The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: ARTICLE I PRELIMINARY PROVISION Section 101. This act shall be known and may be cited as the “Home Rule Charter and Optional Plans Law.” Section 102. As used in this act: “Government study commission” or “commission” means the body composed of electors of the municipality elected under the provisions of this act. “Councilman” means county commissioner, city councilman, borough councilman, town councilman, township commissioner in a township of the first class, and supervisor in a township of the second class. “Election officials” means the county boards of elections. “Electors” means the registered voters of any municipality involved in proceedings relating to the adoption and repeal of optional forms of government. “Governing body” or “municipal council” or “council” means boards of county commissioners, city councils, borough or incorporated town councils, commissioners of townships of the first class, and supervisors of townships of the second class as their successor forms of government. “Home rule charter” means a written document defining the powers, the structure, privileges, rights and duties of the municipal government and limitations thereon. The charter shall also provide for the composition and election of the governing body, which in all cases shall be chosen by popular elections. “Local municipality” means a city, borough, incorporated town or township. “Municipality” means a county, city, borough, incorporated town or township. “Optional forms” means a general description including both home rule charters and optional plans. “Optional plans” means optional municipal powers, procedures and administrative structures as provided by this act.

ARTICLE IPRELIMINARY PROVISION

Section 101. This actshallbeknownandmaybe citedas the “HomeRuleCharterand Optional PlansLaw.”

Section 102. As usedin this act:“Government study commission” or “commission” meansthe body

composedof electorsof the municipality electedunderthe provisionsofthis act.

“Councilman” meanscounty commissioner,city councilman,boroughcouncilman,town councilman,township commissionerin a township ofthe first class,and supervisorin a township of the secondclass.

“Home rule charter” meansa written documentdefining the powers,the structure,privileges,rights and dutiesof the municipal governmentandlimitationsthereon.Thechartershallalso providefor thecompositionandelectionof the governingbody, which in all casesshallbe chosenbypopularelections.

“Local municipality” meansa city, borough, incorporated town ortownship.

“Municipality” meansa county, city, borough,incorporatedtown ortownship.• “Optional forms” meansageneraldescriptionincludingbothhomerulechartersandoptional plans.

“Optional plans” meansoptional municipal powers,proceduresandadministrativestructuresasprovidedby this act.

ARTICLE IIPROCEDUREFOR ADOPTION OF A HOME RULE CHARTER

OROPTIONAL PLAN OF GOVERNMENT

A. GovernmentStudyCommission

Section201. (a) Wheneverauthorizedby ordinanceof the governingbody, or uponpetition of the registeredvotersof any municipality to the

•countyboardof electorsof thecountywhereinthemunicipality islocated,an election shallbe held in the municipality upon oneof the followingquestions:

(1) “Shall agovernmentstudycommissionof (seven,nine or eleven)be elected to study the charter and form of government of themunicipality, to study and considerthe advisability of adoption of anoptional form of governmentand to recommendwhether or not anoptionalplan of governmentshouldbe adopted.”

(2) “Shall agovernmentstudycommissionof (seven,nine or eleven)be elected to study the charter and form of government of themunicipality, to studyanddraft a homerule charterandto recommendwhetheror not a homerule chartershouldbe adopted.”

(3) “Shall agovernmentstudycommissionof (seven,nine or eleven)be elected to study the charter and plan of government of themunicipality, to study and consider the advisability of adoption of anoptionalplan of governmentor ahomerule charterand to recommendwhether or not an optionalform of governmentor a homerule chartershould be adopted.”

The petition calling for suchelectionshallbe in the form requiredbysubsection(b) hereof, andshallbe signedby electorsof the municipalitycomprisingfive percentof the numberof electorsvoting for the Officeof Governor in the last gubernatorial general election within themunicipality.

Within five daysafter the final enactmentof an ordinanceauthorizingsuchelection, the municipal clerk or secretaryshall file a certified copyof the ordinancewith the countyboardof elections,togetherwith a copyof the questionto be submittedto the electors.At the next municipal orgeneralor primary election occurringnot less than sixty daysafter thefiling of the ordinanceor the petition with the county electionboard, itshall causethe appropriatequestionabovestatedto be submittedto theelectorsof the municipality as otherquestionsare submittedundertheprovisionsof the PennsylvaniaElection Code.

(b) A petition underthis sectionshallbe filed at leastsixty-four daysprior to the municipal or general election, and the petition and theproceedingsthereinshallbe in the mannerand subjectto the provisionsof the electionlawswhich relateto the signing,filing andadjudicationofnominationpetitionsin so farassuchprovisionsareapplicable,exceptthat

no petition shallbe signedor circulatedprior to sixty daysbefore thelastday on which such petitionmaybe filed.

Section 202. A governmentalstudy commissionof seven,nine orelevenmembersas designatedin the questionshall be electedby thequalified voters at the sameelection the questionis submitted to theelectors.Candidatesfor the office of governmentstudy commissionershallbe nominatedandplaceduponthe ballotcontainingthequestioninthemannerprovidedby andsubjectto theprovisionsof the PennsylvaniaElectionCodewhich relateto thenominationof candidatesnominatedbynomination papers filed for other offices elective by the voters of amunicipality, exceptthat they shallbe nominatedand listed without anypolitical designationor slogan,and,no nominationpapershallbe signedor circulatedprior to sixty daysbeforethe lastday on which papersmaybe filed. Each voter shall be instructedto vote on the questionand,regardlessof the mannerof his vote on the question, to vote for thedesignatednumberof membersof agovernmentstudycommissionwhoshall serve if the questionis or hasbeendeterminedin the affirmative.

Section 203. (a) Candidatesfor the governmentstudy commissionshallbe registeredvotersof the municipality. Theymay benominatedbynomination papers signed by a number of qualified electors of themunicipality equal at leastto two percentof the largestentirevote castfor anymunicipal officer electedat the lastprecedingmunicipal electionin themunicipality or two hundredregisteredvoterswhicheveris lessandfiled with the countyboardof electionsnot less thanforty-four dayspriorto the dateof the election.

(b) Each nominating paper shall set forth the names, placesofresidence,andpostoffice addressesof thecandidateor candidatestherebynominated,that the nomination is for the office of governmentstudycommissioner,and that the signersare legally qualified to vote for suchcandidateor candidates.Everyvotersigninganominatingpapershalladdto his signaturehis place of residence,post office addressand streetnumber,if any.No votershallsignanominationpaperorpapersfor morethan the designatednumberof candidates.

(c) Each nominating paper shall, before it may be filed with thecounty boardof elections,contain an acceptanceof suchnomination inwriting, signedby the candidateor candidatesthereinnominated,uponor annexedto suchpaper,or if the samepersonor personsbe namedinmore than one paper,upon or annexedto one of such papers.Suchacceptanceshall certify that the candidateis a registeredvoter of themunicipality, that the nomineeconsentsto standas a candidateat theelection,and that if electedhe agreesto take office andserve.

(d) Eachnominatingpapershallbe verified by an oathor affirmationof oneor moreof thesignersthereof,takenandsubscribedbeforeapersonqualified under the laws of Pennsylvaniato administer an oath, to the

effect that the paper was signed by eachof the signersthereof in hisproperhandwriting,that the signersare,to thebestknowledgeandbeliefof the affiant, registered voters of the municipality, and that thenominationpaperis preparedandfiled in goodfaith for the sole purposeof endorsingthe personor personsnamedthereinfor election asstatedin the paper.

Section204. The result of the votescastfor andagainstthe questionasto the electionof a governmentstudycommissionshallbe returnedbytheelectionofficers, anda canvassof suchelectionhad,asis providedbylaw in the caseof other public questionsput to the voters of a singlemunicipality. The votes cast for membersof the commissionshall becounted,and the result thereofreturnedby the election officers, andacanvassof suchelectionhad,as is providedby law in the caseof electionof membersof municipal council or board. The designatednumberofcandidatesreceiving the greatestnumberof votes shallbe electedandshall constitute the commission: Provided, That if a majority of thosevoting on said questionshall vote againstthe election of a commission,noneof the candidatesshallbeelected.If two or morecandidatesfor thelast seat shall be equal in number of votes, they shall draw lots todeterminewhich oneshallbe elected.

Section205. As soonaspossibleandin anyeventno laterthanfifteendaysafter its certification of election,the governmentstudycommissionshallorganizeandhold its first meetingandelectoneof its membersaschairman,anothermemberasvice chairman,fix its hours and placeofmeeting,andadopt such rules for the conductof its businessas it maydeem necessaryand advisable. A majority of the membersof saidcommissionshallconstitutea quorumfor the transactionof business,butno recommendationof said commissionshallhaveanylegal effect unlessadoptedby a majority of the whole number of the membersof thecommission.

Section 206. In case of any vacancy in the government studycommission,the remainingmembersof suchcommissionshall fill it byappointingtheretosomeotherproperlyqualified elector.

Section207. It shallbethefunctionanddutyof thegovernmentstudycommission to study the form of governmentof the municipality, tocompareit with other available forms under the laws of this State, todetermine whether or not in its judgment the government of themunicipality could be strengthened,mademore clearly responsibleoraccountableto the people,or whetherits operationcould becomemoreeconomicalor efficient undera changedform of government.

Section 208. Membersof the governmentstudy commissionshallservewithout compensation,butshallbe reimbursedby the municipalityfor their necessaryexpensesincurred in the performanceof their duties.Council shallappropriatemoneysnecessaryfor suchpurpose.

Within the limits of suchappropriationsandotherpublic andprivatelycontributedfunds and services as shall be made available to it, thecommissionmayappoint oneor moreconsultantsandclerical andotherassistantsto serve at the pleasure of the commission and may fix areasonablecompensationto be paid such consultantsand clerical andotherassistants.

Section 209. The governmentstudy commissionshall hold one ormore public hearings,may hold private hearingsand sponsorpublicforums, and generally shall provide for the widest possible publicinformation and discussionrespectingthe purposesand progressof itswork.

Section 210. (a) The governmentstudy commissionshall report itsfindings andrecommendationsto thecitizens of the municipalitywithinnine calendarmonthsfrom the dateof its electionexceptthat it shallbepermittedan additional threemonthsif it electsto prepareandsubmit aproposedhome rule charter. It shall publish or causeto be publishedsufficient copiesof its final report for public studyand information, andshall deliver to the municipal clerk or secretarysufficient copiesof thereport to supply it to any interestedcitizen upon request. If thecommissionshallrecommendtheadoptionof a homerule charteror anyof the optionalplansof governmentasauthorizedin this act, the reportshall containthe completeplansas recommended.

(b) There shall be attached to each copy of the report of thecommission,asapart thereof,astatementsworn toby themembersof thecommissionlisting in detail the funds, goods,materialsandservices,bothpublic andprivate,usedby thecommissionin theperformanceof its workand the preparationand filing of the report. In addition, the list shallidentify specifically the supplier of eachitem thereon.

(c) A copy of the final reportof the commissionwith its findings andrecommendationsshall be filed with the Department of CommunityAffairs.

Section 211. (a) The government study commission shall bedischargeduponthefiling of itsreport:Provided,That if thecommission’srecommendationsrequirefurther procedureon the partof themunicipalcouncilor board or the peopleof the municipality, the commissionshallnot be dischargeduntil a copy of the report has beencertified to thecounty board of elections. Any time before such procedurehas beenfinally concludedbut not later than one year from the date of thepublicationof its final report, the commissionmaymodify or changeanyrecommendationset forth in said final reportby publishingan amendedreport.

(b) Whenever a commissionissuesan amendedreport pursuanttosubsection(a) above,suchamendedreportshallsupersedethefinal reportand such final reportshall ceaseto haveany legal effect underthis act.

(c) The procedureto be taken underthe amendedreportshall begovernedby all provisionsof Article II of this act applicableto the finalreportof a commissionsubmittedpursuantto section210 of this act.

Section 212. The government study commissionshall report andrecommendin accordancewith the questionpresentedto the electorateasprovidedin section201:

(1) thata referendumshallbe held to submit to the qualifiedvotersof the municipality the questionof adoptingone of the optionalplans ofgovernmentauthorizedby this actto be specifiedby the commission;or

(2) thata referendumshallbe held to submit to the qualified votersof the municipality the questionof adopting a home rule charter aspreparedby the commissionandasauthorizedby this act; or

(3) that the form of governmentof the municipality shall remainunchanged;or

(4) such other action as it may deemadvisableconsistentwith itsfunctions asset forth in this article.

Section 213. (a) If the governmentstudy commissionreport, shallrecommendthe amendmentof anyof theoptionalplansof governmentset forth in this act, exceptthe optionalcounty planprovidedin ArticleX, thereportof the commissionmayspecifythat (i) themunicipal councilshallconsistof three,five, sevenor ninemembers(exceptthatunderthesmall municipality plan as provided for in Article IX, and under theoptional county plan as provided in Article X, the numberof council-men shallbe asprovidedin section911 and section1002, respectively);and (ii) the treasurer,where suchoffice is provided,shallbe electedbythe voters.

If acommissionreport,initiative petitionorordinanceshallrecommendanyoptionalplan,exceptfor the optionalcountyplan set forth in ArticleX, it mayspecifythat the then existingbasisfor electingcouncilmenshallbe changedto an at-large,district, or combinationat-largeand districtbasis.

If acommissionreport,initiative petitionorordinanceshall-recommendthe adoptionof the council-managerform of government,it may specifythat themayorbeelecteddirectly by thevotersof themunicipalityratherthan by council.

If acommissionreport,initiative petitionor ordinancefor acountyshallrecommendtheadoptionof anyof theoptionalplans,excepttheoptionalcountyplan setforth in Article X of this act, it may specifythat thesheriffbe electeddirectly by the voters of the countyasprovidedin Article XIof this act.

In all cases,exceptfor thecouncil-managerplansetforth in Article VIII,the commission report, initiative petition or ordinance shall specifywhether the executive (mayor) of the municipality shall be called“Executive” or “Mayor.”

(b) If the commissionshallrecommendthe adoptionof a homerule

charter,it shall specify the number to be on the municipal council, alloffices to be filled by election, and whether electionsshall be on anat-large,district, or combinationdistrict and at-largebasis.

(c) Notwithstandingany otherprovisionsof this act, if an approvedhome rule charter or optional plan of governmentor other form ofgovernmentadoptedpursuantto the provisions of this act shall specifythat the electionof the municipal council shallbeon an at-large,district,or combination district and at-largebasis, which basis differs from theexistingbasisandthereforerequireseliminating districtsor establishingrevisedor new districts, then electionof municipal officials shallnot takeplace on the new basisuntil the municipal election following the nextprimaryelectiontakingplacelaterthanonehundredeightydaysafter theelection at which the referendumon the questionof a new form ofgovernmenthas been approvedby the electorate.The new form ofgovernmentshall not go into effect until the first Monday in Januaryfollowing the electionof municipal officials on the new basis.New orreviseddistrictsshallbe establishedby the court of commonpleasin thecounty within ninety daysfrom the dateof approvalby the electorateofa new form of government.

Section 214. The question to be submitted to the voters for theadoptionof ahomerulecharteror anyof theoptionalplansof governmentauthorizedby thisactshallbesubmittedin thefollowing form orsuchpartthereofasshallbe applicable.

“Shall the Home RuleChartercontainedinthe report, datedof the GovernmentStudy Commission,prepared Yesin accordancewith the Home Rule Charter andOptional PlansLaw, be adoptedby the

Section215. If the governmentstudycommissionshall recommendthat the questionof adoptinga homerulecharteror oneof the optionalplansof governmentauthorizedby thisactshallbesubmittedto thevotersof the municipality, it shallbethe dutyof themunicipalclerkor secretary,within five daysthereafter,to certify a copyof the commission’sreport tothe countyelectionboard,which shall causethe questionof adoptionorrejectionto be placeduponthe ballot or voting machinesat suchtime asthe commissionshallin its reportspecify.Thecommissionmaycausethequestionto be submittedto the peopleat the next primary, municipalorgeneralelection,occurringnot less than sixty days following the filing ofa copy of the commission’sreportwith the county boardof elections,atsuchtime as the commission’sreport shall direct. At such election, thequestion of adopting that form of governmentrecommendedby thecommissionshallbe submittedto the votersof the municipality by thecounty board of elections in the samemanneras other questionsaresubmittedto the voters of a municipality under the provisionsof thePennsylvaniaElection Code.The commissionshallframethe questiontobeplacedupon theballot ashereinprovided,andif it deemsappropriatean interpretativestatementto accompanysuch question.

Section216. (a) No ordinancemaybe passedandno petition may befiled for the election of a governmentstudy commissionpursuanttosection 201 of this act while proceedingsare pendingunderany other

petition or ordinancefiled or passedunder the authority of this act, noron the samequestionif it has beendefeatedwithin four yearsafter anelectionshallhavebeenheld pursuantto any suchordinanceor petitionpassedor filed.

(b) Forthepurposeof this section,proceedingsshallbe consideredashavingstarted(1) in thecaseof an ordinanceupon the final vote of councilin favor of the ordinance,notwithstandingthe fact that the ordinancecannottakeeffect until a certain numberof daysthereafter;or (ii) in thecase of a petition, as soonas it is properly signed by one-third of thenumberof registeredvotersrequiredfor suchpetitionandwritten noticethereoffiled in theoffice of thecountyboardof electionsandin the officeof the municipal clerk or secretary,who shall cause the sameto beimmediatelypostedin aconspicuousplacein said office, open to publicinspection.

Section 217. Whenever the legally qualified voters of anymunicipality by a majority of thosevoting on the questionvote in favorof adoptingachangein theirform of governmentpursuantto this act,theproposedform shall takeeffect accordingto its termsand the provisionsof this act.

Section 218. The voters of any municipality which has adoptedahomerule charteror an optionalplan of governmentpursuantto this actmaynot vote on the questionof changingthe form of governmentuntilfive yearsafter the homerule charteror optionalplan becameeffective.

Section 219. For the purposesof this act,eachof the optionalformsof governmentprovided by this act and eachof said optional forms asmodified by any availableprovisionsconcerningsizeof council,electionof municipalofficials, thebasisfor electingcouncilmen,is herebydeclaredto be a complete and separateform of governmentprovided by theLegislaturefor submissionto the voters of the municipality.

B. Amendmentof Existing Charteror Optional Form

Section 221. The procedurefor amendinga home rule charter oroptional plan of governmentshallbe the sameas for the adoption of ahomerulecharteror optionalplanof government,exceptthatanoptionalplanof governmentmaybeamendedthroughtheinitiative procedureashereinafterprovidedfor in this act.

C. Amendmentof Optional Planby InitiativePetition or OrdinanceandReferendum

Section 231. A referendum on the questionof amendmentof anoptional plan of government may be initiated by electors of themunicipality, and a referendumon the questionof amendmentof anoptional plan of governmentmay be initiated by an ordinanceof thegoverningbody. A proposalfor amendmentof an optionalplan shallbelimited to the additionaloptions providedfor in section213 of this act.

Section232. A petition containinga proposalfor referendumon thequestionof amendingan optionalplanof governmentsignedby electorscomprisingfive percentof the numberof electorsvoting for the Officeof Governorin the lastgubernatorialgeneralelectionin themunicipality,or an ordinanceof the municipalgoverningbody proposingamendmentof an optionalplan,maybe filed with theelectionofficials at leastninetydaysprior to the next primary,municipal or generalelection.The nameandaddressof thepersonfiling the petitionshallbe clearlystatedon thepetition.

The electionofficials shallreview theinitiative petition asthe numberandqualificationsof signers.If the petition appearsto be defective, theelectionofficials shallimmediatelynotify the personsfiling the petition ofthe defect.Whenthe electionofficials find that thepetition assubmittedis in properorder,they shallsendcopiesof the initiative petition withoutsignaturesthereonto the governingbody of the municipality and to theSecretaryof CommunityAffairs. Theinitiative petitionassubmittedto theelectionofficials, alongwitha list of signatories,shallbeopento inspectionin the office of the election officials.

Section233. A referendumon the questionof the amendmentof anoptionalplanof governmentshallbe held whenthe electionofficials findthatthe initiative petitionor ordinanceof the governingbody is in properorder, and the referendumshall be governedby the provisions of thePennsylvaniaElectionCode.Theelectionofficials shallcausethequestionto be submittedto the electorsof the municipality at the next primary,generalor municipal electionoccurringnot less than sixty daysfollowingthe filing of the initiative petition or ordinancewith the election board.At suchelection,thequestionshallbesubmittedto the votersin thesamemanneras other questionsare submittedunder the provisionsof thePennsylvaniaElectionCode.The electionboardshallframe the questionto be placed upon the ballot.

D. Conductof Election

Section241. All electionsprovidedfor in thisact shallbe conductedby the election officials for such municipality in accordancewith thePennsylvaniaElection Code.The electionofficials shall count the votescastandmakereturn thereofto the countyboardof elections.The resultof any suchelectionshallbe computedby the county boardof electionsin the samemanneras is providedby law for the computationof similarreturns.Certificatesof theresult of any suchelectionshallbe filed by thecounty board of electionswith the municipal council or board of themunicipalityandwith theSecretaryof the Commonwealth,andwith theSecretaryof Community Affairs.

Section 242. At least thirty days’ notice of each election hereinprovidedfor shallbe given by the clerk or secretaryof the municipality.A copy of such notice shall be posted at each polling place of the

municipality on the day of the election,and shallbe publishedin at: leastonenewspaperof generalcirculationin the municipalityonceaweekforthreeconsecutiveweeksduring the period of thirty days prior to theelection.

ARTICLE IIIGENERAL POWERSAND LIMITATIONS OF A

HOME RULE CHARTER MUNICIPALITY

Section301. A municipality which hasadopteda homerule chartermay exerciseany powersand perform any function not deniedby theConstitutionof Pennsylvania,by its homerule charteror by the GeneralAssembly at any time. All grants of municipal power to municipalitiesgovernedby a homerule charterunderthis act, whetherin the form ofspecificenumerationorgeneralterms,shallbeliberallyconstruedinfavorof the municipality.

Section302. (a) The home rule charteradoptedin accordancewiththe provisionsof this act shall not give any power or authority to themunicipality contrary to, or in limitation or enlargementof powersgrantedby actsof the GeneralAssemblywhich areapplicableto a classor classesof municipalities on the following subjects:

(1) The filing andcollection of municipal tax claims or liens andthesale of real or personalpropertyin satisfactionthereof.

(2) The proceduresin the exerciseof thepowersof eminentdomain,and the assessmentof damagesandbenefitsfor property taken, injuredor destroyed.

(3) Boundarychangesof municipalities.(4) Regulationof public schools.(5) The registrationof electorsand the conductof elections.(6) The fixing of subjectsof taxation.(7) The fixing of the ratesof nonpropertyor personaltaxeslevied

upon nonresidents.(8) The assessmentof real or personal property and personsfor

taxation purposes.(9) Defining or providing for the punishment of any felony or

misdemeanor.(b) No municipality shall (i) engagein any proprietary or private

businessexcept as authorized by the GeneralAssembly, (ii) exercisepowerscontraryto, or in limitation or enlargementof powersgrantedbyactsof the GeneralAssembly which areapplicablein every part of theCommonwealth, (iii) be given the power to diminish the rights orprivilegesof any former municipal employeentitled to benefitsor anypresentmunicipalemployein hispensionor retirementsystem,(iv) enactor promulgateany ordinanceor regulation with respectto definitions,sanitation,safety,health,standardsof identity or labelingpertainingto the

manufacture,processing,storage,distributionandsaleof anyfoods,goodsor servicessubjectto anyCommonwealthlaws or regulationsunlesssuchmunicipal ordinanceor regulation is uniform in all respectswith suchCommonwealthlaws andregulations.Nothinghereincontainedshallbeconstruedto in anywayaffectthe powerof anymunicipality to enactandenforce ordinancesrelating to building codes or any other safety,sanitationor health regulation pertaining thereto, nor (v) enact anyprovisioninconsistentwith anystatuteheretoforeenacted-by-the-GeneralAssembly affecting the rights, benefits or working conditions of anyemployeof a political subdivision of the Commonwealth.

(c) Acts of the GeneralAssemblyin effecton the effectivedateof thisact thatareuniform andapplicablethroughouttheCommonwealthshallremainin effect andshallnot be changedor modifiedby this act. Acts ofthe GeneralAssemblyenactedafter the effectivedateof thisact that areuniform and applicablethroughoutthe Commonwealthshall supersedeany municipal ordinanceor resolutionon the samesubject.

(d) No municipality which adoptsa home rule chartershall at anytime thereunder determine duties, responsibilities or requirementsplacedupon businesses,occupationsandemployers,includingthe duty towithhold, remit or report taxesor penaltieslevied or imposedupon themor uponpersonsin their employment,exceptasexpresslyprovidedbyactsof the GeneralAssembly, which are applicable in every part of theCommonwealthor which areapplicableto all municipalitiesor to a classor classesof municipalities.

(e) No municipality shallenactanyordinanceor takeanyotheractiondealingwith the regulationof the transfer,ownership,transportationorpossessionof firearms.

(f) Nothing containedhereinshall limit or take away any right of amunicipalitywhichadoptsahomerulecharterfrom levying anytaxwhichit had the powerto levy had it not adopteda homerule charter.

Section303. No countywhich hasadopteda homerule chartershallat any time thereafterexercisewithin any municipality in the county, apoweror functionbeing exercisedby thatmunicipality on the dateof theadoption of the county home rule charter, except under all of thefollowing conditions:

(1) The exerciseof suchpower or function by the county shall beauthorized by ordinanceof the governing body of the county, whichordinancein additionto suchotherfilings asmayberequiredby law,shall,within thirty daysof its enactment,be filed with the clerkor secretaryofeachlocal municipality within the county.

(2) The transferof a power or function to the county from anylocalmunicipality within thecounty,asauthorizedby suchordinance,shallnotbecomeeffectivefor at leastfifteen monthsfrom thedateof adoptionofsuchordinance.

(3) Within one hundred twenty days from the adoption of such

ordinance,thegoverningbodyof anylocal municipality, exercisingon thedate of the adoption of the county home rule charter any power orfunction authorizedby ordinanceof the county to be exercisedby thecounty, mayelectby ordinanceto be excludedfrom the countyexerciseof suchpoweror function.Within sixty daysafter the dateof adoptionbythe governingbodyof a localmunicipalityof an ordinanceexcludingsuchmunicipality from the exerciseby the county of a poweror function, orin the absenceof any action of the governingbody, the qualifiedvotersof suchmunicipalitymay initiatea petition requiringthat the questionofinclusionor exclusionfrom the exerciseof suchpoweror function by thecountybesubmittedto areferendumof the electorateat theelectionheldon thedateof thenext ensuingprimary,municipalor generalelectionnotlessthan sixty daysafter thefiling of theinitiative petitionwith the-countyboardof elections.Theinitiative andreferendumproceduresset forth inArticles III and IV shall be followed, except where the samemay beinconsistentwith any of the provisionsof this section.

In the eventthe countydeterminesthereis insufficient interestor thatit is not feasibleto establishthe proposedmunicipal function or powerasprovidedfor in theordinancepassedby thecounty,thecountymayrepealthe county ordinanceprior to the effectivedateof the ordinance.

(4) The governingbody of any local municipality mayby ordinance,subsequentto the time limit for action as set forth in clause(3) of thissection, requestthe county to be included in a municipal power orfunction being exercisedby the county: Provided,however, That thecounty may specify the termsand conditionsfor acceptanceor denialofthepoweror function requestedby the localmunicipality to be exercisedby the county, which shall be subject to court review if the localmunicipality determinesthat the termsandconditionsasset forth by thecounty areunreasonable.

(5) No assessment,tax, fee or levy in the naturethereofmadeby thegoverning body of a county in support of the exerciseof a power orfunction asauthorizedby ordinanceof the county, shallbe applicableinanymunicipalitywithin thecountywhich isproviding-thesamemunicipa~poweror function.

(6) If theelectorsof amunicipalityby referendumvoteto excludethemunicipality from the exerciseof a poweror function by the county, apetition maynot be initiated nor may a referendumbe held on the samequestionmoreoften than every five years thereafter.

(7) A local municipality may,by actionof the governingbody, or byinitiative and referendum,withdraw from apower or function which itwasexercisingat the dateof the adoptionof thecounty-home-rulecharterwhich it transferredto a county,providedit againassumesandexercisesthe poweror function but may not vote on the questionof withdrawingsoonerthan four years from the time the county assumedthe powerorfunction of the local municipality.

Section 304. Municipalitiesadoptinga homerule chartershallhavethe powerto sueandbe sued,to haveacorporateseal,to contractandbecontractedwith, to buy,sell, lease,hold anddisposeof realandpersonalproperty, to appropriateand expendmoneys,and to adopt,amendandrepealsuchordinancesandresolutionsasmay be required for the goodgovernmentthereof.

Section 305. The municipal clerk or secretaryof the municipalityshallforthwith causethenewcharterasapprovedby thequalifiedelectorsto be recordedin the ordinancebooksof the municipality. He shall alsofile a certified copy thereof in the office of the Secretary of theCommonwealth,with the Secretaryof the Departmentof CommunityAffairs, and with the county boardof elections.

Section306. All electiveofficials of the municipality in office at thetime of the adoptionof a homerulechartershall continuein office untiltheir terms expire.

Section307. The procedurefor repealof ahomerulechartershallbethe sameas for adoptionof a homerule charter.Wheneverthe electorsof any municipality, by a majority vote of thosevoting on the question,vote in favor of repealof ahomerule charterandthe establishmentof aparticularform of government,suchmunicipality shallbegovernedunderthe form of governmentselectedby the electors,from the first Mondayof Januaryfollowing themunicipal electionat which the electiveofficialsof the form of governmentselectedby the electors shall have beenelected.The governmentstudycommissionshallprovide in its reportforthe new form of governmentto be established.

The elective officials of the municipality under a new form ofgovernmentselectedby the electorsshallbeelectedat thefirst municipalelectionheldafter the referendumon therepealof ahomerule charteror at suchlater dateasmay be specifiedby the commissionin its report.

ARTICLE IVGENERAL PROVISIONSAND LIMITATIONS FOR

OPTIONAL PLAN MUNICIPALITIES

Section 401. Upon the adoption by the qualified voters of anymunicipality of anyof the optionalplansof governmentasset forth in thisact, themunicipality shallthereafterbegovernedby theplanadoptedandby the provisions of generallaw applicable to that class or classesofmunicipality exceptasotherwiseprovidedherein. Unlessanduntil themunicipality should adopt anotherform of governmentas providedbylaw, the plan adoptedandthe provisionsof generallaw applicableto thatclassor classesof municipality shallbecomelaw in themunicipalityat th-etimefixed by thisact. All actsandpartsof acts,local,special,or general,affecting the organization,governmentandpowersof suchmunicipalitywhich arenot inconsistentor in conflict herein,shall remainin full forceuntil modified or repealedasprovidedby law.

Section 402. The municipal clerk or secretaryof the municipalityshall forthwith causethe new plan of governmentas approvedby thequalified electors to be recorded in the ordinance book of themunicipality. He shallalsofile a certifiedcopy thereofin the office of theSecretaryof the Commonwealth,with the Secretaryof the Departmentof CommunityAffairs, and with the county boardof elections.

Section403. The generalgrantof municipal powercontainedin thisarticle is intended to confer the greatestpower of self governmentconsistentwith the Constitution of this Commonwealthand with theprovisionsof and the limitations prescribedby this act. Any specificenumerationof municipalpowerscontainedin thisactor in anyotherlawswill not be construedin anyway to limit the generaldescriptionof powercontainedin this article, andanysuchspecifically enumeratedmunicipalpowersshallbeconstruedasin additionandsupplementaryto the powersconferredin generaltermsby thisarticle. All grantsof municipal powerto municipalitiesgovernedby an optionalplanunderthis act, whetherinthe form of specific enumerationor general terms,shall be liberallyconstruedin favor of the municipality.

Section 404. The optional plan of any municipality adopted inaccordancewith this act shallnotgive anypoweror authority to diminishany rights or privileges of anypresentmunicipalemployein his pensionor retirement system. No municipality shall exerciseany powersorauthoritybeyondthemunicipal limits exceptsuchasareconferredby anact of the GeneralAssembly, and no municipality shall engagein anyproprietary or private businessexcept as authorized by the GeneralAssembly.

ARTICLE VOPTIONAL PLAN: EXECUTIVE (MAYOR) - COUNCIL PLAN A

A. Form of Government:ElectedOfficials

Section501. Theform of governmentprovidedin thisarticleshallbeknown as the “Mayor-Council PlanA” andshall, togetherwith the lawsapplicableto that classof municipality andArticles IV andXII of this act,governanymunicipality the voters of which haveadoptedit pursuanttothis act.

Section 502. Eachmunicipality hereundershallbe governedby anelected council, an elected executive who may be called mayor, asdeterminedby the governmentstudy commission,an elected districtattorney in the case of counties and, when recommendedby thegovernmentstudy commissionand adoptedby the voters, an electedtreasurer,an electedcontroller,andby suchotherofficersandemployesas may be duly appointed pursuant to this article, general law orordinance.

Section 503. The executive (mayor), the treasurer,if elected,thedistrictattorneyin the caseof countiesandthe controller,if elected,shallbe electedby the voters of the municipality at a regular municipalelection, and shall servefor a term of four yearsbeginning on the firstMonday of Januarynext following his election.

Section 504. The council shall consist of five members, unlesspursuant to the authority grantedunder section 213 of this act, themunicipality shall be governedby a council of three, sevenor ninemembers. Membersof thecouncilshallbeelectedat-largeby thevotersof the municipality, unless, pursuant to the authority granted undersection213of thisact,membersshallbeelectedon adistrictbasisin whicheachdistrict is as equalin populationas is feasible,or on acombinationat-largeanddistrictbasisasdeterminedby thecharterstudycommission,or asspecifiedin an initiative petition or ordinanceof the governingbodyunder the provisionsof section231 through section233 of this act, at aregularmunicipalelectionandshallservefor a termof four years,exceptas hereinafterprovided for those first elected beginning on the firstMonday of Januarynext following their elections.

Section505. At thefirst municipalelectionfollowing theadoptionbyamunicipalityof this plan,councilmenshallbeelectedandshallserveforthe termsas providedin section 1262 of this act.

B. Council

Section511. Thelegislativepowerof themunicipality asprovidedbylaws applicable to that class of municipality shall be exercisedby themunicipal council, except as may otherwisebe provided for by theprovisionsof this act.

Section 512. On the first Monday of January following the regularmunicipal election, the membersof council shallassembleat the usualplace of meeting and organize and elect a presidentfrom among itsmembers,who shallpresideat itsmeetingsandperformsuchother-dutiesascouncil may prescribe,andavice president,who shallpresidein theabsenceof the president. If the first Monday is a legal holiday, themeetingshallbe held on the first dayfollowing.

Section513. The council,in additionto suchotherpowersanddutiesasmay be conferredupon it by generallaw, may require anymunicipalofficer, in its discretion, to prepare and submit sworn statementsregarding his official duties in the performance thereof, and mayotherwiseinvestigatethe conductof any department,office or agencyofthe municipal government.

Section514. A municipal clerk or secretaryshallbe appointedin themannerset forth in the AdministrativeCode asprovidedin section1246of this act. The municipal clerk or secretaryshall serveas clerk of thecouncil, keep its minutes and records of its proceedings,maintain andcompile its ordinancesand resolutionsas this act requires,andperform

such functions as may be required by law or by local ordinance.Themunicipal clerk shall, prior to his appointment,havebeenqualified bytraining or experienceto perform the dutiesof the office.

C. Executive(Mayor) andAdministration

Section 521. The executive power of the municipality shall beexercisedby the executive(mayor).

Section 522. The executive (mayor) shall enforce the plan andordinancesof themunicipalityandall generallawsapplicable-thereto.Heshall, annually,report to the council and the public on the work of thepreviousyear and on the conditionand requirementsof the municipalgovernmentandshall, fromtimeto time,makesuchrecommendationsforaction by the council as he may deemin the public interest. He shallsuperviseall of the departmentsof the municipal government,andshallrequireeachdepartmentto make an annualandsuchotherreportsof itswork as he may deemdesirable.

Section523. (a) Ordinancesadoptedby thecouncilshallbesubmittedto the executive(mayor)andhe shall,within tendaysafter receivinganyordinance,eitherapprovetheordinanceby affixing his signaturethereto,or return it to the councilby deliveringit to the municipal clerk togetherwith astatementsettingforth hisobjectionstheretoor to any itemor partthereof.No ordinanceor anyitemor part thereofshalltakeeffectwithoutthe executive’s(mayor’s) approval,unlessthe executive (mayor) fails toreturn an ordinanceto the council within ten days after it has beenpresentedto him, or unlesscouncil upon reconsiderationthereofon orafter the third day following its returnby the executive(mayor) shallbya vote of a majority plus one of the membersresolveto override theexecutive’s(mayor’s)veto.

(b) The executive(mayor)may attendmeetingsof council andmaytakepart in discussionsof councilbutshallhaveno vote exceptin thecaseof a tie on the questionof filling a vacancyin the council,in which casehe may castthe deciding vote.

Section 524. (a) The executive (mayor) shall designate anydepartmenthead,to act as executive(mayor) wheneverthe executive(mayor) shallbe prevented,by absencefrom the municipality,disability,or othercause,from attendingto thedutiesof hisoffice. Duringsuchtimethe personso designatedby the executive (mayor) shall possessall therights, powers, and duties of the executive (mayor). Whenever theexecutive(mayor) shallhavebeenunableto attend to the dutiesof hisoffice for a periodof sixty consecutiveclays for any of the abovestatedreasons,a memberof council shallbe appointedby the council asactingexecutive(mayor),who shall succeedto all the rights, powersand dutiesof the executive(mayor) or the then acting executive (mayor),until heshall returnor his disability shall cease.

(b) The municipality may havea departmentof administrationand

shallhavesuchotherdepartmentsascouncil mayestablishby ordinance.All of the administrativefunctions,powersanddutiesof the municipality,otherthanthosevestedin the office of the clerk, treasurer,if elected,andcontroller, shall be allocated and assignedamong and within suchdepartments.

(c) Each departmentshall be headedby a director who shall beappointedby the executive(mayor)with the advice and consentof thecouncil. Each municipality shall also have a solicitor who shall beappointedby the executive(mayor) with the adviceand consentof thecouncil. Eachdepartmentheadand the solicitor shall serve during theterm of office of the executive(mayor) appointing him, and until theappointmentandqualificationof his successor.No memberof municipalcouncil shallheada department.

(d) The executive (mayor) may, in his discretion, remove anydepartmentheadafter notice and an opportunity to be heard.Prior toremovingadepartmenthead,theexecutive(mayor)shallfirst file writtennoticeof his intention with the council, andsuchremovalshallbecomeeffective on the twentiethday after thefiling of such notice.

(e) Department heads shall appoint subordinate officers andemployes within their departmentsunder proceduresestablishedinsection 1222 of this act.

Section525. Wherea departmentof administrationis established,itshallbe headedby a director. Heshallbe chosensolelyon the basisofhis executiveand administrativequalifications with specialreferencetohisactualexperiencein, or his knowledgeof, acceptedpracticein respectto the duties of his office as hereinafterset forth. At the time of hisappointment,he neednot be aresidentof the municipality or State.Heshallhave,exerciseanddischargethe functions,powersanddutiesof thedepartment.The department,underthe directionandsupervisionof theexecutive(mayor),shall:

(1) Assist in the preparationof the budget;(2) Administer a centralizedpurchasingsystem;(3) Establishand administera centralizedpersonnelsystem;(4) Establishand maintain a centralizedaccountingsystemwhich

shallbe sodesignedas to accuratelyreflect the assets,liabilities, receipts,andexpendituresof the municipality;

(5) Perform suchother dutiesas council may prescribethroughanadministrativecodeor as the executive(mayor) shalldirect.

D. Budget

Section 531. The municipal budget shall be prepared by theexecutive(mayor)with theassistanceof the directorof the departmentofadministration,or otherofficer designatedby the executive(mayor).

Section 532. The budget shall be in such form as is required bycouncil,andshallhaveappendedtheretoadetailedanalysisof the various

itemsof expenditureandrevenue.The budgetassubmittedandadoptedmust be balanced. Council may reduce any item or items in theexecutive’s(mayor’s)budgetby a voteof amajorityof the council,but anincreasein anyitem or itemsthereinshallbecomeeffectiveonly uponanaffirmative vote of a majority plus one of the membersof council.

Council shall, upon the introductionof the proposedbudget,fix a datefor adoptionthereof,which shallexceptasotherwiseprovided-benot laterthan the thirty-first day of Decemberimmediately following.

Section 533. During the month of January next following anymunicipalelection,theexecutive(mayor) maysubmitanamendedbudgetto council andcouncilshallconsiderit in the samemannerasprovidedinsection 532, but final considerationof the amendedbudget shall becompletedby February15 of the sameyear.

Section 534. Council shall have the power to amend the budgetduring the monthof Januarynextfollowing anymunicipal election.Finaladoptionof theamendedbudgetshallbecompletedby February15 of thesameyear.

ARTICLE VIOPTIONAL PLAN: EXECUTIVE (MAYOR) - COUNCIL PLAN B

Section601. The form of governmentprovidedin thisarticleshallbeknown as the “Executive (Mayor) - Council Plan B” and shall, togetherwith Articles IV, V, and XII, with the exceptionof subsection524 (b),governanymunicipality, the votersof which haveadoptedit pursuanttothis act.

Section 602. The municipality shall have a department ofadministrationand shall have such other departmentsas council mayestablishby ordinance.All of the administrative functions,powersanddutiesof the municipality, other than those vestedin the office of theclerk, treasurer,if elected,andcontroller, shallbe allocatedandassignedamongandwithin suchdepartmentsexceptthat the functions specifiedin section 525 of this act shall be assignedto the departmentofadministration.

Section 603. It is the intent and purposeof Executive (Mayor) -

Council Plan B to mandate the establishmentof a departmentofadministration.

ARTICLE VIIOPTIONAL PLAN: EXECUTIVE (MAYOR) - COUNCIL PLAN C

Section701. The form of governmentprovidedin this article shallbe- known as the “Executive (Mayor) - Council PlanC” and shall, together

with Articles IV, V andXII with the exceptionof section522 of this act,governanymunicipality, the votersof which haveadoptedit pursuanttothis act.

Section 702. The executive (mayor) shall enforce the plan andordinancesof the municipalityandall generallaws applicablethereto.Heshall, annually,report to the council and the public on the work of thepreviousyear and on the conditionand requirementsof the municipalgovernmentandshall, fromtimeto time, makesuchrecommendationsforactionby the council as he may deemin the public interest.

Section703. Theexecutive(mayor) shallappoint,with theadviceandconsentof thecouncil,amanagingdirectorwho shallexercisesupervisionoverall activitiesof the departmentsof governmentandwho shallbe thecontactofficer betweenthemayorandsuchdepartments.The managingdirector shall make periodic reportswith suchrecommendationsashedeemsappropriateto the executive (mayor) concerningthe affairs ofmunicipal governmentand particularly of thosedepartmentsunderhisjurisdiction.

The executive (mayor) may, in his discretion, remove a managingdirector after notice and an opportunityto be heard.Prior to removingamanagingdirector, the executive(mayor) shall first file written noticeof his intentionwith the council,andsuchremovalshallbecomeeffectiveon the twentieth dayafter the filing of suchnotice.

ARTICLE VIII

OPTIONAL PLAN: COUNCIL-MANAGER PLAN

A. Form of Government:ElectedOfficials

Section801. The form of governmentprovidedin this articleshallbeknownasthe“Council-ManagerPlan” andshall, togetherwith Articles IVand XII, governany municipality, the votersof which haveadoptedthisplan pursuantto this act.

Section802. Eachmunicipalityunderthisarticleshallbe governedbyan electedcouncilonememberof which shallbeanelectedmayorchosenasprovidedin sections213and811,an electeddistrictattorneyin thecaseof counties,an appointedmunicipal manager,and,whenrecommendedby thechartercommissionandadoptedby thevotersan electedtreasurer,an electedcontroller andby suchotherofficers andemployesasmaybeduly appointedpursuantto this article, generallaw or ordinance.

Section 803. The district attorneyin the case of counties and thetreasurerandcontroller, if providedfor andif elected,shallbeelectedbythe voters of the municipality at a regularmunicipal election, and shallservefor a term of four yearsbeginningthe first Monday of Januarynextfollowing his election.

Section 804. The municipal council shall consist of five membersunless,pursuantto the authoritygrantedundersection213of this act,themunicipality shall be governedby a council of three, sevenor ninemembers.Membersof the municipal councilshallbe elected,at-large,bythe votersof the municipality, unless,pursuantto the authority granted

undersection213 of this act, membersshallbe electedon a district: basisin which eachdistrict is as equal in populationas is feasible, or on acombinationat-largeanddistrict basisasdeterminedby thecharterstudycommissionor as specified in an initiative petition or ordinanceof thegoverningbody underthe provisionsof section231 throughsection233of this act, at a regularmunicipal election, and shall servefor a term offour years, except as hereinafter provided for those first elected,beginningon the first Mondayof Januarynext following their election.

Section805. At the first municipal electionfollowing theadoptionbyamunicipality of this charterplan,councilmenshallbe electedand shallservefor the terms asprovided in section 1262 of this act.

B. Council

Section811. (a) On the first Monday ofJanuaryfollowing the regularmunicipal election,the membersof the municipalcouncil shallassembleat theusualplaceof meetingandorganizeandchooseoneof their numberasmayorunlessotherwiseprovided.Themayorshallbe chosenby ballotby majority voteof all membersof the municipal council. If the membersshall be unable,within five ballots to be taken within two days of saidorganizationmeeting, to elect a mayor, then the memberwho in theelection for membersof the municipal council received the greatestnumberof votesshallbe themayor. Shouldsuchpersondeclineto acceptthe office, then the personreceiving the next highestvote shallbe themayor,and soon, until the office is filled. The mayorshallpresideat allmeetingsof the municipal council andshallhaveavoice andvote in itsproceedings.

(b) On the recommendationof thegovernmentstudycommissionasprovided in section 213, or as specified in an initiative petition orordinanceof the governingbody as authorizedby section231 throughsection233 of this act, the mayorshallbe electeddirectly by the votersof the municipality at the regular municipal election in lieu of beingchosenasprovidedin subsection(a) of this section.

Section812. A municipal clerk or secretaryshallbe appointedin themannerset forth in theAdministrative Codeasprovidedin section1246of this act. The municipal clerk or secretaryshall serve as clerk of thecouncil, keepits minutes and recordsof its proceedings,maintain andcompile its ordinancesand resolutionsas this act requires,andperformsuch functions as may be required by law or by local ordinance.Themunicipal clerk shall, prior to his appointment,havebeenqualified bytraining or experienceto perform the dutiesof the office.

Section813. (a) All powersasprovidedby lawsapplicableto that classof municipality shall be vested in the municipal council, except asotherwiseprovidedby this article, andthe council shallprovide for theexercisethereofand for the performanceof all dutiesand obligationsimposedon the municipality by law.

(b) The council shall by ordinanceadopt an administrative codedefining the responsibilitiesof themunicipaldepartmentsandagencierasit deemsnecessaryand proper for the efficient conduct of municipalaffairs.

(c) The municipal council shall appoint a municipal manager.Theoffice of municipalmanagerandmunicipalclerkor secretarymaybe-heldby the sameperson.

(d) The council may make investigations into the affairs of themunicipality and the conductof any municipal department,office oragency.

(e) Themunicipalcouncilshallcontinueor create,anddetermineanddefine, the powers and duties of such executive and administrativedepartments,boards,andoffices,in additionto thoseprovidedfor herein,asit maydeemnecessaryfor theproperandefficient conductof theaffairsof the municipality including the office of deputy manager. Anydepartment,boardor office so continuedor createdmay,at anytime, beabolishedby themunicipalcouncil.No memberof municipalcouncilshallheadan administrativedepartment.

(f) It is theintentionof this articlethat the municipalcouncilshallactin all mattersas a body, and it is contrary to the spirit of this article foranyof its membersto seekindividually to influencetheofficial actsof themunicipal manager,or any otherofficer, or for the council or any of itsmembersto direct or requestthe appointmentof any personto, or hisremovalfrom office, or to interferein any waywith the performancebysuchofficers of their duties.The council and its membersshalldealwiththeadministrativeservicesolely throughthemunicipalmanagerandshallnot give orders to any subordinatesof the municipal manager,eitherpublicly or privately. Nothing herein contained shall prevent themunicipalcouncil from appointingcommitteesor commissionsof-its- ownmembersor of citizensto conductinvestigationsinto the conductof anyofficer or department,or any matter relating to the welfare of themunicipality, and delegatingto such committeesor commissionssuchpowersof inquiry as the municipal council may deemnecessary.

C. Municipal Manager

Section821. The municipal managershallbe chosenby the councilon thebasisof his executiveandadministrativequalifications.At thetimeof hisappointment,heneednotbearesidentof themunicipality or State.Themunicipal managershallnot hold anyelectivegovernmentaloffice.

Section 822. The municipal managershall be appointed for anindefinite term, andmay be removedby amajority vote of the council.At least thirty days before such removal shall becomeeffective, thecouncil shallnotify the municipalmanagerof its decisionto removehimfrom office, by a majorityvote of its members,statingthe reasonsfor hisremoval.The municipal managermay reply in writing andmayrequest

apublic hearing,which shallbeheldnotearlier thantwentydaysncr laterthan thirty days after the filing of such request. After such publichearing,if onebe requested,andafter full consideration,the council bymajority vote of its membersmay adopt a final resolutionof removal.Bythe preliminary resolution, the council may suspend the municipalmanagerfrom duty,butmay, in anycase,causeto be paid him forthwithanyunpaidbalanceof hissalaryandthereafterhissalaryfor thenext threecalendarmonths.

Section 823. The municipal manager may designate a qualifiedadministrativeofficer of the municipality to perform hisdutiesduring histemporaryabsenceor disability. In the eventof his failure to make suchdesignation,or if theabsenceordisabilitycontinuesmorethanthirty-days,the council may appoint an officer of the municipality to perform thedutiesof the managerduring such absenceor disability until he shallreturnor his disability shall cease.

Section 824. The municipal managershall:(1) Be the chief executive and administrative official of the

municipality.(2) Executeall laws and ordinancesof the municipality.(3) Appoint andhavepower to removedepartmentheads,a deputy

manager,if onebeauthorizedby council,andappointsubordinate-officersand employesunderproceduresestablishedin section 1222 of this act.

(4) Negotiatecontractsfor the municipality, subjectto the approvalof the municipal council,makerecommendationsconcerningthe natureand location of municipal improvements, and execute municipalimprovementsasdeterminedby the municipal council.

(5) Assure that all terms and conditions imposed in favor of themunicipality or its inhabitantsin any statute,public utility franchiseorothercontractarefaithfully keptandperformed,andupon knowledgeofany violation, call the sameto the attentionof the municipal council.

(6) Prepareagenda for and attendall meetingsof the municipalcouncil with theright to takepartin the discussions,butwithout therightto vote.

(7) Make such recommendationsto the council concerningpolicyformulation ashe deemsdesirableandkeepthe council and the publicinformed as to the conductof municipal affairs.

(8) Prepareand submit the annualbudget to the council togetherwithsuchexplanatorycommentashemaydeemdesirable,andadrnini~terthe council approvedbudget.

(9) Performsuch other dutiesas may be required of the municipalmanagerby ordinanceor resolutionof the municipal council.

(10) Be responsible to the council for carrying out all policiesestablishedby it and for the proper administrationof all affairs of themunicipality within thejurisdiction of the council.

D. Budget

Section 825. The municipal managershall submit to council hisrecommendedbudget, together with such explanatory comment orstatementashe maydeemdesirable.The budgetshallbe in suchform asis requiredby council for municipal budgets,andshall in addition haveappendedtheretodetailedanalysisof thevariousitemsof:eLpenciitureandrevenue.Thebudgetassubmittedandadoptedmustbebalanced.Councilshall upon introduction of the proposedbudget fix a date for adoptionthereof which shallbe not later than the thirty-first day of Decemberimmediately following.

Section 826. During the month of January next following anymunicipal election, council may request the manager to submit anamendedbudgetto councilwhich shallconsiderit in thesamemannerasprovidedin section825,exceptthat final adoptionof theamendedbudgetshallnot be later than February15 of the sameyear.

ARTICLE IX

OPTIONAL PLAN: SMALL MUNICIPALITY PLAN

A. Form of Government:ElectedOfficials

Section901. Theform of governmentprovidedin this article shallbeknown as the “Small Municipality Plan.” It may be adoptedby anymunicipalityhavingapopulationof lessthanseventhousandfive hundredinhabitantsby thelastFederalcensus.The plan togetherwith Articles IVandXII of this actshallgovernanymunicipality the votersof which haveadoptedit pursuantto this act.

Section 902. Each municipality shall be governed by an electedexecutive(mayor)andcouncilmen,an electeddistrict attorneyin the caseof countiesandsuchotherofficers asshallbe appointedpursuantto thisarticle, generallaw or ordinance.

B. Council

Section911. The council shall consistof the executive(mayor),whoshall be electedat-large, and two councilmen unless pursuant to theauthority grantedundersection213of this act the municipality shallbegovernedby an executive (mayor) and four councilmen, an executive(mayor) and six councilmen, or an executive (mayor) and eightcouncilmen. Membersof the council shall be elected at-large,unless,pursuantto theauthority grantedundersection213 of this act, membersshall be electedon a district basisin which eachdistrict is as equal inpopulationasis feasible,or on a combinationat-largeanddistrict basis asdeterminedby thecharterstudycommissionor asspecified-inan-initiativepetition or ordinanceof the governing body under the provisions ofsection231 throughsection233of this act,at a regularmunicipalelection

by the voters of the municipality and shall serve a term of four yearsbeginning on the first Monday in Januarynext following their election,exceptashereinafterprovidedfor thosefirst elected.

Section 912. On the first Monday of January following the regularmunicipalelection,themembersof thecouncilshallassembleat theusualplaceof meetingandorganize.The executive(mayor)shallpresideat allmeetingsof the councilandshallhaveavoiceandvoteon its proceedings.Thecouncilshallselectfrom amongitsmembersapresidentof thecouncilwho shall serve in place of the executive (mayor) in the event of hisabsenceor disability.

Section 913. The legislative power of the municipality shall beexercisedby the council,exceptasmaybe otherwiseprovidedby generallaw. A majority of the whole number of the council shall constituteaquorumfor the transactionof business,but a smallernumbermay meetand adjournfrom time to time.

Section914. (a) A municipal clerk or secretaryshallbeappointedinthe mannerset forth in the Administrative Code,asprovidedin section1246of this act. The municipal clerk or secretaryshall serveasclerkofthe council,keepits minutesandrecordsof its proceedings,maintain andcompile its ordinancesand resolutionsas this act requires,andperformsuch functionsas may be required by law. The clerk shall, prior to hisappointment,havebeenqualified by training or experienceto performthe dutiesof the office.

(b) The council may consistentwith acts of the GeneralAssemblyapplicableto that classor classesof municipality providefor the mannerof appointment of a solicitor, any planning board, zoning board ofadjustment,zoninghearingboardor personnelboardin themunicipalityandmay createcommissionsand otherbodieswith advisorypowers.

C. Executive(Mayor) andAdministration

Section 921. The executive power of the municipality shall beexercisedby the executive(mayor).It shallbe hisduty to seethat all lawsand ordinancesin force andeffect within the municipality areobserved.He shalladdressthe council andreport to the residentsannually,and atsuch other times as he may deem desirable,on the condition of themunicipalityanduponitsproblemsof government.Theexecutive(mayor)shall also appointa financecommitteeof the council,which shall consistof one or more councilmen, and may appoint and designateothercommitteesof council of similar composition.

Section922. Theexecutive(mayor) shallappointsubordinateofficersand employeswith the advice andconsentof councilunderproceduresestablishedin section 1222 of this act, except that in municipalitiescommonly known as counties, the office of prothonotaryand clerk ofcourts, register of wills and clerk of orphanscourt shall be filled byappointmentby thepresidentjudgeof the appropriatecourtwith adviceandconsentof a majority of the council.

D. Budget

Section 941. The municipal budget shall be prepared by theexecutive(mayor)andshallbesubmittedto council in a-f-armasisrequiredby council. The budget as submittedand adoptedmust be balanced.Council shall upon introduction of the proposedbudget,fix a date foradoption thereof which shall be not later than the thirty-first day ofDecemberimmediately following.

Section 942. During the month of January next following anymunicipalelection,theexecutive(mayor),uponhisowninitiati-veorattherequestof council,maysubmitan amendedbudgetto council,which shallconsiderit in the samemannerasprovidedin section941, exceptfinaladoptionof theamendedbudgetshallnotbelaterthan-February15 of thesameyear.

ARTICLE XOPTIONAL PLAN: OPTIONAL COUNTY PLAN

A. Form of Government:ElectedOfficials

Section 1001. The form of governmentprovidedin this article shallbe known asthe “Optional CountyPlan” andshall, togetherwith ArticlesIV andXII governanycounty,the votersof which haveadoptedthis planpursuant to this act. This option shall be available only to thosemunicipalitiescommonlyknown as “counties.”

Section 1002. (a) The county officers are:(1) CountyCommissioners,(2) Controller or Auditors,(3) District Attorneys,(4) Public Defenders,(5) Treasurers,(6) Sheriffs,(7) Registersof Wills,(8) Recordersof Deeds,(9) Prothonotaries,

(10) Clerks of the Courts.(b) County officers, except for public defenders who shall be

appointedasprovidedby law,shallbe electedat the municipal electionsandshallholdtheir officesfor thetermof four years,beginningon thefirstMondayofJanuarynextaftertheir election,anduntil their successorsshallbe duly qualified; all vacanciesshallbe filled in suchmanneras maybeprovided by law.

(c) Countyofficersshallbe paidonly by salaryasprovidedby law forservicesperformedfor the countyor any othergovernmentalunit. Feesincidental to theconductof any countyoffice shallbe payabledirectly to

the county or the Commonwealth,or asotherwiseprovidedby law.

(d) Three county commissionersshallbe electedin eachcounty. Inthe electionof theseofficerseachqualified electorshallvotefor notmorethan two persons,andthethreepersonsreceivingthe highestnumberofvotesshallbe elected.

(e) Thecoroneror medicalexaminershallbeastatutoryofficeelectedat themunicipalelectionandshallholdtheofficefor thetermoifQuryearsbeginning on the first Monday of Januarynext after election,and untiltheir successorsshall be duly qualified; shall be paid only by salaryasprovidedby law; all vacanciesshallbe filled in such mannerasmay beprovidedby law.

(f) Jury commissionersshallbe statutoryofficers andshallbe electedat the municipal electionandshallhold their office for the term of fouryearsbeginningon the first Monday of Januarynext after election anduntil theirsuccessorsshallbeduly qualified; thesalary-boardshallfIx theirsalary; vacanciesshall be filled by the presidentjudge of the court ofcommonpleas.

Section 1003. All county officers may exercisethosepowersgrantedby generallaw to county offices of the classof countyto which it belongs.

ARTICLE XIADDITIONAL COUNTY OPTION; ELECTED SHERIFF

Section 1101. A government study commission created andconstitutedas provided in Article II of this act for the municipalitycommonlyknownascounties,or aninitiative petition or ordinanceof thegoverningbodyas authorizedby section231 throughsection23:3 of thisact, mayrecommendandcauseto be placed on the ballotas a partof thequestionsubmittedto the votersfor approval,additionaloptionsaspartof theoptionalplansassetforth in Article V, Executive(Mayor) - CouncilPlan A; Article VI Executive (Mayor) - Council Plan B; Article VIIExecutive(Mayor) - Council PlanC; Article VIII Council-ManagerPlan;or Article IX, Small MunicipalitiesPlan,providing for the electionof thecounty sheriff.

Section 1102. If the optionalplan, including an additionaloption oroptionsasprovidedin section1101,is approvedby thevoters,the countyshall be governedby the provisionsof the article providing the basicoptionalplanandby theprovisionsof Articles IV andXII of thisact,exceptthat theelectedsheriffshallbesubjectto the provisionspertaining-to-thatoffice asprovided in Article X of this act.

ARTICLE XIIGENERAL PROVISIONS COMMON TO OPTIONAL PLANS

A. Officers and Employes

Section1201. In anycasewherea municipalofficer or official electedor appointedknows orby the exerciseof reasonablediligencecould knowthat he is interested to any appreciabledegree, either directly orindirectly, in any contract for the sale or furnishing of any personalpropertyfor theuseof themunicipality,or for anyservicesto berenderedfor such municipality involving the expenditureby the municipality ofmorethanthreehundreddollars ($300)in anyyear,heshallnotify councilthereof,andanysuchcontractshallnotbepassedandapprovedbycouncilexceptby an affirmative vote of at least three-fourthsof the membersthereof. In casethe interestedofficer is a memberof council, he shallrefrainfrom votingupon saidcontract.The provisionsof this sectionshallnot apply to caseswhere such officer or official is an employe of theperson,firm or corporationto which moneyis to be paidin acapacitywithno possibleinfluenceon the transactionand in which he cannotpossiblybe benefitedthereby,either financially or in anyothermaterialmanner.Any officer or officials who shall knowingly violate the provisionsof thissection shall be liable to the municipality upon his bond, if any, orpersonally,to the extentof the damageshownto be sustainedtherebybythe municipality, to ouster from office, and shall be guilty of amisdemeanor;andupon conviction thereof,shallbe sentencedto pay afine not exceedingfive hundred dollars ($500), or imprisonment notexceedingoneyear, or both.

Section1202. No officer or employeshallacceptor receive,directlyor indirectly, from any personoperatingwithin the territorial limits of amunicipality any interurbanrailway, bus line, streetrailway, gasworks,waterworks,electric light or powerplant, heatingplant, telegraphline,telephoneexchangeor otherbusinessusingor operatingunderapublicfranchise, any frank, free pass,free ticket or free service,or acceptorreceive,directly or indirectly, from any person,any otherserviceupontermsmorefavorablethanis grantedto the public generally,exceptthatsuch prohibition of free transportationshall not apply to policemenorfiremen in uniform. Nor shallany free serviceto the municipal officialsheretoforeprovidedby any franchiseor ordinancebe affectedby thissection.

Section 1203. No candidatefor office, appointmentor employmentandno officer, appointeeor employein anymunicipality shall, directly orindirectly, give or promiseany personany office, position,employment,benefitor anything of value for the purposeof influencing or obtainingthe political support,aid or voteof anyperson,underthepenaltyof beingdisqualifiedto hold theoffice or employmentto which he may be or mayhavebeenelectedor appointed.

Section 1204. If any personhereafterelected or appointedto any

office or position in a municipality governedunder this act shall, afterlawful noticeor process,wilfully refuseor fail to appearbeforeanycourt,any legislative committee,or the Governor, or having appearedshallrefuse to testify or to answer any question regarding the property,governmentor affairs of the municipality, or regardinghis nomination,election,appointmentor official conducton the groundthat his answerwould tend to incriminatehim, or shall refuseto waive immunity fromprosecutionon accountof anysuchmatterin relationto-which-hemay-beasked to testify, may be removed from office by the council of themunicipality in its discretion.

B. Treasurer

Section 1211. (a) Underany of the optionalplansas set forth in thisact, exceptfor the plan set forth in Article X - Optional CountyPlan, theoffice of municipal treasurermay be omitted, or may be filled byappointmentasrecommendedby thechartercommissionandadoptedbythe voters. If the office of municipal treasurer is to be filled byappointment, the appointment shall be made in accordancewith theappointmentproceduresfor otherdepartmentheads.

(b) The municipal treasurer,if elected,shallperform such functionsand dutiesand have such powersrelating to the collection, receiving,safekeepingand paymentover of public moneysincluding municipal,county,institution districtandschooldistrict taxesasprovidedby generallaw and shall have such other functions,powersand duties as may beassignedto him by the executiveof the municipality.

C. AppointmentPowerand Personnel

Section 1221. The appointmentpowerof the chiefexecutiveof themunicipalityunderanyof theplansauthorizedby thisactshallincludetheappointmentof membersof boardsandcommissionsauthorizedby thisact, by generallaw now or hereafterenacted,or by action of municipalcouncil.All suchappointmentsshallbe with the adviceand consentof amajority of municipal council.

Section 1222. Appointmentsand promotionsof subordinateofficersandemployeswithin departmentsshallhe madeby the-departmentheadon the basisof apersonnelsystemwhich shall includewritten proceduresfor appointment and promotion based on merit and fitness asdemonstratedby examinationor otherevidenceof positioncompetence.Thepersonnelsystemshallbe governedby personnelruleswhich shallbepreparedby the executive (mayor) or managerand submitted to themunicipal council which shalladopt them with or without amendmentsunlessotherwiseprovidedfor or arrived at by collectivebargaining.Thepersonnelrulesmay provide for:

(1) The classificationof all municipal positions,basedon the duties,authorityandresponsibilityof eachposition,with adequateprovisionfor

reclassification of any position whenever warranted by change ofcircumstances.

(2) A pay planfor all municipal positions.(3) Methods for determining the merit and fitnessof candidatesfor

appointmentor promotion.(4) The policies and proceduresregulating reduction in force and

disciplinary action, including suspensionandremovalof employes.(5) The hoursof work, andprovisionsfor sick andvacationleaveand

holidays,and provisionsfor overtimecompensation.(6) Grievanceprocedures,including proceduresfor the hearingof

grievances.(7) Otherpracticesandproceduresnecessaryto theadministrationof

the municipal personnelsystem.

D. Filling Vacanciesin ElectedOffice

Section 1231. This sectionshall apply to the filling of vacanciesinelectedoffice in all optional plansandoptions except thoseset forth inArticle X - Optional County Plan, and Article XI - Additional CountyOptions.

Section 1232. (a) If a vacancyexists in the municipal council, themunicipal council shall, by a majorityof its remainingmembers,fill suchvacancy,within thirty days thereafter,by electinga qualified persontoserveuntil that first MondayofJanuarywhenhissuccessorwho shallhavebeen electedby the qualified electorsat the next municipal election,occurringat leastfifty daysafter such vacancyexists,is duly sworn intooffice for theremainderof thetermof thepersonoriginallyelectedto-saidoffice.

In casevacanciesshouldexistwherebytheoffices of a majority or moremembers of the municipal council become vacant, the remainingmembers shall fill such vacancies,one at a time, giving each newappointeesuchreasonablenoticeof his appointmentas will enablehimto meet and act with the then qualified memberor membersof themunicipal council in making further appointmentsuntil a baremajorityof members of municipal council members have been qualified,whereuponthe said membersshall fill the remaining vacanciesat ameeting attendedby the said majority membersof municipal council,suchappointeesto receiveamajorityof thevotesof thememberrpTesentat any suchmeeting.The personor personsselectedto fill suchvacancyor vacanciesshallhold their offices ashereinprovided.

If, by reasonof a tie vote,or otherwise,suchvacancyshallnothavebeenfilled by the remainingmembersof municipal council within the timeaslimited herein, the court of common pleas,upon the petition of ten ormorequalified electors,shall fill such vacancyby the appointmentof aqualifiedperson,for the portionof theunexpiredtermasaboveprovided.

(b) If a vacancyoccursin the office of executive(mayor),municipaltreasurer, if elected, municipal controller, if elected,county district

attorney, if elected,or county sheriff, if elected,the municipal councilshall fill such vacancy, within thirty days thereafter, by choosing an

executive(mayor),a municipal treasurer,amunicipal controller,acountydistrict attorneyor a county sheriff,as the casemay be,to serveuntil hissuccessoris elected by the qualified electors at the next municipalelection,occurringatleastfifty daysaftersuchvacancyoccurs,andis dulysworninto office. The personsoelectedshallservefrom the first Mondayof Januarynextsucceedinghis electionfor the remainderof the term ofthe personoriginally electedto such office.

If, by reasonof a tie vote or otherwise,a vacancyin the office ofexecutive (mayor), treasurer,controller, county district attorney, orcounty sheriff shall not havebeenfilled by council within the time aslimited herein,the court of commonpleas,upon petitionof ten or morequalifiedelectors,shallfill suchvacancyby the appointmentof aqualifiedpersonfor the portion of the unexpiredterm ashereinprovided.

E. Legislationby Council

Section1241. Thecouncilshall,by ordinanceor resolution,designatethe timeof holdingregularmeetingswhich shallbeat leastmonthly.Theexecutive(mayor)or thepresidentof council,asthecasemaybe,mayand,uponwritten requestof amajorityof themembersof thecouncil,shallcallaspecialmeetingof the council. In the call,he shalldesignatethepurposeof the specialmeeting and no other businessshall be considered.Allmeetingsof the council shallbe opento the public. The municipal clerkor secretaryshallkeepa journal of its proceedingsandrecordtheminutesof every meeting.

Section1242. (a) Council shalldetermineits own rulesof procedure,not inconsistentwith ordinance or statute. A majority of the wholenumber of membersof the council shall constitutea quorum,and noordinanceshallbe adoptedby thecouncil without the affirmativevoteofa majority of all the membersof the council.

(b) Eachordinanceor resolutionshallbe presentedandconsideredasdeterminedby council rulesof procedure.The vote upon every motion,resolution or ordinanceshallbe taken by roll call andthe yeasandnaysshallbe enteredon the minutes.The minutesof eachmeetingshallbesignedby theofficer presidingatsuchmeetingandby themunicipal-clerkor secretary.

(c) Council shall adopt by ordinancean administrative codewhichshallprovide for theestablishmentandfilling of additionaladministrativeoffices which it shalldeemnecessary,andshallprovidefor administrativeproceduresnot otherwiseprovidedfor in this act or by generallaw.

(d) Thecompensationof the controllerandtreasurershallbe fixed bythe council.

Section 1243. (a) Exceptasmay otherwisebe providedin this act allordinancesshallbe adoptedandpublishedasprovidedby law: Provided,however,Thatanyordinancemayincorporateby referenceany-3-tandard

technical regulationor code,official or unofficial, which neednot be sopublishedwhenever ten copies of said regulationsor code havebeenplacedon file in the office of the municipalclerk or secretaryand in theoffice of the body or departmentchargedwith the enforcementof saidordinance.

(b) No ordinanceother than the local budgetordinanceshall takeeffect less than ten daysafter its final passageby council andapprovalbytheexecutive(mayor)wheresuchapprovalis required,unlessthe councilshall adopta resolution declaring an emergencyandat least a majorityplus oneof all themembersof thecouncilvote in favor of suchresolution.

Section 1244. The municipal clerk or secretary shall record allordinancesand resolutionsadoptedby council and at the close of eachyear,with the adviceandassistanceof themunicipal solicitor, shallbind,compileor codify all theordinancesandresolutions,or truecopiesthereof,of the municipality which then remainin force and effect. He shallalsoproperlyindextherecordbooks,compilationor codificationof ordinancesand resolutions.

Section1245. No ruleor regulationmadeby anydepartment,officer,agencyor authority of the municipality, except such as relates to theorganizationor internalmanagementof the municipal governmentor apartthereof,shalltakeeffect until it isfiled eitherwith themunicipalclerkor secretaryor in such othermannerasmay be providedby ordinance.The council shallprovide for the promptpublication of suchrules andregulations.

Section 1246. The councilshall causeto be preparedand passasanordinancean administrativecodewhich shallprovide for the mannerofappointmentof asolicitor, clerk orsecretary,andmaycreatecommissionsand other bodies with advisory powers, and may provide additionalprovisionsrelating to theinternal structureof themunicipality as long asthe provisionsof the administrativecodearenot in conflict with any ofthe provisionsof this law applicableto the municipality.

F. Audit and Control

Section 1251. The council shallprovideby separateordinanceor inthe administrative codefor the exerciseof a control function in themanagementof the finances of the municipality by the municipalcontroller or, in the caseof the optionalplan set forth in Article X, theOptional CountyPlan,by the controller or auditors.

Section 1252. The council may provide for annualpost auditsof allaccountsby an independentauditor who shall be a certified publicaccountant, registeredin Pennsylvania,or a firm of certified publicaccountantsso registered.

G. Transition to Optional CharterPlan

Section 1261. Wheneverthe electorsof a municipality adoptany ofthe optional plansprovidedby this act at any electionfor that purpose,

suchmunicipality shallbe governedundertheprovisionsof suchplan,theprovisionsof generallaw applicableto that classof municipality andthisact from the first Monday in January following the next succeedingmunicipal election, exceptasprovidedin section213 (c) of this act.

Section1262. (a) Any electedmunicipal official in office at the timeof the adoptionof anyoptionalplanprovidedby this actshall continueinoffice only until the newplan of governmentgoesinto effect asprovidedin section1261,exceptasotherwiseprovidedin subsections(c) and (d) ofthis section.

(b) At the municipal electionnext succeedingthe adoptionof oneofthe optionalplansprovidedfor in this act, if four or less councilmenareelected,theyshallservefor termsof four years.If five areelected,thefoursuccessfulcandidatesreceivingthehighestpercentageofthevotescast-fortheoffice to which theyareelectedshallservefor terms-of-fouryears,andthe candidatereceiving the next highestpercentageof votesshall servefor a term of two years.If six or morecouncilmenare elected,the fivecandidatesreceivingthehighestpercentageof thevotescastfor theofficeto which they are electedshall serve for terms of four years, and theremainingsuccessfulcandidatesreceiving thenexthighestpercentageofvotesshall servefor terms of two years.Thereafter,all councilmenshallbe electedfor termsof four years.

(c) If an electedmunicipal treasureror electedmunicipal controlleror electedcountydistrictattorneyor electedcounty sheriff is in office atthetime of the adoptionof an optional plan underthe provisionsof thisact, a treasureror controlleror districtattorneyor sheriff, asthecasemaybe, shall not be elected or appointed to take office until after theresignation,death, removalor expiration of the term of said treasurer,controller,district attorneyor sheriff.

At the expiration of the term of said treasurer,controller, districtattorneyor sheriff in office at the timeof the adoptionof anoptionalplanunderthe provisionsof this act,a treasurer,controller,districtattorneyorsheriff, asthe casemaybe, shallbeelectedor appointedfor the full termfor said office as providedby the optionalplan adopted.

(d) Any memberof amunicipal governingbody in office at the timeof the adoptionof anoptionalplanshallremainin office,continuingasanat-largeor district councilman,as the casemaybe, until the expirationofhis term in office, andshallreceivethecompensationprovidedby law atthat time: Provided,That if that councilmanwas electedon an at-largebasis, the newly adoptedoptional plan providesfor a total numberofat-largecouncilmenequal to or exceedingthe total numberof at-largecouncilmenunderthe existingform of government;or, if thatcouncilmanwaselectedona districtbasis,thedistrict fromwhich thatcouncilmanwaselectedremainsunchangedandcontinuesto encompassthe exactsamegeographicalareaunder the newly adoptedoptionalplan as under theexistingform of government,andthe numberof councilmento beelected

from that district under the newly adoptedoptionalplan is equal to orexceedsthenumberelectedfrom thatdistrict underthe existingform ofgovernment. Any such councilman may, by writing filed with themunicipal treasurer,direct that any portion of his annualcompensationfor serving in office be returned to the municipal treasury. For thepurposeof this section,anexecutiveor mayorwho is alsoamemberof thecouncil underan existingplan shallbe consideredas a memberof thecouncil,and after the new plangoesinto effect, his dutiesshallbe onlythoseof a memberof council as prescribedby the new plan.

(e) At the municipal electionnext succeedingthe adoptionof oneofthe optional plans provided for in this act, the numberof councilmenprescribedby the terms in the plan less the numberof councilmenthenin office whosetermsdo not expireon the first Monday of Januarynextfollowing, asmaybe determinedby the foregoingsubsection(d), shallbeelected.

(f) If any vacanciesin council occurring by reasonof resignation,deathor removalshallexistninety daysor morebeforesuchelection,theyshall be filled for the remainderof the term of the personoriginallyelectedto that office.

Section 1263. (a) The annualcompensationof the executive(mayor)andcouncilmenelectedto their offices in theyearprior to the transitionyearunderanyof the optionalplans,exceptthe Optional CountyPlansetforth in Article X, adoptedpursuantto thisact, shallbe establishedby thecommissionaspartof its recommendationsor by theinitiative petition orordinance of the governing body authorized by section 231 throughsection233 of this act.

(b) The compensation of the executive (mayor), councilmen,controller, and treasurerelected to their offices subsequentto thetransitionyearto any of the optionalplansset forth in this act, except fortheplanset forth in Article X, the OptionalCountyPlan,shallbefixed byordinanceof council finally passedor adoptedat leasttwo daysprior tothe last day fixed by law for candidatesto withdraw their namesfromnominatingpetitionspreviousto the day of the municipalelection.Aftersuch compensationis once fixed by ordinance,only an increaseordecreasethereofneedbe fixed by suchordinance.

Section 1264. On the effective date of an optional plan adoptedpursuantto this act, all ordinancesandresolutionsof the municipality totheextentthattheyarenot inconsistentwith theprovisionsof thisactshallremainin full force and effect until modified or repealedasprovidedbylaw.

Section 1265. (a) On the effective dateof an optionalplan adoptedpursuant to this act, all appointive offices then existing in suchmunicipality shallbeabolishedandthetermsof all appointed-officersshallimmediatelyceaseandterminate:Provided,That nothing in this sectionshallbeconstruedto abolishthe office or terminatethe termsof office of

anyaldermanor constableor of anyofficial or employenowprotectedbyany tenureof office or civil servicelaw, or of anypolicemanor fireman,whetheror notprotectedby a tenureof office law.

(b) Provisionsfor officers andfor theorganizationandadministrationof the municipal governmentunder the optional planmay be madebyresolution pendingthe adoption of ordinances,but any such resolutionshallexpirenotlaterthansixty daysafter theeffective-dateof theoptionalplan.

Section1266. All actionsandproceedingsof alegislative,executiveorjudicial character, which are pending upon the effective date of anoptional plan adopted pursuant to this act, may continue and theappropriate officer or employe under such optional plan shall besubstituted for the officer or employe theretofore exercising ordischargingthe function, power or duty involved in such action orproceeding.

H. Repealof an Optional Plan

Section 1271. The procedurefor repealof an optionalplan shallbethe sameas for adoption of an optionalplan as providedin Article II ofthis act,excludingthe procedureprovidedin section231 throughsection233of this act. Wheneverthe electorsof any municipality, by a majorityvoteof thosevoting on the question,vote in favor of repealof an optionalplan and the establishmentof a particular form of government,suchmunicipalityshallbegovernedundertheformof governmentselectedbythe electors,from the first Monday of Januaryfollowing the municipalelectionat which theelectiveofficials of theform of governmentselectedby the electors shall have been elected. The government studycommissionshallprovidein its report for thenew form of governmenttobe established.

It is not theintentof this sectionto prohibit or limit in anywayutilizingthe procedureprovidedin section231 throughsection233 of this act toamendan optional plan.

ARTICLE XIIIGENERAL

Section 1301. This act shallnot apply to any city of the first classorto any county of the first class.

Section 1302. No local municipality within a county shall supersedeor exerciseany power, function or service presently exercisedby saidcounty.

Section 1303. Eachmunicipality which doesnot adopta home rulecharteror an optionalplanof governmentundertheprovisionsof thisact,shallretainits existingform of governmentasprovidedin thecodeunderwhich it operates,or undergeneral Law, or under the Constitution ofPennsylvania.

Section 1304. In casethe electorsof any municipality disapproveaproposalto adopta homerulecharteror an optionalplan of governmentthe municipality shall retain its existingform of government.

Section 1305. A municipality assuming a function previouslyperformedby anothermunicipality underthe terms of this act shall alsoassumeall the indebtednessandobligationsof the municipality relatingto the function. If property, indebtedness,or obligations of anothermunicipality not within the boundariesof the municipality assumingthefunctionis involved, thegoverningbodiesof thepartymunicipalitiesshallmakean adjustmentand apportionmentof all public propertyinvolved.

Theadjustmentandapportionmentasmadeshallbereducedto writing,andshallbe filed with thecourtof commonpleasof thecounty,andacopyshall also be filed with the Departmentof Community Affairs.

In casethe municipalities cannotmake an amicableadjustmentandapportionmentof the property, obligationsand indebtednesswithin sixmonths after the function is assumedany of the municipalities maypresenta petition to the court of common pleas. The court shall thenappoint threedisinterestedcommissioners,all residentsand taxpayersofthe county, but none residing in or owners of real estate in themunicipalities,who, after hearing,notice of which shallbe given to themunicipalities as the court shall direct, shall make report to the courtmakingan adjustmentandapportionmentof all thepropertyaswell astheobligationsor indebtedness.The reportshall statethe amountthatshallbe dueandpayablefrom eachmunicipality, theformsof paymentandtheamount of obligationsand indebtednessthatshallbe assumedby each.

The commissionersshall give the municipalities at least five days’written notice of thefiling of their report. Unlessexceptionsare filed tosuchreportwithin thirty daysafter the dateof the filing, the reportshallbe confirmed by the court absolutely.Any sum awardedby the reportshall be a legal and valid claim in its favor against the municipalitycharged. Any property real or personalgiven to a municipality shallbecome its property. Any claim or indebtednesschargedagainst themunicipality may be collectedfrom it.

If exceptionsarefiled to thereportof thecommissioners,thecourtshalldispose of the same, taking testimony therein if it deems the sameadvisable.The court shallenter its decreeconfirming the award of thecommissioners,or modifying the sameas to it appearsjust andproper.

The commissionersshall be allowedsuchcompensationandexpensesfor their servicesas the court shall fix. The costsof the proceedings,including the compensationandexpensesof the commissioners,shallbeapportionedby thecourtbetweenthe municipalitiesas it deemsproper.

In casea municipalityor partof amunicipality is locatedin two or morecounties,the court of commonpleasof the countywhere the largerpartof the municipality assumingthe function is locatedshallhaveexclusivejurisdiction over the proceedings.

Section1306. Any city which beganproceedingsbeforethe effectivedateof this act under the act of July 15, 1957 (P.L.901),knowrL as the“Optional Third ClassCity CharterLaw,” may adopt an optional planthereunderandfunction under the provisionsof that act.

Section1307. All actsandpartsof actsare repealedin so far as theyare inconsistentherewith.

Section 1308. If any provisionof this act, or the applicationof suchprovision to any personor circumstances,shall be held invalid, theremainderof the act andthe applicationof such provisionto personsorcircumstancesother than thoseas to which it is held invalid, shallnot beaffected thereby.

Section 1309. This act shall takeeffect immediately.
