REPORT SUMMARYThe request is for a Conditional Use Permit (“CUP”) to allow a vehicle sales use and showroom(the proposed “Project”) at 121-1 25 South Robertson Boulevard (the “Project Site”). The O’GaraCoach Company (the “Applicant”) proposes to continue using the existing facility that waspreviously authorized for a vehicle sales use by Planning Commission Resolution Nos. 1485 and1538. The Project Site is located at the northeast corner on the intersection of Wilshire Boulevard andSouth Robertson Boulevard. The Project Site has a 100’ frontage along South RobertsonBoulevard. South Robertson Boulevard is a four-lane arterial street while Wilshire Boulevard is asix-lane collector street. The portion of South Robertson Boulevard on which the Project Sitefaces is comprised of commercial sites as well as an existing public school on the east side of thestreet (Horace Mann School). The portion of Wilshire Boulevard that is located in close proximityto the Project Site to the north is comprised of three- to four-story buildings, occupied by office(medical and general) and retail uses. Abutting the Project Site to the south are variouscommercial and office uses. Located to the west of the Project Site are single-family residentialproperties.

Project Site

The Project Site is 10,159 square feet in area. In 1925 a single-story commercial building withtwo tenant spaces was built with a total floor area of 4,443 square feet. Based on the BHMCdefinition of floor area, which measures floor area from the inside of exterior walls and exempts

rooms housing building operating equipment from floor area calculations, the building has a floorarea of 4,100 square feet. The Project Site has a total of 12 parking spaces located on the westand south portions of the lot. The individual tenant spaces originally identified as 121 SouthRobertson Boulevard and 125 South Robertson Boulevard were combined into one tenant spaceon January 13, 2009, which has operated as a single vehicle salesroom for the Lamborghini andAston Martin brands. Patrons of the business are able to access the associated parking area onthe south from the ingress driveway on South Robertson Boulevard and exit through the egressdriveway towards the alley located on the west of the Project Site.

PROJECT DESCRIPTION

CUP Entitlement History

On October 11, 2007, Planning Commission Resolution No. 1485 (Attachment D) was approvedto allow a vehicle sales use to occupy the tenant space located at 121 South Robertson Boulevardfor Lamborghini. The following year on December 8, 2008, Planning Commission Resolution No.1538 (Attachment E) was approved to expand the vehicle sales use to the adjacent tenant spaceat 125 South Robertson Boulevard for Aston Martin. The total floor area of the building wasoccupied by both dealerships, Aston Martin and Lamborghini, and was separated by a partitionwall. On January 13, 2009, the partition wall was removed and the spaces were combined tocreate one dealership for both Aston Martin and Lamborghini. Condition No. 10 of PlanningCommission Resolution No. 1538 allowed for the vehicle sales use to be valid for a period of tenyears from the date of the Planning Commission’s approval on December 11, 2008. Additionally,Condition No. 12 of Planning Commission Resolution No. 1538 states that the CUP is consideredexpired if there is an interruption of the vehicle sales use for a period greater than three months.The Applicant submitted a timely request to renew the CUP on August 29, 2018 and there havebeen no intervening uses at the Project Site.

Vehicle Sales Operation

The Applicant proposes to make no changes to the operations of the vehicle sales use, asconditioned in Resolution Nos. 1485 and 1538. However, the request to continue the vehicle salesuse will only serve the Aston Martin brand and no longer include Lam borghini. The Lamborghinidealership has been relocated to 8423 Wilshire Boulevard in Beverly Hills. The dealership’s hoursof operation are consistent with the existing CUP conditions of approval. Business operationsoccur Monday to Friday from 10:00 A.M. to 7:00 P.M., Saturday from 10:00 A.M. to 5:00 P.M.,and Sundays from 11:00 A.M. to 4:00 P.M. (Attachment H). The operation of the vehicle salesuse proposes to maintain a total of seven to eight staff members with a minimum of four staffmembers at the site at one time.

Proiect Site Revisions

The Applicant does not propose to make any cosmetic changes to the exterior of the building.Any proposed changes to the exterior of the building are subject to architectural review. Theinterior of the building is now open to allow for the vehicle sales use of one dealership, Aston

Martin. The existing Project Site has an existing disabled parking space located along the alley.However, an existing electric pole abutting the parking space allows for an inadequate path oftravel. Therefore in order to meet the Americans with Disabilities Act (ADA) requirements, theApplicant proposes to reconfigure the parking area of the Project Site to relocate one disabledparking space and associated pathway to the front entrance of the building as illustrated in Figure2. The Project Site will maintain a total of 12 parking spaces as originally approved in PlanningCommission Resolution No. 1538.

The Project Site has 12 existing parking spaces on site, five parking spaces on the west portionof the site and seven parking spaces on the south portion of the site which includes the relocateddisabled parking space. The on-site parking is made available to patrons of the business and thetest-drive vehicles. Under the City’s current parking calculations the Project Site requires 12parking spaces at one parking space per 350 square feet. The existing parking conditions areconsistent with current BHMC parking requirements for this retail use.

As approved, Planning Commission Resolution No. 1538 required that the use provide free off-site parking for all employees during all hours of operation. There are currently 24 off-site parkingspaces located at 9100 Wilshire Boulevard in Beverly Hills dedicated to employees working at theProject Site. However, starting March 1, 2019, the off-site parking will be relocated to 8750Wilshire Boulevard where there will be seven parking spaces available to employees working atthe Project Site. Staff review of City records indicates that there is excess parking supply availableat 8750 Wilshire Boulevard so that the seven parking spaces could be leased at this location foruse by O’Gara Coach Company employees. Figure 3 illustrates the locations of the off-siteparking areas and their relation to the Project Site. There will be fewer off-site parking spacesavailable to the employees at the new off-site parking location; however, the revised number ofemployee parking spaces provided appears to meet the parking demand for the number ofemployees expected to be working at the project site during typical operations.

Patrons of the business are able to test drive the vehicles while accompanied by a staff member.As illustrated in Figure 4, the test drive route will proceed by exiting the south parking lot area ofthe Project Site towards the alley to the west of the property. Upon entering the alley the driverwill make a right turn to go northbound up the alley, immediately followed by a left turn onto theeast/west segment of the alley to travel westbound. After traveling westbound the driver will makea right turn onto Clark Drive. Heading northbound on Clark Drive the driver will make a right turnonto Wilshire Boulevard. The driver will then make a right turn onto South Robertson Boulevardand travel towards Olympic Boulevard. Once the driver has reached the intersection they willmake a right turn on Olympic Boulevard and travel westbound towards Doheny Drive. The driverwill then travel northbound on Doheny Drive towards Wilshire Boulevard. Once the driver reachesWilshire Boulevard, the driver will then travel east back to South Robertson Boulevard to completethe loop and enter the ingress driveway of the Project Site back to the associated parking lot. Thetest drive route, as proposed by the Applicant, is in compliance with the City approved test drive

Vehicles will be delivered and serviced in the Service Center located at 2240 Colby Avenue inLos Angeles. Once a vehicle has been serviced, the vehicles will be driven by a member of staffto the Project Site. There will be no vehicles stored on the Site other than the showroom vehicles,test drive vehicles, and vehicles that have been purchased.

Project Site Compliance

The Applicant submitted an Attestation of Compliance (Attachment I) stating that the vehicle salesuse has been in compliance with Planning Commission Resolution Nos. 1485 and 1583.Additionally, staff requested the log of calls for service from the Beverly Hills Police Department(BHPD) from June 8, 2016 to June 8, 2018, which identified 18 calls for service. The calls varied,with eight of the calls being related to alarms, one for petty theft, one for grand theft, one for atraffic accident, and others such as suspicious vehicles (Attachment J). However, there are nocalls for service relating to any code violations of the vehicle sales use. Staff’s review of city codeenforcement records over the 10 years of the dealership’s operation identified two enforcementcases where letters were mailed to the property owner on November 27, 2017 (Attachment L)and November 30, 2011 (Attachment K). The letters informed the property owner that complaintshad been received stating that dealership employees had been conducting test drive routescontrary to the approved route in Planning Commission Resolution Nos. 1484 and 1538. The twocases have subsequently been closed with no further violations identified or complaints received.

REQUIRED ENTITLEMENTS.As proposed, the Project requires the following entitlement:

• Conditional Use PermitPursuant to BHMC §10-3-1613, a vehicle sales use and showroom at the Project Siterequires a CUP to operate in the (C-3) Commercial Zone.

GENERAL PLAN POLICIES2The General Plan includes numerous goals and polices intended to help guide developmentwithin the City. The following goals and policies appear to be most relevant to the PlanningCommission’s review of the Project, although others may also apply:

• Policy LU 2.1 City Places: Neighborhoods, Districts, and Corridors. Maintain andenhance the character, distribution, built form, scale, and aesthetic qualities of the City’sdistinctive residential neighborhoods, business districts, corridors, and open spaces.

• Policy LU 9.1 Diverse Districts and Corridors. Accommodate retail, office,entertainment, dining, hotel, and visitor serving uses that support the needs of localresidents, attract customers from the region, and provide a quality experience for nationaland international tourists.

• Policy LU 12.1 Functional and Operational Compatibility. Require that retail, office,entertainment, and other businesses abutting residential neighborhoods be managed toassure that businesses do not create an unreasonable and detrimental impact onneighborhoods with respect to safety, privacy, noise, and quality of life by regulating hours

of operation, truck deliveries, internal noise, staff parking and on-site loitering, trashstorage and pick-up and other similar business activities.

• Policy LU 15.1 Economic Vitality and Business Revenue. Sustain a vigorous economyby supporting businesses that contribute revenue, quality services and high-paying jobs.

ENVIRONMENTAL ASSESSMENTThis Project has been assessed in accordance with the authority and criteria contained in theCalifornia Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.),the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.),and the environmental regulations of the City. Upon review, the Project appears to qualify for aClass I Categorical Exemption (Existing Facilities) in accordance with the requirements of Section15301 of the state CEQA Guidelines. This exemption is applicable to the operation, repair,maintenance, permitting, leasing, licensing, or minor alteration of existing public or privatestructures, facilities, mechanical equipment, or topographical features, involving negligible or noexpansion of use.

Public CommentA resident located on the 200 block of South Hamel Drive called staff on February 25, 2019 andexpressed concerns for possible noise emitted by the vehicles being test driven. No othercomments or concerns have been received since the notification date.

ANALYSIS3Project approval, conditional approval, or denial is based upon specific findings for thediscretionary action requested by the Applicant. The specific findings that must be made in orderto approve the Project are provided as Attachment A to this report, and the draft resolution inAttachment B contains draft language for findings that may be used to guide the PlanningCommission’s deliberation on the proposed Project.

In reviewing the requested entitlement, the Commission may wish to consider the followinginformation as it relates to the Project and required findings.

Parking and Traffic

The Project Site has 12 parking spaces as provided in the west and south parking areas. Theon-site parking will only be for patrons of the vehicle sales use, test-drive vehicles, andvehicles that are prepared for pick-up by a purchaser. There will be no vehicles stored orserviced on-site. Pursuant to the City’s parking requirements, 12 parking spaces are requiredwith one parking space per 350 square feet. The existing parking conditions are consistentwith current code requirements for this retail use. The Applicant does not request to modifythe condition under Planning Commission Resolution No. 1538 that free off-site parking isprovided for all employees. The Applicant has included information regarding the existinglocation of employee off-site parking (9100 Wilshire Boulevard) and the proposed relocatedemployee off-site parking (8750 Wilshire Boulevard) location in their application.

The circulation of the Project Site will allow for dealership patrons to enter the Project Siteparking area from the ingress driveway on South Robertson Boulevard and exist via the alley,which is consistent with many commercial businesses in the City that are located adjacent toan alley. Additionally, the proposed test drive route plan (Attachment D) is consistent with theCity’s approved test drive routes pursuant to BHMC §4-4-701 (Attachment G).

The Project Site currently appears to be in compliance with the existing conditions of approvalcontained in Planning Commission Resolution No. 1538 regarding parking requirements,approved test drive route, and site circulation. The Applicant does not request to modify theexisting conditions of approval. As noted above, there have been no calls for service to BHPDregarding violations of the parking and traffic conditions as approved in Planning CommissionResolution No. 1538. Additionally, within the 10 years of operation only two code enforcementcases have been opened regarding deviating from the approved test drive route, with bothcases being subsequently closed. Recommended conditions are included in the attached draft

The analysis provided in this section is based on draft findings prepared by the report author prior to the public hearing. ThePlanning commission in its review of the administrative record and based on public testimony may reach a different conclusionfrom that presented in this report and may choose to modify the findings. A change to the findings may result in a final action thatis different from the staff recommended action in this report.

resolution that impose limitations on the dealership including: no on-site servicing of thevehicles, only light detailing and waterless washing of vehicles at the Project Site, continuedcompliance with the previously approved test drive route, and free off-site parking fordealership employees during all hours of operation.

Compatibility of Use and Operations

The Project Site is located in an area comprised of a variety of uses such as restaurants,printing shops, retail, and offices. The primary uses that will occur at the Project site are: ashowroom for the Aston Martin brand’s vehicles, administrative office use for the employees,and the transfer of vehicles to and from the site for test drive or purchase. The proposed retailsales use has similarities with other retail uses to the north and south on the South RobertsonBoulevard commercial corridor. There are residential properties located to the west of theProject Site and a public school located east of the Project Site. The Project Site is separatedfrom the neighboring residential properties to the west by an existing 15’ alley. As proposed,the vehicle sales use will not adversely impact neighboring residential properties. Thisestablished dealership use has operated at the Project Site for over 10 years with limitedpolice calls for service and City code enforcement action. The previously approved test driveroute seems appropriate as it utilizes primary arterial roadways and does not includeresidential streets or the roadway adjacent to the entrance to the nearby Horace Mann School,as indicated in Figure 2. Additionally, there will be no servicing or storage of the vehicles onthe Project Site. The vehicle sales use is conditioned to only provide light detailing of thevehicles at a location on the Project Site that is furthest away from the neighboring residenceslocated to the west of the Project Site. This type of vehicle preparation will not generateexcessive noise, unpleasant odors, or noxious fumes.

The Project Site has been operating as a vehicle sales use for Aston Martin and Lamborghinisince 2008. The Applicant’s renewal application indicates that the site will now only be usedfor the sale of Aston Martin vehicles. The Applicant has provided an Attestation of Compliance(Attachment I) stating that the operation of the vehicle sales use has been in full compliancewith the conditions of Planning Commission Resolution Nos. 1485 and 1538. Given the limitedcompliance issues and nature of current operations, continued operation of the vehicle salesuse appears to be compatible with the surrounding neighborhood.

Staff Recommendation

Staff is recommending modification to the Project’s conditions of approval so that there be nocondition limiting the term of the CUP for the vehicle sales use. The rationale for thismodification is that this vehicle sales use has been conducted in a code compliant manner,with very limited code enforcement action occurring during the past ten years of operation

The Planning Commission of the City of Beverly Hills hereby finds, resolves, and

determines as follows:

Section 1. Murray Fischer, representative on behalf of O’Gara Coach

Company, Inc. (collectively the “Applicant”), has submitted an application for renewal of a

Conditional Use Permit (CUP) to allow a vehicle sales use in an existing commercial building

located at 121-125 South Robertson Boulevard (the “Project”). A vehicle sales use is identified

as a conditionally permitted use in the C-3 Zone pursuant to Beverly Hills Municipal Code §10-3-

1604, and therefore requires an entitlement that can be granted by the Planning Commission

pursuant to a CUP.

Section 2. The Planning Commission has previously twice granted CUP

approval to the existing vehicle sales use located at the Project Site. The first approval was granted

on October 11, 2007 and the second approval was granted on December $, 2008. The existing CUP

authorizing the vehicle sales use at the site was conditioned to expire ten (10) years after the

December 8, 200$ date of approval. However, the Planning Commission may extend the CUP if

the Commission finds that the use is operating in a manner approved by the Planning Commission;

is abiding by the conditions imposed by the Planning Commission; and is not creating significant

adverse impacts on the surrounding neighborhood. The Applicant filed a timely request to renew

the CUP on August 29, 2018. The Applicant is proposing no modifications to the existing

conditions of approval and generally appears to have been operating in a code-compliant manner.

Additionally, staff is recommending modification to the Project’s conditions of approval so that

there be no condition limiting the term of the CUP for the vehicle sales use. The rationale for this

modification is that this vehicle sales use has been conducted in a code compliant manner, with

very limited code enforcement action occurring during the past ten years of operation.

Section 3. The Project has been environmentally reviewed pursuant to the

provisions of the California Environmental Quality Act (Public Resources Code Sections 21000,

et seq.(”CEQA”), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections

15000, et seq.), and the environmental regulations of the City. The Project qualifies for a

categorical exemption pursuant to Section 15301 (Class 1 — Existing facilities) of the Guidelines.

Specifically, the Project involves the continued operation of a vehicle sales use within an existing

one-story commercial building and existing parking facility and the Planning Commission

therefore finds the Project exempt from further review under the provisions of CEQA.

Section 4. Notice of the Project and public hearing was mailed on February 22,

2019 to all property owners and residential occupants within a 1,000-foot radius (plus block-face)

of the property; an on-site notice was posted on the subject property on february 22, 2019; and a

notice was published in two newspapers of local circulation, the Beverly Hills Courier and the

Beverly Hills Weekly. On March 14, 2019, the Planning Commission considered the application

at a duly noticed public hearing. Evidence, both written and oral, was presented at the meeting.

Section 5. In reviewing the request for a CUP for a vehicle sales, the Planning

Commission considered whether it could make the following findings, pursuant to BHMC §10-3-

1613 and §10-3-3 800, in support of the Project:

1. Whether the proposed use is compatible with the area and surrounding uses;

2. Whether the proposed use will have adequate buffering between the use and

residential areas;

3. Whether the proposed use will create an adverse traffic impact or a traffic

safety hazard to pedestrians or to vehicles, including, but not limited to, an

adverse impact on traffic circulation or parking;

4. Whether the proposed use will create excessive noise, unpleasant odors,

noxious fumes, excessive lighting, or substantial interference with

neighboring properties or uses due to the activities associated with the

proposed use or its hours of operation; and

5. Whether the location of the proposed use will be detrimental to adjacent

property or to the public welfare.

Section 6. Based on the foregoing, the Planning Commission hereby finds and

determines as follows with respect to the CUP:

1. The Project Site maintains a single-story commercial building built in 1925.

The surrounding uses of the Project Site consist of commercial and office

uses on Wilshire Boulevard and South Robertson Boulevard, including

retail uses that are compatible in nature to the vehicle sales use occurring at

the Project Site. East of the Project Site is the Horace Mann School and

single family residential properties are located to the west. The tenant space

at the Project Site addressed 121 South Robertson Boulevard has operated

as a vehicle sales use for Lamborghini since 2007, as approved by the

Commission on October 11, 2017. On December 8, 2008, the Applicant

received approval to expand the use to the adjacent tenant space (125 South

Robertson Boulevard) to accommodate additional showroom space for

Aston Martin vehicles. Since the vehicle sales use commenced operation at

the site, there have been a limited number of code enforcement cases (one

case in 2011 and a second in 2017) and calls for service to the Beverly Hills

Police Department regarding the operation of the dealership. Based on the

small scale and limited volume of the dealership facility, which is located

in an existing single-story commercial building, as well as its location on a

long-established commercial corridor in the City, the proposed vehicle sales

and showroom use is compatible with the area and the surrounding uses.

2. An alley located west of the Project Site serves as a buffer from the nearest

residential property. The alley is a minimum of 15 feet in width. The

proposed vehicle sales use will not include any vehicle servicing on the

Project Site. On-site work on vehicles is limited to light detailing at a

Project Site location that is furthest away from the neighboring residential

properties located to the west of the Project Site. This limited vehicle

preparation work will not generate excessive noise, unpleasant odors, or

noxious fumes. The proposed test drive route does not utilize any residential

streets and is in compliance with the City’s approved test drive routes

pursuant to BHMC §4-4-701. Additionally, Condition No. 9 of this

resolution states that the City reserves jurisdiction over the Project relative

to any adverse impacts to the neighborhood, including, without limitation,

traffic, parking, noise, lighting, loading, or any combination thereof. If the

Director of Community Development determines that unanticipated

impacts are occurring as a result of the Project, a hearing before the

Planning Commission may be scheduled and additional conditions of

approval may be required to mitigate any impacts to the adjacent residential

uses. Based on the location of the Project’s outdoor business activity and

the Project condition that reserves the right for the City to add additional

limitations on the Project to mitigate any unanticipated impacts, the

Planning Commission finds that there is adequate buffering between the

subject use and residential uses.

3. There is no evidence of an adverse traffic impact, a traffic safety hazard to

pedestrians or vehicles, or an adverse impact to traffic circulation or parking

that have occurred as a result of the vehicle sales use in the 10-year timespan

that the use has been in operation. Vehicles will be serviced and stored at

an off-site location, and will be driven to the Project Site. Additionally, the

Project is subject to a condition that requires the provision of free off-site

parking for employees. Therefore, the 12 on-site parking spaces are

exclusive to patrons of the use, test drive vehicles, and purchased vehicles

awaiting pick-up by customers. Patrons of the Project Site enter the parking

area from the ingress driveway on South Robertson Boulevard. Vehicles

exit the Project Site by making a right turn onto an alley located to the west

of the property. Upon entering the alley vehicles head north and make a left

turn onto another alley that exits on Clark Drive. The proposed test drive

route plan (Exhibit A) for this Project is consistent with the City’s map of

approved test drive routes, authorized pursuant to BHMC §4-4-701. A

review of calls for service associated with the Project Site that were made

to the Beverly Hills Police Department from June 8, 2016 and June 8, 2018

showed no evidence of an adverse impact due to traffic created by the

vehicle sales use. Additionally, there have only been two code enforcement

cases related to the operation of the vehicle sales use over the facility’s 10

years of operation. Therefore, the Planning Commission finds that

continued operation of the subject business will not create an adverse traffic

impact or a traffic safety hazard to pedestrians or to vehicles, including, but

not limited to, an adverse impact on traffic circulation or parking.

4. The proposed vehicle sales use proposes to continue its operations in the

same manner as approved on December 8, 2008. As conditioned, no

servicing or delivery of vehicles is allowed on-site. Additionally, vehicle

cleaning is limited to light detailing (cleaning, vacuuming). Further, the

proposed business hours (10:00 AM to 5:00 PM on weekdays, 10:00 AM to

5:00 PM on Saturdays, and 11:00 AM to 4:00 PM on Sundays) limit the

potential for nighttime or early morning impacts from its operations. The

project will not create excessive noise, unpleasant odors, noxious fumes,

excessive lighting, or substantial interference with neighboring properties

or uses due to the activities associated with the Project or its hours of

operation.

5. The vehicle sales use is located on a commercial property in an existing

one-story building. There are residential properties adjacent to the subject

property to the west, separated by an alley with a minimum width of 15 feet.

As conditioned, the outdoor vehicle maintenance activity allowed on the

property is limited to light detailing. Allowed on-site vehicle maintenance

activity does not include power washing, vehicle body, mechanical, or

engine servicing that would utilize heavy equipment such as mechanical

lifts, compressors, or painting equipment, which significantly reduces the

potential for noise or odor impacts on adjacent properties. The conditions

of approval include limitations on various operational aspects of the Project,

such as hours of operation, vehicle preparation activities allowed in the

outdoor area adjacent to the building, and provision of free parking for

employees at an off-site location, which will further reduce any potential

impacts of the proposed use on adjacent properties. Based on the

operational characteristics of the business, the limited number of police and

code enforcement incidents related to the operation of the business and the

conditions included in this resolution, the Project will not be detrimental to

adjacent property or to the public welfare.

Section 7. Based on the foregoing, the Planning Commission hereby grants the

requested Conditional Use Permit renewal. The following conditions encompass all relevant

conditions of approval previously imposed on the subject site in Planning Commission Resolution

No. 1583. Therefore, the previously approved Resolution shall be superseded by this Resolution.

The Project is subject to the following conditions:

1. The conditions set forth in this resolution address the

operations of the vehicle sales and showroom use as presented to and

approved by the Planning Commission. To ensure that any subsequent

vehicle sales and showroom use operated at the subject site does not cause

adverse impacts to the surrounding neighborhood, any transfer of

ownership, management, or control of the vehicle sales and showroom use

shall be reviewed by the Director of Community Development to determine

whether the proposed change substantially conforms to the Project as

approved by the Planning Commission. If the Director determines that the

proposed change does not substantially conform to the approved Project,

the Director shall schedule a hearing before the Planning Commission in

accordance with provisions of Beverly Hills Municipal Code (BHMC) § 10-

3-3800. The Planning Commission expressly reserves jurisdiction at said

hearing to revoke the CUP or to impose additional conditions as necessary

to ensure that the operation of the subsequent vehicle rental business at the

subject site is compatible with adjacent land uses. The full cost of any such

review hearing and implementation of any additional conditions or

mitigation measures shall be paid for by the Applicant.

2. Hours of operation for the vehicle sales use, including any

cleaning or vehicle preparation activities, shall be limited to 10 :00 AM —

7:00 PM Monday through friday, 10:00 AM — 5:00 PM Saturday, and

11:00 AM — 4:00 PM on Sunday.

3. The Applicant shall ensure that the handicap-accessible

(ADA) parking space located adjacent to the subject building is clear and

available for use by patrons at all times. Staff shall not be stationed within

the required ADA parking space.

4. The test-drive route shall comply with the City’s approved

Test Driving Routes pursuant BHMC §4-4-701. Dealership staff shall

accompany customers when test driving any vehicle and comply with the

route as prescribed in Exhibit A of this resolution.

5. Cleaning and maintenance ofvehicles on site shall be limited

to the south parking area of the Project Site, at a location furthest from the

rear property line that is not located within the required ADA parking space.

Cleaning and maintenance activities shall be limited to light detailing,

including vacuuming and waterless cleaning. All other maintenance

activities shall occur off-site.

6. Any signage or renovation to the façade of the building shall

be subject to architectural review.

7. All employees, including contractors or other agents, of the

subject business shall be provided with free parking located at an off-site

location subject to review and approval by the Director of Community

Development or his/her designee.

8. The Project shall comply with all operational restrictions set

forth in BHMC §10-3-1956, or its successor ordinance, for businesses

located in a commercial-residential transition zone.

9. The City expressly reserves jurisdiction over this Project

relative to any adverse impacts to the neighborhood, including, without

limitation, traffic, parking, noise, lighting, loading, or any combination

thereof. In the event that the Director of Community Development

determines that operation of the use at this site is causing unanticipated

adverse impacts, the Director of Community Development shall require the

Applicant to pay for appropriate studies. After reviewing the study, if, in

the opinion of the Director of Community Development, any of the issues

merit review by the Planning Commission, the Director of Community

Development shall schedule a hearing before the Planning Commission in

accordance with the provisions of Title 10 of the Beverly Hills Municipal

Code. The Planning Commission shall conduct a noticed public hearing

regarding the issues and may impose additional conditions as necessary to

mitigate any unanticipated impacts caused by the proposed Project, and the

Applicant shall forthwith comply with any additional conditions at its sole

expense.

10. APPEAL. Decisions of the Planning Commission may be

appealed to the City Council within fourteen (14) days of the Planning

Commission action by filing a written appeal with the City Clerk. Appeal

forms are available in the City Clerk’s office. An appeal fee is required.

11. RECORDATION. This Resolution shall not become

effective until the owner of the Project site records a covenant, satisfactory

in form and content to the City Attorney, accepting the conditions of

approval set forth in this resolution. The covenant shall include a copy of

the resolution as an exhibit. The Applicant shall deliver the executed

covenant to the Department of Community Development within 60 days of

the Planning Commission decision. At the time that the Applicant delivers

the covenant to the City, the Applicant shall also provide the City with all

fees necessary to record the document with the County Recorder. If the

Applicant fails to deliver the executed covenant within the required 60 days,

this resolution approving the Project shall be null and void and of no

further effect. Notwithstanding the foregoing, the Director of Community

Development may, upon a written request by the Applicant, grant a written

waiver from the 60 day time limit if, at the time of the request, the Director

determines that there have been no substantial changes to any federal, state

or local law that would affect the Project.

12. VIOLATION Of CONDITIONS: A violation of any of

these conditions of approval may result in termination of the entitlements

granted herein.

13. This approval is for those plans approved by the Planning

Commission on March 14, 2019, a copy of which is maintained in the files

of the City Planning Division. Project development shall be consistent with

such plans, except as otherwise specified in these conditions of approval.

14. Project Plans are subject to compliance with all applicable

zoning regulations, except as may be expressly modified herein. Project

plans shall be subject to a complete Code Compliance review when building

plans are submitted for plan check. Compliance with all applicable

Municipal Code and General Plan Policies is required prior to the issuance

of a building permit.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OFBEVERLY HILLS CONDITIONALLY APPROVING A REQUESTFOR A CONDITIONAL USE PERMIT FOR A LAMBORGHINIAUTOMOBILE SHOWROOM AT 121 SOUTH ROBERTSONBOULEVARD (O’GARA COACH CO.)

Section 1. Bruce Frederick, on behalf of O’Gara Coach Company, (tenant at 125

South Robertson Blvd) and the Marion N. Levenson family Trust, (property owner at 121 South

Robertson Blvd) (collectively, the “applicant”) has submitted an application for a Conditional

Use Permit (“C.U.P.”) to use the existing 2250 square foot tenant space, addressed as 125 South

Robertson Boulevard as a showroom and sales office for Lamborghini automobiles. The project

does not propose the operation of either vehicle services or a fuel station at the project. Six

parking spaces will continue to be provided for the tenant space addressed 125 South Robertson

Boulevard. Twelve parking spaces will be provided for the overall building.

The project is located in the C-3 Zone which allows vehicle sales and service uses

if authorized by a C.U.P.

Section 2. On October 11, 2007, the Planning Commission held a duly noticed

public hearing to consider the application. Evidence, both written and oral, was presented at said

hearing.

Section 3. The applicant is proposing to locate the automobile showroom in

one of the two tenant spaces located in the existing building at 121 South Robertson Boulevard.

The building was originally constructed in 1925. No expansion of floor-space, change to

structure height or increase in building size is proposed. There will be no servicing of vehicles at

this location. O’Gara Coach Co. has existing service facilities located in West Los Angeles. No

truck drop-off or pick-up of vehicles is proposed for the project site or on South Robertson

Boulevard. It is proposed that truck drop-offs and pick-ups for Lamborghini inventory occur on

Olympic Boulevard in the designated truck drop-off areas for the existing O’Gara Coach

dealership located at 2833 Olympic Boulevard.

The project involves the renovation of the interior of the tenant space to display four vehicles.

Also proposed for the interior space is a lounge seating area, an accessories display, a coffee bar,

a desk and a restroom. A façade remodel is proposed for the exterior of the structure. The

applicant has proposed to update the exterior with new white and grey paint with a black

roofline. “Lamborghini Beverly Hills” signage is proposed.

It is proposed to reconfigure six existing parking spaces on the southern portion of the site from

diagonal parking oriented for entry from the alley, to angled parking spaces oriented for entry

from a new access off of Robertson Boulevard. The building will continue to have a total of 12

parking spaces. A small outdoor vehicle display area is proposed to be located along the fence

fronting the lot. All vehicles are proposed to leave the site through the alley behind the

dealership. Vehicles leaving the site would turn north onto the alley and then west along another

alley and outlet onto Clark Drive.

Section 4. The Project has been environmentally reviewed pursuant to the

provisions of the California Environmental Quality Act (Public Resources Code Sections 21000,

et seq. (“CEQA”), the State CEQA Guidelines (California Code of Regulations, Title 14,

Sections 15000, et seq.), and the City’s Local CEQA Guidelines. The City prepared an initial

study and, based on the information contained in the initial study, determined that there was no

substantial evidence that approval of the Project may have significant environmental impact.

Accordingly, the City prepared a negative declaration in accordance with Section 15070 of the

State CEQA Guidelines. Pursuant to Section 15074(b) of said Guidelines, the Planning

Commission independently reviewed and considered the contents of the initial study and the

negative declaration prior to deciding whether to approve the Project. Based on the initial study,

the negative declaration, the comments received thereon, and the record before the Planning

Commission, the Planning Commission hereby finds that the negative declaration prepared for

the Project represents the independent judgment of the City and that there is no substantial

evidence that the approval of the Project may have any significant environmental impact. The

documents and other material which constitute the record on which this decision is based are

located in the Department of Planning and Community Development at 455 North Rexford Drive

in Beverly Hills, California and are in the custody of the Director of Planning and Community

Development.

Section 5. In reviewing the request for a C.U.P., the Planning Commission

evaluated whether the proposed location of the use will be detrimental to adjacent property or the

public welfare. The Planning Commission also considered:

(1) Whether the proposed use is compatible with the area and surrounding uses;

(2) Whether the proposed use will have adequate buffering between the use and

residential areas;

(3) Whether the proposed use will create an adverse traffic impact or a traffic safety

hazard to pedestrians or to vehicles, including but not limited to, any adverse impact on traffic

circulation or parking; and

(4) ‘Whether the proposed use will create excessive noise, unpleasant odors, noxious

fumes, excessive lighting, or substantial interference with neighboring properties or uses due to

activities associated with the proposed use or its hours of operation.

Section 6. Based upon the evidence presented, the Planning Commission hereby

finds as follows with respect to the application for a C.U.P.:

6.1 As conditioned, the proposed showroom expansion is compatible with the

area and surrounding uses. The proposed use is currently allowed by the Zoning Code and is in

conformance with the General Plan. It is the replacement of a commercial personal service use

with a luxury automotive retail use. The hours of operation for the facility are no more intense

than the existing retail uses along this portion of South Robertson Boulevard. O’Gara Coach

company sold 70 Lamborghini vehicles in 2006 and does not anticipate a substantial increase in

vehicles sales by moving to this location. Given the very low volume of sales it is not

anticipated that the use will generate substantial additional traffic to and from the site.

6.2 As conditioned, the proposed showroom expansion will not result in any

additional need for buffering between the Dealership and the neighboring residential area. There

is an alley separating the location of this existing commercial structure from the single family

residential lots located on Clark Drive. The project is required to comply with the City’s

Commercial-Residential Transition Ordinance because of the site’s proximity to residential

properties. Specifically, section 10-3-1955 requires that the placement of mechanical equipment

and reflective material not impact residential neighbors.

6.3 As conditioned, the proposed showroom expansion will not change how the

existing Dealership operates and it will not create an adverse traffic impact or a traffic safety

hazard to pedestrians or to vehicles, including but not limited to, any adverse impact on traffic

circulation or parking. The submitted traffic analysis concludes that there will be negligible

impacts during AM peak period traffic and very small increases to overall trips in the PM peak

period as a result of this project. The project will not result in any change in level of service at

the critical intersection of Wilshire Boulevard and Robertson Boulevard. Therefore no adverse

traffic impacts are foreseen to be generated by this project. The low speed movement of vehicles

in the alley on their way to exit onto Clark Drive and eventually Wilshire Boulevard should not

create additional traffic safety hazards to pedestrians or to vehicles.

6.4 As conditioned, the proposed showroom expansion will not create excessive

noise, unpleasant odors, noxious fumes, excessive lighting, or substantial interference with

neighboring properties or uses due to activities associated with the proposed use or its hours of

operation. No vehicle servicing is proposed for the site. Some short term noise impacts are

possible during the indoor tenant improvement and outdoor façade remodel and parking lot

changes but these will be short-term in nature and after completion should improve the

appearance of the existing commercial structure. The structure could use some exterior

refreshing as the site has been the subject of graffiti enforcement actions by City Code

Enforcement in the past.

For the reasons stated in the above paragraph and those stated in paragraphs 6.1

through 6.3, the Project will not create excessive noise, unpleasant odors, noxious fumes,

excessive lighting, or substantial interference with neighboring properties or uses due to

activities associated with the proposed use or its hours of operation.

Section 7. Based upon the foregoing, the Planning Commission hereby approves

the C.U.P. for the Project, subject to the following conditions:

1. The project shall be improved and maintained in substantial conformance to the plans

submitted to the Planning Commission for its meeting of October 11,2007.

2. The project shall be subject to architectural review and approval by the City’s

Architectural Commission.

3. All test driving of vehicles are required to follow to route prescribed in the submitted test

drive route on file with the Planning Division. The Planning Commission expressly

reserves the jurisdiction relative to impacts associated with the test drive route and the

right to impose additional conditions as necessary to mitigate any unanticipated impacts

caused by the proposed Project as they arise.

4. The applicant shall provide free off-street parking for all dealership employees during all

hours of operation.

5. Truck delivery, service and maintenance of vehicles must occur off-site at the O’Gara

Coach Company service facility, currently located in West Los Angeles. Additionally,

limited truck deliveries may occur at the designated vehicle delivery locations authorized

in Planning Commission Resolution No. 1466 for O’Gara Coach Company’s Olympic

Boulevard showroom.

6. Hours of operation are restricted to the following:

Monday to Friday, 10 AM to 7 PM

Saturday, 10 AM to 5 PM

Sunday, 11 AM to 4 PM

7. The applicant shall adequately protect the existing mature tree located on Robertson

Boulevard near the vehicle access to the project site. The location of1he curb-cut and

access to the site is subject to approval by the City’s Urban Forester. The Urban Forester

will require the applicant to provide an arborist’s report that identifies any long term

effects on the stability of the tree in relation to the proposed curb-cut.

8. The applicant is responsible to pay the City’s costs for the installation of one way

directional signs and the painting of speed and directional arrows in the alley adjacent to

the project site. The location of signs and painting is subject to approval by the City’s

Engineering Division.

9. The applicant shall pay the costs of removal and revenue loss of metered parking spaces

that are adjacent to the site during the construction phase. This fee will be collected at

the time that the applicant applies for issuance of the street use permit. Please contact

10. The validity of this Conditional Use Permit is Limited to automobile dealerships with

another facility in the City of Beverly Hills. This permit authorizes a vehicle showroom

that is an ancillary location to a larger dealership facility within the City.

11. This Conditional Use Permit is valid for a period of ten (10) years from the date of the

Planning Commission’s adoption of this Resolution.

12. This Conditional Use Permit shall expire if there is an interruption of the automobile

sales use for a period greater than three (3) months.

13. These conditions of approval shall run with the land and shall remain in flu force and

effect for the duration of the life of this project.

STANDARD CONDITIONS

14. The City reserves the right to make modifications and/or impose additional conditions

which may become necessary to enable implementation of the specific conditions set

forth in this resolution and the Applicant, the owner and their heirs, representatives,

successors and assigns shall comply with all such modified or additional conditions.

15. This Resolution approving a C.U.P. shall not become effective until the Applicant signs a

statement, satisfactory in form and content to the City Attorney, accepting the conditions

of approval set forth in this resolution. The statement shall include a copy of this

resolution as an exhibit.

The Applicant shall deliver the executed statement to the Department of Community

Development within 60 days of the Planning Commission’s adoption of this resolution. If

the Applicant fails to deliver the executed statement within the required 60 days, this

resolution approving a C.U.P. shall be null and void and of no further effect.

Notwithstanding the foregoing, the Director of Planning and Community Development

may, upon a request by the Applicant, grant a waiver from the 60-day time limit if, at the

time of the request, the Director determines that there have been no substantial changes to

any federal, state or local law that would affect the C.U.P.

16. Within three working days after approval of this Resolution, the Applicant shall remit to

the City a cashier’s check, payable to the County Clerk, in the amount of $50.00 for a

documentary handling fee in connection with the filing of the Notice of Determination,

along with the appropriate Department of Fish and Game filing fee.

Section 8. The Secretary of the Planning Commission shall certify to the passage,

RESOLUTION Of THE PLANMNG COMMISSION OF THE CITY OFBEVERLY HILLS CONDITIONALLY APPROViNG A REQUESTFOR A CONDITIONAL USE PERMIT FOR A 2,139 SQUARE FOOTAUTOMOBILE SHOWROOM AT 121 SOUTH ROBERTSONBOULEVARD (O’GARA COACH CO.)

Section 1. Laurence Allen, on behalf of O’Gara Coach Company, (tenant at 125

South Robertson Blvd) and the Marion N. Levenson Family Trust, (property owner at 121 South

Robertson Blvd) (collectively, the “applicant”) has submitted an application for a Conditional

Use Permit (“C.U.P.”) to use the existing 2,139 square foot tenant space, addressed as 121 South

Robertson Boulevard as an automobile showroom and sales office. The project does not involve

the operation of either vehicle services or a fuel station at the project. Six parking spaces will be

provided for the tenant space addressed 121 South Robertson Boulevard. Twelve parking spaces

will be provided for the overall building.

The project is located in the C-3 Zone which allows vehicle sales if authorized by

aC.U.P.

Section 2. On December 11, 2008, the Planning Commission held a duly noticed

public hearing to consider the application. Evidence, both written and oral, was presented at said

hearing.

Section 3. The applicant is proposing to locate a 2,139 square foot automobile

showroom in one of the two tenant spaces located in the existing building at 121 South

Robertson Boulevard. The building was originally constructed in 1925. No expansion of floor-

( are, change to structure height or increase in building size is contemplated by the project. There

will be no servicing of vehicles at this location. O’Gara Coach Co. has existing service facilities

located in West Los Angeles. No truck drop-off or pick-up of vehicles is permitted for the

project site or on South Robertson Boulevard. Truck drop-offs and pick-ups occur on Olympic

Boulevard in the designated truck drop-off areas for the existing O’Gara Coach dealership

located at 8833 Olympic Boulevard.

The project involves the renovation of the interior of the tenant space to vehicles. Also

proposed for the interior space is a customer lounge/seating area, a desk, an office/work room

and a restroom.

The parking spaces will be accessible via the drive/parking area along the south side of

the building accessed offofRobertson Boulevard and also via the alley along the west side ofthe

(. building. The building is non-conforming with respect to current parking requirements, but will

continue to provide a total of 12 parking spaces. All vehicles are proposed to leave the site

through the alley behind the dealership. Vehicles leaving the site would turn north onto the alley

and then west along another alley and outlet onto Clark Drive.

Section 4. The Project has been environmentally reviewed pursuant to the

provisions of the California Environmental Quality Act (Public Resources Code Sections 21000,

et seq. (“CEQA”), the State CEQA Guidelines (California Code of Regulations, Title 14,

Sections 15000, et seq.), and the City’s Local CEQA Guidelines and a Class 1(e) (15301)

Categorical Exemption (Existing facilities) has been issued.

Section 6. Based upon the evidence presented, the Planning Commission hereby finds as

follows with respect to the application for a C.U.P.:

6.1 As proposed and conditioned, the automobile showroom is compatible with the area

and surrounding uses. The use is currently conditionally permitted by the Zoning Code within the C-3

zoning district and is in conformance with the City’s adopted General Plan. The project will be

compatible with the area and surrounding uses as it represents a modest sales display area for vehicles in

conjunction with an existing and long-established car dealership. The replacement of a commercial

service use with a luxury automotive retail use would augment the existing vehicle sales showroom in

the adjacent tenant space. The hours of operation for the facility are no more intense than the existing

retail uses along this portion of South Robertson Boulevard and consistent with the hours of operation

for the existing car dealership. Given the low volume of sales, the use will not generate substantial

additional traffic to and from the site. Further, several conditions of approval have been added to the

project to ensure its compatibility with the area and surrounding uses. As conditioned, all test-driving of

vehicles are directed away from residential streets and on to a previously approved test drive route. In

addition, although no additional employees are proposed in conjunction with this request, approval of

the project is conditioned to require off-street employee parking. Finally no vehicle servicing is

permitted on site and no washing of vehicles within the surface parking lot abutting the single-family

residences to the west of the project site. Therefore, as proposed and conditioned, the project is

compatible with the area and surrounding uses

6.2 As proposed and conditioned, the showroom expansion will not result in the

need for additional buffering between the Dealership and the neighboring residential area. There

is an alley separating the location of the existing commercial structure from the single family

C residential lots located on Clark Drive. The project is required to comply with the all aspects of

the City’s Commercial-Residential Transition Ordinance because of the site’s proximity to

residential properties, including ensuring that the placement of mechanical equipment and

reflective material not impact residential neighbors. The change of use at the site from personal

service to luxury automobile retail will not affect the existing adequacy of the buffering of this

site from the nearby residential areas. To ensure the same level of adequacy, approval of the

project is conditioned to prohibit the washing of vehicles in the surface parking lot abutting the

alley and single-family residences to the west.

6.3 As proposed and conditioned, the sales showroom will not create an adverse

traffic impact or a traffic safety hazard to pedestrians or to vehicles, including but not limited to,

any adverse impact on traffic circulation or parking. A traffic analysis has been prepared for the

project and reviewed and approved by the City and concludes that there will be negligible

impacts during AM peak period traffic and very small increases to overall trips in the PM peak

period as a result of this project. The project will not result in any change in level of service at

Thecomplaints are specific to the test driving of vehicles from to and from your location. YourConditional Use Permits (section #7, condition #3) restrict the test driving of vehicles to aspecific City approved drive route (copy enclosed). Deviations from this approved routeconstitute a violation of your agreement.
