20 Injunction shall be and hereby is granted and that plaintiff recover no monetary sum from the

22 PERMANENT GANG INJUNCTION23 After due consideration of all papers fied in this action, including the moving papers and

24 evidence submitted in support of plaintiffs Ex Parte Application For Order To Show Cause Re:

25 Preliminary Injunction, the deemed admissions of the defaulting defendants and the authorities

26 presented by counsel, this Court makes the following finding of facts by clear and convincing

28 (1) The WESTSIDE GANG is a criminal street gang as defined in Penal Code § 186.22,

29 having as one of its primary activities the commission of acts constituting a public nuisance;

2 members, agents, servants, employees and all persons acting under, in concert with, for the

3 benefit of, at the direction of, or in association with them or for any of them, are hereby enjoined

4 and restrained from engaging in or performing directly or indirectly, any of the following

5 activities in the SAFETY ZONES. "SAFETY ZONE ONE" wil now be defined as follows:

6 The border of SAFETY ZONE ONE begins at the intersection ofW. Grand Avenue and N.

7 Escondido Boulevard. The border extends north to the intersection with W. El Norte Parkway

8 and includes the 100 through 1200 blocks ofN. Escondido Boulevard. From N. Escondido

9 Boulevard and W. EI Norte Parkway, the border extends east to the intersection with N.

10 Broadway and includes the 200 through 100 blocks ofW. EI Norte Parkway. From W. EI Norte

11 Parkway and N. Broadway, the border extends south to the intersection with E. Lincoln Avenue

12 and includes the 1200 through 1000 blocks ofN. Broadway. From N. Broadway and E. Lincoln

13 Avenue, the border extends east to the intersection with N. Midway Drive and includes the 100

14 through 1900 blocks ofE. Lincoln Avenue. From E. Lincoln Avenue and N. Midway Drive, the

15 border extends south to the intersection with E. Grand Avenue and includes the 900 through 100

16 blocks ofN. Midway Drive. From N. Midway Drive and E. Grand Avenue, the border extends

17 west to the intersection ofN. Ash Street and includes the 1900 through 1200 blocks ofE. Grand

18 Avenue. From E. Grand Avenue and N. Ash Street, the border extends south to the intersection

19 with E. 3rd Avenue and includes the 100 through 200 blocks ofS. Ash Street. From S. Ash

20 Street and E. 3rd Avenue, the border extends west to the intersection with S. Fig Street and

21 includes the 1100 through 700 blocks ofE. 3rd Avenue. From E. 3rd Avenue and S. Fig Street,

22 the border extends north to the intersection with E. Grand Avenue and includes the 200 through

23 100 blocks ofS. Fig Street. From S. Fig Street and E. Grand Avenue, the border extends west to

24 the intersection ofN. Escondido Boulevard and includes the 600 block ofE. Grand Avenue

25 through the 200 block ofW. Grand Avenue and extends 100 yards to the outside of each of the

26 boundary streets listed herein. "SAFETY ZONE TWO" wil now be defined as follows: The

27 eastern boundary is the 100 block of south Juniper Street from Grand A venue to the 1600 block

28 of south Juniper Street to Felicita Avenue. The southern boundary wil be the 200 block of east

29 FelIcita Avenue from Juniper Street to the 600 block of west Felicita Avenue at Redwood Street.

6AMENDED JUGMENT BY COURT AFTER DEFAULT FOR PERMANENT GANG INJUCTION

1 The boundary then turns north on Redwood Street from the 1600 block of south Redwood Street

2 to the 1500 block of south Redwood Street at 15th Avenue. The boundary then turns west on

3 15th Avenue at the 700 block of west 15th Avenue and continues to the 900 block of west 15th

4 Avenue. The border then turns north at the 1500 block of south Upas Street and runs north to

5 Valley Parkway at what would be the intersection of Upas Street (Upas Street ends in the 100

6 block of S. Upas Street at Murray Court, and would continue in a straight line to Valley

7 Parkway). At Valley Parkway, the SAFETY ZONE turns east in the 900 block of west Valley

8 Parkway and runs east (where Valley Parkway turns into Grand Avenue at the 800 block) to

9 Juniper Street at the 200 block of east Grand A venue and extends 100 yards to the outside of

10 each of the boundary streets listed herein. The SAFETY ZONES include both sides of the

11 streets listed above, as well as any alley, driveways, parking lots, strctures, and businesses

12 located thereon. (See EXHIBITS A-I & A-2).

13 a. No Association With Known Gang Member: Standing, sitting, walking,

14 driving, gathering or appearing, anywhere in public view or any place accessible to the public,

15 with any named Defendant herein or any known member of the WESTSIDE, also known as

16 "WSG" criminal street gang;

17 b. No Intimidation: Confronting, intimidating, annoying, harassing, threatening,

18 challenging, provoking, assaulting, or battering any person known to be a witness to or victim of

19 crime, or any person known to have complained about the gang activities of the WESTSIDE,

20 also known as "WSG" criminal street gang;

21 c. Stay Away From Drugs In Public: (1) Participating in the selling, possessing or

22 using of any controlled substance, or ilegal drug, including, but not limited to: heroin, cocaine,

23 cocaine base, methamphetamine, and marijuana; (2) possession of related drug paraphernalia,

24 including, but not limited to, rollng papers, pipes, or other devices used for injecting, smoking

25 or ingesting ilegal drugs; (3) knowingly remaining in the presence or anyone selling,

26 possessing, or using any controlled substance or ilegal drug; or (4) being under the influence of

27 a controlled substance, or ilegal drug;

28 d. Stay Away From Alcohol In Public: Anywhere in public view or anyplace

29 accessible to the public, (1) drinking or possessing an open container of an alcoholic beverage,

1 (2) being under the influence of alcohol; (3) knowingly remaining in the presence of anyone

2 possessing an open container of an alcoholic beverage in public; (4) knowingly remaining in the

3 presence of an open container of an alcoholic beverage in public;

4 e. No Guns or Dangerous Weapons: Anywhere in public view or anyplace

5 accessible to the public, (1) possessing any weapons: firearms, including BB guns, airsoft guns,

6 pellet guns and replica guns, ammunition, knives, baseball bats, brass knuckles, or screwdrivers,

7 without a legitimate purpose, or ilegal weapon as defined in Penal Code section 12020,

8 (2) knowingly remaining in the presence of anyone who is in possession of such gun,

9 ammunition or dangerous weapon, or (3) knowingly remaining in the presence of such gun,

10 ammunition or dangerous weapon;

11 f. No Fighting: Engaging in fighting in public streets, alleys and/or public and

12 private property;

13 g. No Trespassing: Being present on any property not open to the general public,

14 except with (1) the prior written consent of the owner, owner's agent, or the person in lawful

15 possession of the property, or (2) in the presence of and with the voluntary consent of the owner,

16 the owner's agent, or the person in lawful possession of the property;

17 h. No Blocking Free Passage: Blocking the free passage of any person or vehicle

18 on any street, walkway, sidewalk, driveway, alleyway, or other area of public passage;

19 1. No GraffitiNandalism or Tools: (1) Spray painting, marking with marker pens,

20 or otherwise applying graffiti on any public or private property, or (2) possessing spray paint

21 cans, marker pens or other objects capable of defacing property;

22 J. No Acting as Lookouts: Acting as a lookout, whistling, yelling or otherwise

23 signaling another person to warn of the approach or presence of law enforcement officers;

24 k. No Gang Hand Signs: Using words, phrases, physical gestures, or symbols

25 commonly known as hand signs, which describe or refer to the gangs known as WESTSIDE,

26 also known as "WSG", such as: forming the letter "W" with one hand by crossing the ring

27 finger and the middle finger while separating the index and the last finger or by using two hands

28 by touching the tips of both thumbs and extending the index fingers at an angle, or touching the

29 tips of the index fingers together while extending the thumbs. Two people can form the "W" by

grasping there hands while extending the opposite hand. The "S" is made by cupping both hands

as if making the letter "C" then placing the right hand on top of the left hand. Placing the index

finger under the middle finger and separating the two while extending the thumb in a downward

position also makes the "S." "Varro" Westside is symbolic by making a "V" while separating

two fingers with one hand and making a "W" with the other hand."

i. No Gang Clothes: Wearing clothing or accessories, including, but not limited to,

caps and belt buckles with the letter "W" on them. Westside Gang members have worn

athetic jerseys with the number "23" on the m. It is also common for Westside Gang

members to wear shirts with "Westside" pri nted on them or any clothing or accessories which

display their gang moniker;

m. No Burglary Tools: Possessing burglary tools with no legitimate purpose,

including, but not limited to screwdrivers, shaved keys, spark plugs or porcelain casings, or

other devices capable of being used to break into locked vehicles;

n. No Littering: Littering in any public place or place open to public view;

o. Juvenile Curfew: If under the age of eighteen (18), being in a public place

between the hours of 11:00 p.m. on any day, and 5:00 a.m. ofthe following day, unless (1)

accompanied by a parent or legal guardian, or by a spouse eighteen (18) years of age or older, or

(2) performing an errand directed by a parent or legal guardian, or by a spouse eighteen (18)

years of age or older, or (3) returning directly home from a public entertainment, such as a

movie, play, sporting event, dance or school activity, or (4) actively engaged in some business,

trade, profession, or occupation which requires such presence;
