Distingueshed Guests, Ladies and Gentlemen:I am pleased to be here, on behalf of Ministry of Justice the Republic of Turkey.We are honored to take part in this Summit by reason of presenting our Project UYAP, namely National Judiciary Informatics System.I am reporter judge in ministry of Justice since 2003, before 2003 I worked as a criminal judge approximitly 10 years long in differents cities. since December 2007 also I am member of e- goverment advisory groups which established in prime ministry of turkey this groups aim is to accelarate the e -goverment projects in turkey

The "Crystal Scales of Justice" 2008 Edition

• Following the jury meeting of the Prize "The Crystal Scales of Justice", which was organised in Brussels on 2 October 2008, the jury selected the 4 following projects (presented in the alphabetical order by country): – Barreau de Paris" (France); – Court of Milan (Italy);– Ministry of Justice UYAP(Turkey) ;– HCMS, The Small Claims Mediation Service (United Kingdom)

• Among this selection, one project awarded the Prize "The Crystal Scales of Justice", the three others awarded a "special mention".

• As for the previous editions, the jury decided to keep secret the name of the winner until the Award ceremony in Catania, Italy (24 October 2008).

• The 4 selected projects will be invited in Catania by the European Commission.

WHAT IS UYAP ?

The Ministry of Justice has prepared an “National Judiciary Informatics System (UYAP)”, to achieve establishing a information system between the Courts and all other judicial institutions and Ministry, including prisons. Before UYAP equipped these institutions with computers, network and internet connection UYAP have central filing system. Structure is central.All servers are in Ankara. All data flow in to central units. Data standards and data standardization improved data quality and enabled reliable operational and management reporting system.

Average duration of assize in Turkey is very lengthy (excessive).Processes keep up around about one year in courts. administrative processes continue more then one year in Council of State Times of the Judgement (Decision making) elongates (uzatmak) incessant (sürekli) in Turkey. A draft Product Breakdown Structure is shown with a note on critical products below;1. A business process model for TJS analysing the inputs, outputs, controls policies, procedures and resources, staff roles,for each level of process2. A verified functional requirements catalogue, derived (elde etmek) from and traceable to the business process model and the articles in the laws.3. A non functional requirements catalogue (we defined audit and security requirements and performence requirements4. Delivered software which is tested and meets the quality criteria determined by project board 5. Deployment of the delivered software on the UYAP infrastructure in a phased implementation across Turkey6. Training of our users in the effective use of the delivered and deployed software7. putting into operation NJNP first of all in 30 pilot units than plus 12 units The first studies concerning this project started in 1998. First, fixed idea infrasubtructure studies on the set up of the computer system were done. Also as a result of the reorganization study in the structure of Ministry of Justice, Personnel General Directorate, at the end of 1999 Data Processing Department Presidency was founded. Later on, by contacting the technology companies, by deciding which data technologies shall be used, it was believed that it will be better to carry out this work in one item. This work which was started as one part of e–State, as of year 2000, the name National Judicial Network Project (NJNP) was given.As parallel to the developments in computer technology, it appeared in the aim of meeting the need of reaching the information directly, in a secure and fast sort. The project was considered in two phases. 1. phase includes Minstry of Justice Center Organization automation. In this scope, establishment of a central system was finished for the all the units’ works such as personnel, budget, health, administrative and financial works in the Ministry Central, works which concern all the units and besides that for caryying out the tasks given to them by Law, for doing the processes in the electronic environment special to the units. Immediately beside this general system concerned with the task and administrative works, a Document Management System (DMS) was also established which includes all the units of Ministry, which gives the opportunity to make the correspondence in electronic environment in a central structure. It was provided to make the correspondence of DMS which was founded in the centre and units which were put into operation later on, their correspondence with Centre and each other, in the electronic environment. 1. Phase of the Project was put into operation in 2001 by completing entirely.II. phase of NJNP is the automation of the provinces units. In the II. phase, 30 pilots and test units were chosen, the necessary studies were done on these pilots and test units. NJNP implementation softwares has been started to be used on Pilot and test units since February, 2004. As of 10.10.2005, Wide Area Network (WAN) connection was made in 54 the provinces organization, it went into action, until the end of 2005 it will go into action by connecting to Wide Area Network in the scale of state in all the High Criminal Centre units. As it is shown above, as of 16.10.2005 16 High Criminal Centres, in 4 District Administrative Tribunals, 9 Penitentiaries were taken into operation. In these courthouses where NJNP is being used, 299.149 law cases, 234.418 criminal cases, 295.341 administrative cases and 656.912 legal medicine dossiers, 2.539.558 execution cases have started to be implmented as being registered to the system.

All judiciary units were connected with each other via sole central network. This connection was provided through territorial lines and satellite. These connection types are the substitutes for each other. Cable was laid in 807 units to deliver 45.778 connection points across Turkey. There are 35.298 activated users in the domain. Satellite devices were set up in 643 units in order to ensure continious connection .

• As a recent development, after reaching and agreement with the GSM operators; text messages containing information about the case files can be sent to the parties of cases, who need to be warned to attend court. All documents, processes and files are standardised:

• Before UYAP courts and other judicial units have being writen the writs one by one. After UYAP similar writs are being writen through stencils.

• Due to standart and ready forms, all the data are filled automatically into the documents like instructions, indictmans, hearing minutes, decision and others so as to finish cases faster and more efficient and not to wait for days.

• It is nearly saved on labour force by 30 % In the past it took so many times to prepare all the documents durıng the case or hearing but now it takes only minutes and it provide us speed and reliance.

ELECTRONIC SIGNATURE

• After the enactment of the Law on Electronic Signature, the Ministry of Justice has reached an agreement with the public e-signature provider, for the delivery of the 30.000 e-signatures for judges, prosecutors and staff until the end of June 2008.

• Until now, 33.493 personnel have applied for the e-signature and 16.811 of them have been given their e-signature.

• It was required by a regulation by the Ministry of Justice that documents will no longer be circulated physically among the judicial units after 01.07.2008.

• All the documents will be required to be sent only in the electronic environment, which are signed by e-signature.

INTEGRATING WITH THE EU

• The UYAP database can be connected to the central databases of the EU or member states and can form a broadened network in which European courts can benefit from.

• In the near future it will be possible to bridge UYAP with the backbone networks such as TESTA and other EU member countries’ systems.

• Achieving this goal will result in secure and swift transition of international requests such as rogatory letters, extradition matters and transfer of sentenced persons.

• Apart from these, UYAP case and document management system and word processor software were designed to be independently used by other judicial systems.
