¿De qué manera se relacionan el matrimonio
y la libertad religiosa?
El matrimonio (la unión de un hombre y una mujer como esposo y
esposa) y la libertad religiosa son dos bienes distintos que también se
relacionan entre sí. La protección de cada bien se infiere del deber de
proteger la dignidad inviolable de la persona. La protección jurídica del
matrimonio como la unión de un hombre y una mujer también protege la
libertad religiosa de quienes se adhieren a esa visión del matrimonio.
¿Cómo podría afectar la libertad religiosa la modificación
de la definición jurídica del matrimonio?
Modificar el término jurídico “matrimonio” no es una modificación en la
legislación, sino que equivale a miles de modificaciones al mismo
tiempo. El término “matrimonio” se encuentra en el derecho de familia, el
derecho laboral, fideicomisos y patrimonios, derecho de salud, derecho
impositivo, derecho de propiedad y muchos otros. Estos derechos
afectan y de manera generalizada regulan a las instituciones religiosas,
tales como iglesias, escuelas con afiliación religiosa, hospitales y
familias. Cuando la Iglesia y el Estado están de acuerdo en lo que
significa el término jurídico “matrimonio” (la unión de un hombre y una
mujer), hay armonía entre el derecho y las instituciones religiosas.
Cuando la Iglesia y el Estado no están de acuerdo en el significado del
término "matrimonio", (por ejemplo si el Estado redefine el término con el
fin de reconocer el así llamado “matrimonio” entre personas del mismo
sexo), surge un conflicto a escala masiva entre el derecho, las
instituciones religiosas y las familias, porque el Estado aplicará diversas
sanciones en contra de la Iglesia por su negativa a cumplir con la
definición del Estado. La libertad religiosa
entonces se ve amenazada.
How are marriage and religious liberty connected? Marriage (the union of one man and one woman as husband and wife) and religious liberty are two distinct goods that are also
related to each other. The protection of each good follows from the duty to protect the inviolable dignity of the human person. But even more directly, the legal protection of marriage as the union of one man and one woman also protects the religious freedom of those who adhere to that vision of marriage. How could changing the legal definition of marriage have any effect on religious liberty? Changing the legal term “marriage” is not one change in the law,
but rather amounts to thousands of changes at once. The term “marriage” can be found in family law, employment law, trusts and estates, healthcare law, tax law, property law, and many others. These laws affect and pervasively regulate religious institutions, such as churches, religiously-affiliated schools, hospitals, and families. When Church and State agree on what the legal term “marriage” means (the union of one man and one woman), there is harmony between the law and religious institutions. When Church and State disagree on what the term
“marriage” means (e.g., if the State redefines marriage in order to recognize so-called same-sex “marriage”), conflict results on a massive scale between the law and religious institutions and families, as the State will apply various sanctions against the Church for its refusal to comply with the State’s definition. Religious liberty is then threatened.

THE LORD OF LIFE At this bountiful time of year, our Sunday readings teem with life and
abundance. Both the first reading, from the book of Wisdom, and the Gospel
passage from Mark assure us that God did not make death or even will us to be
ill. Illness and death entered the world through the presence of evil, the
Wisdom author tells us. Mark’s stories of Jesus healing a hemorrhaging woman
and resuscitating a dead little girl make it clear that Jesus is from God. As the
Son of God he does not will that anyone suffer illness or death. In the face of
such power, the second reading, from Paul’s Second Letter to the Corinthians,
provides a stark contrast. Jesus, who could raise the dead to new life, “though
he was rich, for your sake he became poor” (2 Corinthians 8:9). Our gift of new

EL SEÑOR DE LA VIDA En este tiempo tan fecundo del año nuestras lecturas dominicales rebosan con vida y abundancia.
Tanto la primera lectura, del libro de la Sabiduría, como la tercera del Evangelio de san Marcos nos
aseguran que Dios no creó la muerte, ni quiere que suframos de ninguna enfermedad. Fue por la envidia
del diablo que la muerte entró al mundo, según nos dice el Sabio. Y lo que san Marcos nos cuenta sobre
la curación de la hemorroisa y cómo revivió la hija de Jairo nos muestran claramente que Jesús viene de
Dios. Como Hijo de Dios, Jesús no quiere que nadie sufra enfermedad ni muerte. Pero en el contexto de
tanto poder, la segunda lectura, de la segunda carta de san Pablo a los corintios, nos presenta un fuerte
contraste. Jesús, que puede levantar a los muertos a una nueva vida, “siendo rico se hizo pobre por
ustedes” (2 Corintios 8:9). Así pues, la nueva vida que recibimos como regalo de Cristo exige una
