Dear Ms. Taksar:

I have received your letter of August 18, 1994 regarding complaint number MUR4033 filed by the Friends of Marjorie Margolics-Mezvinsky capagn with respectto the Horsham Republican Party.

This matter was brought to my ateton at or around the same time a press releasewas issued by Marjorie Margolies-Mezvinsky campaign. I have reviewed thematter with our staff and learned that we had, in fact, accepted contributions fromthe Horsham Republican Party on three separate dates. At the time we receivedthe contribution we presumed that the Horsham Republican Party was a politicallysophisticated organization with resec to campaign finance law and had filed allappropriate papers with the Federal Election Commission. As you know fromreviewing our reports, we have properly disclosed all contributions received fromthis organization.

As soon as we learned that the organization had not filed, wecontributions (both for the primary and the general election).have returned more money than referenced in the complaint.

To the General Counsel:

The Fox for Congress Committee (committee') wishes to repn to the the above referenced complaintfied by the Friends of Marjorie Margolies-Mervinsky.

In response to Part I of the complaint, the Committee was not aware at the time of receipt of the 5127/94contribution that the Horsham Republican Party ('Party') was not registered with the Federal ElectionCommission ("Commission'). Upon discovery of this information, the Committee notified the Party ofthe laws and procedures under the Federal Election Campaign Act ('the AcC) related to this matter andrefunded the full $2,000 in contributions. It is the Comamittee's understading that the conribution itreceived from the Horsham Republican Party onl 3121194 was allowable under Federal election law. Arefund of the full $2,000 was made in an effort to demostrate good faith in complying with the Act anduntil such a time that the Party may become registered.

In reference to Parts 2 and 3 of the complaint, the Commite wihfles to assert that many of the nameslisted as missing employer information (23 names), dearly do not require employer information (ie.,Retired, Homemaker, Partnership). In addition, the Committee has previously supplied the Commissionwith copies of sample solicitations requesting such information as well as follow-up letters to those whodid not supply the information with the initial request (copies are again included). The Committee waswaiting for a sufficient number of responses to it request for information letter before sending memoversions of Schedule A with the supplied infrmation. This information has been received for mnmyindividuals following second and third requests and the Committee has prepared the enclosed schedulesfor filing with the Clerk of the House.

The Committee feels that, in light of the information above, the Commission has no reason to take furtheraction in this matter.

that the Commission no longer pursue the identified lower

priority and stale cases under the Enforcement Priority System.

I I. CASE RECONqRENDED FOR CLOSING

A. Cases Not Warranting Further Pursuit Relative to Other

Cases Pending Defore the Commission

A critical component of the Priority System is identifying

those pending cases that do not varrant the further ezpenditure

of resources. Each incoming matter is evaluated using

Commissionl-approved criteria and cases that, based on their

rating, do not warrant pursuit relative to other pending cases

are placed in this category. By closing such cases, the

Commission is able to use its limited resources to focus on more

important cases.

Having evaluated incoming matters, this Office has

identified 10 cases which do not warrant further pursuit

relative to the other pending cases. 1 A short description of

5. Stale Cases

Investigations are severely impeded and require relatively

more resources vhen the activity and evidence are old.

Consequently, the Office of General Counsel recommends that the

Commission focus its efforts on cases involving more recent

activity. Such efforts will also generate more impact on tbe

current electoral process and are a more efficient allocation of

our limited resources. To this end, this Office has identified
