With the Hong Kong InternationalArbitration Centre(HKIAC) winning the Global Arbitration Review(GAR) innovation award of 2014, Hong Kong hasshowcased to the world that a “Hong Kong” brandofinternationalarbitrationisinthemaking. RegionalarbitrationhastakenrootinAsia,withHongKongfeaturingatthevanguardofbestarbitrationpractices. Widely regarded as a top arbitration seat,Hong Kong has set a successful model for otherAsian jurisdictions to adopt. Arbitration in HongKong has flourished in recent years due to itsmodernlegal infrastructure and independent judicial systemcoupled with its excellent geographical connectivity.This is reflected by the large number of caseshandledbyHKIACsinceitsestablishmentin1985. HongKongismorethanamajorarbitrationseatontheglobalarbitrationmap.Itisaleaderindevelopinginnovative practices to meet the demands of its users.This article highlights a number of distinctive featuresthat setHongKong apart frommany other arbitrationjurisdictions.

First-class Arbitration Legislation

The backbone of Hong Kong’s arbitration regime isthe Arbitration Ordinance (Cap. 609) (Ordinance),which is one of the most modern and user-friendlyarbitration statutes in theworld. TheOrdinance cameinto force in June 2011 and adopts a unitary regimeapplicabletoallarbitrationsinHongKong. TheOrdinance istheonlyAsian legislationthatadoptsthelatestversionoftheUNCITRALModelLaw,

whichmeansthatthearbitraltribunalandtheHongKongcourtshavethepowertoorderabroadrangeofinterimrelief.TheOrdinancehasgonefurtherthanmanyotherarbitrationstatuesbypermitting interimrelief issuedbytribunals inoroutsideHongKong tobeenforceable inthesamemannerasaHongKongcourtorder. HongKongisoneofthefewjurisdictionswhosearbitration law expressly recognises the enforceabilityof decisions issued by emergency arbitrators in oroutsideHongKong.Whilemanyinstitutionalruleshaveintroduced procedures making such decisions available,the arbitration laws of these institutions’ homejurisdictions are silent on the effectivenessofthesedecisions. Another notable feature of Hong Kongarbitration is the explicit assurance of confidentialityprovided by the Ordinance. Under Hong Kong law,the duty of confidentiality covers not only arbitralproceedingsandawards,butalsorelatedcourtproceedingsandjudgments.Thebreadthofsuchdutyrepresentsthehighestlevelofprotectionofconfidentialityintheregion.

Neutral Forum, Pro-arbitration Judiciary and Excellent Enforcement Record Arbitral proceedings in Hong Kong are conducted ina neutral environment and supportedbyindependentjudiciary. HongKong’shighestcourtisoneofakind,asitincludes18eminentjudgesfrommanyothercommonlaw

jurisdictions.Thepresenceoftheseforeignjudgesensuresthat the court decisions reflect leading internationalthinkingonjudicialsupportofarbitration,andservesasaguaranteeoftheindependenceofthecourts.Assuch,theWorld Economic Forum’s“Global CompetitivenessReport2014-2015”rankedHongKongfifthintheworldandfirstinAsiaforjudicialindependence. The Hong Kong courts are internationallyrenowned for their pro-enforcement and hands-off approach to arbitration. Hong Kong judges havedeveloped a body of non-interventionist case law thatdemonstrates Hong Kong’s strong judicial support forthe arbitral process and awards. This is evidenced bythe fact that the Hong Kong courts have not refusedto enforce any awards over the past four years. Since Hong Kong is a party to the NewYorkConventionandvariousregionalarrangementsonmutualenforcement,awardsmadeinHongKongareenforceableinover150countriesworldwide.Inparticular,HongKongawardsmaintainanimpressiverecordofenforcementinChina,astheChinesecourtshavenotrefusedtoenforceanyHongKongawardsoverthepastfiveyears.

Top-tier Arbitral Institution PartieswhowishtoarbitrateinHongKongbenefitfromeasyaccesstoHKIAC’sservices. HKIACisamongtheworld’s leadingdisputeresolution institutions,providingone-stop-shopservicesinrespectofarbitration,mediation,adjudicationanddomainnamecases. Votedamong theworld’stopfourhearingcentresinGAR’sHearingCentresSurvey(7October2014),HKIAChastakenanumberofstepstorefineandimproveitsofferingsinrecentyears.HKIAC’s current administered arbitration rules includeinnovativemechanisms tocontrol thearbitral tribunal’s

fees and to deal with complex arbitrations involvingmultiplepartiesorcontracts.HKIACisthefirstandonlyarbitral institutionthathasupdated itsmodelclausetopromptpartiestodesignateanappropriatelawtogoverntheir arbitration agreement. enthusiasticallyandsuccessfullyparticipateinarangeofinternationalmootingcompetitionsatahighlevel. Based in Hong Kong, the Willem C. Vis (East) International Commercial Arbitration Mootwaslaunchedin2003asasistercompetitiontotheVisMootinVienna.In 2012 the CityU team prevailed over 90 teams, towin the 9th AnnualVis East competition. Hong Kong’s Vibrant Mooting Scene students have also impressed in the foundingVienna-based Willem C. Vis International Commercial Arbitration Moot: the CityU team won the 2013 competition,beating almost 300 teams. (See photograph page 5.) Hong Kong students have participatedsuccessfully in a rangeofothermoots,both inside andoutside the region. In 2004 the Hong Kong Universityteam was a quarterfinalist in the Philip C. Jessup International Law Moot Court Competition, also winningsecond place prize in theAlona E. Evans competitionand third place in the Hardy Dillard Memorial Prizecompetition.In2014,aCityUmooterwasplacedthe13thbest individual oralist in the international competition,and in 2013 the CityU team’s Respondent’s memorialwasrankedinthetop5Respondent’smemorials.
