To commemorateour 40thanniversary,

this book illustrates thedaily operations andstructure of Council 13 –with a respectful nod toour rich history.

40 years ago, Gerald W.McEntee was elected asCouncil 13’s firstExecutive Director. Itwas McEntee whostarted a statewideorganizing campaign in1969 that led the drive toorganize more than75,000 PA public serviceemployees – the largestunion mobilization inAmerican history. Aftercalling for a rally in 1970to pass a collectivebargaining law (Act 195)5,000 people protested in the streets of Harrisburg and the bill was signed into law twomonths later. It was the nation’s first statewide strike against a state government.Employees were finally guaranteed a 40 hour work week, overtime, seniority, grievanceprocedures and health coverage – and they no longer had to fear being fired forbelonging to the ‘wrong’ political party or for attending a union meeting.

In 1981 McEntee became president of our international union (a position he held for 30years) and Ed Keller took over as Council 13’s Executive Director. Keller had helpedMcEntee in that extraordinary organizing drive many years before. Under Keller’sreign Sen. Bill 291 “Agency Shop” was passed in 1988 guaranteeing that all whobenefit from union representation would pay a fair share fee. To this day anti-workerlegislators introduce right-to-work-for-less bills every year in the hopes of cripplingunions and the power they wield for worker friendly politicians.

Since Ed’s retirement in 2002, I’ve been honored to serve as your Executive Director. Wetook off into the 21st century with a new look and the latest technology. For the firsttime ever, Council 13 gained a presence on TV. Real-time member communication grewwith ever-expanding social networking tools, GetActive alerts and statewide conferencecalls. We set up hotlines for members to easily contact legislators on important issuesand we remain a constant presence at capitol hearings and lobbying efforts.

Seeing the need to grow our membership and assist members with internalorganizing drives, I developed Council 13’s first Organizing Department in 2005.Organizing victories have prevailed and with those victories came the power innumbers necessary to battle corporate agendas. In 2009 we used that power to rallyon the capitol steps, and throughout the state, after a 101-day budget impasse wherestate employees were forced to work without pay. That fight resulted in litigationthat made payless paydays something to remember about our past, not something to

fear as we moveforward.

Under my leadershipCouncil 13 developed anAFSCME Next Wavemovement that spreadacross the country. Wesaw the need for young,innovative leadership asour seasoned activistsinched closer toretirement. And nowyoung activistseverywhere arebouncing back from theself-indulgent hiatus ofthe 80’s and 90’s andgetting involved insocial, political andorganizing movements.

government and policy recall battles and monumental health care reform. We’veblocked union busting privatization efforts and faced adversity head-on to organizethose who seek our help. Ours is a fight not just about labor, but about equality.Just give us a glass ceiling and we’ll be there to break it. Look around you. There’sno group like us - young, old; black, white; city, rural; male, female – all boundtogether in rock solid unity. Because for us, the message is inherently simple:Freedom and justice for all.

EXECUTIVE BOARD

Members control Council 13 by electing their officers and delegates, andparticipating in Local Union meetings, District Council DelegateAssemblies, Council 13’s annual conventions, AFSCME’s biennial

International conventions, and AFL-CIO meetings and conventions. Members electCouncil 13’s Executive Board, which meets bi-monthly to establish and enforcepolicy for the union when the convention is not in session. Council 13’s ExecutiveBoard is comprised of a President; Secretary; Treasurer; Vice Presidentsrepresenting State, County, City, School District, Other Political Sub-Divisions andHealth Care employees – elected by delegates at the annual convention; one VicePresident elected by each of Council 13’s eight District Councils; and the ExecutiveDirector, also elected by the members assembled at the convention.

The Executive Director initiates andadministers policies adopted byCouncil 13’s annual convention and

Executive Board, and directs the union’s dailyoperations. The Executive Director serves asCouncil 13’s chief spokesperson, chair of allCouncil 13 committees, and Chief Negotiatorof Council 13’s Statewide NegotiatingCommittee for collective bargainingagreements with the Commonwealth ofPennsylvania.

David Fillman has served as AFSCMECouncil 13’s Executive Director since 2002.He was re-elected to a third three-year term atCouncil 13's 38th Annual Convention in Aprilof 2010. Fillman has also been elected as anAFSCME International Vice-Presidentrepresenting Pennsylvania since 2000.

Fillman has been instrumental in growing Council 13’s membership. One of his firstcourses of action as Executive Director was to implement the first OrganizingDepartment in Council 13. During his leadership Council 13 has added more than4,500 new members to its ranks. He has also brought our union into the 21st centurytaking part in television ads, numerous on-air battles with anti-worker politicians,and interacting on a personal basis with members through social networkingmediums. Fillman serves as Chair of the Pennsylvania Employees Benefit TrustFund (PEBTF) which administers benefits for more than 200,000 participantsincluding Commonwealth employees, their dependents and retirees. He also sits onthe Board of the State Employees Retirement System (SERS), which administersbenefits for more than 100,000 retirees of the Commonwealth. Fillman also chairsAFSCME’s Health and Welfare Fund and was recently appointed Chair to AFSCMEInternational’s Pension Committee.

He also Chairs the Coalition for Labor Engagement and Accountable Revenue(CLEAR).  CLEAR is a coalition of labor organizations, including Council 13,representing more than 1.1 million Pennsylvanians.  CLEAR advocates for a fair andstable state budget.

CHARLIE BENN, a representative with Council 13 for 20 years, assists with theresolution of statewide issues for members in several Commonwealth agencies,including Labor and Industry, Revenue, and Environmental Protection. He servedas a District Council 88 Staff Representative (1993-97). Benn is a past Local 2346President, Executive Board Member and Steward. He is a member of CBTU.

WILLIAM BRENNER, assists with agencies including PennDOT, Education, and theGovernor’s Office. He is also Council 13’s Personnel Director. The formerAccelerated Grievance Procedure Manager for Council 13’s Grievance andArbitration Department, Brenner served as a District Council 89 Staff Representative(1992-06) and is a past Officer and Steward for Local 2163.

KAREN MOMBERGER, a former District Council 84 Staff Representative (1992-2009),is responsible for the resolution of statewide issues in Commonwealth agenciesincluding DPW, Office of Attorney General, Auditor General and Treasurer; as well asLayoff Coordination and Master Agreement negotiations. She is also responsible fornegotiations with NHS, one of the largest Non-State contracts. Momberger is a pastSteward and President of Local 2105.

JESSE NEWCOMER, IV, a former District Council 86 Staff Representative (1984-87),serves as liaison to the PEBTF. Newcomer also oversees the AFSCME Health andWelfare Fund where he has served as Operating Manager since 1987. He concentrateson developing and implementing Council 13’s policies to ensure that AFSCMEmembers continue to receive quality health care for themselves and their families.

Council 13’s Business Office conducts,accounts for, and reports all of theunion’s financial transactions,

including the collection of membership duesand agency fees; preparation of all budgetforecasts and financial statements;maintenance of membership records; andpayments of all union expenses. TheDepartment also oversees the union’sScholarship Program.

Through its Information Systems, theDepartment also maintains a statewidecomputer network linking all District Counciloffices with Council 13, as well as aninteractive membership/fair share database.Council 13 can target information directly tomembers; provide updated information toAFSCME International; and update addressesfor Council 13 publications. Information

Systems also coordinates the sign-up process and establishment of websites forLocal Unions who participate in the AFSCME/AFL-CIO LaborWeb program.

The Communications and PublicRelations Department strives tocommunicate information of interest

and importance to Council 13’s members; andto the public that they serve.

Regular publications include the quarterlymembership newspaper, “Council 13Connection” (formerly “Public EmployeePress”) and President’s Packets.

The Department designs all print resources;coordinates media alerts, op-eds andinterviews; creates outdoor marketingcampaigns; manages Council 13’s LicensePlate program; maintains the Council 13website www.afscme13.org, as well asFacebook and Twitter social networkingaccounts; coordinates the annual Council 13convention and all television, radio,photography and video productions.

Member Benefits

Member-only benefits, temporary unioncards for new members and memberdatabase updates are also coordinatedthrough this Department. Member-onlymoney-saving programs include cell phonesavings, health club discounts, legal services,pet insurance, scholarships, mortgageprograms, entertainment and travel,financial planning and more.

Pursuant to the union’s commitment toprepare its members, leaders, and staffto prevail over growing and more

complex threats to their dignity andlivelihoods, Council 13’s EducationDepartment: conducts biennially the Council13 Leadership Institute; assists Council 13’seight District Councils in developing andconducting their biennial education seminars;and, through its Local Union TrainingInstructor Program, trains the trainers ofLocal Union officers and stewards.

In order to meet the specific needs of particulargroups of its members, the EducationDepartment also: develops and providesspecialized instruction and training, includingthe biennial Women’s Education Conference,the biennial Non-State Education Conferencefor members employed by counties, cities,

other political sub-divisions, school districts, and private, non-profit health careinstitutions, and the biennial Next Wave Conference for members 35 and under.

The Grievance and ArbitrationDepartment is a sophisticated unitwith the most advanced research

technology available. Council 13’s GrievanceRetrieval and Information Tracking Systemenables staff to efficiently research thedispositions of grievances, develop logicalsimilarities for case preparation, evaluatearbitrators, and research wages, hours andworking conditions for use in justifyingcontract proposals at non-state negotiations.

AFSCME’s Grievance and Arbitration Department continues to advance in its efforts to timely resolve grievances throughthe Accelerated Grievance Process and Arbitration. Never accepting the status quo iswhy Council 13 consistently recoversthousands of dollars annually for its membersthrough its grievance procedures. TheDepartment also processes unfair labor practice charges for the state.

With the newlydevelopedSubcontracting Unit ofthe Department, theGrievance andArbitration Departmentworks vigorously toenforce contractual barsto all forms ofoutsourcing AFSCMEmembers’ jobs.

The Department alsoadministers the union’sInternship Program.

In order to continue the growth andstrength of our union, Executive DirectorFillman integrated an Organizing

Department at Council 13 in September of2005. Since that time over 3,000 new membershave been added to Council 13's ranks. Someof the Department's biggest externalorganizing victories are Centre Crest NursingHome (252 employees), Montgomery Countycourt related employees (245 employees),West Shore School District (221 employees)and Altoona School District (194 employees).

The Organizing Department trains andsupervises field organizers, leads theVolunteer Member Organizer (VMO)program, works with District CouncilDirectors and Staff Representatives to identifypotential new organizing targets, supervisesorganizing campaigns and assists LocalUnions with internal organizing campaigns.

If it were not for political and legislativeaction Council 13 most likely would nothave a history because that’s how public

employees secured the right to organize andbe recognized by their employers. That was in1970, when Act 195 was enacted. Since then,Council 13’s Political and Legislative AffairsDepartment has vigilantly continued to makegovernment work for AFSCME members, notonly as private citizens but as publicemployees as well.

Political Action

AFSCME Council 13 has secured permanentpolitical and legislative presence thanks in largepart to member participation in the Political &Legislative Fund (PAL) which supports a widerange of candidates from the municipal level tostatewide positions who vote for AFSCME onissues which are vital to public employees.

Legislative Action

The Legislative Department of AFSCMECouncil 13 continues to lead the fight againstthe repeal of Agency Shop laws for publicemployees in Pennsylvania; works to protectour collective bargaining rights; and continuesto promote anti-privatization legislation, andpension and health care benefits.

The successful lobbying effort of AFSCMECouncil 13’s legislative staff over the years hassecured in the Commonwealth’s budget thefunding necessary to maintain the functions ofstate, local governments, education andprivate, non-profit organizations that employour members.

Council 13 often relies onthe expert legal counseland representation of

one of the state’s leading laborlaw firms, Willig, Williams &Davidson. They have beenproven virtually invinciblebefore the National and PALabor Relations Boards and theFederal and State Court systems.

The firm has won numerouslandmark decisions on behalf ofCouncil 13 including forcing thereinstatement of 200 disabled PennDOT employees; drafting and defending the stateagency shop law; defending arbitration awards against constant appeals; andsecuring the rights of citizens to vote on an initiative to prevent privatization.Recently, they won a major victory in the PA Supreme Court against theCommonwealth’s attempts to hold employee’s pay hostage during budget disputesand delays, thereby ending the practice of payless paydays. 

The firm also represents members injured on the job.  Our lawyers won fatal benefitsfor the widow of a PennDOT employee, and benefits for hearing loss suffered bymunicipal employees.  They also regularly win and protect benefits for membersreceiving Heart and Lung and Act 534 benefits.

FACILITY DEPARTMENT

Council 13’s Facilities Department maintains Council 13’seight buildings: AFSCME Council 13, PennsylvaniaPublic Employees Health and Welfare Building and

AFSCME Conference Center, and assists District Councils 83, 84,85, 86, 87 and 88. The Department is responsible for every aspectof the facilities, including structure, HVAC, roofing, electricity,fire surveillance and prevention, water and sewer systems andenvironmental management and regulatory compliance; as wellas custodial, landscaping and snow removal services.

AFSCME Conference Center

Council 13’s Conference Center located at 150 South 43rd Street, Harrisburg houses the PA Public Employees Health and WelfareBuilding and offices of: the PA Employees Benefit Trust Fund (PEBTF), which

manages benefits for state employees; the AFSCME Health and Welfare Fund, whichmanages benefits for non-state employees; AFSCME District Council 89; the RetiredPublic Employees of Pennsylvania (R.P.E.P.); and a field office of U.F.C.W. 1776. Themulti-purpose facility also offers 10,000 square feet of space for meetings, conferences,contract negotiations, and grievance and arbitration hearings by AFSCME, PA AFL-CIO,Harrisburg Regional Central Labor Council, and other labor organizations.

COUNCIL 13 DISTRICT COUNCILS

The International Union chartered Council 13 February 3, 1973. The next day,it chartered the statewide union’s eight affiliated District Councils – numbers83 thru 90 inclusive.

The District Councils were organized to enhance representation of members by allowingthem more flexibility concerning local and regional matters while maintaining a statewideunion’s strength of numbers. For instance, the District Councils’ P.E.O.P.L.E. Committeesendorse candidates for local governments, and representatives from their areas for the PAGeneral Assembly, and U.S. Congress.

Each of the District Councils convenes a Delegate Assembly as their top governingbody. The District Councils’ authority is otherwise held by their Executive Boards.

The District Councils are fully funded by AFSCME per capita dues collected, anddisbursed by Council 13.

The AFSCME Health and Welfare Fund wasfounded in 1974 to develop and administersupplemental benefits pursuant to collective

bargaining agreements covering Council 13 membersemployed by counties, cities, and other politicalsubdivisions, school districts, and private, non-profithealth care institutions.

Benefit coverage is negotiated on an employer byemployer basis. Presently, 78 employers are makingcontributions for more than 6,000 employees to havebenefits administered by the fund. The AFSCME Healthand Welfare Fund currently administers four benefitprograms – Prescription Drug, Vision Care, Dental Care,and Disability Insurance; and continues coverage toformer participants pursuant to COBRA.

The AFSCME Health and Welfare Fund is governed byan eight member Board of Trustees: four representingmanagement and four representing the union.

RETIRED PUBLIC EMPLOYEES OF PENNSYLVANIA

Since its 1979 charter convention, the number of members of the Retired PublicEmployees of Pennsylvania (R.P.E.P.) Chapter 13 has increased to more than12,000.

The former public employees are organized into 35 Sub-Chapters statewide toprotect and promote the rights and benefits of AFSCME members after they retire.

R.P.E.P. and AFSCME together have battled for state employees’ pension earlyretirement and the cost of living adjustment (C.O.L.A.). In addition, R.P.E.P. wasinstrumental in establishing a discount drug program for senior citizens.

Council 13 members are urged to continue their association with AFSCME after theyretire by joining R.P.E.P.
