SIR:

I transmit herewith the Annual Report on the regis¬

tration of Doctors of Medicine who are licensed to

practice in this State, which is the first annual compila¬

tion of such information prepared by the Bureau of

Vital Statistics. It is based on original applications filed

as provided for in Chapter 12005, Laws of Florida, Acts of

1927. It is apparently the first publication of its kind

in the history of this State, and will undoubtedly prove

of considerable value when information is desired con¬

cerning the number and whereabouts of those practicing.

Foreword DURING the calendar year, 1928, a total of 1,430 Doctors of

Medicine holding Florida licenses to practice registered with

the State Board of Health and Certificates of Registration is¬

sued. For the first time in the history of the State, a central record

has been provided, containing authentic information as to the number

and whereabouts of individuals practicing the healing arts in this State.

Through the efforts of the leaders in organized medicine, a bill was

prepared and presented providing for the annual registration of persons

holding Florida licenses to practice the healing arts. This bill, which was

known as Senate Bill Number 75, became a law on May 28, 1927, and

appears in the statute books of this State as Chapter 12005, Laws of

Florida, Acts of 1927, which is reproduced in full on pages 29-30. Forms

and blanks were immediately prepared and printed. Application blanks

were mailed to all individuals whose names appeared as eligible for

registration in the files of the State Board of Health. Lists were se¬

cured from the secretaries of the different state examining boards.

Registration began as of January 1, 1928.

For the most part, enthusiastic support has been given. A number of

objections were raised by a minority. The objections, however, were not

directed at the annual registration, but more particularly at certain pro¬

visions contained in the law. The question as to whether non-residents

must register annually has been raised. The Attorney General renders an

official opinion to the effect that the purpose of the registration seems to

be mainly to preserve information as to the whereabouts of the doctors

licensed to practice rather than a registration of those doctors actually

engaged in practice. This also brings up the question as to the status of

retired doctors, who, while not actually practicing, do not wish to relin¬

quish their rights to practice. The Attorney General again renders an

official opinion to the effect that all persons holding licenses should reg¬

ister annually, but might be exempt from registration under the Act by

notifying a jury to that effect if they wish to engage in some other occu¬

pation. Another new feature in this law is the requirement that a prac¬

titioner must have his license recorded in the County in which he resides

or intends to practice. This makes it mandatory that a practitioner who

moves from one County to another shall re-record his license in the

County in which he practices or expects to have his abode. Another

interesting opinion from the Attorney General is to the effect that a

Certificate of Registration is not to be withheld from a practitioner for

the calendar year because of said practitioner’s failure to register for

the previous year. The Attorney General’s opinion seems to hold that

the practitioner is guilty of the violation of a statute which may

subject him to prosecution, provided he has failed or neglected to

register for the previous year. It is also held by the Attorney General

that practitioners are required to register with the State Board of Health

only once each year, and that Senate Bills numbers 75, 77, and 366 all

relate to one and the same registration, although the requirement is re¬

peated separately in each of these Acts.

The enacting clause contains the word “midwives” and apparently

the authors of the Bill intended that midwives should be registered

annually. However, there appears to be no law making provision for

the licensing of midwives, and since the law requires registration in

connection with those who are officially licensed in the State, individuals

practicing midwifery are evidently not included among those who are

required to register. Veterinary doctors or surgeons are evidently exempt

also. On the other hand, podiatrists are required to register, as their

practice is kindred and similar to the practice of medicine, but is limited

to a specific portion of the human body. Dentists have not registered,

although the matter has been taken up with the State Board of Dental

Examiners. The Attorney General's opinion was given to the Secretary

of the Board. Electro-therapeutists and professional masseurs have been

considered and the matter referred to this department. The Attorney

General holds that the practice of naturopathy is defined as including

electro-therapeutists, and would also seem to include professional mas¬

seurs, which practitioners would fall under the classification of those

engaged in the practice of material health sciences used to aid in the

purifying, cleansing and normalizing of the human tissues for the preser¬

vation of and restoration to health. This opinion, therefore, construes

the two laws together, making it appear that persons engaged in the

practice of electro-therapy as well as professional masseurs are engaged

in the practice of naturopathy. In order that there may be no mis¬

understanding regarding the operation of the law as it has been put into

effect, the opinions from Honorable Fred H. Davis, Attorney General,

to Stewart G. Thompson, Director of the Bureau of Vital Statistics,

appear in full on the different points to which reference is made above, so

that the exact wording of the opinions may be studied, should the

reader so desire (page 30).

Tabulations have been prepared showing registration by counties,

by color, by nativity, by ages and by length of residence in Florida.

The first table represents the number of Doctors of Medicine who have

registered, by counties and by color. You will observe that 1,362 white

persons practicing as Doctors of Medicine registered during the calendar

year 1928. Similar information is given for colored persons. The second

table gives the birthplace of those registered. Georgia ranks first.

Even though the record is for the State of Florida, more practitioners

were born in Georgia than in any other State. Native Floridians rank

second, Alabama with 124 third, South Carolina fourth with a total

of 67, Illinois fifth with a total of 50, Pennsylvania sixth with a total

of 49 and Kentucky seventh with a total of 41. It is interesting to note

that 40 of the 48 States are represented as the birthplace of practitioners j|

in this State. A total of 79 were foreign born, 17 countries being rep¬

resented. Canada ranks first with a total of 26, Germany and Cuba 1

second with a total of 10 each, and England third with a total of 8. The s

third table gives information concerning the length of residence in Florida.

Being a tourist State, there is always a question of length of residence

in connection with our population. 156 practitioners have lived in

Florida from 15 to 19 years, 155 practitioners have lived in the State

from 5 to 9 years, 147 practitioners have lived in the State from 10

to 14 years, 146 practitioners have lived in the State only 2 years; 78

practitioners have lived in the State from 40 to 44 years, 16 have lived

in the State more than 60 years. The fourth table shows the number reg- (

istered by age, by color, and by sex. The greatest number of white male

practitioners are between the ages of 40 and 44, there being a total of

229. Further comment on this table will not be made as the infor¬

mation for both sexes is contained in Table Number 4.

The law under which this registration has been carried on is re¬

produced in full. The names and addresses of members of the State

Board of Medical Examiners are also contained herein.

This publication will be mailed to each individual who registered

and will also be sent on request as far as the supply will permit.

Chapter 12005, Acts of 1927 AN ACT to Require the Registration of All Physicians, Surgeons,

Osteopaths, Chiropractics, Naturopaths, Midwives and All Others Practicing the Medical and/or Material Healing Art in the State of Florida; to pro¬ vide Fees for the same and Penalties for Violation.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF FLORIDA:

SECTION 1. That from and after the passage of this Act every license to practice medicine, osteopathy, chiropractic, naturopathy, midwifery and every other medical and /or material method of the practice of the healing art shall before the licensee begins practice thereunder be recorded in a book for that purpose in the office of the Clerk of the Circuit Court of the County in which he resides, or in which such practice is intended to be carried on with the name, residence, place and date of birth of the licensee and the source, number and date of his license to practice. Before regis¬ tering, each licensee shall file, to be kept in a bound volume, in the office of the Clerk of the Circuit Court an affidavit of the above facts and also that he is the person named in such license and had before receiving the same complied with all the requirements as to examination required by law; that no money was paid for such license except the regular fee paid by all applicants therefor; that no fraud, misrepresentation or mistake in any material regard was employed by anyone or occurred in order that such license should be granted. The Clerk’s fee for recording such license and affidavit shall be the same as for recording a Deed. The Circuit Clerk of each County shall make and report to the Secretary of the State Board of Health on the 31st day of December of each year of all certificates registered by him.

SECTION 2. That every person now lawfully engaged in the practice of medicine, osteopathy, chiropractic, naturopathy, midwifery and other medical and /or material systems of healing and every other person here¬ after duly licensed to practice the same shall, on or before the 1st day of January of each year, apply to the Secretary of the State Board of Health for a Certificate of Registration upon a blank form to be furnished by such Secretary and shall pay at such time a fee of One ($1.00) Dollar.

SECTION 3. That every person in making his first registration here¬ under, shall write or cause to be written upon the application blank so furnished by the Secretary of the State Board of Health, his full name, post office and residence address, the date and number of his license and such other facts for the identification of the applicant as a licensed prac¬ titioner as may be deemed necessary and shall duly execute and verify the same before an officer authorized to take acknowledgments of deeds, and shall file the same with the Secretary of the State Board of Health. Registration subsequent to the first registration need not be upon the sworn application unless the Board of Health in particular case, for reasons satisfactory to them, may require that the application be under oath.

SECTION 4. That the Secretary of the State Board of Health, on or before October 1st of each year after the first registration shall mail or cause to be mailed to each person so registered a blank form of appli¬ cation for registration, addressed to the last known post office address of such Registrant. The form of such application shall be such as to con¬ tain space for the insertion by the applicant of the information required by the provisions of this Act.

SECTION 5. The Secretary of the State Board of Health shall issue to any duly licensed physician, osteopath, chiropractor, naturopath, mid¬ wife and others duly licensed by any State Board to practice the medical and /or material healing art upon his application therefor, in accordance with the provisions hereof, a Certificate of Registration under the seal of the Board for the year ensuing and ending December 31st.

SECTION 6. Every holder of Registration Certificate granted here¬ under, shall conspicuously display the same in his office at all times.

SECTION 7. Any person who fails or neglects to register as required by the provisions of this Act, or who shall violate the provisions of this Act, shall upon conviction thereof, be punished by fine of not more than Fifty ($50.00) Dollars.

SECTION 8. This Act shall take effect immediately upon its passage and approval by the Governor, or upon its becoming a law without such approval.

OPINION NO. 17

REGISTRATION: VETERINARY DOCTORS

In Re: Whether Veterinarians Required to Register Under Chapter 12005, Acts of 1927, Laws of Florida

Chapter 12005, Acts of 1927, Laws of Florida, is entitled:

“AN ACT to require the registration of all physicians, sur¬ geons, osteopaths, chiropractics, naturopaths, midwives and all others practicing the medical and/or material healing art in the State of Florida; to provide fees for the same and penalties for violation.”

There is nothing in either the title or the body of this Act which can be construed as applying to veterinary doctors or surgeons, and I am there¬ fore of the opinion that veterinarians are not required to register under this Act.

OPINION NO. 18

REGISTRATION: NON-RESIDENTS

I am of the opinion that Senate Bill No. 75, Chapter 12005, Laws of 1927, contemplates that doctors, whether practicing or not, shall register annually with the State Board of Health.

The purpose of this registration seems to be mainly to preserve infor¬ mation as to the whereabouts of the physicians licensed to practice rather than a registration of those physicians actually engaged in practice. The statute says that all those licensed to practice who at the time the statute was enacted were lawfully engaged in the practice of medicine should register annually as required in the Act.

If a person applies for a license to practice medicine and engages in some other occupation he would probably be exempt from registration under the Act by notifying the jury to that effect.

OPINION NO. 19

LICENSE RECORDED COUNTY WHERE PRACTICING

Section 1 of Senate Rill No. 75, approved May 28th, 1927, provides:

“That from and after the passage of this Act every license to practice * * * shall before the licensee begins to practice thereunder be recorded in a book for that purpose in the office of the Clerk of the Circuit Court of the County in which he re¬ sides or in which such practice is intended to be carried on. * *

It is apparent from this provision, taken in connection with other pro¬ visions of the Act, that if a physician has his license recorded in the County in which he resides and intends to practice, it is necessary to have said license recorded in another County whenever he moves from one part of the State to another, or changes his abode from one part of the State to another, as the law requires that the license be recorded in the County “in which such practice is intended to be carried on.”

OPINION NO. 20

REGISTRATION: MIDWIVES.

Section 2 of Chapter 12005, Laws of Florida, Acts of 1927, provides:

“That every person now lawfully engaged in the practice of * * * midwifery and other medical and/or material system of healing and every other person hereafter duly licensed to prac¬ tice the same shall, on or before the 1st day of January of each year, apply to the Secretary of the State Board of Health for a Certificate of Registration upon a blank form to be furnished by such Secretary and shall pay at such time a fee of One ($1.00) Dollar.”

Section 5 of the same Act provides:

“The Secretary of the State Board of Health shall issue to any duly licensed * * * midwife and others duly licensed by any State Board to practice the medical and/or material healing art upon his application therefor, in accordance with the provisions hereof, a Certificate of Registration under the seal of the Board for the year ensuing and ending December 31st.”

Construing these two Sections together, it is apparent that only “duly licensed” midwives are required to apply for a Certificate of Registration and since there is no statute in the State of Florida at this time providing for the licensing of midwives or the practice of midwifery, it is also ap¬ parent that Chapter 12005 at present has no application insofar as requiring the registration of midwives is concerned. The obvious purpose of the statute is to provide for the registration of licenses and where no licenses are provided for no registration can be had.

OPINION NO. 21

REGISTRATION: DENTISTS—PODIATRISTS

Chapter 12005, Acts of 1927, requires registration of every license to practice medicine, osteopathy, chiropractics, naturopathy, midwifery and every other medical and/or material method of the practice of healing art, before the licensee begins to practice.

I am of the opinion that the words: “every other medical and/or material method of the practice of the healing art,” as used in this Act are words of general import which are limited by the specification of the particular words theretofore used and that the principle of noscitur a sociis or ejus idem generis applies and limits the general words to the same class of things as are covered by the specific words.

In short, podiatrists would be required to register as their practice is kindred and similar to the practice of medicine but is limited to a specific portion of the human body.

Dentists on the other hand, can hardly be called practitioners of the same kind of science as ordinary doctors, and, therefore, I think that they are excluded, unless, of course, the practice of dentistry is held to em¬ brace the right to give treatments for human ailments due to correction of dental deficiencies. As I understand the same, some dentists do this and some dentists do not.

It is possible that there might be a distinction between the practice of dentistry and the ordinary practice of medicine. However, if the license of the dentists authorizes, and the practice of his science embraces a certain degree of surgery and therapeutic treatment such as would ordin¬ arily be administered by a physician, a dentist would be as much within the requirement to register as would the podiatrist. As to dentists the question should be determined by a consideration of what the dentist is licensed to do under the rules and regulations of the Dental Board and the laws of Florida.

OPINION NO. 22

REGISTRATION: ELECTRO-THERAPEUTISTS—PROFESSIONAL MASSEURS

Section 2 of Chapter 12005 requires all persons engaged in the practice of naturopathy to register with the State Board of Health. Section 1 of Chapter 12286, Acts of 1927, provides for the licensing of naturopaths. The practice of naturopathy is defined as including electro-therapeutics and would also seem to include professional masseurs, which practitioner would fall under the classification of those engaged in the practice of ma¬ terial health science used to aid in the purifying, cleansing and normalizing of the human tissues for the preservation of, and restoration of health.

Construing these two laws together it would appear that persons en¬ gaged in the practice of electro-therapeutics as well as professional mas¬ seurs are engaged in the practice of naturopathy and are, therefore, re¬ quired to register as such under Chapter 12005, Acts of 1927.

OPINION NO. 23

REGISTRATION: ELECTRO-THERAPEUTISTS—PROFESSIONAL MASSEURS

Answering your letter of February 2nd, requesting my opinion as to the status for registration of electro-therapeutists and professional masseurs, it seems to me clear from the provisions of Chapter 12286, Acts of 1927, that all electro-therapeutists and professional masseurs should have a cer¬ tificate as such from the State Board of Naturopathic Examiners before they exercise the right to practice their respective professions as such if these two sciences use mechanical, psychological or material health sciences and to aid in purifying, cleansing and normalizing human tissues for the preservation or restoration of health according to the fundamental principles of anatomy, physiology, and applied psychology as it is apparent that they do.

Of course, if the Naturopathic Board of Examiners has not issued any license to electro-therapeutists and professional masseurs the provisions of Chapter 12005, Laws of Florida, requiring them to register certificates can¬ not be applied, as the purpose of Chapter 12005 was to secure the registra¬ tion of all professional certificates relating to the healing art as a means of checking up on those who are practicing without any certificate as required by law.

OPINION NO. 32

REGISTRATION HEALING ARTS—PENALTY

Physicians, surgeons, osteopaths, naturopaths, midwives or other persons practicing medical or material healing arts, who fail to comply with the provisions of Sections 3398 to 3403, Compiled Laws, 1927, relating to regis¬ tration of all persons practicing the medical or material healing arts is subject to a prosecution for such failure but the failure itself will not pre¬ vent the practitioner from complying with the same and thereby avoiding liability for unlawful practice in the future.

I am, therefore, of the opinion that if an individual has failed to register for 1928 although engaged in practice, he is guilty of a violation of the statute, which may subject him to criminal prosecution, but yet at the same time there is nothing in the statute which authorizes the withholding from him of a 1929 registration or in requiring him to register for 1928, be¬ fore he is authorized to register for 1929.

The purpose of the provisions of this Act as has been previously pointed out is to furnish a current record of those presently engaged in practice for the particular year in question.

There is nothing in the Act which prohibits a physician who practiced in 1928 without registration from now filing his registration for the year 1928 in order to have recorded the fact that he did practice during 1928 but such filing subsequent to the time fixed in the statute will not by itself exempt him from liability which he has already incurred from the practice without the proper registration.

OPINION NO. 33

REGISTRATION HEALING ARTS—COMBINED

Answering your request of the 17th inst. for my opinion in the premises, I beg to advise that I am of the opinion that a requirement for registra¬ tion of those licensed to practice medicine, osteopathy, chiropractics, etc., as found in Senate Bills Nos. 75, 77 and 366, all relate to one and the same registration although the requirement is repeated separately in each of these Acts.

Under this construction, it is not necessary that physicians register more than one time with the Bureau although there are two separate statutes which require such registration.
