Its partnership with Local Government Unit - PanaboCity stems from its social response to the provi­s ions on the United Nations Convention on the Rights of the Child (UNCRC) which was ratüied by the Philip­pines in August 21, 1990.

By ratifying the Convention (provi­sions), the Philippines became a state party which means that it is committed itself to un­dertake all appropriate measures to ensure that the child is pro-

With the forego­ing, appreciative of the situation of the margi.nalized children in Panabo City, then Mayor Atty. Jose Silvosa sought the assistance of the Ger­man Mariphil Asso­ciation and the Fili­pino Mariphil Foun­dation in 2009 to have a collaborative development inter· vention to children in need of special protec-

The German and Philippine MARIPHIL Foundations are both acknowledged as Non­profit and Non-stock Organizations and co­operate successfully regarding develop­ment aid since 1998. The Association oper­ates in the areas of Panabo City and Car­men in the region of Davao del No;rte, Mindanao. According to the slogan of the Association "Future for Children" it fo­cuses on the help for children in need es­pecially regarding the access to education (scholarships, school renovations, educa­tional programs etc.) and health care (fi­nancing of Opera­tions, provision of medicine etc.). Pres­ently, it has more than 200 indigent scholars within the area of Panabo and Carmen.

Other programs of the MARIPHIL As­sociation, for exam­ple a Rice Farmer's Cooperative, the pro­vision of solar pow­ered water tanks and the annual distribu­tion of rice during Christmas season aim to improve the general living Situa­tion of indigent peo-

The Mariphil Children's Village was opened in 2012 and it was licensed and accredited in 2013 by the Department of Social Welfare and De­velopment Field Of­fice RO XIto operate as a welfare and de­ve lopment agency implementing resi­dential care services and programs to dis­advantaged children, youth and children in conflict with the law.

In deference to COA's observation, the Mariphil Children's Village posits that the subsidy of the City Government of Panabo does not constitute loss and wastage of money which caused injury to its coffer.

Said amount was utilized for public pur­pose - the provision of appropriate social serv­ices to children in need of special protection which is the pr~ordial role of the city gov­ernment of Panabo concretized by the Mariphil Children's Village.

The personnel of the Mariphil Children's Village are instrumental to the fulfillment of the pubHc purpose. The social services will only be felt by the children beneficiaries through the human capital managing and fa­cilitating the services.

This administrative cost as pointed out in the AOM is necessary or relevant in ad-vancing the public interest. ·

Philippines in the case of Ramon R. Yap vs. Commission Audit, GR No. 158562, April 23, 2010 elaborates the nature and mean­ing of the term public purpose, in relation to disbursement of public funds, to wit:

"As understood in the tra.­ditional sense, public purpose or public use means any purpose or use directly available to the general public as a matter of right. Thus, it has also been de­fined as an activity as will serve as benefit to [the) community as a body and which at the same time is directly related function of government.However, the con­cept of public use is not limited to traditional purposes. Here as elsewhere, the idea that public use is strictly limtted to clear cases of use by the public has been discarded. In "fact, this Court has already categorically stated that the term public pur­pose is not defined, since it is an elastic copcept that can be hammered to fit modern Stand­ards. It should be given a broad interpretation; therefore, it does not only pertain to those pur­poses that which are tradition­ally viewed as essentially gov­ernment functions, such as build-

ing roads and delivery of basic services, but also in­cludes those purposes de­signed to promote socialjus­tice.

Thus, public money may now be used for the relocation of illegal settlers, low-cost housing and urban or agrarian reform. In short, public use is now equated with public inter­est, and that it is not un­constitutional merely be­cause it incidentally ben­efits a 1imited number of persons."

Here, Mariphil Chil­dren's Village fulfills the mandate of the government which is to aid those chil­dren in need of special pro­tection. The village was able to provide shelter, psycho­social support, education, basic needs (Le clothing, food, medicine, etc) and nurturing environment to more than 100 physically / sexually abused, neglected, orphan and children in con­flict of the law, among others. These services are impressed with public inter­est, thus, fall within the ambit of public service ..

lt must be noted that the subsidy of the City Government represents approximately 30% of the total yearly expenses. lt is the German Mariphil Association and the Filipino Mariphil Asso­ciation that share the most. In this partnership, the obligation of the City Government of Panabo under the Triparty Agreement is advantageous and economical to the government.

As recipient of public funds, Mariphil Children's Village is mindful and conscious of this fundamental principle: "Public funds are the property of the peo­ple and must be used prudently . at all times with a view to pre­vent dissipation and waste".

Mariphil Children's Village hopes to shed light to the on­going issues pertaining to this undertaking entered into by the City Government of Panabo through its late Mayor Jose Silvosa.

lt belieyes that the City Gov­ernment of Panabo shall continue the partnership. It must act as parenspatriae to protect the chil­dren, who because of their cir­cumstances, are being prejudiced and discriminated.It is called upon to manifest an attitude of caring for the welfare of the marginalized children.

As to Mariphil Children's Village, its existence is meant to bring the marginalized youth into the folds as it affirms the vital role of the youth in nation build­ing (RA 8044).
