelong resident of Freeport and a friendto many.

Funds are being raised for a monumentin memory of Richie, which is to be con-structed and placed in the Village ofFreeport. All monies raised from this

tournament will go to the fund for thismonument.

THE CELEBRITY FACTOR...From thevery beginning of our nation, there hasbeen confusion as to the kind of leaderswe wanted. That confusion continues.

Free from the control of England,many, particularly Jefferson and his fol-lowers, wanted nothing to do withmonarchy and deplored any vestige of itstrappings. But others, with only themodel of monarchy to go by, supportedcertain rituals and perogatives, particular-ly as the role of the president developed.

Even the beloved George Washingtonwas criticized as his second term ofoffice began for "aping royalty in hispresidential etiquette."

Today we are beset by the same con-fusion. How else can we explain theattempts of our elected leaders to appear"of the people" on the one hand but spe-cial and apart on the other. And the pub;lie encourages, even enables, those spe-cial perogatives, treating elected offi-cials as celebrities.

Rarely are our elected officials, evenour most lowly, ever alone. They travelwith an entourage of aides, drivers,communication directors, and of course

the ominipresent photographer. Whetherrt be the president of the United States orhis challenger criss-crossing the countryor a state official visiting at a localschool gym, their entrances on the sceneseem to lack only the flourish of trum-pets.

Despite our democratic roots, weseem determined to create royaltywhether it be of the Hollywood brandor the political. We are enablers in cre-ating a' government that focuses onpersonality rather than achievementand promises rather than accomplish-ment.

We stand on ceremony. We allow ourelected officials to create their ownfacades; we don't demand follow-through, and we permit them to establishthemselves as the elite.

One has only to attend a news confer-ence to see the ritual that occurs.Everyone waits for the elected official toarrive. He, or she, is then greeted andfawned over when they appear. Theydeliver a speech which appears sponta-neous but which covers the talkingpoints contained in pre-written and dis-

tributed press releases. They lake pic-tures, smile, make promises, and ifasked questions, talk in generalities.

And we allow it. The press partici-pates in the process to secure futureaccess. Citizens, perhaps too lazy to careor too intimidated to protest, don't com-plain.

And so, we accept with obsequiousgratitude the financial crumbs given byelected officials, as though thesemonies were coming from their veryown checkbooks. Certainly, each andevery public official who facilities acommunity or organization receivingfunding should be acknowledged. Butthere should be no mistake that it is tax-payer money that is being distributed.

Each time my husband and I drive tothe Southern State Parkway via themain street in another community, wepass by a school with a large granitesignboard. Engraved in the sign is theinscription that the sign is a "gift" of alocal official.

Each time I see it, I cringe. "I doubt ifthat is (fill in the blank) own money," Isay. And my husband responds, "Are you

going to say that every time we drive by?"I probably will, because that sign, to

me, epitomizes what we have allowed tohappen. Our government, at every level,should be "of, by and for the people."From its very inception, our leaders rec-ognized the careful balancing act thatmust be maintained if we were to be ademocratic republic rather than amonarchy.

And yet today, we, the people, encour-age our elected officials to think ofthemselves as celebrities. Is it any won-der that they feel the necessity to createthat aura as they campaign for office?

How pleasant it is for this reporter tocover those officials who see their jobs asa sacred trust, those officials whose smilesare real and not plastic, who are graciousinstead of entitled, who work hard for thepeople they represent, whose eye is on thetask at hand, not some future position, whounderstand the concept of service in theterm, public service. Baldwin school board appoints new deansby Joan Delaney

Two new deans were named forBaldwin Middle School at the district'sregular Board of Education meetingheld on August 4. They are Craig Tupotand Samuel Thompson IV.

Mr. Tupot has worked in Baldwinsince 1996, first as 'a technology teacherat the high school land for the last fiveyears as the technology coordinator. Hehas also worked voluntarily in the dean'soffice.

Mr. Tupot has a B.A. and a B.S.degree in architectual technology fromthe New York Institute of Technologyand an M.S. degree from NY1T inInstructional Technology. He has hisAdministration Certificate from theState University at Stony Brook.

Mr. Thompson was a teacher ofSpecial Education in Island Trees since1996 and has served as a supervisor inthe Summer Recreation Program.

He is a 1990 graduate of BaldwinHigh School.and has a B.S. degree inSecondary English and Education fromWest Virginia University as well as anM.A. from that university in SpecialEducation. He received hisAdminstration Certificate from TouroCollege.

Speaking to The Leader after themeeting, Mr. Tupot noted that he is

" happy to continue in Baldwin. I startedhere as a teacher and I'm happy to con-tinue." Referring to comments made atthe board meeting about district goals toprovide life-long careers for educatorsin the district, he added, "That's how Iwant to be. I wouldn't want to be any-where else."

. Mr. Thompson noted that he was"excited and looking forward to workingin the Baldwin community." He notedthat his return to Baldwin is " an oppor-tunity to give back."

In other business, the board discussedfive priority goals for the year. Theyinclude: the search for and hiring of anew superintendent of schools to replaceDr. Kathy Weiss who is retiring; contin-ued focus on curriculum through thepresentation of cyclical reviews atschool board meetings; continued updat-ing of the district website with a partic-ular view toward further outreach to par-ents and community; a focus on main-taining an environment for staff to havelife-long careers in Baldwin and to seekinput from staff on their needs for pro-fessional growth, and continued investi-gation for the ways to help students"express what they know on standard-ized tests" with particular emphasis ontechnology and materials.

The last priority, it was stressed, was

not intended as a criticism of staff norwas it intended as a deviation from thedistrict's commitment "not to teach tothe test but to provide a whole educa-tion." Board President James Scannellexpressed gratitude to the communitywhich "shares in that philosophical deci-sion." He noted the board's "apprecia-tion of the patience of the community,"saying that "It takes time to show posi-tive progress."

Superintendent of Schools KathyWeiss announced that 200 elementarylevel students in 16 classes attendedsummer school for four weeks. At thesecondary level, 480 students in 51classes taking 31 courses attended a six-week program. Many of them will takeAugust Regents exams.

There were also 600 children and 170counselors in the Baldwin SummerRecreation Program which receives a$5000 subsidy from (he district along

with indoor space in inclement weather.In an; update on the facilities bond.

Assistant Superintendent Ed Cignanoted that work on the middle schoolroof is proceeding on time with an antic-ipated substantial completion date ofAugust. Design work is being completedon other bond components.

Director of Facilities MichaelSheehah gave a presenation on the disjtrict's School Facility Report Card. Thisis the first year this report is required ofdistricts. Mr. Sheehan noted compliancewith all health and safety issues anddescribed categories of anticipatedmaintenance and repairs that are budget-ed either in the annual budget or facili-ties bond.

The Baldwin Educational Assembly, acommunity advisory group, has metwith the hoard and developed "charges"

To The Leader:Where is Mayor Glacken, Tustees

Miller, Frierson, White, Mauersberger,while our village is being turned into"Dodge City," with murderous streetshootings every couple of weeks? Nopublic statements from the Mayor, or theTrustees, to reassure us that somethingis going to be done to protect the villageresidents. Why is there no public con-cern from Village Hall? Are their "headsburied in the sand?" Someone needs todo a statistical crime report, comparingcrime statistics for each month and yearover the last three years, Under MayorGlacken, Trustees White, Frierson,Mauersberger and Miller, I believe vio-lent crime has probably risen over 200%in the last 3 years.

I am extremely concerned at the cur-rent "Crime Wave" that seems to havehit Freeport. In the last 60 days, therehave been "2 murders." In a Village thesize of Freeport, that number is "huge."In the June/July 2004 arson fire thatkilled one person on Broadway, inFreeport, there are over 200 people liv-ing in that building. If that fire got out ofcontrol, all 200 people could have beenkilled. Does this represent a 200%,

500%, etc. increase in violent crime inFreeport? In the bikepedaling murder ofDiana Correa in June 2004, 3 peoplewere on that porch that could have beenkilled. This many murderous events, ina 60-day time period, constitutes a"Crime Wave" of major proportion, in avillage the size of Freeport, in my mind.Everyone in Freeport should be con-cerned. I urge all residents of Freeport towrite to Mayor Glacken, trusteesMauersberger, White, Miller andFrierson, tell them they need to dosomething about this "Crime Wave."

Nassau County Legislator DaveDenenberg (D-Merrick) will hold ahearing on Monday, August 16, from10 a.m. to 3 p.m. at the NassauCounty Legislature, One West Streetin Mineola, on the county's plan tocomply with Phase II of the federalClean Water Act.

This phase of the Clean Water Actrequires Nassau County to draft,adopt and implement a plan over thenext five years to address non-pointsource pollution, which consists ofcontaminants that originate from

sources other than from a specificlocation, such as a sewage treatmentplant. The most common non-pointsource pollution is storm waterrunoff, which picks up gasoline, oiland other substances from the roads.

The hearing will provide inputtowards the plan, which will tacklethe problem of pollution in the coun-ty's creeks, ponds and. other environ-mentally sensitive areas.

Based on the state Department ofHealth 2004-2005 Advisories as theyrelate to chemicals in sportfish andgame, and on information from thestate Department of EnvironmentalConservation's monitoring programof fresh water sites, the NassauCounty Department of Health advisesresidents to limit consumption of fishfrom nine local fresh water ponds andlakes.

Individuals are advised of the fol-lowing guidelines regarding thepreparation and consumption of cer-tain fish due to elevated levels ofchemicals:

• Freeport Reservoir, Freeport: Eatno more than one meal of carp permonth (chlordane).

« Loft's Pond, Baldwin: Eat nomore than one meal of carp or gold-fish per month (chlordane).

BaldwinA residence on Carlton Place was bur-glarized on July 26 at 7 a.m. The loss isunknown. Entry was gained by cuttingthe screen on a front window. On July 25at 6 p.m., the victim observed two suspi-cious Hispanic men repeatedly passingby the house, staring for a long period oftime. The men were approximately 19-2-3years of age and about 5'6". One had amuscular build and the other a thin buildwith short black hair, and multiple tattooson both arms and chest. They were wear-ing blue jeans, white tank tops and whitesneakers, One subject wore a blue cap.

A 2003 Volkswagen was stolen onWestminster Road between 10 p.m. onJuly 25 and 7 a.m. on July 26.

A residence on Kings Parkway was bur-glarized between 9 p.m. on July 27 and1:58 a.m. on July 28. The loss is unknown.Entry was gained through a rear wood

door. The bedroom was ransacked.A residence on Wilson Street was bur-

It looks like we might actually see astate budget by week's end. TheFreeport School District has receivedpreliminary numbers for estimatedstate aid in the amount of $39,948,454which is a 3.24% increase in aid from2003. These numbers were reported inNewsday and could not be confirmedby Kishore Kuncham, assistant super-intendent of business, as he wasunavailable by press time. The 2004-2005 Freeport school budget is for atotal of $112,772,779.

As of press time, the stateLegislature had not passed its budgetalthough both Assemblyman DaveMcDonough and Senator CharlesFuschillo told The Leader that they arehopeful the budget will pass by the endof the week. The numbers writtenabove are merely projections.However, neighboring districts inBellmore and Merrick told our sisterpapers Bellmore Life and Merrick Lifethat the figures were sent to them bylocal Assemblyman Dave McDonough.

"Now that the state has a better ideaabout the revenue coming in, we canfinalize our budget," saidAssemblyman McDonough. "Theschool districts need to know becausemost of them have to set a tax levy bythe middle of August. Freeport schoolswill set their tax levy at the August 1 1

Board of Education meeting.Senator Charles Fuschillo said

"another $750 million has been addedto the budget for education." Lastweek, the state Legislature passed abill releasing $9 billion for educationaid, from the total of $15.1 billion thatGovernor George Pataki and stateSenate and Assembly leaders agreedupon. This represents about $555 mil-lion more than the governor originallyincluded in his budget for educationaid.

But even with the increase in aid, thebudget is still four months late. Formany school districts it means theymust borrow money and pay intereston that money.

Assemblyman McDonough said.thatone of the biggest stumbling blocks topass the budget was the Campaign forFiscal Equity, which is a lawsuitbrought against the state to ensureequitable funding for New York cityschools. Mr. McDonough said thatSheldon Silver, speaker of theAssembly, was adamant on having thestate address the mandate to increasefinancing of New York City schools."But we don't have to worry about thatright now," said AssemblymanMcDonough, referring to the proceed-ing in State Supreme Court inManhattan to appoint a committee toaddress the problem.

Department Regional Associate Janet Smith describedthe district's practices in glowing terms and suggestedonly a few modifications of some technical proce-dures.

When asked if his clients approached their respectiveassociations, Mr. Newman said that Ms. Farb did but hewas "not sure of the others."

The legal process, as described by Mr. Newman,begins with each client submitting the facts of theircomplaint to the state Division of Human Rights. Thedistrict is then notified. Subsequently, the state inves-tigates the facts, a process which can take six months.Depending on the findings, a formal complaint may ormay not be issued. Both parties have the opportunity torespond to that decision. Depending on the final deci-sion, a federal suit can then be filed with the EqualEmployment Opportunity Commission (EEOC).Matters of this nature must begin at the state levelbefore they proceed to the federal level.

At the August 4 school board meeting, in response toseveral questions from members of the audience, boardPresident James Scannell noted that he could confirmthat during personnel actions, the board voted for "thetermination of Dean Brown's probationary appoint-ment."

He added that he couldn't comment further because"Mr. Brown is personally and legally entitled to priva-cy."

Three parents asked specific questions about DeanBrown and the article, which appeared in Newsday.They questioned "How will our children hear about it?"and "How will the transition take place?" One parentpraised Dean Brown's help to her and her child.

Another parent noted, "It's unfortunate that we onlyget to hear that side of it that's to the benefit of the per-son making the allegation. It puts the district and otherpeople at a disadvantage."

Still another parent noted,"! applaud Mr. Brown[James Brown, the principal] for the help he has givenme. and 1 congratulate the new deans [see story else-where in this issue]. The familiar faces should help thechildren's transition."

Mr. Scannell noted, "The new deans will get all thesupport-they need to make that smooth .transition." Inresponse to a question concerning the allegations inNewsday regarding services fot Specials-educationchildren, board member B.A. Schoen noted, "Yes, wedo provide appropriate services for special educa-tion."

In approved Board of Education minutes reflectingthe boardmeeting of July 7. the personnel actions reportshows that the board approved an unpaid leave ofabsence for Dr. Mark Lerner, effective May 24 to June30. Additionally, Principal James Brown was one of 48staff members to receive tenure at that time.

Responding to questions concerning liability, Mr.Scannell noted. "We are appropriatedly insured; how-ever, we are very confident that when everything isaired, the district will be vindicated."

Former board member Bernard Pittinsky engaged in averbal exchange with Dr. Weiss on research regardingthe value of "leave back" policies, particularly researchgarnered in Chicago city schools. Dr. Weiss indicatedthat further studies show that the positive results areshort-term and that children actually regress. Mr.Pittinsky asked if she would provide him with some ofthat research.

The next regular meeting of the board will be onWednesday, September 8. at 8 p.m. at the DistrictOffice. The first day of school for students is September2.

Senator Charles J Fuschillo, Jr. (8thSenate District) recently joinedBernadette Castro, commissioner of theNew York State Office of Parks,Recreation and Historic Preservation, tocelebrate the 75th Anniversary of theopening of Jones Beach State Park.Senator Fuschillo also marked the occa-sion by announcing that he had secured$100,000 in state funding for the beachto complete a master plan.

Jones Beach, considered the CrownJewel of the state park system, isrenowned throughout the nation and theworld. Opened on August 4, 1929, thepark has seen a renaissance sinceCommissioner Castro took office in1995.

Senator Fuschillo secured will helpdefray the cost of the Master Plan thatJones Beach has been putting together.This is in conjunction with the applica-tion for recognition as a Nat ionalHistorical Landmark thatCommissioner Castro has recentlyannounced for the park.

"Jones Beach is one of our mostbeloved and historic landmarks on LongIsland and I commend CommissionerCastro for the work that has gone intothe park since 1995," stated SenatorFuschillo. "This is not only the one ofour environmental treasures on LongIsland but in the entire state and 1 amproud that I represent the area thatencompasses such a beautiful naturalwonder."
