Question: I am trying to rentmy condo. I posted a listingon Craigslist. A company con-

tacted me and asked if they couldbring by potential tenants and Iagreed. I have not signed any agree-ment with them, but have e-mailedand talked with them numeroustimes. They are very aggressive. With-out my express permission, they re-posted my Craigslist posting and puttheir phone number on it.

Recently they brought by a potentialtenant I would like to rent to. Unfortu-nately, they over-pressured this person.He called me and told me he didn'tfeel comfortable with them. He neversigned any agreement with them butdid submit a rental application forcredit check with them, which theygave to me.

The company would receive a pay-ment of one month's rent for bringingthis person to me, but because theclient won't work with them, I don'twant to pay them. I offered them $500to write up the lease but they refusedand accused me of undercuttingthem.

Now they are threatening to sue meif I rent to him. I do not have a signedcontract with them, and neither doesthe tenant, but they have threatenedto sue. Do I or the prospective tenanthave an implied contract with them?

Answer: You might need to talk to alawyer on this one if you decide not topay the real estate company the feethat seems to have been agreed upon,even if it was under a verbal agree-ment.

Most states have laws that require areal estate broker and agent to have awritten agreement for the payment ofa commission or finder's fee when itcomes to real estate. Without thatwritten agreement, the real estate bro-ker or agent might be out of luck.

Furthermore, to be in the real es-tate business, you generally have tohave a real estate brokerage license, orhave an agent license and work for alicensed real estate broker.

Assuming the company you hiredhad a valid real estate license in yourstate, and that its employees or agentsyou dealt with were licensed as well,the only thing missing would havebeen for them to have drawn up awritten agreement with you.

You may decide not to pay themanything, but they could decide to sueyou. If your state law does not permitthem a recovery from you as a resultof their failure to obtain a written list-ing agreement, a written agreementto pay them a commission in finding atenant for your property, or a writtenagreement to pay them as an agentrepresenting a tenant, you may haveno obligation to pay them. But theycan still cause you misery by suingyou, forcing you to go to court, havingyou represent yourself, even if you suc-ceed in getting the case thrown out asa result of their failure to have theright paperwork.

You would have to balance your de-sire to not pay them with the risks ofbecoming involved in that litigation.

You could decide to pay them andmove on. You would have found a ten-ant you like and could decide never towork with that company again.

First-time homebuyersCraig and Amanda Cameronwere among the couples whoreceived a flight on a heli-copter as part of a home-buying promotion.

“It was cool to seeLoveland and Fort Collinsfrom the air,” Craig said.The Camerons admittedthey were interested in buy-ing a home at The CottagesAt Enchantment Ridge be-forehand, but the helicopterflight was a nice bonus. Theirflight went over HorsetoothReservoir and PoudreCanyon, Craig said.

The Cottages subdivisionwas developed by John Giu-liano, and homes in it are be-ing built by Aspen Homes ofColorado. The subdivision is

represented solely by TeamCook of The Cottage Realtyin Berthoud.

“We were trying to dosomething a little bit differ-ent,” said Realtor Kevin Cookof Cottage Realty.

“We had three differentpeople who bought homesthat month.” Cook said thehelicopter promotion, alongwith dinner for two at the4th St. Chophouse inLoveland, was available toCottages homebuyers duringthe month of March. Thepromotion will also be avail-able for homes sold duringthe remainder of December.

The Camerons took theirflight on October 15. Thehelicopter is owned byGiuliano, who is also a pilot.

Cook said Realtors anddevelopers are offering morepromotions than in thepast, partly because of thecomparative lag in homesales.

“We sold 31 houses in31 days in July of 2001.We didn’t have to offeranything.”

Cook said that althoughhomebuying has slowed froma decade ago, given thesuppressed home prices andlow interest rates, it is an ide-al time to buy now. “Pe o p l eare getting a lot more housefor their dollar now,” he said.

“It truly is the best time tobuy right now.”

The Camerons’ home,called the Foxfield model, is atwo-story with three bed-rooms, three bathrooms, afull unfinished basementand a two-car garage. Craigand Amanda moved in inAugust. They said they wereable to customize virtuallyeverything in the home.

“We really liked being ableto work with the builder andcustomize,” Amanda said. “Itwas step-by-step all the waywith the builder. We had a sayin all of it.”

“We ’ve lived in enoughapartments that we knewwhat we liked and what wedidn’t,” Craig said.

They also were able to takeadvantage of of the low inter-

est rates and lower homeprices for new construction,he said. The couple ended upwith a mortgage paymentnot far from what theywere paying to live in anapartment.
