C. Presentation: Presentation by Taylor Johnson of the Lake Ministerial Association regarding the opening of a Warming Center this winter.

VII. COUNCIL BUSINESS:

A. City Clerk

1. Appointments to Lakeport Economic Development Advisory Committee

Appoint members to the Lakeport Economic Development Committee effective January 1, 2016, and expiring December 31, 2017; and/or direct staff to continue to advertise the open seats.

2. Appointments to the Parks and Recreation Commission

Appoint three (3) members to the Parks and Recreation Commission effective January 1, 2016, and expiring December 31, 2017; and further move to appoint one member to fill the current vacancy on the Commission effective immediately, and expiring December 31, 2016.

3. Appointments to the Traffic Safety Advisory Committee

Appoint three voting members to the Traffic Safety Advisory Committee effective January 1, 2016, and terminating in December 31, 2019; and direct staff to further advertise the remaining open seats.

4. Appointment to the Lake County Vector Control District Board of Trustees

Re-appoint the incumbent, George Spurr to serve a 4-year term to the Lake County Vector Control District Board of Trustees effective January 1, 2016, and expiring December 31, 2019.

B. Police Chief

1. Application 2016-002 Approve Application No. 2016-002 with staff recommendations for the Lakeside Car and Boat Show to be held in Library Park on August 12 and 13, 2016.

WHAT IS BEING ASKED OF THE CITY COUNCIL/AGENCY/BOARD:

The Council is asked to hold its annual reorganization meeting.

BACKGROUND:

In December, the City Council holds its annual reorganization meeting. This meeting includes the election of Mayor and Mayor Pro Tem.

DISCUSSION:

Mayoral elections are conducted by the City Clerk as part of that position’s statutory duties. It is recommended that the current Mayor announce that elections for Mayor and Mayor Pro Tem are to be conducted by the Acting City Clerk and turn the meeting over to the Acting City Clerk.

The Acting City Clerk will request nominations for Mayor (which do not require a second but do require the acceptance of the nomination by the nominee) and conduct a public election by voice vote. Following the election of Mayor, the Acting City Clerk will provide a similar nomination and election process for Mayor Pro Tem.

At that point, the new Mayor will be seated, and the meeting will be turned over to the new Mayor.

The new Mayor has the responsibility to make appointments to various commissions, boards, and committees. In order to give the Mayor time to review these committees and ascertain who would like to serve on them, the appointments to the commissions, boards, and committees will take place at the next regular council meeting. A copy of the current assignments is included for informational purposes.

OPTIONS:

The reorganization meeting is a mandatory meeting for all City Councils.

I. CALL TO ORDER & ROLL CALL: Mayor Scheel opened the meeting at 6:00 p.m. with Council Members Kenneth Parlet, Stacey Mattina, Marc Spillman, and Mireya Turner present.

II. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was let by Kevin Ingram.

III. ACCEPTANCE OF AGENDA: A motion was made by Council Member Spillman, seconded by Council Member Mattina, and unanimously carried by voice vote, to accept the agenda as posted.

IV. CONSENT AGENDA:

V. PUBLIC PRESENTATIONS/REQUESTS:

A. Citizen Input: Bill Graham asked the City Council to re-paint the bike lanes on Lakeshore Boulevard beyond High Street to the edge of town. The Mayor stated his concern would be passed along to the Public Works Director.

VI. COUNCIL BUSINESS:

A. Community Development Director

1. Continuance of Appeal of Planning Commission Approval of Cell Phone Tower:

Community Development Director Ingram presented the staff report updating the appeal of the Planning Commission’s approval of a cell phone tower for Verizon at 1875 North High Street.

Appellant Nancy Ruzicka was unable to attend the meeting but was amiable to the proceeding moving forward.

Mayor Scheel opened the public hearing.

Elizabeth Kaneshige, Suzanne Lyons, and Kerry Hershey spoke against the cell tower and in favor of the appeal.

Mayor Scheel closed the public hearing.

Verizon representative Jennifer Blocker spoke about the gap in coverage in Lakeport; detailed the need for the cell tower at the 1875 N. High Street location and relayed efforts to locate alternate locations.

Verizon legal counsel Paul Albritton thanked the Council for their time and effort on the item. He also detailed Verizon's efforts to locate alternate sites, stating Verizon would stand behind its studies identifying the 1875 N. High Street location as the best location.

Benjamin Santa Maria, engineer from Verizon, answered questions of the City Council regarding alternate sites.

A motion was made by Council Member Parlet, seconded by Council Member Spillman, and unanimously carried by roll call vote, to adopt the resolution granting an Appeal from the Planning Commission’s Decision to Approve File No. UP 14-09 for a Wireless Communication Facility at 1875 North High Street and

denying File No. UP 14-09 due to the fact that the height, appearance and location of the proposed wireless communication facility does not adequately comply with the applicable criteria and standards specified in the Lakeport Municipal Code and General Plan.

B. City Manager

1. Reorganization of Certain Positions within the Administrative Services Department:

City Manager Silveira presented the staff report regarding the proposed reorganization of the Administrative Services Department. Administrative Services Director Buendia answered questions of the City Council.

Suzanne Lyons spoke against the change.

Kim Beall asked questions of the City Council.

A motion was made by Council Member Turner, seconded by Council Member Mattina, and unanimously carried by voice vote, to:

a. Authorize and direct staff to reclassify the Administrative Services Director position to include the duties of City Clerk and return with an ordinance reflecting the change from a Council-appointed City Clerk to a City Manager hired City Clerk.

b. Reinstate the Deputy City Clerk position and at the same time disencumber funds for an Administrative Specialist (Department Secretary).

c. Approve the reclassification of the Deputy City Clerk position from a single class to a flex-class position.

VII. CITY COUNCIL COMMUNICATIONS:

A. Miscellaneous Reports, if any: Council Member Spillman reported on the Lakeport Main Street Association Board meeting that was held last week, and that the new executive director is Panette Talia. Judges are still needed for the Holiday Decorating Contest.

Council Member Turner attended the Chamber of Commerce Board meeting where medical marijuana was a topic, along with the cell tower appeal.

Council Member Mattina reported that the LMSA will have Santa and Hot Cocoa on Thursday at the Gazebo in Library Park.

Council Member Scheel reported that APC and LTA meet next week. The Lakeport Senior Center is doing a second Sunday breakfast. Monday, December 7 is the Pearl Harbor memorial celebration to start at the mast in Library Park.

Council Member Parlet had nothing to report.

City Manager Silveira had nothing to report.

VIII. ADJOURNMENT: Mayor Scheel adjourned the meeting at 7:25 p.m.

WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City of Lakeport City Council, the City of Lakeport Municipal Sewer District (CLMSD); the City of Lakeport Redevelopment Successor Agency, the Lakeport Industrial Development Authority and the Municipal Financing Agency of Lakeport are asked to adopt a revised Conflict of Interest Code.

BACKGROUND/DISCUSSION:

The Political Reform Act, Government Code Section 81000, requires state and local government agencies to adopt and promulgate Conflict of Interest Codes. The code designates positions required to file a Statement of Economic Interests, Form 700, and assigns disclosure categories specifying the types of interests to be reported. The Form 700 is a public document intended to alert public officials and the public to the types of financial interest that may create a conflict of interest. The Political Reform Act also requires every government agency to amend its conflict of interest code when changed circumstances necessitate an amendment and review its conflict of interest code biennially to determine if changed circumstances require an amendment to the conflict of interest code.

The City Council approved updates to the Conflict of Interest Code on October 6, 2015 after the biennial review. Since that time, changes in circumstances have occurred that necessitate an amendment, namely the establishment of the Lakeport Industrial Development Authority and the Municipal Financing Agency of Lakeport. The proposed policy requires that board members and officers of these agencies report financial interests. The existing code is presented in both strikethrough format and a finalized version for adoption. All five agencies are asked to adopt the code.

Incorporation of Section 18730 of the California Code of Regulations The Fair Political Practices Commission has adopted a regulation (2 Cal. Code of Regs., Section 18730) that contains the terms of a standard conflict of interest code and may be incorporated by reference in an agency’s code. After public notice and hearing, the standard code may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act. Therefore, the terms of 2 California Code of Regulations Section 18730 and any amendments to it duly adopted by the Fair Political Practices Commission are hereby incorporated by reference. This regulation and the attached appendices designating positions and establishing disclosure requirements shall constitute the conflict of interest code of the City of Lakeport.

Filing Individuals holding designated positions shall file their statements with the City Clerk, who shall be the filing officer for the City of Lakeport, the City of Lakeport Municipal Sewer District, and the City of Lakeport Redevelopment Successor Agency, the Lakeport Industrial Development Authority, and the Municipal Financing Agency of Lakeport and who shall retain the statements and make the statements available for public inspection and reproduction pursuant to Government Code Section 81008.

AMENDING AND ADOPTING AN UPDATED CONFLICT OF INTEREST CODE

WHEREAS, Government Code section 87300 of the Political Reform Act, requires state and local government agencies to adopt and promulgate Conflict of Interest Codes; and

WHEREAS, the Fair Political Practices Commission has adopted a regulation, title 2, section 18730 of the California Code of Regulations, which contains the terms of a standard Conflict of Interest Code that can be incorporated by reference and will be amended to conform to amendments of the Political Reform Act;

WHEREAS, the Conflict of Interest Code designates positions required to file a Statement

of Economic Interests, Form 700, and assigns disclosure categories specifying the types of interests to be reported; and

WHEREAS, the Political Reform Act also requires every government agency to amend its Conflict of Interest Code when changed circumstances necessitate an amendment and review its Conflict of Interest Code biennially to determine if changed circumstances require an amendment to the Conflict of Interest Code; and WHEREAS, staff has recommended amendments to the Conflict of Interest Code adopted October 6, 2015 based on changed circumstances; and

WHEREAS, under Assembly Bill 1484, as modified ABx1 26, the Successor Agency to the City of Lakeport Redevelopment Agency is a separate legal entity from the City that formed the former Redevelopment Agency; and

WHEREAS, the City of Lakeport Municipal Sewer District, the Lakeport Industrial Development Authority and the Municipal Financing Agency of Lakeport are also each separate legal entities from the City. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lakeport, the Successor Agency to the Lakeport Redevelopment Agency, the Board of the City of Lakeport Municipal Sewer District, the Board of the Lakeport Industrial Development Authority and the Board of the Municipal Financing Agency of Lakeport hereby adopt the Conflict of Interest Code attached as Exhibit A, and;

Approve the removal of Lakeport Economic Development Advisory Committee member Rick Hamilton from the Committee.

BACKGROUND/DISCUSSION:

The City Council appoints officers to serve on the Lakeport Economic Advisory Committee, who serve on a volunteer basis without pay in an advisory capacity only. The City Council may remove a Commissioner for any reason or no reason as the Government Code provides that all appointed officers serve at the pleasure of the City Council. (Govt Cod § 36506.)

The City Council appointed Rick Hamilton to LEDAC on December 2, 2014. However, for personal reasons, Mr. Hamilton is unable to as effectively serve the City. Staff therefore recommends the City Council approve Mr. Hamilton's removal from LEDAC for the period remaining in his term, effective today.

The Lakeport City Council thanks Mr. Rick Hamilton for his service to LEDAC.

WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to invite applicants to make a short presentation and appoint individuals to serve on the Lakeport Economic Development Committee.

BACKGROUND/DISCUSSION:

The Lakeport Economic Development Committee was established in December of 2010. The purpose of the Committee is to advise the City Council, City Manager, and Lakeport Economic Development Program staff on developing potential programs and strategies for economic development in the City, establishing and maintaining regular communication between the City and the business community, evaluating community needs and desires for economic development, and focusing on commerce solutions that enhance the quality of life for the Lakeport community. The committee consists of 11 members as well as Staff, designated by the City Manager, who serve as ex-officio members. Currently, the City Manager is the City's ex-officio member. Members are to serve two-year terms, with terms commencing on January 1.

The terms of five of the committee members will expire December 31, 2015. The Council should review the applications and allow each applicant to make a short presentation detailing his/her background, interests and why he/she would like to serve. The Council should then nominate and appoint the individuals to serve on the Lakeport Economic Development Committee as set forth above.

Recruitment for membership was done by a press release that went out to all local media, and by advertising on the City’s website. Letters were sent to all persons whose terms were expiring, and they were invited to reapply. Five applications have been received.

Dear Hilary and the Honorable City Council of Lakeport, CA:  Thank you for the opportunity to reapply for the Lakeport Economic  Development Action Committee after my three enjoyable years of serving on the Committee.   After our conversation and my earlier email copy to you via my note to Wilda,   I was unable to retrieve my previous letter of application from my computer, so this email will let you know that my primary public interests are to develop and strengthen  Lakeport cultural and economic interests to their highest and best potential.  I have worked in ten metropolitan areas, among them, St. Louis, Cleveland, Philadelphia, Northern New Jersey, New York City, Boston, MS, Washington, D.C., San Francisco, Los Angeles, CA, Jacksonville, Florida and Tulsa, Oklahoma, as well as my hometown, Ft. Smith, Arkansas, where I have served on various boards and commissions for public health, mental health, well being of children, local and state campaigns, peace, political campaigns on both sides of the aisle.  I have a strong background in writing and media work, and served on the White House Press Corps for eight years, writing on the President, Arms Control and the federal budget.  I was also appointed by the California State Attorney General to serve for three years on the invitational Training for Trainers in Sacramento in the “Safe from the  Start”, and represented Sonoma County at state levels of this broad educational program.  Here in Lake County, I have worked with the Superior Court and Probation in directing Alternatives to Violence, a 52‐week rehabilitation for men and women offenders of domestic violence, and with Probation and the Courts for juvenile correction in Sonoma County.  My companies, Clear Lake Counseling Center and LakeCountyFilm.com are located in offices at 149 Norh Main Street, in the center of Lakeport’s downtown area.    If approved, I look forward to serving another term as a Member of LEDAC.  Many thanks for your support as a Council Member or Department leader in furthering this private work in the public interest of our remarkable town, Lakeport, CA.  Taira St. John, Ph.D., MFT

WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to invite applicants to make a short presentation and appoint individuals to serve on the Parks and Recreation Commission.

BACKGROUND/DISCUSSION:

The Parks and Recreation Commission was established in 1984 to act in an advisory capacity to the City Council in matters pertaining to city parks and recreation, to cooperate with the planning commission and civic organizations to advance the sound planning of new recreation areas and facilities, to recommend, from time to time, policies on city recreation facilities to the city council for consideration and approval, and to perform such other duties as may be assigned to the commission by the city council.

The commission consists of five members who serve two-year terms. The terms are staggered between even and odd years so that three members are chosen in December of odd years and two members chosen in December of even years. The terms of three of the commission members will expire December 31, 2015.

In addition to the three terms that are expiring this year, there is currently one vacant seat on the Commission. The Lakeport Municipal Code Chapter 2.20.020 states that “vacancies in the commission occurring otherwise than by expiration of term of office shall be filled for the unexpired term by appointment of the city council.” The member appointed to this seat would serve the remainder of the current term, which would expire December 31, 2016.

The Council should review the applications and allow each applicant to make a short presentation detailing his/her background, interests and why he/she would like to serve. The Council should then nominate and appoint the individuals to serve on the Parks and Recreation Commission as set forth above.

Recruitment for membership was done by a press release that went out to all local media and by advertising on the City’s website and social media. Letters were sent to all persons whose terms were expiring, and they were invited to reapply. Five (5) applications were received.

OPTIONS:

1. Choose three members to serve two year terms expiring December 31, 2017 and choose one member to fill the vacant seat, the term to expire December 31, 2016.

2. Direct staff to further advertise the positions.

WHAT IS BEING ASKED OF THE CITY COUNCIL/AGENCY/BOARD:

The City Council is being asked to invite applicants to make a short presentation and appoint four individuals to serve on the Traffic Safety Advisory Committee (TSAC) for four-year terms.

BACKGROUND/ DISCUSSION:

The Traffic Safety Advisory Committee was established in 1991 to make recommendations to the City Council regarding traffic safety, pedestrian safety, and parking, as it relates to traffic safety. The committee consists of five voting members, one nonvoting member from the insurance industry, and the following ex officio members: the City Engineer or his/her designee, the City Police Chief or his/her designee, and the City Clerk or his/her designee.

The City of Lakeport currently has five (5) general openings and one opening for a member of the insurance industry on its Traffic Safety Advisory Committee (TSAC) as a result of the expiration of existing member terms. Committee Members must be residents of the City, and are appointed by the City Council on the basis of interest and qualifications. Familiarity with traffic safety and/or the California Vehicle Code is desirable, but is not required.

Membership on the TSAC is for a four-year term and is a non-compensated volunteer position. The committee normally meets once a month, as needed, provided there are traffic issues to be addressed that fall under the purview of the committee. Attached please find copies of the three applications.

Recruitment for membership was done by a press release that went out to all local media and by advertising on the City’s website. Letters were sent to all persons whose terms had expired, and they were invited to reapply. In addition, a letter was sent to ten (10) insurance agencies located in Lakeport, inviting any interested parties from the insurance industry to apply.

At this time, the Clerk’s office has only received three applications for the voting member seats, and none from the insurance industry.

The Council should review the applications and allow each applicant to make a short presentation detailing his/her background, interests, and why he/she would like to serve. The Council should then nominate and appoint the individuals to serve on the TSAC.

OPTIONS:

Choose three voting members for four-year terms on the TSAC and/or direct staff to further advertise the positions.

WHAT IS BEING ASKED OF THE CITY COUNCIL/AGENCY/BOARD:

The City Council is being asked to invite applicants to make a short presentation and appoint one individual to serve on the Lake County Vector Control District's Board of Trustees.

BACKGROUND/ DISCUSSION:

The Lake County Vector Control District is a public health agency that protects Lake County residents and visitors from vectors and vector-borne diseases. The District is an independent special district that operates under the California Health and Safety Code §§ 2000-2093, and is governed by its own board of trustees.

The California Health and Safety Code §2022 (b) & (d) requires that each person appointed by a city council to be a member of a board of trustees shall be a voter in that city and a resident of that portion of the city that is within the district, and that it is the intent of the Legislature that persons appointed to boards of trustees have experience, training, and education in fields that will assist in the governance of the districts.

The Lake County Vector Control District is governed by a Board of Trustees that establishes policies for the operation of the district. The Board consists of five trustees: one appointed by the City of Clearlake, one appointed by the City Lakeport, and three appointed by the County of Lake. Each trustee is appointed to serve a 2-year or 4-year term, at the discretion of the appointing authority.

Recruitment for membership was done by a press release that went out to all local media and by advertising on the City’s website. One application was received.

The incumbent appointee, George Spurr, was appointed to an initial 2-year term in December 2013, as required by District rules. This term expires December 31, 2015. Mr. Spurr has submitted an application for reappointment.

The Council can review the application and allow the applicant to make a short presentation detailing his background, interests, and why he would like to serve. The Council can then nominate and appoint the individual to serve on the Lake County Vector Control District Board of Trustees for either a 2-year or 4-year term, as set forth above. The incumbent’s application is attached.

For Friday, August 12th: City will need to close the small Fourth Street parking area between the Coach Craft yard and the north side of Fourth St. This will be to allow up to six speed boats (While on trailers) to run their motors for short periods of time for their "Night of Fire" after the concert in the park ends. Due to noise disturbances issues boat motors shall not be started after 10:00 PM. For Saturday, August 13th: Street and parking area closures necessary are: 1: Park Street from First Street to Third Street and second Street from N. Main Street to Park Street. 2: All parking between the prolongation of the east edge of Park Street from the north end of Library Park to the south edge of Fifth Street. (Fifth Street parking area on the north side of the street is to remain open for regular public use) 3: Between 9:00 AM & 11:00 AM boat launch ramps at First Street, Third Street, Fifth Street and Clearlake Ave will be closed for public safety while the speed boats are making their runs.

Library Park including the Gazebo (from the center of the park to its north end to be reserved for the event. Controlled traffic (with access for local traffic including residents, business persons or their customers) necessary is: 1: Third Street from N. Main Street to Park Street. 2: Fourth Street from N. Main Street to the City Lakefront parking area. Event promotors shall work with businesses and residence including Park Place & the Stevenson's to ensure that their locations can be accessed throughout the day. 3: The Alley behind City Hall between Second & Third Streets. Event Promotors shall submit alcohol sales authorization applications to both the Lakeport Police Department and the California Department of Alcoholic Beverage Control for approval at least 20 days prior to event. Event Promotors shall provide monthly updates of projected event attendance to police and public works.
