The rates for item marked as * for high rates are not to be taken for reference in futuretender in isolation.

2. Based on the accepted rates, the total value of contract works out to 22, 17,752/-( Rupees twenty two lakh, seventeen thousand, seven hundred and fifty two only). Yourattention in this connection is invited to the various conditions stipulated by the Railway in thetender and signed by you.

3. The security deposit to be remitted by you is 1, 10,888/- (Five percent of the contract value).The sum of 33,000/- remitted through FDR No. MMDC.No 964517 dated 21.11.2012 issued byCentral Bank of India, Ariyalur Branch 621704 towards earnest money deposit will be provisionally accepted as security deposit till the equivalent amount is recovered in cash 10% ofrunning bills and FDR will be returned.

4. The balance security deposit amount of 77,888/- will be recovered at the rate of 10% of therunning bills only. No other mode of payment shall be accepted. No interests will accrue on theSecurity Deposit Amount.

5. In addition to that, you have to submit irrevocable Bank guarantee for 5% of the contract valuei.e. 1, 10,888/- from the Nationalized/Scheduled Banks/ only towards performance guaranteebefore signing of agreement  or in cash to be remitted through Sr.Divisionalcashier/S.Rly/Tiruchchirappalli. FDR towards performance guarantee may be drawn in favour ofSr.Divisional finance manager, Southern Railway, Tiruchchirappalli. The performanceguarantee bond should be valid up to stipulated date of completionplus 60 days beyond that.

6. The successful bidder shall have to submit a Performance Guarantee (PG) within 30 (thirty)days from the date of issue of Letter Of Acceptance (LOA). Extension of time for. submission ofPG beyond 30 (thirty) days and upto 60 days from the date of issue of LOA may be given by theAuthority who is competent to sign the contract agreement. However, a penal interest of 15% perannum shall be charged for the delay beyond 30 (thirty) days, i.e. from 31st day after the date ofissue of LOA. In case the contractor fails to submit the requisite PG even after 60 days from the

date of issue of LOA, the contract shall be terminated duly forfeiting EMD and other dues, if any payable against that contract. The failed contractor shall be debarred from participating in re-tender for that work.

6(i) This LOA is the due notice for submission of PG and no further communication will be sentto you reminding for submission of PG. In case of failure to submit PG with in the stipulated dateaction will be taken under clause 16(4) of GCC is final and binding.

7. In regard to variation in contract quantities as per new clause 42(4) to Indian Railway GeneralConditions of contract, the procedure detailed below shall be adopted for dealing with variationsin quantities during execution of works contracts.

7.1 Individual NS items in contracts shall be operated with variation of plus or minus 25% and

 payment would be made as per the agreement rate. For this no finance concurrence would berequired.

7.2 In case an increase in quantity of an individual item by more than 25% of the agreementquantity is considered unavoidable, the same shall be got executed by floating a fresh tender. Iffloating a fresh tender for operating that item is considered not practicable, quantity of that itemmay be operated in excess of 125% of the agreement quantity subject to the following conditions.

(a) Operation of an item by more than 125% of the agreement quantity needs the approval of anofficer of the rank not less than S.A. Grade;

(i) Quantities operated in excess of 125% but upto 140% of the agreement quantity of theconcerned item, shall be paid at 98 % of the rate awarded for that item in that particular tender;

(ii) Quantities operated in excess of 140% but upto 150% of the agreement quantity of theconcerned item shall be paid at 96% of the rate awarded for that item in that particular tender;

(iii) Variation in quantities of individual items beyond 150% will be prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associatefinance and shall be paid at 96% of the rate awarded for that item in that particular tender.

(b) The variation in quantities as per the above formula will apply only to the Individual items ofthe contract and not on the overall contract value.

c) Execution of quantities beyond 150% of the overall agreemental value should not be permittedand, if found necessary, should be only through fresh tenders or by negotiating with existing

contractor, with prior personal concurrence of FA&CAO / FA&CAO(C) and approval of GeneralManager.

7.3 In cases where decrease is involved during execution of contract:

(a) The contract signing authority can decrease the items upto 25% of individual item withoutfinance concurrence.

(b) For decrease beyond 25% for individual items or 25 % of contract agreement value, theapproval of an officer not less than rank of S.A. Grade may be taken, after obtaining 'No ClaimCertificate' from the contractor and with finance concurrence, giving detailed reasons for eachsuch decrease in the quantities.

© It should be certified that the work proposed to be reduced will not be required in the samework.

7.4  The limit for varying quantities for minor value items shall be 100% (as against 25%

 prescribed for other items). A minor value item for this purpose is defined as an item whoseoriginal agreement value is less than 1% of the total original agreement value. 

7.5 No such quantity variation limit shall apply for foundation items.

7.6 As far as SOR items are concerned, the limit of 25% would apply to the value of SORschedule as a whole and not on individual SOR items. However, in case of NS items, the limit of25% would apply on the individual items irrespective of the manner of quoting the rate (single percentage rate or individual item rate).

8. The work will have to be completed with in Six months from the date of issue of this letter.You should submit a programme of work in suitable proforma within 10 days of receipt of this

letter in consultation with the Assistant Divisional Engineer/North/Tiruchchirappalli.

9. The letter of acceptance issued is binding contract between Railways and the contractor andthe date of completion will be reckoned from the date of issue of this letter only and therefore youmay please make arrangements to commence the work immediately.

10. Please attend this office on any working day to execute the agreement duly Producing

Performance Bank Guarantee as stated in para.5. 

11. Please commence the work within fifteen days form the date of receipt of this letter inconsultation with Section Engineers/ P.Way / Ariyalur & Lalgudi.

12. In addition to the above, the other terms and conditions given in the tender documentsubmitted along with your offer will also be applicable and the contract agreement to be signed byyou will be replica of the same.

13. The accepted rates of schedule item Nos 1, 8, 9(b) (i) & 9(b) (ii) of schedule shall not be takenfor future reference in future tender in isolation.

1.0 SITE OF WORK : The sites of work are as follows 

(i) Replacement of Trap switches in specified station yards in Section Engineer/ P.way/AriyalurSection listed vide annexure

The Tenderer should satisfy himself with the site conditions and facilities available before submittingthe tender at his own cost.

2.0 SCOPE OF WORK : 

The work involves as follows

(i) Replacement of existing Trap switches involving transportation of PSC sleepers from specifiedlocation to site of work. Anticorrosive treatment of rails before relaying, assembling and insertion oftrap switches on special sleepers

(ii)(a) Casual renewal of PSC sleepers in various bridges including transportation of PSC sleepers fromspecified location.

(ii)(b) Collection, supply, spreading and consolidation of soil as per specification to correct profile fortrolley refuges

(iii) Deep screening of ballast in track manually under traffic conditions with two rear packings atspecified roads in various station yards

and other connected works with contractor's men, materials as specified, tools and plant etc complete as per Railway's drawings, schedule, specifications, Manuals and special conditions.

3.0 SCHEDULE :

3.1 This schedule contains only one schedule for  items not covered by Schedule of Rates 2008.

The tenderer/Contractor shall quote unit rate  in words in bold “CAPITAL LETTERS”  besidesfigures for each item of schedule separately only in the space provided as tabulation with squares in theschedule for filling up of rates. Please do not leave any of the squares left blank but may be filled up

with letters and Indian numerals as the case may be or mark `X’ suitably in each square if notapplicable.

If the rate quoted by the tenderer/contractor is stated differently in figures and in words, then the ratequoted in words shall prevail.

The quantity furnished in the schedule is only approximate and may vary during execution. Paymentwill be made for the actual work done as per agreement conditions.

3.2 LIST OF PLANS:  The copy of plans listed can be seen in the office of Divisional RailwayManager (Works), Tiruchchirappalli on all working days during office hours.

5 Collection and supply of soil  (as per specifications) for forming/

widening/extension/ raising of  trolley refuge etc by contractor's vehicles or othermeans including excavation from earth quarries outside the Railway limits asapproved by Engineer's representative, spreading the earth in layers of 15 cm,sectioning to standard profile, consolidating, manually or mechanically if anyrequired at site of work with all labour, tools and plant, cutting equipments,vehicles, consumables, lead, lift, descent, seignorage charges, conveyance fromthe place of availability etc, loading, unloading, along side the track in site ofwork within Railway limit, dumping, spreading and consolidation charges, trackcrossing if any., and incidental charges etc., complete by the contractor and asdirected by the Engineer's representative.

 NOTE:

1.The specifications of soil to be used should be as under:-

"The soil to be used in the works should be well graded gravel (GW) or poorly

 graded gravel (GP) or well graded sands (SW) or poorly graded sands (SP) as

 per IS:1498-1970 soil classification and that it should contain soil particles

 finer than 75 microns a minimum of 10% and a maximum of 20% and that the

 minimum unit dry density of the soil should be 1.80 gram/cubic centimetre" 

2.Payment will be made for the quantity assessed by cross section method only.

3.Initial cross section at regular intervals to be taken by Engineer's representative jointly with the contractor and to be recorded for measurement purposes.

4.The quantity of earth work furnished is only the net quantity. The contractor

shall ensure that sufficient quantity is collected to get the finished form of thework.

5.Exact location and quantity of hard soil/red earth to be stacked/unloaded will beintimated by Engineer's representative during execution.

6 Casual renewal of PSC sleepers to bridge involving trucking out the

Railway's PSC sleepers to bridge  including fittings and fasteningsetc., available at various motorable locations viz, concerned P.Waystores depot/ nearest station yard/ level crossings to required site of workwith an average lead of  3 km using Railway’s dip lorry supplied free ofhire charges or by contractor's own means including collecting, loading,conveyance, unloading at site of work without infringement to standardmoving dimensions and damage to sleepers, releasing the existingdamaged/broken/ineffective PSC sleepers at various  bridges  undertraffic conditions 

without lifting the track duly removing the ballast in the shoulder to theminimum required depth and inserting the new PSC sleeper class I or IIto bridge and providing all fittings supplied by Railways free of cost and putting back the Railway's ballast in the shoulder and packing below thesleeper, greasing of ERC with Railway's supply of grease graphiteincluding one round of kutcha packing on the renewed portion includingremoval and refixing guard rails including removal of corroded rail

screws by heating and refixing Railway's new/old screws and  truckingout the released materials  such as PSC sleepers to  bridge,  fittingsfrom the site of work to various motorable locations viz, nearest stationyard/ level crossings using Railway’s dip lorry supplied free of hirecharges including collecting, loading, conveyance, unloading andstacking in quantities item wise in a countable manner withoutinfringement to standard moving dimensions and damage to sleeperswith all labour, tools, equipment, lead, lift, descent, conveyance,incidental charges etc., complete by the contractor and as directed byEngineer’s representative.

8 Deep screening of ballast in track manually under traffic conditions toapproved longitudinal and transverse profile and putting back thescreened ballast to correct profile as per IRPWM and boxing of ballastetc complete with initial rough packing to allow the train at 20 kmph as per special conditions for deep screening of ballast (attached) anddisposing of muck as directed by the Engineer’ representative for repairof cess or slope or leading out from side cutting and depositing at placesfrom where it is not likely to be washed back into side drain includingremoving and rooting out the vegetation and bushes for a width of 1.50m from the toe of ballast on either side of track and disposing the sameas directed by the Engineer in charge with all labour, tools and plant,lead, lift, track crossing if any, incidental charges etc., complete by thecontractor and as directed by the Engineer’s representative.

1 The rates to be quoted by the Tenderer/contractor shall be inclusive of execution of works under traffic conditions unless orotherwise specified and the contractor should engage adequate labour force and complete the work early to minimize the speedrestrictions.

2 All tools and plant required for the work unless or otherwise specified shall be arranged by the contractor at his own cost.

3 Dip lorry will be supplied by Railway free of hire charges if required.

4 If any defective cutting in the rail is noticed, then the same has to be recut and rectified as directed by the Engineer’s representativeat the cost of contractor only.

5 The released materials from the site such as sleepers, fittings such as fish plates and bolt and nuts, cut rails etc, after relaying if any,as per inventory shall be returned to the stores of the SE/P.way concerned with contractor’s own labour . Under no circumstancessecurity deposit will be refunded unless the released materials are moved to the nominated locations.

6 The contractor is responsible for the safety of track till the work is completed in all respects and restoration of traffic is made.

7 In the event of any accident in the work spot for that departmental enquiry will be held by the Railway and the contractor is bindingon the findings of the enquiry committee and is liable for any damages to the property, loss of life etc.

8 The availability of line block/power block is subjected to the operational conditions on the day of the work and for burst of block

due to failure of contractor; the cost of loss to the administration is liable for recovery from the contractor.***
