Meetings summary
The COR meets once each month, and once every two months with the director present: the
so‐called COR consultation meeting. A summary of the 2013 meeting dates is listed below.
11 COR meetings: 29 January, 26 February, 26 March, 23 April, 28 May, 18 June, 27
August, 24 September, 29 October, 19 November and 19 December.

August, 29 October and 19 December.
The COR meetings and COR consultation meetings are open to FOM employees, after
registration with the COR official secretary. The approved minutes of the meetings are also
public. Interested FOM employees can register for the COR mailing via [email protected] and will
then receive the agendas and approved minutes monthly.
Approval requests
The director can fell certain decisions only after the COR has issued its approval (Article 27
WOR, Works Councils Act). In 2013, the COR received three decision intentions from the
director with the request to approve these.
A summary of the 2013 requests for approval and the approvals issued is listed below.
2013Health&SafetyPolicyMemorandum
On 26 March, the COR received the request for approval of the annual Health & Safety Policy
Memorandum for 2013. The COR discussed this plan extensively with Ralf Cornelissen, FOM's
central health & safety officer.
The COR found the plan to be lacking in clear prioritisation. Cornelissen indicated that one of
the priorities for 2013 was the registration of accidents in which FOM employees are
involved, especially at universities. Setting up a health & safety Sharepoint for the FOM
health & safety officers and developing a policy for working safely with nanomaterials were
also a high priority. The COR agreed to the plan. In November, the COR discussed the
progress of the 2013 Health & Safety Policy Memorandum with the central health & safety
officer.
Sale of holiday leave hours
In October 2013, the COR received a request to increase the number of holiday leave hours
that FOM employees may sell in 2014 from 80 to 120 (Personalised Conditions of
Employment ‐ AVOM) ‐ pro‐rata for part‐time employees. The COR approved this request.

Expanding the possibility for FOM employees to sell their holiday leave hours increases their
range of choices.
Adjustments to the Centraal Beheer pension plan
As the result of a legislative change, Centraal Beheer (CB) made an adjustment to the
pension plan regulations as of 1 January 2014. CB pensions are accrued by people who were
employed by FOM prior to 1977. The changes involve an increase in the premium percentage
and a change in the retirement age to conform to the new laws. These adjustments have
very limited consequences. Even though CB proposes these changes, FOM's COR must
approve them. CB also changed the definition of "partner".
The COR received the request to approve the changes to the CB pension plan regulations on
2 December 2013. Since CB was unable to send the text of the amended regulations at that
time, the COR gave its approval after its consultation meeting on 19 December, on the
condition that the regulations contained no other changes than the changes stated in the
request for approval. The COR also insisted on good communication with the employees
affected.
Requests for advice
In addition to its right of approval, a works council also has an advisory right. In accordance
with Article 25 of the WOR, the director gives the works council the opportunity to make
recommendations about certain intended decisions. In 2013, the COR received the following
request for advice:

(ARCNL)
In January 2013, ASML asked a number of parties to submit bids for setting up an Institute
for Nanolithography (INL, to operate subsequently under the name: Advanced Research
Centre for Nanolithography: ARCNL). ASML considers fundamental research in this area
essential. On 27 May 2013, ASML announced its intention to set up this ARCNL together with
FOM, UvA, VU and NWO, such that ARCNL will start under the aegis of AMOLF and will be
able to use AMOLF's support facilities. Once the new institute has achieved sufficient
momentum, it can then become independent.
On 12 June, the COR received a request for advice concerning the intended decision to
participate in the research centre implemented by FOM. A COR committee was formed to
handle the request for advice properly. This committee includes two representatives of the
AMOLF Works Council to maintain optimal communication with the local participatory

authority. Much was unclear at the start of the process ‐ particularly the budget, the
institute's relationship with AMOLF and FOM, the added scientific value and the governance
structure. Therefore, during the advice procedure, the COR paid particular attention to these
subjects. The COR was further informed during the course of various meetings and the COR
and FOM exchanged ideas. The COR was pleased to note that FOM included COR's input.
On 4 November, the COR issued an interim recommendation concerning the Memorandum
of Understanding, in which some additional issues were pointed out. In 2014, the COR will
issue a recommendation about the collaboration agreement that is to be drawn up ‐ and
likely completed in February 2014. ARCNL will commence on 1 January 2014.
Negotiations concerning secondary conditions of employment (IR)
The FOM Implementation Regulations (IR) are agreed on by FOM and the COR for a fixed
period of three years in principle. After this, FOM and the COR renegotiate and establish the
new IR together. For the COR, good secondary terms of employment for FOM employees
remain paramount.
The last IR dates from December 2012; its duration was one year. FOM and the COR decided
to extend the IR and to shift the negotiations to mid‐2014 due to the introduction of the
Labour Costs Ruling and the delayed collective employment negotiations.

Expanding information on My FOM‐People
My FOM‐People is an e‐portal that FOM has been working on for some time in order to
modernise the provision of information to its personnel. It gives FOM employees the
possibility to view their own information or to handle administrative issues. In the previous
term, the COR agreed to the level of security in the system proposed at that time. FOM
would like to expand the portal's possibilities. Since many of these expansions contain
personal information, the COR believes that approval should be required for this. The COR
has drawn up a letter explaining the COR's points of view with regard to the expansion of the
My FOM‐People portal. The COR wants to be involved in the process at an early stage so that
a request for approval does not arrive ex post facto. The discussions with the director are still
ongoing.
Furthermore, in 2013 ‐ partly at the insistence of the COR ‐ the security of the My FOM‐
People portal was tested. This revealed that the system was vulnerable. The portal was taken
off‐line for a while, until security was adequate. FOM has decided that the system's security
should be tested every six months.

benefits. The three scientists remained in FOM's employment and are free to take on
research topics that align with their new work environment.
Moving the research groups from the KVI to the Mathematics and Natural Sciences Faculty of
the University of Groningen may present delays for PhD candidates. The COR is keeping a
close eye on this.
Intern compensation
In March, the DIFFER Works Council brought DIFFER's effective cancellation of compensation
for interns to the COR's attention. This decision turned out to be based on the desire to align
policy with Eindhoven University of Technology and to save money in connection with
otherwise‐unspecified financial problems. However, the Implementations Regulations focus
precisely on national regulations that are the same for all FOM employees. Initially, it
appeared that the issue could be resolved internally at DIFFER. When that ended up taking
too long, the COR insisted on FOM consulting with DIFFER to find a solution. This was to no
avail. Subsequently, in a letter to FOM in December, the COR asked FOM to take
responsibility for ensuring that the Implementation Regulations ruling concerning
compensation of interns is implemented. Around Christmas, this resulted in FOM
management's acceptance of the ruling's application to MBO and HBO students (students at
further education colleges and universities of applied sciences). University‐level interns will
have to wait for consultation in the context of negotiations concerning the Implementation
Regulations, expected to take place in the spring of 2014.
COR‐FOM agreements
The text of the agreements between FOM and the COR was outdated. The COR therefore
agreed to propose amendments to the text at the end of 2012 to bring existing agreements
up to date and to make new arrangements that allow both the COR and FOM to proceed
further. The COR hopes to conclude these agreements with FOM in early 2014.
