All potential buyers must register for the sale prior to placing a bid.Registration information may be submitted in person at our reception desk,by fax or through our website at www.freemansauction.com. We will requireproof of identification and residence and may require a credit card and/or abank reference. By registering for the sale, the buyer acknowledges that heor she has read, understood and accepted Freeman’s Terms and Conditionsof Sale.

A Buyer’s Premium will be added to the successful bid price and is payableby the buyer as part of the total purchase price. The Buyer’s Premium shallbe: 25% on the first $50,000 of the hammer price of each lot, 20% on theportion from $50,001 through $1,000,000, and 12% thereafter.

All items in the catalogue are subject to the 8% Pennsylvania andPhiladelphia sales tax. Dealers purchasing for resale must register their taxnumbers on current PA forms. Forms should be submitted to our ClientServices office on the second floor.

All item descriptions, dimensions and estimates are provided for guidanceonly. It is the buyer’s responsibility to inspect all lots prior to bidding toensure that the condition is to their satisfaction. If potential buyers areunable to inspect lots in person, our specialists will be happy to preparedetailed Condition Reports on individual lots as quickly as possible. Theseare for guidance only, and all lots will be sold “as is” as per our Terms andConditions of Sale.

At the sale Registered bidders will be assigned a bidder number and given apaddle for use at the sale. Once the first bid has been placed, theauctioneer asks for higher bids in increments determined by the auctioneer.To place your bid, simply raise your paddle until the auctioneeracknowledges you. The auctioneer will not mistake a random gesture for abid.

By phone A limited number of telephone lines are available for bidding byphone through a Freeman’s representative. Phone lines must be reserved inadvance. Requests must be submitted no later than 24 hours prior to thescheduled start of the sale.

In writing Bid forms are available in the sale room and at the back of thecatalogue. These should be submitted in person, by mail or by fax no laterthan one hour prior to the scheduled start of the sale. The auctioneer willbid on your behalf up to the limit.

On the internet A fully-illustrated catalogue is available on-line atwww.freemansauction.com. Registered bidders may leave absentee bidsthrough the web site and will receive email confirmation of their bid.Freeman’s is not responsible for errors or failure to execute bids.

Payment is due within ten (10) working days of the sale. Lots purchased willnot be released until we have received full payment. Payment may be madein cash, by check, money order, or debit card. Payments by check must clearthe bank before goods will be released.

Deliveries will not be made during the time of the sale unless otherwiseindicated by the auctioneer. All items must be paid for and removed withinten (10) working days of the sale. Purchases not so removed may be turnedover to a licensed warehouse at the expense and risk of the purchaser.

Responsibility for packing, shipping and insurance shall be exclusively thatof the purchaser. Upon request, Freeman’s will provide the purchaser withnames of professional packers and shippers known to us.

Odalisques were Matisse’s primary subjectduring the period in which the artist kept astudio in Nice from 1917-30. His principalmodel during the period, HenrietteDarricarrère, was depicted over and overagain, posed in specially staged areas filledwith exotic pillows, objets d’art, embroi-dered cushions, screens, carpets and furni-ture evocative of a harem setting.

Although obviously lacking the lush, brightcolors of his oils and pastels of this period,Matisse’s drawings and prints are no lessexpressive; rather, the monochromaticmedium allows his facility with pen and inkto shine. Various marks, textures andshading suggest patterns found in exotic,

Moroccan inspired furnishings, while thefigure itself, with its sensual, relaxedcurves, is rendered with only a few dynam-ic lines.

With her arm draped langorously overheadand dressed in an exotic blouse and loose,draped pants, the subject is dressed inattire typical of the women the artist hadseen during his travels in Morocco andAlgeria.

As in so many of his sculptures, paintingsand drawings of this period, Matisse’sreclining female subject is presented hereas cooly confident, elegant and theatricallyseductive.

In the early 1960s, Chuck Close wasan art student at the University ofWashington in Seattle. Frequenttrips with friends to San Franciscowould expose him not only to music,theater and film but also to the workof First Generation Bay Area artistssuch as Richard Diebenkorn, ElmerBischoff, and David Park.Additionally influenced by instructorAlden Mason, Close would adopt anearly style that utilized the gestural,figurative style of these artists.

Close was chosen to attend YaleSummer School and subsequentlythe Yale MFA program. Faculty inthese programs included BernardChaet, Philip Guston, Jack Tworkov,and Al Held. Their criticism andinstruction, (as well as exposure tothe work of fellow classmatesRichard Serra, Vija Celmins, BriceMarden, Nancy Graves and RobertMangold) would continue to have animpression on his output during thistime.

The two works shown herebookmark the period between whenClose was studying in Washingtonand New Haven. Close’s largecanvases of the early 1960’scombine Abstract Expressionist andBay Area styles in his use of figureswithin an abstract structure,utilization of bright colors andpainterly brushwork. Also notable isthe use of text, which would be aprominent and important element ayear later in his provocative 1961mixed media piece “Betsy RossRevisited.”

These works are from the collectionof Lee Dalton, a childhood friend ofthe artist.

Miguel Covarrubias (1904-1957),the 20th century caricaturist,illustrator, painter, writer,anthropologist and archeologist,was Mexico’s Renaissance man. Hisaccomplishments in these arts, aswell as his revelation throughimages and words, give us anunderstanding and appreciation forthe art and cultural life of Mexico.

One of the regions to attractCovarrubias’ attention was theIsthmus of Tehuantepec in Mexico.He spent several years visiting andstudying the diverse people of thearea and learned the Zapoteclanguage in order to bettercommunicate with his nativeinformants.

Nothing escaped Covarrubias’interest. He researched everythingfrom history, archeology, ethnologyand economics to folklore, literature,music, art, religion, sexual customsand family life. What’s more, heparticipated in the excavation ofancient cultural sites from Veracruzto Oaxaca.

Mexico South: The Isthmus ofTehuantepec, was published in 1946.It is a comprehensive portrayal ofhis native land southeast ofVeracruz and of the pre-Hispanicand contemporary inhabitants. Thebook is copiously illustrated withdrawings and gouaches byCovarrubias, as well as ninety-sixphotographs taken by his wife, Rosa.

Examining the paintings in MexicoSouth, one perceives the sensualaspects of Covarrubias’ art, whichwas always bright and livelybecause of his use of euphoriccolors and luminous greensreminiscent of tropical landscapes.

“Old Lady and Girl in EverydayDress” is similar to the gouachefound in Mexico South, which firstappeared in Vogue Magazine inJanuary 1942, in an article titled“Women of Fashion in Tehuantepec,Mexico.” In the foreground is anolder woman dressed conservativelyin a wrapped skirt and a blackshawl, who carries a lacquered bowlwith painted flowers on her head

that gives her a quiet dignity incontrast to the flair and statelinessof the younger girl. She is dressed ina ruffled full skirt in bright lemon-yellow cotton and a geometricchain-stitch embroidered huipil witha pink ribbon bow in her hair. In thebackground is the TehuantepecRiver with bathers and the Oaxacamountains beyond.

To view this painting and the otherpaintings from the book as solelydecorative works of art is to ignoretheir ideological and anthropologicalvalue and Covarrubias’ exceptionalgenius as a gifted documentaryartist.

In a New York Times review of thebook, Diego Rivera wrote:

“Mexico South’s author is anartist of great value so deeply inlove with the subjects which hesketches and paints, that, in orderto know them more and, thus topaint them better, he has enteredwith devotion and intelligenceand humor into everything

concerning the land which he haspainted, and which is a part of hisown country." [1]

All property offered and sold (“property”) through samuel t. freeman & co, (“freeman’s”) shall be offered and sold on theterms and conditions set forth below which constitutes the complete statement of the terms and conditions on which allproperty is offered for sale. by bidding at the auction, whether present in person or by agent, by written bid, telephone,internet or other means, the buyer agrees to be bound by these terms and conditions.

Packingand handling of purchased lots is atthe responsibility of the buyer and isat the entire risk of the buyer.

16In no event shall any liability ofFreeman’s to the buyer exceed thepurchase price actually paid.

17 No claimed modification oramendment of this Agreement onthe part of any party shall bedeemed extant, enforceable orprovable unless it is in writing thathas been signed by the parties tothis Agreement. No course ofdealing and no delay or omission onthe part of Freeman’s in exercisingany right under this Agreement shalloperate as a waiver of such right orany other right and waiver on anyone or more occasions shall not beconstrued as a bar to or waiver ofany right or remedy of Freeman’s onany future occasion.

18These Conditions of Sale and thebuyer’s, the Consignor’s andFreeman’s rights under theseConditions of Sale shall be governedby, construed and enforced inaccordance with the laws of theCommonwealth of Pennsylvania andConsignor and Buyer agree to theexclusive jurisdiction of thePhiladelphia, Pennsylvania Court ofCommon Pleas and the UnitedStates District Court for the EasternDistrict of Pennsylvania.

Inaddition, a defaulting buyer will bedeemed to have granted andassigned to Freeman’s, a continuingsecurity interest of first priority inany property or money of, or owingto such buyer in Freeman’spossession, and Freeman’s mayretain and apply such property ormoney as collateral security for theobligations due to due to Freeman’s.Freeman’s shall have all of the rightsaccorded a secured party under thePennsylvania Uniform CommercialCode.

10Unless the sale is advertised andannounced as “without reserve”,each lot is offered subject to areserve and Freeman’s mayimplement such reserves by biddingthrough its representatives on behalfof the Consignors. In certaininstances, the Consignor may payless than the standard commissionrate where Freeman’s or itsrepresentative is a successful bidderon behalf of the Consignor. Wherethe Consignor is indebted toFreeman’s, Freeman’s may have aninterest in the offered lots and theproceeds therefrom, other than thebroker’s Commissions, and all salesare subject to any such interest.

11No “buy” bids shall be accepted atany time for any purpose.

12Any pre-sale bids must be submittedin writing to Freeman’s prior tocommencement of the offer of thefirst lot of any sale. Freeman’s copyof any such bid shall conclusively bedeemed to be the sole evidence ofsame, and while Freeman’s acceptsthese bids for the convenience ofbidders not present at the auction,Freeman’s shall not be responsiblefor the failure to execute, or, toexecute properly, any pre-sale bid.

13A Buyer’s Premium will be added tothe successful bid price and ispayable by the buyer as part of the

Subject to theforegoing, all Property shall be paidfor and removed by the buyer athis/her expense within ten (10)days of sale and, if not so removed,may be sold by Freeman’s, or sentby Freeman’s to a public warehouse,at the sole risk and charge of thebuyer(s), and Freeman’s mayprohibit the buyer fromparticipating, directly or indirectly,as a bidder or buyer in any futuresale or sales. In addition to otherremedies available to Freeman’s bylaw, Freeman’s reserves the right toimpose a late charge of 1.5% permonth of the total purchase price onany balance remaining ten (10) daysafter the day of sale. If Property isnot removed by the buyer within ten(10) days, a handling charge of 1%of the total purchase price permonth from the tenth day after thesale until removal by the buyer shallbe payable to Freeman’s by thebuyer; Freeman’s shall charge 1.5%of the total purchase price permonth for any property not soremoved within 60 days after thesale. Freeman’s will not beresponsible for any loss, damage,theft, or otherwise responsible forany goods left in Freeman’spossession after ten (10) days. If theforegoing conditions or anyapplicable provisions of law are notcomplied with, in addition to otherremedies available to Freeman’s andthe Consignor (including withoutlimitation the right to hold thebuyer(s) liable for the bid price)Freeman’s, at its option, may eithercancel the sale, retaining asliquidated damages all paymentsmade by the buyer(s), or resell theproperty. In such event, the buyer(s)shall remain liable for any deficiencyin the original purchase price and

4Freeman’s in its sole and exclusivediscretion, reserves the right towithdraw any property, at any time,before the fall of the hammer.

5Unless otherwise announced by theauctioneer at the time of sale, allbids are per lot as numbered in theprinted catalogue. Freeman’sreserves the right to determine anyand all matters regarding the order,precedence or appropriate incrementof bids or the constitution of lots.

6The highest bidder acknowledged bythe auctioneer shall be the buyer.The auctioneer has the right to rejectany bid, to advance the bidding at hisabsolute discretion and in the eventof any dispute between bidders, theauctioneer shall have the sole andfinal discretion either to determinethe successful bidder or to re- offerand resell the article in dispute. If anydispute arises after sale, theFreeman’s sale record shall beconclusive in all respects.

7If the auctioneer determines that anyopening or later bid or any advancebid is not commensurate with thevalue of the Property offered, he mayreject the same and withdraw theProperty from sale.
