1.0 Introduction

1.1 The purpose of this report is to examine the issues facing St. Anne's on the

Sea in ensuring that it is a thriving, sustainable community; it seeks to

determine what options are available to address these issues and whether

they would best be addressed by a formal neighbourhood planning approach,

that is by the making of a Neighbourhood Development Plan, Neighbourhood

Development Order or Community Right to Build Order.

1.2 In respect of a Neighbourhood Development Plan (referred to simply as 'the

Neighbourhood Plan or as 'the NDP' in the remainder of this document), the

report examines whether the identified issues and particular options are best

addressed by:

Inclusion of policies in the Neighbourhood Development Plan (NDP);

Inclusion in its accompanying Implementation Plan1; or as not being

relevant or appropriate to be addressed.

1.3 It is intended that this report will provide the Town Council with:

information on the potential benefits and risks of proceeding or not

proceeding with the NDP;

advice on the potential issues and options which are appropriate to be

addressed through the NDP; and specifically;

Information on the scope and content of both the Neighbourhood

Development Plan and its accompanying Implementation Plan.

1.4 This report is informed by, and should be read in conjunction with, the

Neighbourhood Profile and Consultation Reports. Those documents are

frequently cross referenced in this paper but for the sake of brevity and clarity,

wherever possible, their contents are not repeated here.

Structure of the Report

1.5 The remainder of the report is structured as follows:

Section 2: provides information on the background to the Neighbourhood

Development Plan, including its aims and objectives, and its broad structure.

Section 3: explains how the Key issues have been identified

Section 4: describes the various statutory and regulatory requirements which

the neighbourhood Development Plan would need to comply with

Section 5: describes how the Issues and options for addressing them have

been appraised, with a view to determining a realistic and cost effective

Neighbourhood Planning approach, as well as potential risks.

Section 6: sets out the outcome of the Issues and Options Appraisal.

2.0 The St. Anne's on The Sea Neighbourhood Plan

Background to the Neighbourhood Plan

2.1 St. Anne's on the Sea Town Council is the responsible body for producing a

Neighbourhood Plan (and Neighbourhood Development Order or Community

Right to Build Order). The parish has been designated as a Neighbourhood

Area. The area covers the whole of the parish, including the Blackpool Airport

site. A plan showing the Neighbourhood Plan Boundary can be downloaded

here.

2.2 Work on the plan commenced in February 2014. The Town Council, in

collaboration with other stakeholders, has gathered all the evidence which it

believes it will need to support and justify the policies contained in the

proposed Neighbourhood Plan. This has been assembled and collated in a

Neighbourhood Profile document. This:-

Describes the locational context and boundaries of the NDP;

Presents an up to date demographic profile of St. Anne’s;

Explains current and emerging local planning policy;

Captures and summarises relevant baseline “evidence” relating to the

range of issues which the NDP may seek to address; and

Identifies key issues for achieving a sustainable vibrant St. Anne’s in the

future.

2.3 The Town Council has undertaken a wide-ranging consultation exercise,

consulting statutory consultees, and; people or organisations who may have a

responsibility for providing services, or have a personal or business interest in

the town. This initial consultation sought views on the issues which a

neighbourhood planning approach could or should deal with. This consultation

ran from Monday 14th April to Wednesday 28th May 2014. This community /

stakeholder involvement exercise is part of an ongoing process of discussion,

meetings and correspondence. An important part of this process has been the

meetings of the Theme Groups, which have taken a detailed look at the major

'themes' and issues that a neighbourhood planning approach may address.

The Aims and Objectives of the St. Anne's on the Sea Neighbourhood Plan

2.4 The over-riding aim of the Town Council is to ensure that St. Anne's on the

Sea is and remains a thriving, sustainable community.

2.5 Details of the Plan's Aims and Objectives are set out below:-

Aims of the Plan

The draft aims of the neighbourhood plan will be to seek to:

Identify the future development proposals for St. Anne’s on the Sea and

how these can be enhanced to support the vision of the town as a

‘Garden town by the Sea’;

Bring forward proposals which will support the quality of life in St. Anne’s

on the Sea in the years to come;

Protect and enhance the distinctive architectural design and the historic

environment within the Town.

Objectives

2.6 To further these aims, the following objectives have been identified:

1. Set out a positive vision for the future of the town, ensuring that it reflects

the aspirations of its residents, who will be involved in making the plan,

monitoring its progress and delivering development.

2. Ensure a high quality of life for all the town's residents.

3. Ensure that the town will have a prosperous local economy into the

future.

4. Support sustainable development meeting local needs.

5. Secure high quality sensitive design which prioritises local

distinctiveness and enriches the landscape and built environment.

6. Enjoy and utilise our natural landscape and assets whilst protecting it for

future generations.

7. Support the transition to a low carbon future taking full account of climate

change, flood risk and coastal change, encourage the reuse of existing

resources and the use of renewable resources.

8. Deliver high quality housing development that meets the town's needs.

9. Seek improvements to transport, to utility infrastructure and to digital

connectivity.

10. Protect and enhance the town's greenspace, and improve access to it.

11. Ensure that St. Anne's remains a high quality year round visitor resort.

12. Ensure that the town is safe, accessible and attractive to all its residents,

visitors and people who work in it.

13. Protect the town's heritage assets whilst encouraging appropriate high

quality contemporary architecture.

14. Improve health, social and cultural wellbeing for all residents,

encouraging and providing opportunities for an active lifestyle, and

ensuring high quality local facilities for existing and new residents.

The proposed structure of the Neighbourhood Plan

2.7 At the present time, it is anticipated that the plan will be in two parts:-

A - The statutory development plan, setting out land use planning policies

B - An Implementation Plan, setting out strategies and actions to deal with

issues which are of local significance but are not included in the statutory

plan. For example, this might include infrastructure projects that the Town

Council considers should be given priority consideration for Community

Infrastructure Levy funding.

3.0 How the Key Issues have been Identified

3.1 The issues identified in this paper derive from the existing evidence base and

have been developed through the process of engagement with key

stakeholders and consultees. This process is set out below as a series of

steps.

First, the Neighbourhood Profile, which sought to capture and summarise

relevant baseline “evidence” relating to the range of issues which the NDP

may seek to address and identified key issues for achieving a sustainable

vibrant St. Anne’s in the future.

Second, through the consultation carried out with the local community, which

specifically sought to identify the key issues raised by the diverse community

that lives, works and carries on business in the neighbourhood area.

Third, through discussion with key stakeholders, including Fylde Borough

Council, Blackpool Airport, the St. Anne's on the Sea Chamber of Trade and

Lytham St. Anne's Civic Society.

Fourth, through in depth analysis by Theme Groups, which looked at the

following themes:-

Environment (including open space & flooding)

Housing

Transport and Movement

Economy

Community and Health

Design and Heritage

The Theme Groups sought to identify issues relating to that theme;

understand the role of existing plans, strategies and programmes and their

relationships to the neighbourhood planning process and how these might

deal with the issues highlighted; and highlight potential options for dealing with

these issues through a neighbourhood planning approach.

3.2 Underlying this, has been the need to ensure that the subsequently identified

neighbourhood planning approach achieves the following:

1. Meets the Town Council's aims for the plan and delivers the identified

objectives.

2. That the approach complies with the statutory 'tests', that is meets the

basic conditions; and

3. Reflects the issues identified by the community and delivers on its

aspirations.

3.3 A summary of the Key Issues which emerged through these steps is set out in

Appendix 11 of the Report of Consultation. These form the basis of the

appraisal set out in Section 5.

4.0 Statutory and Regulatory Requirements

4.1 A key part of the appraisal of potential issues/ options for inclusion in the NDP

set out in Section 5 is whether they are compliant with national policy and

guidance issued by the Secretary of State. This statutory and regulatory

framework is summarised below.

A -“Basic Conditions”

4.2 The basic conditions to be met by a Neighbourhood Development Plan or

Order are set out paragraph 8 (1) (a) (2) of Schedule 4B to the Town and

Country Planning Act 1990 (inserted by the Localism Act 2011) and are as

follows:-

1. having regard to national policies and advice contained in guidance

issued by the Secretary of State it is appropriate to make the order (or

neighbourhood plan).

2. having special regard to the desirability of preserving any listed building or

its setting or any features of special architectural or historic interest that it

possesses, it is appropriate to make the order. This applies only to ND

Orders.

3. having special regard to the desirability of preserving or enhancing the

character or appearance of any conservation area, it is appropriate to

make the order. This applies only to ND Orders.

4. the making of the order (or neighbourhood plan) contributes to the

achievement of sustainable development.

5. the making of the order (or neighbourhood plan) is in general conformity

with the strategic policies contained in the development plan for the area

of the authority (or any part of that area).

6. the making of the order (or neighbourhood plan) does not breach, and is

otherwise compatible with, EU obligations.

4.3 Regulations 32 and 33 of the Neighbourhood Planning (General) Regulations

2012 (as amended) set out two basic conditions in addition to those set out in

the primary legislation. These are:

the making of the neighbourhood plan is not likely to have a significant

effect on a European site (as defined in the Conservation of Habitats and

Species Regulations 2012) or a European offshore marine site (as defined

in the Offshore Marine Conservation (Natural Habitats, &c.) Regulations

2007) (either alone or in combination with other plans or projects). (See

Schedule 2 to the Neighbourhood Planning (General) Regulations 2012

(as amended) in relation to the examination of neighbourhood

development plans.)

having regard to all material considerations, it is appropriate that the

Neighbourhood Development Order is made (see Schedule 3 to the

Neighbourhood Planning (General) Regulations 2012 (as amended),

where the development described in an order proposal is EIA

development. Each of these conditions is addressed in more detail below.

B - National policy and guidance from the Secretary of State

4.4 The National Planning Policy Framework (NPPF) sets out the Government’s

economic, environmental and social planning policies for England and how

these are expected to be applied. The policies set out in this framework apply

to the preparation of local and neighbourhood plans and to development

management decisions. There is a separate waste planning policy statement

which remains in place until the National Waste Management Plan is

published.

4.5 This national policy context is set out in detail in the Neighbourhood Profile,

with the main principles set out in Chapter 3 of that document and detailed

guidance in the subsequent 'thematic' chapters of that document.

4.6 The Government has produced National Planning Practice Guidance to set

out its approach to planning.

4.7 The section of the NPPG on neighbourhood planning provides advice on the

neighbourhood planning system introduced by the Localism Act including key

stages and decisions (e.g. deciding neighbourhood areas, the legal tests for

neighbourhood plans, and the process of independent examination and

referendum).

4.8 Paragraph 002 advises that communities have choices to achieve the

outcomes they want through other planning routes, not just through the

neighbourhood planning approach. It says:

Neighbourhood planning is not a legal requirement but a right which

communities in England can choose to use. Communities may decide that

they could achieve the outcomes they want to see through other planning

routes, such as incorporating their proposals for the neighbourhood into the

Local Plan, or through other planning mechanisms such as Local

Development Orders and supplementary planning documents or through pre-

application consultation on development proposals. Communities and local

planning authorities should discuss the different choices communities have to

achieving their ambitions for their neighbourhood.

4.9 Paragraph 003 emphasises the benefits of Neighbourhood Planning. It says:

Neighbourhood planning enables communities to play a much stronger role in

shaping the areas in which they live and work and in supporting new

development proposals. This is because unlike the parish, village or town

plans that communities may have prepared, a neighbourhood plan forms part

of the development plan and sits alongside the Local Plan prepared by the

local planning authority. Decisions on planning applications will be made using

both the Local Plan and the neighbourhood plan, and any other material

considerations.

Neighbourhood planning provides the opportunity for communities to set out a

positive vision for how they want their community to develop over the next ten,

fifteen, twenty years in ways that meet identified local need and make sense

for local people. They can put in place planning policies that will help deliver

that vision or grant planning permission for the development they want to see.

To help deliver their vision communities that take a proactive approach by

drawing up a neighbourhood plan or Order and secure the consent of local

people in a referendum, will benefit from 25 percent of the revenues from the

Community Infrastructure Levy arising from the development that takes place

in their area.

Communities without a parish or town council will still benefit from this

incentive. If there is no Parish or Town Council the charging authority will

retain the Levy receipts but should engage with the communities where

development has taken place and agree with them how best to spend the

neighbourhood funding. Charging authorities should set out clearly and

transparently their approach to engaging with neighbourhoods using their

regular communication tools e.g. website, newsletters, etc. The use of

neighbourhood funds should therefore match priorities expresses by local

communities, including priorities set out formally in neighbourhood plans."

4.10 Paragraph 040 advises on the evidence needed to support a neighbourhood

plan or Order. It says:

"While there are prescribed documents that must be submitted with a

neighbourhood plan or Order there is no ‘tick box’ list of evidence required for

neighbourhood planning. Proportionate, robust evidence should support the

choices made and the approach taken. The evidence should be drawn upon

to explain succinctly the intention and rationale of the policies in the draft

neighbourhood plan or the proposals in an Order.

A local planning authority should share relevant evidence, including that

gathered to support its own plan-making, with a qualifying body."

4.11 Paragraph 041 advises on the drafting of neighbourhood plan policies. It says:

"A policy in a neighbourhood plan should be clear and unambiguous. It should

be drafted with sufficient clarity that a decision maker can apply it consistently

and with confidence when determining planning applications. It should be

concise, precise and supported by appropriate evidence. It should be distinct

to reflect and respond to the unique characteristics and planning context of

the specific neighbourhood area for which it has been prepared."

4.12 Paragraph 042 addresses whether a neighbourhood plan can allocate sites

for development. It says:

"A neighbourhood plan can allocate sites for development. A qualifying body

should carry out an appraisal of options and an assessment of individual sites

against clearly identified criteria."

4.13 Paragraph 043 addresses the potential conflict that might occur if a local

planning authority is also intending to allocate sites in the same

neighbourhood area. It advises:

"If a local planning authority is also intending to allocate sites in the same

neighbourhood area the local planning authority should avoid duplicating

planning processes that will apply to the neighbourhood area. It should work

constructively with a qualifying body to enable a neighbourhood plan to make

timely progress. A local planning authority should share evidence with those

preparing the neighbourhood plan, in order for example, that every effort can

be made to meet identified local need through the neighbourhood planning

process."

4.14 Paragraph 044 provides guidance as to whether a neighbourhood plan can

allocate additional or alternative sites to those in a Local Plan. It says:

"A neighbourhood plan can allocate additional sites to those in a Local Plan

where this is supported by evidence to demonstrate need above that identified

in the Local Plan.

A neighbourhood plan can propose allocating alternative sites to those in a

Local Plan, but a qualifying body should discuss with the local planning

authority why it considers the Local Plan allocations no longer appropriate.

The resulting draft neighbourhood plan must meet the basic conditions if it is

to proceed. National planning policy states that it should support the strategic

development needs set out in the Local Plan, plan positively to support local

development and should not promote less development than set out in the

Local Plan or undermine its strategic policies (see paragraph 16 and

paragraph 184 of the National Planning Policy Framework). Nor should it be

used to constrain the delivery of a strategic site allocated for development in

the Local Plan.

Should there be a conflict between a policy in a neighbourhood plan and a

policy in a Local Plan, section 38(5) of the Planning and Compulsory

Purchase Act 2004 requires that the conflict must be resolved in favour of the

policy which is contained in the last document to become part of the

development plan."

4.15 Paragraph 045 addresses whether a neighbourhood plan should consider

infrastructure. It advises:

"A qualifying body may wish to consider what infrastructure needs to be

provided in their neighbourhood area alongside development such as homes,

shops or offices. Infrastructure is needed to support development and ensure

that a neighbourhood can grow in a sustainable way.

The following may be important considerations for a qualifying body to

consider when addressing infrastructure in a neighbourhood plan:

what additional infrastructure may be needed to enable development

proposed in a neighbourhood plan to be delivered in a sustainable way;

how any additional infrastructure requirements might be delivered;

what impact the infrastructure requirements may have on the viability of a

proposal in a draft neighbourhood plan and therefore its delivery;

what are the likely impacts of proposed site allocation options or policies

on physical infrastructure and on the capacity of existing services, which

could help shape decisions on the best site choices.

Qualifying bodies should engage infrastructure providers (e.g. utility

companies, transport infrastructure providers and local health commissioners)

in this process, advised by the local planning authority."

4.16 Paragraph: 046 advises on what a qualifying body should do if it identifies a

need for new or enhanced infrastructure? It says that it should set out in the

draft neighbourhood plan the prioritised infrastructure required to address the

demands of the development identified in the plan.

4.17 Paragraph 066 advises that

"Throughout the process of developing a neighbourhood plan or Order a

qualifying body should consider how it will demonstrate that its neighbourhood

plan or Order will meet the basic conditions that must be met if the plan or

order is to be successful at independent examination."

C - Contributing to the achievement of sustainable development

4.18 The UK Sustainable Development Strategy "Securing the Future" describes a

common purpose for Sustainable Development:

"The goal of sustainable development is to enable all people throughout the

world to satisfy their basic needs and enjoy a better quality of life, without

compromising the quality of life for future generations."

4.19 The UK Sustainable Development Strategy 2005 set a new framework for

sustainable development and describes how this should be pursued. Five

Guiding Principles are identified:

Living within environmental limits;

Ensuring a Strong, Healthy and Just Society;

Achieving a Sustainable Economy;

Promoting Good Governance; and

Using Sound Science Responsibly

4.20 The Government’s approach to sustainable development as set out in the

National Planning Policy Framework is about enabling development to cater

for the needs of current generations, ensuring that growth doesn’t mean

worse lives for future generations.

4.21 Paragraph 3 advises that the purpose of the planning system is to contribute

to the achievement of sustainable development.

4.22 Paragraph 7 states that there are 3 dimensions to sustainable development.

These are an economic role (contributing to the economy), a social role

(supporting communities) and an environmental role (protecting and

enhancing the natural and built environment). Paragraph 8 says that these

factors are mutually dependent.

4.23 Paragraph 9 says that sustainable development includes making it easier for

jobs to be created, replacing poor design with better design and widening the

choice of high quality homes.

4.24 Paragraph 14 says that there is a presumption in favour of sustainable

development. For plan making this means that:-

Local planning authorities should positively seek opportunities to meet the

development needs of their area;

Local Plans should meet objectively assessed needs, with sufficient

flexibility to adapt to rapid change, unless:

o any adverse impacts of doing so would significantly and demonstrably

outweigh the benefits, when assessed against the policies in the

Framework taken as a whole; or

o specific policies in the Framework indicate development should be

restricted.

4.25 Paragraph 15 says that policies in Local Plans should follow the approach of

the presumption in favour of sustainable development so that it is clear that

development which is sustainable can be approved without delay. All plans

should be based upon and reflect the presumption in favour of sustainable

development, with clear policies that will guide how the presumption should be

applied locally.

4.26 Paragraph 16 says that the application of the presumption will have

implications for how communities engage in neighbourhood planning.

Critically, it will mean that neighbourhoods should:

develop plans that support the strategic development needs set out in

Local Plans, including policies for housing and economic development;

plan positively to support local development, shaping and directing

development in their area that is outside the strategic elements of the

Local Plan; and

identify opportunities to use Neighbourhood Development Orders to

enable developments that are consistent with their neighbourhood plan to

proceed.

4.27 Paragraph: 072 of the NPPG advises on what a qualifying body must do to

demonstrate that a draft Neighbourhood Plan or Order contributes to

sustainable development. It emphasises the planning principle that all plan-

making and decision-taking should help to achieve sustainable development.

It further advises that:

"A qualifying body must demonstrate how its plan or Order will contribute to

improvements in environmental, economic and social conditions or that

consideration has been given to how any potential adverse effects arising

from the proposals may be prevented, reduced or offset (referred to as

mitigation measures).

In order to demonstrate that a draft neighbourhood plan or Order contributes

to sustainable development, sufficient and proportionate evidence should be

presented on how the draft neighbourhood plan or Order guides development

to sustainable solutions. There is no legal requirement for a neighbourhood

plan to have a sustainability appraisal. However, qualifying bodies may find

this a useful approach for demonstrating how their draft plan or order meets

the basic condition. Material produced as part of the Sustainability Appraisal

of the Local Plan may be relevant to a neighbourhood plan."

The Current Position in Fylde

4.28 As part of the Emerging Local Plan preparation process, a combined interim

Sustainability Appraisal (SA) and Strategic Environmental Assessment (SEA)

was undertaken. The SA process commenced with pre-scoping consultation

undertaken in November 2005. Following this an SA Scoping Report was

prepared in 2006 which was also consulted upon. Subsequently all work was

delayed on the Local Plan (formerly the Local Development Framework

(LDF)) by the need to produce additional evidence-based studies and the

availability of resources. In 2010 an updated SA Scoping Report was

prepared (that took into consideration all previous consultations) and was

issued to statutory consultees. An interim SA report accompanied the Issues

and Options paper published for consultation in June 2012. This sustainability

appraisal has informed this paper.

How we have addressed sustainability in appraising potential options

for the NDP

4.30 Before a decision is made on the scope of the NDP in terms of issues to be

addressed and the nature of policies to be included it would be premature to

commence a formal SA process, including a request to Fylde Borough Council

for a “Screening Determination”. Instead we have appraised each option in

terms of its potential contribution to meeting the requirements of the “Egan

Sustainability Wheel”. This is a useful tool to gain a broad indication of

whether and how a specific policy option can contribute to the sustainability of

the town.

The Egan Sustainability Wheel

4.31 Egan (2004) identifies sustainable communities as meeting the ‘diverse needs

of existing and future residents, their children and other users’ through

promoting opportunity and choice. At the heart of the process of being

sustainable is:

making effective use of natural resources

enhancing the environment

promoting social cohesion and inclusion and

strengthening economic prosperity

4.32 He introduced what is referred to as the ‘Egan Wheel’ (see above), which can

be used as a tool for judging sustainable communities.

The Eight Strands2

Governance - When decisions are made about a community, local people

are included in the decision-making process. The community enjoys a

sense of civic values, responsibility and pride.

Transport and Connectivity - The transport facilities, including public

transport, help people to travel within and between communities and

reduce dependence on cars. There are facilities to encourage safe local

walking and transport.

Services - High quality services for families and children. A good range of

affordable public, community, voluntary and private services that are

accessible to the whole community.

Environmental - Actively seek to minimise climate change (e.g. people

are encouraged to recycle and save water, live in homes that do not

waste electricity and that are built on waste land so that no new

forest/fields are destroyed).Create cleaner, safer and greener

neighbourhoods (e.g. by reducing litter and graffiti, and maintaining

pleasant public spaces).

Equity - People of all ages, races, cultures, sexes and abilities are given

access to services, jobs and education in the community. This fairness is

not a luxury; it is normal to everyone. This fairness lasts to provide

opportunities for future generations.

Economy - Local people have the opportunity to make money and have a

good quality of life. They are encouraged to open small businesses and

spend their wages locally to help improve other people’s businesses.

Successful businesses create more jobs for more people, and better

standards of living for more people in the community.

Housing & Built Environment - A sense of place. Buildings are

attractive, safe and useful to the people who use them. Buildings that

people want to go into. Lots of open space for people to play and relax.

Social & Cultural - A community spirit is created. People are always

welcome to join events. Neighbours look out for one another, and people

respect each other. All people are treated fairly. There are low levels of

crime, drugs and anti-social behaviour with viable, effective and

community friendly policing.

4.32 This report uses the Egan Wheel to assess each option to determine its

contribution to sustainability. Where relevant, it also draws on the

sustainability appraisal work already carried out in support of the emerging

Local Plan.

D - General conformity with the strategic policies contained in the

development plan

4.33 Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires

that:

“where in making any determination under the planning Acts, regard is to be

had to the development plan, the determination shall be made in accordance

with the plan unless material consideration indicates otherwise."

4.34 The Development plan for Fylde Comprises the following:

Saved policies of Fylde Borough Local Plan, adopted May 2003. i.e.: All

were saved except Policy TR9 : Car Parking within New Developments;

Saved policies of Alterations Review to the Fylde Borough Local Plan,

adopted October 2005. i.e.: All were saved except Policy HL1: The

Quantitative Housing Issue / Affordable Housing;

Saved Policy 29 of the Joint Lancashire Structure Plan 2001-2016: Sites

for Gypsy and Traveller Families, adopted March 2005;

Joint Lancashire Minerals and Waste Development Framework Core

Strategy Development Plan Document, adopted February 2009; and

Joint Lancashire Minerals and Waste Local Plan: Site Allocations and

Development Management Policies, adopted September 2013.

4.35 Paragraph 215 of the NPPF indicates that relevant policies in existing plans

will be given weight according to their degree of consistency with the NPPF.

4.36 The development plan context is set out in detail in the Neighbourhood Profile,

with the main principles set out in Chapter 3 and detailed guidance in the

subsequent 'thematic' chapters of that document.

The emerging Local Plan

4.37 The Fylde Borough Local Plan is dated, and work is advancing on its

replacement which will look at the period to 2030. The Fylde Local Plan to

2030 will consist of the following documents:

Fylde Local Plan to 2030: Part 1

Fylde Local Plan Part 2: Site Allocations to 2030.

4.38 The Local Plan to 2030: Part 1 is currently under preparation and is scheduled

to be adopted in April 2015. The Local Plan will be informed by a

comprehensive evidence base. A consultation exercise was undertaken over

summer 2013 on the ‘Preferred Option’ of the Part 1 to this Plan which

included strategic locations for development.

4.39 The emerging Local Plan is in its early stages. The level of “weight” attached

to policies in the Local Plan Preferred Options in the determination of planning

applications will vary by policy, depending on the number and nature of

representations received during the recent consultation. As the plan

progresses, greater weight can be attached.

4.40 The timescale for preparing the Fylde Local Plan to 2030: Part 1 has already

slipped significantly. It is unclear at this stage whether or not there will be

further delay. This does emphasise the potential benefit to St. Anne's in

ensuring that it has an up to date development plan in place for its area. It

does however present a logistical problem for the preparation of the

Neighbourhood Development Plan, in that, it is likely that policies will be

revised further down the line; making it difficult to ensure that policies in the

Neighbourhood Development Plan align with, do not duplicate and conform

with the emerging Local Plan.

Minerals and Waste

4.41 The Joint Lancashire Minerals and Waste Local Plan contains mineral and

waste specific policies for use in determining planning applications for waste

or quarry developments in Lancashire, including those areas administered by

the Unitary Authorities of Blackburn with Darwen Borough Council and

Blackpool Borough Council (the Joint Plan area). The Local Plan forms part of

an area's development plan.

4.42 The Minerals and Waste Local Plan contains the following documents:

Core Strategy: Sets out the long-term spatial vision for the local planning

authority area, the spatial objectives, and outlines the strategic policies

required to deliver that vision.

Site Allocations and Development Control Policies: Policies will identify

specific locations for development, any specific requirements for individual

proposals, and a series of criteria-based policies which ensure that all

development within the area meets the spatial vision and spatial

objectives set out in the Core Strategy.

Other Planning Documents

4.43 Fylde Borough Council operates an Interim Housing Policy (Revised 13th

February 2013) to inform decisions on planning applications for housing. It

should be noted that this is an informal document and does not form part of

the development plan for the Borough.

4.44 Fylde Borough Council has adopted a number of Supplementary Planning

Guidance (SPG) notes, which are not part of the development plan but

provide planning guidance and are used in making development management

decisions. The SPGs relevant to St. Anne's are:-

4.45 This report (see Section 5) assesses each option in relation to its compliance

with the adopted Local Plan but also, where appropriate, with the Fylde Local

Plan to 2030: Part 1, in order, as far as possible, to 'future proof' the approach

recommended by that option

Strategic Environmental Assessment (SEA)

4.46 The National Planning Practice Guidance (NPPG) (para 27) advises that:

"In some limited circumstances, where a neighbourhood plan could have

significant environmental effects, it may fall within the scope of the

Environmental Assessment of Plans and Programmes Regulations 2004 and

so require a strategic environmental assessment. One of the basic conditions

that will be tested by the independent examiner is whether the making of the

neighbourhood plan is compatible with European Union obligations (including

under the Strategic Environmental Assessment Directive).

Whether a neighbourhood plan requires a strategic environmental

assessment, and (if so) the level of detail needed, will depend on what is

proposed in the draft neighbourhood plan. A strategic environmental

assessment may be required, for example, where:

a neighbourhood plan allocates sites for development

the neighbourhood area contains sensitive natural or heritage assets that

may be affected by the proposals in the plan

the neighbourhood plan may have significant environmental effects that

have not already been considered and dealt with through a sustainability

appraisal of the Local Plan."

4.47 Paragraph: 028 offers guidance on determining if a draft neighbourhood plan

might have significant environmental effects. It says:

"To decide whether a draft neighbourhood plan might have significant

environmental effects, its potential scope should be assessed at an early

stage against the criteria set out in Schedule 1 to the Environmental

Assessment of Plans and Programmes Regulations 2004.

The local planning authority should put in place a process to provide a

screening opinion to the qualifying body on whether the proposed

neighbourhood plan will require a strategic environmental assessment. The

qualifying body should work with the local planning authority to be sure that

the authority has the information it needs in order to provide a screening

opinion.

When deciding on whether the proposals are likely to have significant

environmental effects, the local planning authority should consult the statutory

consultation bodies. Where the local planning authority determines that the

plan is unlikely to have significant environmental effects (and, accordingly,

does not require an environmental assessment), it should prepare a statement

of its reasons for the determination. Where a statement of reasons is provided

in respect of a neighbourhood plan a copy of the statement should be

provided to the qualifying body in order that the statement can be made

available to the independent examiner. For example by including it in the

basic conditions statement.

Where a neighbourhood plan is likely to have a significant effect on the

environment a strategic environmental assessment must be carried out."

4.48 Paragraph: 029 advises on when a plan-maker should start producing a

strategic environmental assessment. It says:

"Where a neighbourhood plan requires a strategic environmental assessment,

work on this should start at the same time that work starts on developing the

neighbourhood plan. This is so that the processes for gathering evidence for

the environmental report and for producing the draft neighbourhood plan can

be integrated, and to allow the assessment process to inform the choices

being made in the plan."

4.49 Paragraph: 030 advises on the level of detail is required in a strategic

environmental assessment. It says:

"The strategic environmental assessment should only focus on what is

needed to assess the likely significant effects of the neighbourhood plan. It

should focus on the environmental impacts which are likely to be significant. It

does not need to be done in any more detail, or using more resources, than is

considered to be appropriate for the content and level of detail in the

neighbourhood plan."

4.50 Paragraph 031 advises on who is responsible for ensuring that the strategic

environmental assessment requirements have been met. It says:

"It is the responsibility of the local planning authority to ensure that all the

regulations appropriate to the nature and scope of a draft neighbourhood plan

submitted to it have been met in order for the draft neighbourhood plan to

progress. The local planning authority must decide whether the draft

neighbourhood plan is compatible with EU obligations (including obligations

under the Strategic Environmental Assessment Directive):

when it takes the decision on whether the neighbourhood plan should

proceed to referendum; and

when it takes the decision on whether or not to make the neighbourhood

plan (which brings it into legal force).

A qualifying body should make every effort to ensure that the draft

neighbourhood plan that it submits to the local planning authority:

meets each of the basic conditions;

has been prepared in accordance with the correct process and all those

required to be consulted have been; and

is accompanied by all the required documents.

The local planning authority should discuss the steps that the qualifying body

needs to take and what needs to be produced in order to comply with the

Environmental Assessment of Plans and Programmes Regulations 2004 as

part of meeting its duty to advise or assist the qualifying body with

neighbourhood planning.

The local planning authority should consider what further assistance it can

provide to help a qualifying body comply with the regulations, for example

making available information and evidence that may help a qualifying body

that is preparing the report."

4.51 Paragraph 032 advises on how the strategic environmental assessment

process should be applied to neighbourhood plan preparation.

4.52 Each option set out in the Option Appraisal Matrix accompanying this paper

has been assessed in relation to any potential requirement for environmental

assessment and impact on 'European' protected sites/species. This is

indicative only for the purposes of establishing the initial scope of the NDP.

The actual requirement for SA/ SEA can only be determined following a

request to Fylde BC for a screening determination which should be a key first

step in the next stage of preparing the NDP.

5.0 Issues and options

How the Option Appraisal was undertaken

5.1 Options have been developed to seek to address each of the issues identified

(see section 3 above for the process undertaken to identify the issues). The

identified options have been developed and appraised through discussion at

the Theme Groups, taking into account the wider consultation.

5.2 Where appropriate, each key issue has been appraised to identify more

specific 'sub issues'. Each sub issue has then been appraised to determine

potential options. Although not specifically listed in the Option Appraisal

Matrix, a 'do nothing' option has been considered for each issue.

5.3 Each option has been assessed against a range of criteria, which sought to

determine:

1. its 'fit' with the plan aims and objectives.

2. whether it meets the 'basic conditions'.

3. its resource and cost implications.

4. whether or not it would potentially require SEA3 or detailed SA.

5. whether or not the issue is best addressed by inclusion of a policy/policies

in the main NDP; inclusion in the Implementation Plan; not addressed at

all in the NDP; or requires more work before options can be developed or

adequately appraised.

5.4 The specific appraisal criteria are:

5.5 The option appraisal sets out two main Scenarios for preparing the NDP:

Strategic Issues/ Risks to Consider

5.6 It is unclear at this time whether the emerging Local Plan will be further

delayed. This presents something of a logistical problem for the Town Council

in deciding which 'scenario' approach to take and even which policies to

include in the NDP. Whilst the Town Council might not wish to unnecessarily

duplicate policies that Fylde BC might be likely to include in the emerging

Local Plan or undertake work that Fylde BC is likely to undertake', the exact

content of the new Local Plan Part 1 cannot be precisely known at this stage

and adoption of Part 2 (Site specific and development management policies)

is some way off. There is a risk that the NDP might become out of step with

the new Local Plan. The absence of an up to date development plan may

mean that there is ongoing risk of speculative development, occurring in

places, and of a type or quality, that does not meet the Community's needs

and aspirations if the Local Plan is delayed

Other potential risks include:

1. That the Plan does not achieve a 'yes' vote in the required referendum;

2. That it is not found to meet the 'basic conditions at Examination;

3. That costly and time consuming environmental assessment or detailed

sustainability appraisal is required - although this risk can be lessened by

close liaison with (and formal screening by) Fylde BC;

4. Fylde BC is unlikely to make rapid progress with CIL before the next

election. What will happen if the introduction of CIL is significantly

delayed? At the very least that would have major implications for the

implementation of the NDP. There is also risk that CIL regime may

change after the next general election.

Potential Resource and Financial Costs

5.7 The Town Council needs to give careful consideration as to how its chosen

approach to neighbourhood planning would be resourced. There are

significant potential costs e.g. producing a design guide. Consideration should

also be given to the resource implications arising from the implementation

stage.

Implementation Plan

5.8 Whichever 'scenario' approach is taken, an Implementation Plan will be

required. This will be needed to manage and develop the implementation of

the policies as well as related complimentary (non land use planning) actions:

6.0 Issues and Options Appraisal Outcomes

6.1 The results or our Issues and Options Appraisal are set out in a series of

Appendices as follows:

Appendix 1: sets out the full issues and Options appraisal matrix;

Appendix 2: sets out the Issues and Options which could be addressed as

part of the “NDP Lite Scenario”;

Appendix 3: sets out Issues and Options which could be addressed as part of

the Comprehensive Sustainable NDP;

Appendix 4: Sets out those Issues which are not considered appropriate to

include in the NDP or Implementation Plan.

7.0 The Next Steps

7.1 This report has identified a number of options that the NDP could address.

Preferred options have been identified. The Town Council also has the benefit

of the existing evidence base, examined in the Neighbourhood Profile, and the

information from the initial community consultation and engagement with

stakeholders. Taking this information, the Town Council has a number of

decisions to make. These are set out below:

1. Whether or not to proceed with the NDP - A balanced judgement needs to

be made as to whether or not it would be beneficial to proceed with

seeking to progress an NDP. Our advice in this respect is that, from the

evidence presented, there is a compelling case to proceed. The Town

Council does however need to take a clear view as to how this would be

resourced. In doing so, consideration should also be given to the resource

implications arising from the implementation stage;

2. Whether or not there is justification for the making of a Neighbourhood

Development Order (NDO) or Community Right to Build Order (CRtBO) -

this report (and work undertaken in the preparation of the Neighbourhood

Profile) has not identified any specific benefit from the making of an NDO

or CRtBO. The Town Council needs to be satisfied that there is no

compelling reason to utilise these important neighbourhood planning

tools. These tools could of course be used at a future stage, should the

need arise;

3. Whether non-NDP planning measures are needed - this could include

further input into the Fylde emerging Local Plan, input into planning

guidance etc;

4. Which scenario approach to proceed with, i.e.

NDP lite

NDP Comprehensive

This has great significance in determining the scope and potential impact

of the NDP. It is for the Town Council to decide which issues it thinks can

be best addressed through the NDP. The Town Council may make a

reasoned judgement to proceed with some or all options in each scenario,

or even a variation e.g. the 'lite' approach but some of the options from the

'comprehensive' approach;

5. Composition of the Implementation Plan - Consideration needs to be

given to the matters that would best be covered in the Implementation

Plan, its scope and how its delivery will be managed and resourced;

6. Determine if Sustainability Appraisal (SA) /Strategic Environmental

Assessment (SEA) required - Once the scope of the Draft Plan is

determined an assessment needs to be carried out to determine any

further requirements for SEA/SA. A formal screening opinion should be

sought from Fylde BC. Before doing so, the Town Council needs to take a

clear view as to how it wishes to approach the key strategic issues e.g.

housing land allocation.
