1.0 INTRODUCTION

Advertising signage has become a major visual element in the contemporary urban environment. It characterises many shopping centres and shopping streets in our city. However, many streetscapes are dominated by the proliferation of signage that detracts from the scenic quality of the area. The commercial areas of Parramatta Road, Burwood Town Centre, Strathfield Town Centre, Enfield Shopping Centre, Georges River Road (Croydon Park) and The Strand, Croydon within the Burwood Council area have different levels of signage and different signage opportunities. In general, however, the buildings in an area should be the predominant feature and not signage, which should be deferential to the built form. This DCP contains guidelines relative to the appropriate placement of signage in all areas of the Burwood local government area.

1.1 Date of Adoption

Development Control Plan No 9 - Advertising Signs (Amendment No 1) was adopted by Council on 25 September 2001 and came into force on 10 October 2001.

1.2 Citation

This plan may be cited as Burwood Development Control Plan No. 9 for Advertising Signs.

1.3 Application

This plan applies to the whole of the Burwood Local Government Area.

1.4 Relationship with other plans

The relevant provisions of the Burwood Planning Scheme Ordinance must be fulfilled in any application for signage in the Burwood Council area. In particular, the zoning table gives information about the types of development permissible and prohibited in each zone. Under the Burwood Planning Scheme Ordinance (as amended by Burwood Local Environmental Plan No. 47, 2001) particular developments meeting certain criteria are exempt from the necessity of obtaining formal Council approval. These developments are called exempt developments, and include the following types of signs (subject to the satisfaction of certain criteria):

Business identification signs in residential areas;

Real Estate signs in residential areas;

Real Estate signs (Advertising premises/land for sale or rent) in specified commercial and industrial areas;

Existing under awning signs;

Non Illuminated Signs Behind Glass Frontage of Shops;

Temporary Signs; and

Top Hamper Sign (non-illuminated).

The relevant exempt provisions and the exemption criteria for each sign is contained within Appendix 1 of this DCP. In addition, reference should be made to Development Control Plan No. 12 for Exempt and Complying Development for further information in relation to exempt developments.

1.4.1 State Environmental Planning Policy No. 64 – Advertising & Signage

State Environmental Planning Policy (SEPP) No. 64 – Advertising and Signage was gazetted on 16 March 2001 and regulates advertising and signage in NSW. The following extract from the SEPP demonstrates its parameters. 6. Signage to which this Policy applies (1) This Policy applies to all signage: (a) that, under another environmental planning instrument that applies to the

signage, can be displayed with or without development consent., and (b) is visible from any public place or public reserve. except as provided by this Policy. (2) This Policy does not apply to signage that, or the display of which, is exempt

development under an environmental planning instrument that applies to it.

State Environmental Planning Policy No. 64 – Advertising & Signage (2001)

Council cannot grant development consent to any applicable signage proposal unless it is satisfied that the proposal is consistent with the provisions of the SEPP. Where possible, relevant sections of the SEPP have been incorporated into this DCP. However, in the case of any inconsistency, the SEPP will override this plan. Please refer to the SEPP and the SEPP 64 Explanatory information published by the Department of Urban Affairs & Planning where proposed signage meets the criteria as set out above.

2.0 AIMS & OBJECTIVES OF THIS DCP

The aims of this DCP are: 2.1 To provide guidelines for the display of signs.

2.2 To ensure that signs preserve and enhance the desired visual and heritage character of the area.

2.3 To ensure that signage is compatible with the desired amenity and desired future character of the area.

2.4 To ensure that signs complement the buildings to which they are attached and their surroundings.

2.5 To prevent excessive signage and visual clutter on and around buildings.

2.6 To promote effective and visually interesting advertising of goods and services within the Burwood area.

2.7 To ensure that signage provides effective communication in suitable locations.

2.10 To ensure that the design and location of signs is visually interesting and integrated with the architecture of the buildings and is of a high quality design and finish.

2.11 To ensure that signs do not affect the amenity of residents, occupiers etc by way of excessive shadow effects and night illumination effects.

2.12 To ensure that community ethics and values are maintained.

2.13 To ensure that access for disabled persons is not impaired.

3.0 DEFINITIONS & REQUIREMENTS

A-frame An advertising signboard or sandwich board displayed on a public

footpath which complies with the following: (a) Not to be located on Burwood Road between Wilga Street and

Belmore Street; (b) Is licensed by Council (see Section 4.14 and Appendix 3); (c) Must be a free-standing A-frame with maximum dimensions of

0.9m high and 0.6m wide with no protrusions, sharp corners and are stable;

(d) The board is located between 0.3m and 1.0m behind the face of the kerb;

(e) The owner must carry public liability insurance of at least $10 million;

(f) There must be a minimum of 1.5 metres clear to any other obstructions on the footpath such as poles, litter bins, seats etc.;

(g) The business and proprietor’s name is to be clearly marked on the sign.

Advertisement means the display of symbols, messages or other devices for promotional purposes or for conveying information, instructions, directions or the like, whether or not the display includes the erection of a structure or the carrying out of a work.

Advertising panel any advertising structure, other than those described below, including a hoarding or bulletin board that complies with the following: (a) Maximum size 12m2 (b) Only one per building facade. (c) Not to extend laterally beyond the wall. (d) Not to project above top of wall. (e) Not to cover any window or architectural feature.

Advertising Structure means any structure used as a backing or support upon which an

advertisement or sign is erected, attached and/or displayed. Business identification sign means an advertisement which, in respect of any place or premises

to which it is fixed, contains any or all of the following and does not exceed 0.8m2 in area: (a) The identification or description of the place or premises,

details of the occupation or activities carried out, or the goods or services provided at the place or premises

(b) Such directions or cautions that are usual or necessary relating to the place or premises or any occupation carried on there

(c) Any notifications required or permitted to be displayed by or under any State or Commonwealth Act

(d) A reference to an affiliation with a trade, professional or other association relevant to the business conducted at the place or premises

Fascia sign a sign attached to the fascia or return of an awning which complies

with the following: (a) Does not project above or below the fascia or return end of the

awning to which it is attached. (b) Does not extend more than 300mm from the fascia or return

end of the awning

Fin sign a sign erected on or above the canopy of a building and complying with the following: (a) Maximum size 4m2.

(b) Does not extend more than 2.6m above the canopy on or above which it is erected.

Flush wall sign a sign attached to the wall of a building (other than the transom of a

doorway or display window) and not projecting more than 300mm from the wall and complying with the following: (a) Only one per building facade for each occupancy of the

premises. (b) Not to occupy more than 20% of the area of the wall. (c) Shall not project above or beyond the wall to which it is

attached Fly Poster means an unauthorised advertisement promoting any event or activity

fixed to power poles, bus shelters or other public property, fences, buildings or hoardings.

Illuminated means designed to be lit by an internal or external artificial source of light.

Painted wall sign a sign painted onto a wall of a building and complying with the following: (a) Only one per building facade for each occupancy of the

premises. (b) Not to occupy more than 20% of the area of the wall.

Pole or pylon signs a sign erected on a pole or pylon independent of any building or other structure and complying with the following: (a) Maximum area 8m2, maximum height 7.5m above natural

ground level except where special circumstances exist. (b) Minimum height above ground level shall be 2.6m above the

ground where it projects. (c) Where more than one pole or pylon sign is provided they

should have the same setback and be of uniform design and spacing.

(d) Should not obscure or detract from any landscaped area provided.

Projecting wall sign a sign attached to the wall of a building (other than the transom of a

doorway or display window) and projecting horizontally more than 300mm and complying with the following: (a) Not to exceed 2.5m in length and 0.5m in depth. (b) Erected at right angles to the building.

(c) Erected horizontal to the ground and at no point less than 2.6m from the ground.

Real Estate Sign An advertisement in respect of any place or premises to which it is affixed, contains only a notice that the place or premises is or are for sale or letting together with particulars of the sale or letting, and: (a) in the case of an advertisement in respect of residential

premises relating to a letting, sale by private treaty or sale by auction, does not exceed 2.5m2 in area; and

(b) in the case of an advertisement in respect of commercial or industrial premises, does not exceed 3.5m2 in area; and

(c) is not displayed for more than seven days after the commencement of the letting or completion of the sale of the premises or place to which the sign relates and displayed for not more than 40 days in total.

Roof sign a sign erected on or above the roof or parapet of a building. School sign A sign located within the boundaries of a school and which are:

(a) not greater than 4m2 in area; (b) not more than 3 m in height from ground level to the top of the

sign; and (c) not more than 3 signs per premises.

Temporary Sign means an advertisement of a temporary nature which:

(a) announces any local even of a religious, educational, cultural, political, social or recreational character or relates to any temporary matter in connection with such an event; and

(b) does not include advertising of a commercial nature (except for the name of an event’s sponsor); and

(c) is not a fly poster or a footpath A frame sign; and (d) is not displayed earlier than 28 days before the day on which

the event is to take place and is removed within seven (7) days after that event.

Top hamper sign a sign attached to the transom of a doorway or display window of a

building and complying with the following: (a) Not to extend more than 200 mm beyond any building

alignment. (b) Not to extend below the head of the doorway or window to

which it is attached.

Under awning sign a sign attached to the underside of an awning (other than the fascia or return end) which complies with the following:

(a) Not to exceed 2.5m in length and 0.5m in depth. (b) Erected at right angles to the building. (c) Erected horizontal to the ground and at no point less than

2.6m from the ground. (d) Not to project beyond the awning. (e) Securely fixed by metal supports. (f) Not closer than 3m from any other under-awning sign. (g) Not closer than 600m to kerb.

Window sign a sign attached to, or displayed on, the shop window and not covering

more than 50% of the window area.

4.0 SIGNS IN ALL AREAS

The guidelines contained within this section apply to all signs and within all areas and are in addition to the particular controls contained within the remainder of this DCP.

4.1 Matters for consideration

Applications for advertising signs will be considered in relation to the controls contained within this DCP; the matters contained within Section 79C of the Environmental Planning & Assessment Act, 1979, as amended; the assessment criteria contained within Appendix 2; and the merits of the individual application. Applications for signage should also consider and document the following additional matters: (a) The number of existing signs on the building and adjacent buildings; (b) The placement of the sign in relation to streetscape, including effect on views and

architectural features; (c) The scale of the sign in relation to spaces, people and other urban elements including

buildings, trees and other signs; (d) The size and shape of the sign; (e) The design of the sign, including size and type of lettering; (f) The materials and construction details of the sign including means of attachment; (g) the colour and reflectivity of the sign; (h) The wording and/or graphics on the sign; and (i) The satisfaction of the aims and objectives contained in Section 2.0 of this DCP.

4.2 Is Development Consent Required?

The zoning requirements of the applicable statutory planning instrument e.g. Burwood Planning Scheme Ordinance, LEPs or DCPs should be consulted to determine whether advertising is permissible.

4.2.1 Signs not requiring Development Consent

Some signage is “exempt development” under clause 24(4)-(5) of the Burwood Planning Scheme Ordinance (as amended by LEP No. 47 – 27 October 2000). This means that development consent is not required in certain circumstances. Please refer to Schedule 10 of the Planning Scheme Ordinance (reproduced in Appendix 1 of this DCP) to determine the types of signage and the criteria for exemption, and discuss your signage plans with Council staff prior to commencing any works. The following signs are exempt development under the provisions of the Burwood Planning Scheme Ordinance, as amended by Burwood Local Environmental Plan No. 47): (a) Business Identification Signs in Residential areas (b) Real Estate signs in residential areas and specified commercial and industrial

premises (c) Replacement of advertising panels on existing under awning signs (d) Non illuminated signs behind glass frontage of shops (e) Temporary signs (f) Top hamper signs (non-illuminated) Refer to Appendix 1 for details of exemption circumstances and requirements for each of the above signs.

4.2.2 Prohibited Advertisement

The following advertising signs are prohibited in the Burwood council area: (a) Roof Signs (b) Fly posters (c) Large advertising balloons (d) Flashing, moving or running signs (e) Advertising on parked cars, trailers, shipping containers, whether or not

registered, where the principal purpose is for advertising.

4.2.3 Existing Non-Conforming Signage

Existing signs not in conformity with this DCP may be retained until replacement is required (due to wear and tear). Any replacement signage is to comply with this plan and will be subject of a new Development Application.

4.3 General Appearance, Content and Maintenance Provisions

Council discourages signs prone to deterioration in appearance and may order removal of redundant, unsightly, dilapidated or objectionable signage. Council may require provision for maintenance of signage and discourages signage on common boundaries where maintenance difficulties could occur.

4.4 Traffic and Pedestrian Safety

Council discourages signs that could cause distraction to motorists in close proximity to traffic lights, pedestrian signs, etc. Signs Facing Roads with High Traffic Volumes, Traffic Lights or major intersections may be referred to the Roads and Traffic Authority (RTA) for comment. Advertising signs greater than 20m2 in area and within 250 metres of a classified road will automatically be referred to the RTA for concurrence prior to a decision being made.

4.5 Illumination and Electrical Wiring

Care needs to be taken to avoid nuisance to adjoining and surrounding residents due to glare and light spillage. Electrical wiring to illuminated signs or spotlights is to be concealed where it would detract from building façade qualities. Moving, flashing or running light signs are not permitted.

4.6 Language

Advertising signs are to be displayed in English but may include a translation in another language in smaller lettering or characters.

4.7 Signs on Council Property

In considering applications for signs in association with public facilities (such as seating, telephone booths, waste bins or bus shelters) careful consideration should be given to where they are placed. Exact location, design and maintenance requirements should be included in any agreement and subject to a Development Application. Council does not favour internally illuminated pole signs, as they are generally too bulky, increase visual clutter and conflict with existing signage and traffic signals.

4.8 Large developments

Signage to large commercial type developments and those that contain multiple tenancies should be the subject of a coordinated approach.

4.9 New developments

Signage to new developments should be incorporated in the architecture of the building or site and approved as part of the original development approval.

4.10 Proportions of signs

Proportions of signs should relate to major architectural elements of the building, including window heads, sills, etc.

4.11 Painted wall signs

Council does not favour the painting of entire building façades as part of a signage application, as such overall colour schemes generally obscure architectural features.

4.12 Major Advertising Panels

Large scale advertising signs are subject to the provisions of SEPP No. 64 and will be assessed with regard to that Policy (see Section 1.4.1 of this DCP). In general, advertising signs greater than 20m2 or higher than 8 metres above ground are considered “advertised development” under the provisions of the Environmental Planning & Assessment Act, 1979 and Regulation 2000. In such cases, the development must be notified and advertised in accordance with the Regulation and a copy must be forwarded to the Director-General of the Department of Urban Affairs & Planning, and where greater than 20m2 and within 250 metres of, and visible from, a classified road, the RTA (in which case, the concurrence of the RTA is required). Advertisements that have a display area of greater than 45m2 are not permissible in the Burwood Council area1.

4.13 Advertisements

The wording on signs is to generally relate to goods and services sold on the premises. Major advertisements on say, Parramatta Road contrary to this requirement will be considered on their merits.

4.14 A-frame Advertising Signboards on Footpaths

Council allows the placement of footpath signs in certain areas. Footpath signs must comply with the requirements for A-frames contained in Section 3.0 of this DCP and must be licensed with Council. Application for a footpath sign shall be made on the form contained in Appendix 3 and submitted to Council for approval. Applications will be processed by Council’s Engineering Department on payment of applicable fees. 1 Consent for advertisements with a display area of greater than 45m2 cannot be given unless a development control plan prepared on the basis of an advertising design analysis has been prepared (clause 19 of SEPP No. 64). No such DCPs are in place for any part of the Burwood Council area.

Applications for footpath A frame signs adjacent to moving traffic will be considered on their merits and signs will be placed in accordance with the approval. Placement of signboards on the footpath will be determined by the assessing officer. All applications for A-frame advertising signboards shall be accompanied by a sketch plan showing placement of the A-frame in relation to the footpath and shopfront. A-frames will only be permitted in front of licensee premises.

5.0 SIGNS IN RESIDENTIAL AREAS

5.1 Matter for Consideration

The provisions of Burwood Planning Scheme Ordinance, as amended, and Exempt & Complying Development DCP No. 12 shall be taken into consideration.

5.2 Controls

Residential Buildings

One commercial sign per site, not exceeding 0.3m2 in area in a Residential 2(a) zone (as per clause 45 of the Burwood Planning Scheme Ordinance) is permissible. Such signs should be located wholly within the property. In special circumstances, consideration may be given to a sign on the fence fronting a main street.

Such signs should be located unobtrusively, so as to appear an integral part of the building or landscaping. A free standing sign where appropriate is to have a maximum height of 1.5 metres. The wording of an advertising sign can only indicate the purposes for which the land, building or work on which it is erected is used (clause 45 of Burwood Planning Scheme Ordinance). Generally, illuminated signs are not permitted. Standard “gate light boxes” or “cubes” are permitted to identify health care professionals.

9.0 SIGNS ON OR IN THE VICINITY OF HERITAGE LISTED PROPERTIES

9.1 General

The provisions of the applicable statutory planning instrument should be consulted for provisions relating to heritage listed properties. Buildings or sites may be listed as heritage items either individually or as part of a group or a conservation area. There are a number of heritage items and conservation areas within the Burwood area recognised by the community as having heritage significance. Any development, including signage, should preserve and enhance the character of these areas. In general, signage other than exempt development, business identification signs and building identification signage is prohibited in heritage areas and conservation areas.

9.2 Controls

Signage should never dominate the architectural features of the building. Advertising should preferably be placed in locations on the building or item, which would traditionally have been used as advertising areas. Opportunities for advertising therefore, may be somewhat limited.

9.3 Traditional Signage Opportunities

Generally, sign panels can be determined by dividing a building into a grid and identifying locations on:

a solid parapet above a cornice

the horizontal panel below a cornice

verandah or awning fascia

notice boards or plaques on ground floor piers/beside entrance doors

small signs on individual architectural elements such as rendered blocks

side walls/party walls able to be viewed above adjacent buildings

9.5 Guidelines

The following additional matters should be taken into consideration in heritage areas and Burwood Town Centre: (a) As the external colours applied in different historical periods varied and were more

limited in range than those available today, it is wise to research appropriate colour ranges for buildings in heritage areas. Generally, however, the following muted colours are suggested dark green, maroon, brown, terracotta, charcoal, etc highlighted with creams, pinks, ochres and earth tones.

(b) Heritage lettering styles may involve shaded letters, the mixing of styles and letters and ornamental scrolls as relevant to the period of the building.

10.0 SIGNS WHICH DO NOT REQUIRE DEVELOPMENT CONSENT

A development application is to be lodged for all outdoor advertisements, other than the following types of signs, which fulfill the requirements listed under Section 3.0 – Definitions & Requirements:

school signs;

temporary signs;

real estate signs;

under awning signs within an existing sign box;

painted fascia signs to shop awnings;

painted top hamper signs to shop premises;

painted window signs to shop premises;

non-illuminated signs behind the glass line of a shop window;

advertisements within a site but not visible from outside of that site.

Notwithstanding the above, all outdoor advertising in heritage areas or on heritage listed properties require the lodging of a development application except exempt development under the provisions of clause 24(4)-(5) of the Burwood Planning Scheme Ordinance, as amended (see Appendix 1).

11.0 SUBMISSION REQUIREMENTS FOR DEVELOPMENT APPLICATIONS FOR SIGNS

The following information is required to avoid delays in processing your application:

Provision of the standard details to amount to a valid Development Application (see Council’s Development Application form).

Drawings of proposed signage including a site plan and elevations: 3 copies are required. ALL DRAWINGS MUST BE TO SCALE. In some cases Council may require perspective drawings and/or a photomontage. Coloured photographs and/or drawings may be submitted with a signage application but only in addition to scale plans and elevations.

Means of structural support or fixing.

The drawings should indicate colours, materials, wording and lettering style.

A coloured photograph or drawing showing any existing signage on the building.

A Statement of Environmental Effects indicating that the requirements of this policy (including an assessment of the proposal in accordance with Appendix 2) have been considered, may be required in some cases.

Shadow diagrams where they project above a building or will overshadow adjoining or nearby buildings.

APPENDIX 1 PLANNING SCHEME ORDINANCE & EXEMPT DEVELOPMENT

The following are extracts from the Burwood Planning Scheme Ordinance, 1979, as amended. It is provided as a guide and not meant to replace the need to read and understand the provisions of the Burwood Planning Scheme Ordinance.

Clause 24(4)-(5) (extract)

Exempt Development 24. (4) Development listed in Schedule 10 is exempt development, except as

provided by subclause (5). (5) Development is exempt development only if: (a) it does not cause interference with the amenity of the neighbourhood

because of the emission of noise, vibration, smell, fumes, smoke, vapour, steam, soot, ash, dust, waste water, waste products, grit or oil or otherwise, and

(b) it complies with any deemed-to-satisfy provisions of the Building Code of Australia relevant to the development, and

(c) it does not contravene any condition of a development consent applying to the land, and

(d) it does not obstruct drainage of the site on which it is carried out, and (e) it does not restrict any vehicular or pedestrian access to or from the

site on which it is carried out, and (f) it is carried out at least one metre from any easement or public sewer

main and complies with the building over sewer requirements of Sydney Water Corporation applying to the land, and
