Also present: County Manager Jeff Page, District Attorney Steve Rye and Deputy Clerk Donna MacGill. 1. Public participation There was no public participation. 2. For Possible Action: Review and adoption of agenda Comm. Fierro moved to approve the agenda as presented. Comm. Hastings seconded and the motion passed unanimously 5 0. 3. Fierro said he attended the Carson Water Subconservancy District meeting. They are doing their summer tours from Alpine County California down to Churchill County Nevada. They are going to different counties to see what they are working on. In Carson City they are working on a project removing silt from the Carson River. He also mentioned a brochure the district puts out on rafting in the Carson River. He also said there will be a bus tour the first weekend in June if you are interested in knowing more about the water shed. Comm. Alt said this morning he noticed that the Carson River is running full and Lake Lahontan is filling up so it appears the irrigation for agriculture will be good this year. The Honorable Board of Lyon County Commissioners met this day in regular session with the

following present: Chairman Joe Mortensen, Vice-Chairman Bob Hastings, Commissioners Greg

1. Public participation

There was no public participation.

2. For Possible Action: Review and adoption of agenda

Comm. Fierro moved to approve the agenda as presented. Comm. Hastings seconded and the

motion passed unanimously 5 – 0.

3. Presentation of awards and/or recognition of accomplishments

There were no awards or recognitions.

4. Commissioners/County Manager comments

Comm. Fierro said he attended the Carson Water Subconservancy District meeting. They are

doing their summer tours from Alpine County California down to Churchill County Nevada.

They are going to different counties to see what they are working on. In Carson City they are

working on a project removing silt from the Carson River. He also mentioned a brochure the

district puts out on rafting in the Carson River. He also said there will be a bus tour the first

weekend in June if you are interested in knowing more about the water shed.

Comm. Alt said this morning he noticed that the Carson River is running full and Lake Lahontan

5. Elected Official’s report

Sheriff Al McNeil discussed the state requirement that all ATV’s need to have a sticker. The

sheriff’s department does the VIN check prior to the sticker being issued. A percentage of the

fees collected are allocated to law enforcement. At the present time there is approximately

$200,000 of unspent funds. He is mandated by SAR to go out into the hills and fine the

individuals who are not in compliance. Sheriff McNeil said he will not have a deputy going into

the hills writing tickets for unpermitted ATV’s. He does not have enough deputies to take one

off the streets to go out into the hill for ATV compliance checks. He discussed a Cooperative

Agreement with BLM for a cost recovery. The sheriff’s department responds to the Wilson

Comm. Alt asked who would be handling the oversite of these funds.

Maureen Williss explained these are funds from a CDBG grant and will be distributed by the

Lyon County comptroller’s office.

Comm. Alt moved to accept the grant from the Commission for Cultural Centers and Historic

Preservation, in the amount of $130,000 for restoration of the Carson & Colorado Railroad

Depot in Dayton, Nevada (requested by Historical Society of Dayton Valley). Comm. Mortensen

seconded and the motion passed unanimously 5 – 0.

11. For Possible Action: Accept the FY17 Low Income Housing Trust Funds award in

the amount of $75,000 to provide housing services (requested by Human Services

Director)

12. For Possible Action: Approve contract for entertainment services at the Lyon

Comm. Alt asked that Item #10 be removed from the consent agenda and acted on separately.

Comm. Fierro moved to approve the consent agenda as presented with Item #10 being removed

and acted on separately. Comm. Hastings seconded and the motion passed unanimously 5 – 0.

REGULAR AGENDA

24. For Possible Action: Appoint a member to the Smith Valley Advisory Board with a

term expiring December 31, 2016 (requested by Smith Valley Advisory Board)

County Manager Jeff Page presented. He explained that the Smith Valley Advisory board

recommended one person but there are applications from two people. Mr. Page recommended

appointing one of the applicants. He said the Steve Rye, Maureen Williss and himself have

provided direction to the advisory board regarding open meeting laws and how to run an

advisory board. He said it continues to fall on deaf ears. He said if the issues are not resolved by

July 1st Mr. Page will ask for the problem members to be removed.

Comm. Mortensen read email from John Abrott into the record.

County Manager Jeff Page explained that he also heard from Maralyn Abrott. Mr. Page said that

prior to 2011 the county was in violation of state law. The advisory boards would elect the

members and send their list to the board of county commissioners and they would be appointed.

The advisory board has to fall under the open meeting law. The advisory board makes the

recommendation and the board of county commissioners makes the appointment. He said these

boards are created to be advisory to the board of commissioners.

There was continued discussion regarding advisory boards.

Comm. Hunewill moved to table this item until the advisory board gets straightened out. Comm.

Mortensen seconded the motion.

The commissioners expressed their comments and concerns.

Comm. Hunewill said the advisory board recommended one applicant but he feels the other

applicant is more qualified and has lived in the area for a longer period of time.

Comm. Fierro agreed with Comm. Hunewill on who he feels is most qualified.

County Manager Jeff Page explained that the advisory boards are not elected and do not

represent the people. They are only advisory to the board of commissioners to capture

information, concerns and complaints of the people and report those to the board of

commissioners. He also explained other issues that are going on with the Smith Valley Advisory

Board. He said it appears to be a personality conflict that is going on in Smith Valley. He

recommended making a decision today. There will be members of staff at all of the future Smith

Valley Advisory Board meetings until the issues are resolved. He said the advisory board is

costing the county a considerable amount of money due to their actions.

Julie Cosner, an applicant to the Smith Valley Advisory Board, said she feels the advisory board

is a special interest group. She would be willing to take on the job if she were appointed. She

does not feel the board is properly representing the citizens of Smith Valley and something needs

to be done to correct it.

Tom Cartwright commented on the small percentage of residents who attend the Mason Valley

Advisory Board meetings. He said that if the commissioners are going to choose a person for the

open position they should choose the most qualified not the most popular person.

Comm. Mortensen withdrew his second.

Comm. Fierro moved appoint Julie Cosner to the Smith Valley Advisory Board with a term

expiring December 31, 2016. Comm. Hunewill seconded and the motion passed unanimously

5 – 0.

25. For Possible Action – Approve professional services statement of work with

Armstrong Consultants, Inc. in the amount of $35,000 for engineering services

related to applying for a FAA grant for airfield pavement rehabilitation at the

Silver Springs Airport (requested by Silver Springs Airport LLC)

Manager of the Silver Springs Airport and owner of the Silver Springs Airport LLC Kay Bennett

presented. She said this is a request for $35,000 for the engineering services for the FAA grant

rehabilitation project. It was included on the airport capital improvement plan that was

submitted to the FAA earlier this year. It is phase II of the rehabilitation of the taxi lanes. The

runway was rehabilitated last year. The matching funds are eligible for reimbursement by the

Nevada Aviation Trust Fund.

Comm. Fierro moved to approve the professional services statement of work with Armstrong

Consultants, Inc. in the amount of $35,000 for engineering services related to applying for a

FAA grant for airfield pavement rehabilitation at the Silver Springs Airport. Comm. Hastings

seconded and the motion passed unanimously 5 – 0.

TIME SPECIFIC - 10:00 A.M. - For Possible Action: Approve budgets and establish tax

rates and spending authorizations for all County departments, boards, and funds for fiscal

year 2016/2017 (action will be taken)

Comptroller Josh Foli said the only thing that changed from the tentative budget to the final

budget would be the salary increase from 2% to 2.5% and the decrease in in the workers

compensation rate. Those changes were flowed through the budget and the difference was taken

through contingency or ending fund balance. The tax is .9287 or $.9287 per $100 of assessed

valuation. The breakdown is as follows:

Comm. Hastings moved to approve budgets and establish tax rates and spending authorizations

for all County departments, boards, and funds for fiscal year 2016/2017 as presented. Comm.

Mortensen seconded and the motion passed unanimously 5 – 0.

Lanona Higley of Lyon County said she realizes the county is short on money but said there is

still a need for a code enforcement officer. She hopes the commissioners will take it into

consideration in the future.

DISTRICT BOARD

27. For Possible Action: Approve budgets and establish tax rates and spending

authorizations for the Central Lyon County Vector Control District for fiscal year

2016/2017

Comptroller Josh Foli said there are no changes from the tentative to the proposed final budget.

He received a letter from the Department of Taxation stating they have examined the tentative

budget and have found it in compliance with the law and Nevada Administrative Code. The tax

rate is .035 or $.035 for $100 of assessed valuation.

Comm. Fierro moved to approve budgets and establish tax rates and spending authorizations for

the Central Lyon County Vector Control District for fiscal year 2016/2017 as presented. Comm.

Hastings seconded and the motion passed unanimously 5 – 0.

28. For Possible Action: Review and accept claims and financial report

The cash balance as of May 18, 2016 was $352,795.46. Claims totaled $30,390.00; there was no

payroll.

Comptroller Josh Foli said he received a letter from the Department of Taxation stating they

have examined the tentative budget and have found it to be in compliance with the law and

Nevada Administrative Code. Mr. Foli said the only changes would be changing the salary

increase from 2% to 2.5% effective July 1, 2016 and the workers compensation changes from

the Mason Valley Mosquito Abatement District for fiscal year 2016/2017. Comm. Hastings

The cash balance as of May 18, 2016 was $396,619.12. Claims totaled $16,119.37 and payroll

totaled $3,394.70.

tentative budget is in compliance with law and the Nevada Administrative Code. There are no

changes from the tentative budget to the final budget. He said there is no tax rate for this district.

There is an assessment on the land of $.0847 per $100 of assessed valuation.

the Walker River Weed Control District for fiscal year 2016/2017. Comm. Hastings seconded

and the motion passed unanimously 5 – 0.

TIME SPECIFIC - 10:15 A.M. - For Possible Action: Propose an ordinance to establish

reasonable expectations of alarm users and alarm businesses, ensuring that alarm users

and alarm businesses are held responsible, thus reducing false alarm dispatches to the

Lyon County Sheriff Office

Sheriff Al McNeil expressed concerns regarding the number of false alarms received by dispatch

and the cost to taxpayers. They looked at Washoe County and the City of Reno and looked at

their ordinances to try and reduce the number of false alarms. He said the industry standard for a

false alarm is about $120 per call. It takes deputies off the streets to look into a false alarm. He

reached out to Steve Keefer, the retired Chief of Police for the City of Sparks, to assist in the

draft ordinance that is presented today. He said in 2014 there were only 9 valid alarms out of

over a thousand false alarms. In 2015 there were only 5 valid alarms out of 1,016. The sheriff

said there appears to be an increase in 2016 over the same period in the prior year.

There were concerns regarding the permits required

Steve Keefer is the retired Chief of Police from the City of Sparks and is currently employed by

Security Industry Alarm Coalition (SIAC) While he was still with the police department he

helped them implement the ordinance that is similar to the one presented to the commissioners

today. He said that SIAC is a non-profit organization who represents the four largest trade

associations in North America of the alarm industry. SIAC partners with law enforcement to

help them find solutions regarding false alarms. He said the number of false alarms that Sheriff

McNeil reported is not alarming. He said it is similar across the country. He said that 98% to

99% of alarms are false and it could create a real problem on resources when you are already

spread thin. He discussed the ordinance and best practices with the commissioners. He

discussed fines for false alarms and if that doesn’t work, there is always suspension. He said the

ordinance also addresses equipment upgrades of antiquated systems that would reduce false

alarms. He also discussed enhanced call verification. The ordinance also addresses an appeal

process. He discussed several cities with an ordinance in place and how the false alarms have

been drastically reduced. He predicts there will be a 50% reduction in false alarms within two

years of implementing the ordinance.

The commissioners had concerns regarding the additional cost to citizens and business owners if

they are required to have a permit.

There was discussion about charging the offenders of false alarms.

County Manager Jeff Page said a private company would be monitoring the alarm companies

and the collection of permits not county staff. He said having an alarm system for your home or

business is a privilege. He has a problem with the taxpayers paying for the monitoring of these

systems.

Sheriff Al McNeil said there are cities that do not respond to alarm systems. He also addressed

the cost of the permits. He said the recommended permit fee would be $25 per year and $12.00

for senior citizens.

Comm. Fierro said he is not pleased with this ordinance.

Comm. Alt said he is totally against any permit fee. He said the abusers of false alarms should

be paying.

Comm. Mortensen proposed the ordinance and requested the sheriff to come back to the board of

commissioners with a fee schedule.

Tom Cartwright said he should not be penalized for choosing to put in an alarm system. It is his

job to protect his property.

Lanona Higley said this is a serious problem. There are a number of benefits to having an

ordinance.

Marjorie Gartenberg commented on the number of false alarms and the expense being paid. She

is in favor of the ordinance.

TIME SPECIFIC - 11:00 A.M. - For Possible Action: To approve a collective bargaining

agreement between the Lyon County Employees Association and Lyon County to begin

July 1, 2016 and end June 30, 2017.

County Manager Jeff Page presented the track changed copy of the contract. The public has

been notifyed by posting it on the county’s website. The employees will be getting a 2.5%

increase. The Lyon County Employees Association ratified the contract unanimously. The

contract will go into effect July 1, 2016 and end June 30, 2017. A change in the state law is that

if there is not a successor agreement in place there will be no wage increases of any kind.

Comm. Fierro expressed his questions and concerns.

Comm. Alt moved to approve a collective bargaining agreement between the Lyon County

Employees Association and Lyon County to begin July 1, 2016 and end June 30, 2017. Comm.

Mortensen seconded and the motion passed unanimously 5 – 0.

48. Public participation

Julie Cosner thanked the board for making what some people may consider a controversial

decision and will do her best to be a positive and productive member of the Smith Valley

Advisory Board.

Tom Cartwright apologized for going over his time limit on public comment.

49. Closed Session, pursuant to NRS 241.015(3)(b)(2), to receive information from the

District Attorney regarding potential or existing litigation involving a matter over

which the Board has supervision, control, jurisdiction or advisory power, and to

deliberate toward a decision on the matter (requested by District Attorney)

50. Closed Session for labor relation discussion as allowed under NRS 288.220

51. Adjourn
